to sign up at this time. And at this time, I would recognize House Bill 1773. Representative Clowney would recognize you to present your bill. I mean, excuse me, we're concurring on a Senate amendment. Yes, Mr. Chair, that's all we're doing today. Thank

Representative Nicole Clowney Unverified 0:26
you. Thank you, committee. I hope y'all are bright-eyed and bushy-tailed this morning. This is an amendment that came to us on the Senate side after some collaboration with the Municipal League. And hopefully, I think maybe we'll hear from them, but after Senator Dismang added this amendment, the Municipal League did not speak against this bill and committee on that side. Basically, what this amendment does, so if you'll recall, this bill was creating a mechanism for six months of cancer leave for firefighters who contract cancer in the line of duty. One of the ways that a municipality can get this is by relying on something that we created in this bill called the Firefighter Cancer Relief Network. All this amendment does is creates a start date for that network to ensure that it actually is up and running and that cities can take advantage of it as soon as September 1st, 2019. So I'd be happy to answer any questions that y'all might have on

Mr. Chairman and committee, the amendment actually is being more inclusive than what was previously put into place. Actually, at one time it just said that the election commission could make a determination about closing a voting site, but now it has to be all three, which is where if you had two Republican and one Democrat or two Democrats and one Republican, now it takes all three people and that's that's basically it okay all right any

So that will be coming forward. I didn't want to hold up the meeting, but I do want to run that bill. But I think now everybody's in agreement with the bill because there's some good portions of that bill in regards to the studies and different things that we must do to address the issue in Arkansas. but there were some things that were giving some people some heartburns. I heard you all. I responded to you all. And so once we get that amendment over here, we'll go ahead and amend the bill, and

have Representative Love, would you identify yourself and who's at the table with you? Representative Frederick Love, District 29, I have with me Municipal League Director Mark Hayes, who is now in agreeance with my bill. Okay, you may proceed. Committee, I'm going to go ahead and turn it over to Mark Hayes so that he
▶ Play Suggest a correction Report an error
Speaker 78 17:57
can explain the amendment in its entirety. Mark Hayes with the Municipal League. thank you all for your patience in this I'll be very brief as I testified two days ago the the task force did some incredible work mainly in the rate in training area that's really about 95 or 99 percent of what they really focused on that is a absolutely imperative to keep systems running smoothly and to be fiscally responsible so when representative love called me and asked me to work with him on the amendment that's the goal that we took so what we did is remove the governance issues and some other things about demands of water and those kinds of things and focused exclusively on the rating and the training aspects of the bill there were one or two minor things there that needed to be cleaned up and that's all in the amendment uh we added some uh some additional language to clarify what the intent of the bill is just so everybody's clear that it's training and education and then we kept in the necessary exemptions such as texarkana and those kinds of things because of their unique circumstances so all told it is a i think a very good bit of public policy now it does directly reflect what the task force spoke to and wanted and i want to thank my friend representative love for leading the charge here it was very helpful to to get something that i think will be good for water providers in this state we'll continue to work on this issue because it's not going to go away in the in the off season and and as this bill gets put into effect there'll There'll probably be some practical things that need to be tweaked here and there, but nothing of great substance, I hope. So it's been well vetted. All the people you've heard from have been involved in this process over the last 12 hours or whatever it's been. And I feel very good about where we are. So we stand behind the amendment and the bill as a whole then. Yes,
▶ Play Suggest a correction Report an error
Chair Unverified 20:13
Representative Speaks, you're recognized. Thank you,
▶ Play Suggest a correction Report an error
Representative Nelda Speaks Unverified 20:16
Mr. Chair. One question I have, are we forcing these water providers in these cities and that to take the blame is going to come back on the state to raise their water rates and that? Is that out of there?
▶ Play Suggest a correction Report an error
Speaker 82 20:35
Yeah, we're not forcing those types of things.
▶ Play Suggest a correction Report an error
Speaker 78 20:38
What we're saying is that where you have some problems with the status of your water provider system, then you will need to do a series of rate studies and then the implementation over time, and there's mechanisms to be flexible in that process. So it's not a dictate in that you shall do this right now and your citizens be darned. That's not at all what it is. I think this is designed to actually get to some of those smaller systems and help them. At least that's the way I've taken the task force report, and that was the goal when we wrote
▶ Play Suggest a correction Report an error
Chair Unverified 21:20
this. Okay. Is there any other questions on the amendment? Huh? It should be on your tablet. I'm sorry. I'll give
▶ Play Suggest a correction Report an error

