Uh, we're going to do a little bit, um, a little out of order this morning, as is the practice in, uh, judiciary, uh, we often have the attorney general come to introduce his staff because we do have a lot of business with the Attorney General's office and so Attorney General Griffin is here in the room, and I would ask him to uh I think he was. Oh, there he is. If you'll just come to the table, attorney General, and um the mic is yours. Thank you. Thank you, chair, for having me. Thank all of y'all for having me. I, I want to start out by saying, thank you for Supporting the stuff that we've been doing, uh, particularly as it relates to my request. fiscal request earlier in the year to fund some very specific investigator slots. When I got in the job, there were no full-time investigators. They were splitting their duties with investigating and doing some other stuff. And the things that we're supposed to investigate be investigating, we're not a priority necessarily because they were doing other stuff that was not related to investigations. And As you know, criminals are creative and they're always looking for new ways to, uh, to take from us, etc. So, you know, we've had a rise in the last, really the development of organized retail crime over the last decade or so. So we really needed somebody looking at that. We started a cold case unit. We've got a full-time human trafficking investigator, obviously, uh, public integrity, uh, and, um, y'all funded that? We couldn't do it without you. So, Uh, I get that y'all are critical, critical, critical part of the process, uh, and, um, thank you for letting me have the tools, funding the tools so that we can do our job. I think I don't want to overlook that because it's, it really, the worst case scenario is when y'all think I'm doing something. And we're not doing it because we don't have the body or the bodies or the tools or whatever. So my goal is to make sure that what you think we're doing, your expectations are aligned with the reality. And um I think we're in a really good place right now, uh, on that, and so thank you for that. Um, Hopefully I'll get to talk with uh you as a group, uh, but also individually about some priorities down the road. I know you got a lot of other stuff to do today, but I do want to mention, uh, organized retail crime is a priority because our statutes don't really cover it. We've got some few changes on human trafficking, uh, juvenile justice is a priority. We've done a lot ontETA, uh, and I think the juvenile justice part of that equation, uh, needs to be looked at in-depth cybersecurity, we had 1700 people attend our cyber register and attend our cybersecurity summit. Uh, so there are a lot of different priorities I look forward to working with y'all on. But the point today is to tell you who you're introduced the folks that you're gonna see a lot more than me. You already know Alex Benton. Stand up over there, Alex, you know, Alex, she's the deputy. If you don't know Alex, you hadn't been in the Capitol, OK. She's, she's excellent. She's the deputy AG for intergovernmental. She's a great resource, uh, she has a wonderful, uh, relatively new, uh, baby, but you can always reach Alex. She's up 24/7 apparently, uh, because of the baby. And, uh, so she'll text you all through the morning and She's just a great resource. Um, Justin Brasher is a senior attorney. There's Justin who has litigated a lot of our big front page of the paper, cases and one and uh he wanted to, he, he was a prosecutor before that, uh, before he came to us, uh, but he wanted to get involved in intergovernmental after almost 2 years litigating, and he is now senior assistant AG for intergovernmental. He will be a great Great resource because there's only so many people Alex can talk to at one time. And, um, and Barrett Dudley, you know, Barrett from his years in the house. I don't know if Barrett is back there. Barrett's not physically over there, but you all know Barrett, who's just a great, great guy. And uh is a part of that team. And during this time, we expand to about 40 other people from our office who read every single bill. And become part of this temporary elevated legislative team, uh, they will be working through Alex and Justin, but we have a lot of subject matter experts and, and other people. And look, the goal is to help you. Because if we help you, if the bill gets In litigation, which many do, we want to win. And uh there have been instances where there was a well-intentioned bill, but we knew it was dead on arrival in the federal court system because it was unconstitutional. And we got that. Particular bill that I'm thinking of changed. Another state did not. There's got killed in the federal courts. Ours was never challenged. Now it had to look different. Wouldn't this politically flashy, but we're not about political flash. At the cost of survival, right, the expense of survival. We're about good quality legislation that we can make a good faith argument in court about. And that doesn't always align with the first draft, but we're here to help you get it there. And, um, we enjoy that. We're on the same team, and we just want to be helpful. You all have my cell phone. Call me, text me, uh, if you can't get Alex or if you