that came to us on the Senate side after some collaboration with the Municipal League. And hopefully, I think maybe we'll hear from them, but after Senator Dismang added this amendment, the Municipal League did not speak against this bill and committee on that side. Basically, what this amendment does, so if you'll recall, this bill was creating a mechanism for six months of cancer leave for firefighters who contract cancer in the line of duty. One of the ways that a municipality can get this is by relying on something that we created
in this bill called the Firefighter Cancer Relief Network. All this amendment does is creates a start date for that network to ensure that it actually is up and running and that cities can take advantage of it as soon as September 1st, 2019. Mark Hayes with the Municipal League. thank you all for your patience in this I'll be very brief as I testified two days ago the the task force did some incredible work mainly in the rate in training area that's really about 95 or 99 percent of what they really focused on that is a absolutely imperative to keep systems running smoothly and to be
fiscally responsible so when representative love called me and asked me to work with him on the amendment that's the goal that we took so what we did is remove the governance issues and some other things about demands of water and those kinds of things and focused exclusively on the rating and the training aspects of the bill there were one or two minor things there that needed to be cleaned up and that's all in the amendment uh we added some uh some additional language to clarify what
the intent of the bill is just so everybody's clear that it's training and education and then we kept in the necessary exemptions such as texarkana and those kinds of things because of their unique circumstances so all told it is a i think a very good bit of public policy now it does directly reflect what the task force spoke to and wanted and i want to thank my friend representative love for leading the charge here it was very helpful to to get something that i
think will be good for water providers in this state we'll continue to work on this issue because it's not going to go away in the in the off season and and as this bill gets put into effect there'll There'll probably be some practical things that need to be tweaked here and there, but nothing of great substance, I hope. So it's been well vetted. All the people you've heard from have been involved in this process over the last 12 hours or whatever it's been. And I feel very good about where we are.

If you look on page 3 of the amendment, and this is the corresponding language to kind of the big concern of what everybody wanted, it says if you go down to the last of the amendments, it says delete page 6, delete lines 27 through 36 and page 7, 1 through 36.
That was the crux of the bill in which you all had that issue with. So I just want to make sure since it wasn't all the language in it, I want to make sure that you all knew that that was the that was kind of the prevailing sentiment of the committee to take that out. So, and then page one, and it goes on the next page, the page eight, delete lines one through 20. So, as I said, committee, I heard the sentiment of the committee. So, those will address the issues that, the overwhelming issue with the bill as presented yesterday.

and complex, but help us understand what it is that's left. Okay, sure. So, Representative Boyd, there was a task force convened probably about two years ago to look at water, wastewater, and just some certain things.
And so what this bill does is it lays out two pieces. It lays out some training for municipal water systems, and wastewater was included, but we took that out. And so right now the training is just for the training and education is for municipal water systems. But the second big piece it is, and this is kind of the crux of the bill, about 85 percent of our water systems in the state are actually not collecting the rates they should in order to maintain their systems.
And so what we put in the statute is that they will have rate studies done on their systems. However, as Representative Speaks, her concern was, are we mandating them to actually impose those rates on their customers? This bill does not mandate that they impose those rates on their customers. However, we are encouraging them to take affirmative actions to actually move their rates up. But one of the things that we have in this bill is we classify water systems as distress.
So, therefore, if you're not collecting enough maintenance funds to maintain your water systems, then we can actually classify you in distress. And so we want to make sure that you take affirmative actions, Not to say that, hey, your rate needs to come up to $28, because I think yesterday there was a comment that, hey, somebody's collecting $7, and I think ANRC testified somebody's collecting $7 for their water, and they need to be collecting $28. So you can do a rate study to say, hey, my rate needs to be $28, but we're not mandating in this bill that you take your rates to $28.
But what we are saying is that this is the rate that you need to be collecting. can you take some affirmative actions before you come to the state to say that hey my water system is in disrepair and now the state is turned over to the state because we adq will then come in and say hey we can't make this water system is no longer functional you have to shut it down then the state is forced to say we're going to put money into it and so what this bill outlines is some affirmative ways in which a community can say hey we're looking at raising the rates but
at the same time apply for funding through the state to say hey my system needs some repair and so that's where the cdbg funds came in that uh that representative brown talks about so this this piece of public policy is just saying hey communities you can't wait on the state legislature to come and fix your water systems, you have to take some sort of affirmative action. And so I think in a nutshell, that's what the bill does. Follow up.

i just want to say i spent a lot of time like representative love on this task force and that's the one thing there were a lot of things that we learned and gleaned from this process but the one thing that was very clear and fort smith i'm just going to call fort Smith out I represent Southwest Fort Smith had the there had been a kicking the can down of the
road on the wastewater system and the federal government caught us and said you're going to have to raise your rates and what happened is then all of a sudden there was a tripling of the rate now this only deals with the water this doesn't deal with wastewater but our perception what we gleaned was this was happening with water systems and wastewater systems all over the state not just Fort Smith and so I just want to speak in favor of this bill that I feel like it really puts an important mechanism in place that will help protect the citizens it'll help to protect the
citizens in that community and it will ultimately help the citizens outside of that community so that everybody doesn't have to come in and get a bailout because there's not enough money in Arkansas to suddenly overnight come in and update all of these water systems so I think this is a good start. I hope we continue