you all a minute here to look at the amendment.
▶ Play Suggest a correction Report an error
Speaker 78 21:41
and i i had to uh just if i might i i don't reading those amendments is very difficult for me so i actually wrote on the bill so i think i could keep up with any questions that you may have it was a little easier for me to take out the language and the places on it and hand

language. If you click the amendment, underneath amendment, that's the amendment.
▶ Play Suggest a correction Report an error
Unknown speaker 23:00
Thank you.
▶ Play Suggest a correction Report an error
Speaker 99 23:30
All right. Everyone has a copy of the amendments,
▶ Play Suggest a correction Report an error
Chair Unverified 24:02
and we will, Representative Love, are you all ready to start accepting some questions?
▶ Play Suggest a correction Report an error
Representative Fredrick J. Love Unverified 24:11
Yes, sir. Okay. I think I know where everybody's looking for in regards to deleting, and I was just talking with Mark. If you look on page 3 of the amendment, and this is the corresponding language to kind of the big concern of what everybody wanted, it says if you go down to the last of the amendments, it says delete page 6, delete lines 27 through 36 and page 7, 1 through 36. That was the crux of the bill in which you all had that issue with. So I just want to make sure since it wasn't all the language in it, I want to make sure that you all knew that that was the that was kind of the prevailing sentiment of the committee to take that out. So, and then page one, and it goes on the next page, the page eight, delete lines one through 20. So, as I said, committee, I heard the sentiment of the committee. So, those will address the issues that, the overwhelming issue with the bill as presented yesterday.
▶ Play Suggest a correction Report an error
Speaker 99 25:23
Okay, Representative Lobby, are you ready to answer any questions or
▶ Play Suggest a correction Report an error
Chair Unverified 25:29
may be? Yes, sir. I'm open to take any questions. Okay. Representative Boyd, you're recognized. Thank you, Mr. Chair. To either of you, could you just tell us one more time, what are we voting on? What is in here? I mean, it doesn't have to be long
▶ Play Suggest a correction Report an error
Representative Fredrick J. Love Unverified 25:48
and complex, but help us understand what it is that's left. Okay, sure. So, Representative Boyd, there was a task force convened probably about two years ago to look at water, wastewater, and just some certain things. And so what this bill does is it lays out two pieces. It lays out some training for municipal water systems, and wastewater was included, but we took that out. And so right now the training is just for the training and education is for municipal water systems. But the second big piece it is, and this is kind of the crux of the bill, about 85 percent of our water systems in the state are actually not collecting the rates they should in order to maintain their systems. And so what we put in the statute is that they will have rate studies done on their systems. However, as Representative Speaks, her concern was, are we mandating them to actually impose those rates on their customers? This bill does not mandate that they impose those rates on their customers. However, we are encouraging them to take affirmative actions to actually move their rates up. But one of the things that we have in this bill is we classify water systems as distress. So, therefore, if you're not collecting enough maintenance funds to maintain your water systems, then we can actually classify you in distress. And so we want to make sure that you take affirmative actions, Not to say that, hey, your rate needs to come up to $28, because I think yesterday there was a comment that, hey, somebody's collecting $7, and I think ANRC testified somebody's collecting $7 for their water, and they need to be collecting $28. So you can do a rate study to say, hey, my rate needs to be $28, but we're not mandating in this bill that you take your rates to $28. But what we are saying is that this is the rate that you need to be collecting. can you take some affirmative actions before you come to the state to say that hey my water system is in disrepair and now the state is turned over to the state because we adq will then come in and say hey we can't make this water system is no longer functional you have to shut it down then the state is forced to say we're going to put money into it and so what this bill outlines is some affirmative ways in which a community can say hey we're looking at raising the rates but at the same time apply for funding through the state to say hey my system needs some repair and so that's where the cdbg funds came in that uh that representative brown talks about so this this piece of public policy is just saying hey communities you can't wait on the state legislature to come and fix your water systems, you have to take some sort of affirmative action. And so I think in a nutshell, that's what the bill does. Follow up.
▶ Play Suggest a correction Report an error
Speaker 107 29:05
Thank you, Mr. Chair. So I was on the task force with you,
▶ Play Suggest a correction Report an error
Chair Unverified 29:11
and I just want to make sure there are a couple of things I'm hearing. so one we're not mandating anything other than a review because yes but so you said 85 percent of the water
▶ Play Suggest a correction Report an error
Speaker 110 29:29
systems are there is an implementation mechanism so it so it does say you study and then
▶ Play Suggest a correction Report an error
Speaker 78 29:35
you have to implement but in in response to representative speaks that implementation it has a flexible standard to it and essentially it allows for you to if you're the provider to work with the overseeing entity which is I think if I've gotten my head so turned around right I think that's the Natural Resources Commission and so that allows you the flexibility to over time work with them and find a way in which to get things put together financially that will work and not stressful to your citizens so it it's a combination of
▶ Play Suggest a correction Report an error
Speaker 106 30:10
things i may continue my question yes um so
▶ Play Suggest a correction Report an error
Chair Unverified 30:14
what this does is it creates some transparency for one the residents of the city and then two a business that might want to move into the city therefore hopefully stimulating some competition to focus on that infrastructure so everybody knows where we where we are yes sir um and then one more follow-up and then i'm i think i'm done okay i just wanted there's something representative love had said and i want to make sure i don't misunderstand it you talked about grant funding but we're not talking about creating a mechanism where the state's going to come in and bail everybody out no no no actually it's
▶ Play Suggest a correction Report an error
Representative Fredrick J. Love Unverified 30:59
just the opposite because the state yeah it's not going to be a bill out to where and that's what we're trying to prevent with the rate studies and showing people hey this is where your rate needs to be in order to maintain your system because what's happening now is they are coming to the state and we're having to bail them out because their systems are in such disrepair and so it's actually the exact opposite so yes so you can present the bill on the floor when it gets there