can't. You always get Alex. But uh we're just here to help and uh look forward to talking more. Thank you, uh, Attorney General Griffin, we appreciate it. We appreciate the help your office gives this committee. It's always invaluable and uh for the new members on this committee when the Attorney General says we're here to help you. He really does mean that. And so reach out to his office if you were having a bill in here because they will look at it in terms of constitutional issues and try to help you make it a better bill. I will let you know if I don't, if I have personal feelings about your bill, and I may oppose it on the substance, but that is not gonna interfere with our legal analysis. It may, you know, if it's constitutional, I'll tell you, but I still may hate it and put my policy hat on and oppose it. But we're gonna give you good legal advice. Thank you. Thank you. Uh, members at this time, we're going to pass the sheet around while we're doing our other announcements and uh for those of you who are new to this committee, um, what we do is, um, communicate a lot by text message. And so I will need a good cell phone number that we can get a hold of you and a good email, your preferred email that, so that she will be making its rounds, and if you'll do that, because we do think a little bit different in this committee, uh, then some committees just by the volume of the bills that get filed here. We don't just start at the top and start calling them. I will go to members. We already have several bills, and I will reach out to members to see if they're ready to run their bill, and we do it, we do it that way just like it representative Tosh this morning. He has a bill on our agenda. He's not quite ready because he needs some amendments. Well, there's no sense in me calling it 3 times and. stopping it to deferred. So that's the way we run this committee. If you have a bill in here and you're ready to run it, let me know and I'll slot a time for you and what you will receive from me, from your email or your not email but your text message from me is, I will always text you. The day before, hopefully 2 days before, you'll know on a Tuesday, hopefully here because I always announce, here's the bills I'm anticipating on Thursday, um, on Wednesday, I will confirm that with you by text message, so there's no reason for you to read the 200 or 300 bills that may get filed in this committee to try to be ready every day, you will know whether you have 4 or 5. 10 bills are just one bill, um, because otherwise you're going to spend a lot of time reading a lot of bills for this committee that we might not get to for a month or so. So that's how we operate. Um, if there's any questions, feel free to reach out to me on that. We do get through all of them. We have um We have to work hard sometimes. We try not to stay late. We try to push through, and that's how we're going to do that. I don't see any media in here, but, uh, our staff knows if you ever feel that the media is encroaching upon your desk or anything, let us know, but we always tell them that they can go to the very back, back there or off to the side, but if you feel like you have media coming in on you, uh, we try to watch that, but just let us know and we let the media know what they can do. Um. Now we're I'm pleased to have Representative Underwood. He's our new vice chair this year. Uh, those of you who have been here, I think he's our 4th vice chair since I've been in this chair and we're looking forward to working, but it's not, he's not new to the committee. This is his 3rd time to be on this committee looking forward to working with Representative Underwood, and so we'll start with him, go around the table, if you'll just briefly so the people out here will know who's on our committee and your name, your district, anything else you'd like for us to know of course I feel like everybody know. high end, but I'm sure Alby and I'm pleased to be the chair of this committee again. Representative Underwood. Can Underwood, this is my 3rd term in the house 3rd term on this committee. I serve a District 16, which is Northwest Arkansas. Rogers Lowell, Cave Springs area. Um, appreciate the opportunity to be here. Thank the Speaker Evans for allowing me to do this, and I appreciate being your vice chair as well and look forward to working with all of you. Thank you, Madam Chair. I'm representative Dwight Tosh. I represent District 38, which covers the southern part of uh Craighead County, Parks Poinsett County, and a small part of Jackson County. Uh, this actually is my 3rd time to be on judiciary. I was just on the judiciary my first term and was vice chair of my second term, so it's a great, great privilege and pleasure for me to be back on judiciary. I have a background in law enforcement. I spent 37 years with the. State police and I retired from that agency as a troop commander, so I'm looking forward to serving on this committee and serving with you, Madam Chair. My name's John Eubanks. I'm a representative for District 46 West Central Arkansas, all of Logan County, part of Franklin, Sebastian and Johnson. This is actually my second time to be on this committee. The first time was my first term, and that was in 2011, and of course this