▶ Play Suggest a correction Report an error
Representative Fredrick J. Love Unverified 33:42
a due pass that's amended on this bill okay okay
▶ Play Suggest a correction Report an error
Chair Unverified 33:45
we have a due pass any discussion yes we have discussion thank you mr chair i just want to say i spent a lot of time like representative love on this task force and that's the one thing there were a lot of things that we learned and gleaned from this process but the one thing that was very clear and fort smith i'm just going to call fort Smith out I represent Southwest Fort Smith had the there had been a kicking the can down of the road on the wastewater system and the federal government caught us and said you're going to have to raise your rates and what happened is then all of a sudden there was a tripling of the rate now this only deals with the water this doesn't deal with wastewater but our perception what we gleaned was this was happening with water systems and wastewater systems all over the state not just Fort Smith and so I just want to speak in favor of this bill that I feel like it really puts an important mechanism in place that will help protect the citizens it'll help to protect the citizens in that community and it will ultimately help the citizens outside of that community so that everybody doesn't have to come in and get a bailout because there's not enough money in Arkansas to suddenly overnight come in and update all of these water systems so I think this is a good start. I hope we continue

to the discussion and see if there's not a way to add wastewater in and the next legislative session.

Okay, Representative Harlan Brough. What I want to do, this
▶ Play Suggest a correction Report an error

bill right here is, well, it's 548, But basically what it does, it just amends the law for procedure to be incorporated. I'm speaking specifically Holiday Island, where I live. Most of the people want to be incorporated, and that's what this is all about. Okay. Well, actually, it's for procedure to do that, a procedure to be incorporated.

▶ Play Suggest a correction Report an error
Speaker 78 37:46
Okay, please identify yourself with the record. Yes, sir. Mark Hayes with the Municipal League. And I think I can address the – we don't have a problem with the bill. This standard has changed on incorporations several times over the last decade, and there and it seems like every time the population standards change there's another situation where a fairly substantial group of people want to incorporate and so you have to kind of you keep coming back and look at the population level so this is going to affect best i know one one place right now if we get some other places that get above 1500 and want to want to incorporate,
▶ Play Suggest a correction Report an error
Chair Unverified 38:29
it will be applicable to them as well. Okay. Representative Richman, you're recognized.
▶ Play Suggest a correction Report an error
Representative Marcus E. Richmond Unverified 38:40
I know that a few minutes ago you said that most of the people in, I guess, what, Holiday Island? Yes. I want this bill passed so they can incorporate, but the emails and the messages and things I've been getting would seem that there is a considerable number of people who are not in agreement

Speaker 137 39:03
with that yes there is some opposition but uh for the most part those are people that don't live there and uh and they don't they can't they're not supposed to vote but they may have a time share something like that and there is some opposition to tell you and so i went with i said i had a meeting with him if the majority of the people want to do this and they signed the petition it was just overwhelmingly for it now were these other calls coming in we'll just have to see how

that goes okay thank you representative whitaker you're recognized thank you

Representative David Whitaker Unverified 39:47
mr chair uh just to Just to clarify, if I'm reading it correctly, we're really just changing the population threshold to be eligible. And confirm for me, if you can, nothing else about the rather complex procedure of getting incorporated changes. That's correct. Yes, sir. That's correct. Thank you. Okay.