is my last term, so I'm glad to be here. I'm Representative Jimmy Gazaway. I represent District 31, which is essentially just the city of Perigord. Uh, you know, each of our legislative districts have 30,000 people. The city of Perigor has 30,000 people, and so when they did redistricting a few years ago, I asked them to and they did. They drew my district as just the trace of the city limits of the city of Perigold, so that's my district professionally. I'm a practicing attorney. I've practiced law for the last 18 years. I practiced with a law firm in Jonesboro, Snelgrove, Langley, Culpepper, Williams, and Mulally. Uh, prior to my election to the House, I served as a deputy prosecutor, which you'll hear be referenced from time to time in this committee. For 9 years before I was elected and been on judiciary all 5 terms, or this will be my 5th term, all terms since I've been elected, so it's a great committee, does a lot of good work, and I look forward to working with you all. Thank you. Just Gonzalez, my district's 89. It's uh Pike County, Clark County, Nevada County, and small portion of hot spring and Garland County. It's my first time on this committee, and I'm looking forward to learning new things. I'm Nicole Clowney. I represent District 21, which is Fayetteville. I am a lapsed but licensed lawyer, and I am 4 for 4, and this is my 4th term and my 4th time on judiciary, so I'm happy to be back. Hello, Cindy Crawford. I served District 51, which is Fort Smith South and east parts of Fort Smith. Uh, this is my 4th term, and I am 4 for 4 as well, so, uh, 4th term, 4th time on judiciary, looking forward to working with you guys. Andrew Collins. I represent parts of Little Rock, uh, same 4 for 4 on this committee. It's a great committee. Thanks. Good morning. My name is Joyce Springer. I am state representative for District 76. My district starts like in Midtown and goes all the way to Barrel Road and um this is my 3rd term serving in the House of Representatives, and I previously served on this committee before not being a legislator under the tutelage of Representative John Walker, so I'm familiar with this committee. Thank you and look forward to serving. My name is Jeremiah Moore. I represent District 61, covers a large swath of East Arkansas, the Southeast third of Jackson County, all of Woodruff County, the eastern third of Prairie County, a little over half of Monroe County and most of Arkansas County. This is my 2nd term sitting on judiciary, and I'm glad to be here, happy to serve. Shad Pierce, District 40. I represent a little bit, a lot of independence County, a little bit of white and a little bit of Cleburne. Um, I'm honored to be here, uh, I'm 2 for 2 on judiciary and I'm honored to serve again and I just pray to be fair and consistent throughout. Thank you. Good morning, Scott Richardson, District 13, which is actually Bentonville Rogers, and I, I don't know, but it may be the smallest geographic district in the state, but anyway, mostly urban, mostly subdivisions, that kind of stuff this is my first time on judiciary, uh, a little, uh, a little overwhelmed with the idea I'm not a lawyer, and have no idea what to expect, but we'll make it fun either way, so I'm happy to be on the committee. We'll remind you representative Richardson, the lawyers here, we can all say we're lawyers, we're working for the government, we're here to help you. Yeah Good morning. I'm Steve Unger. 2nd term, 2nd time in the judiciary. I represent District 19, which is South Springdale, West Springdale, all of Johnson, a little bit of Fayetteville and a little bit of Tawneytown. Uh, Matt Brown, District 55, the west half of the city of Conway, first time on the judiciary. Representative Howard Beatty, District 95, um, Ashley County, Chico County in southeast Arkansas, uh, 3rd term legislator, first time in judiciary, had so much fun in here last session running a couple of bills. I just couldn't resist being a part of this great committee and um look forward to the debate that we'll have in here. Tippi McCullough represent District 74, uh, downtown Little Rock up through the middle, uh, going into my 4th term, but 3rd term on judiciary. Ashley Hudson, uh, District 75, West Little Rock, starting my 3rd term and 3rd term on judiciary, also entering my 18th year practicing law. I'm a civil a civil litigation on plaintiff and defense side both, um, employment and healthcare regulatory work as well. Brian Evans, District 68, which is all of the city of Cabot and a small portion of North Loanoke County, um, outside of the legislature, I own a supply chain management logistics company, past 3 terms. I've been on the public education committee and made the decision to move over to the judiciary this time, so I'm looking forward to working with this group. Chairman Dalby and Vice Chairman Underwood. Thank you. Thank you members as chair of this committee. I'm excited to have each one of you on here, we do have, we, we are at times lighthearted, the matters that come before us are very serious, um, and, uh, with that, I will remind you as I will occasionally, you know, we have a, a varied group of folks who will come. Citizens of Arkansas who will want to speak for and against, and it is uh, always, and I'm proud