In reading this bill, it talks about the county judge. Yes, ma'am.
▶ Play Suggest a correction Report an error
Speaker 78 40:18
that that's a that's current law that's the way the law currently is and and actually annexations have to go through a process with the county and the county judge ultimately has to execute a signature on the annexation some of that some most of the time there's an actual substantive decision for the county judge to make there are a few instances where it's kind of perfunctory but the

county judge is always involved thank you okay representing hawks you're recognized okay is there any other questions representing

Representative Cameron Cooper Unverified 41:38
Brough, I'll echo what Mr. Richman was saying. I've received a lot of emails in opposition to this, so I wanted to make sure I understood what you said. You think those are from people that just own timeshares and don't actually live in the community?
▶ Play Suggest a correction Report an error
Speaker 137 41:57
Well, I'm saying that, but a lot of people are just, it's not overwhelming where I thought it was at one time. there's still some people that the ones that more opposition than not whether that's the majority or not we'll just have to see because most of the people I talked to and signed the petition that was just overwhelming and if they're the only thing they hollering about it now is is a different situation. They're thinking maybe giving the commission or the CED too much power. It's not dealing with this right here, just being incorporated. That's my understanding. Representative Kavanaugh, you're

recognized. Thank you, Mr. Chair.
▶ Play Suggest a correction Report an error
Representative Frances Cavenaugh Unverified 42:54
Representative Brough. So this is not going to force anybody to automatically be in court annexed. It's not going to happen. There's going to be ability that the area trying to be annexed can say no I don't want to
▶ Play Suggest a correction Report an error
Speaker 137 43:10
no ma'am that's just a procedure change where they can if they want to yeah that
▶ Play Suggest a correction Report an error
Speaker 78 43:16
um you know I probably should have clarified some of this on the front end I'm sorry I was a little preoccupied with something else called water um when I when I was called up here so let me now my brain's kicked in a little bit we were asked to look at the bill legally it's not a league bill but we were asked to look at the legal standards just to make sure everything kind of fit with the other annexation laws and there wasn't a problem and we that's what our function was there's no requirement for some group of people to to annex they have to affirmatively try to do that so it's it's a
▶ Play Suggest a correction Report an error
Speaker 145 43:56
And it's the proverbial group effort, if you will, to make that

occur. Thank you. Okay, Representative Brown, you're
▶ Play Suggest a correction Report an error
Representative Karilyn Brown Unverified 44:08
recognized. Thank you, Mr. Chair. And I think you've answered this, but this is just sort of
▶ Play Suggest a correction Report an error
Speaker 161 44:14
permissive. I mean, it just enables them to go forward, but it doesn't
▶ Play Suggest a correction Report an error
Speaker 78 44:20
force them to go forward. That's correct. And if histories have helped anybody, at one time the incorporation numbers were, I think, 200 or more, 200 people or more. And that, over time, had proved to be not just a very unrealistic thing to put on the books. And so that's how ultimately it's crept up. I wish I had checked, but it's had four or five changes in the last

Chair Unverified 44:53
15 years or so. thank you representing bro and mr. Hayes back to representing Whitaker's question yes sir really all we're doing here today is is rising raising the threshold in which they can incorporate correct lowering it lowering it so the still there'll be local action it'll take place and we're not deciding where that will or will not happen, correct? That is correct. Exactly, yeah. Okay, any other questions? Yes, Representative Cooper, you're recognized. I'm going to say this in an effort
▶ Play Suggest a correction Report an error
Representative Cameron Cooper Unverified 45:24
to clear things up, but I know I have to do it in the form of a question. When we were getting emails, it dawned on me that they were talking about two different Senate bills. There was 548 and 510, and I looked up 510 real quick, And I think that that is probably the bill that these residents or property owners had an issue with. It wasn't 548. Would you agree with that? I
▶ Play Suggest a correction Report an error
Speaker 137 45:59
do agree with that. That's two separate. Thank you, Dad.

▶ Play Suggest a correction Report an error
Representative Johnny Rye Unverified 46:14
place but if this actually took place which say we don't have a lot to do or say about that anyway from here but i'm sure that they would have to have an election is it through the city council or would it be just like an election for overall for the people that's in that town or in
▶ Play Suggest a correction Report an error
Speaker 158 46:31
that area it you'd have to have an election there's also some other mechanisms you have to go through