of this committee for this fact that we are always very respectful to the folks who come before us. We don't limit their time, so those of you who have come from other committees, uh, we don't, we, we typically don't limit time, um, now I'll limit them, and if it gets out of hand, we'll start limiting it, but we try to give everybody an opportunity and And so I just remind you, we always want to treat our fellow citizens with respect when they come before us and likewise we respect each other on this committee. We will have varying even the lawyers among the committee will have Opposite views on things, but we treat each other with great respect. I and I will expect people who come To treat us with respect, so, uh, those of you who are returning members know that how those kinds of things work. We do have uh for new members, you may not know our staff that's been with us for a little while. We have Kobe Little, who is our uh committee analyst, uh, all of y'all, most of y'all, I think, know Kobe, we're excited to have you with us again and, and they're working really hard to make things comfortable. We also have, uh, Emily Jamieson, and Uh, she is kind of new in her role, that has already taken hold and is really doing fine things. So members, if you need anything, um, let us know. Emily will get to it, get to you, Kobe will help you out, uh, so we're really lucky that we have these individuals our committee attorney is Caitlyn Bennett. I know those of you who are already running stuff in this committee, probably have met Caitlyn. She's not in the room today, but Caitlin is our committee we have just a few minutes because we will go to the house floor at 10:30, but we have a number of people who are we often refer to as our frequent flyers that um sit in our committee room because we are just a little toe tapping with butterflies and rainbows in this committee, and so they like to come all the time and so I will now, Scott, you're laughing. Um, so if there's anybody in the room, one of our If you'd like to come to the table into the table, this is your time to do it. Um, you can come, we're not going to ask you any questions, just come introduce yourself and tell, tell us what role you uh appear in our committee, and we certainly would even welcome uh any of the lobbyists in the room if they would like to announce who it is that they work for. I can sit right there. The room was full. I sat right there and uh Madam Chair told me that wasn't a place for me to be sitting. Uh, so, you learn quickly in here what you're supposed to do and not do. As I said, I work for the sheriffs. I've been here for 7 years as a, I was a sheriff for 16 in Van Buren County from in Clinton. I'm proud to work for the sheriffs, uh, if you have a bill that you want them to see our board serves as our committee, so I, I would take it and give it to them, and we'll have some input if you, if you so desire, uh, I'm always available to you. I've got cards in my pocket. I think most of you have my number. If you don't, I'll give you my card. It's got my cell phone number on it. You can reach me and I'll share what information you give me to my sheriffs and and if you're looking for input, we can definitely do that. Thank you. Taylor is a newly minted attorney, so he's joined with the association of Arkansas Counties. Uh, we are an umbrella organization association of Counties, which includes and supports the sheriffs. The other county officials we represent, you know, the county judges, the circuit clerks, the county clerks, the collectors, just the piece corners, etc. Uh, in addition to myself, you might see director, our director Christopher Lyons, Lindsey French, Lindsay typically handles matters for the county clerks and the assessors, and then Josh Curtis typically handles matters for the they do tag team. The circuit clerks, uh, justice of the peace and the well I'm thinking of what collectors, tax collectors. And of course if y'all got any questions, we work with you, of course. 24/7 year round if you got any constituent questions well or any kind of bill we need to work with those groups. Thank y'all. I started my career at North Rock Police Department and retired from there and went on to be the chief at Benton Police Department and then retired at the Jacksonville Police Department before I become the executive director of the Arkansas Police Chiefs Association. I am, I'm with the Attorney General's office. I'm one of those 40 people my boss was talking about, and I will be one of the people who will be here every day. So if you can't catch the more senior people, you can just catch me and I'll send your message along. And I'm the other person that will be here most of the time. My name is Brooke Gasaway and I'm also in the criminal division of the AG's office with Joe and one of us will be here daily when y'all meet. Thank you members, uh, Alex Benton, AG's office. For the last 23 years I've had the privilege and honor to work for the administrative office of the courts. And for the last 8 years, I've served as director of the administrative Office of the courts. I just want to point out since 1988, there have been two directors of the administrative office of the courts. My predecessor retired in March of 2017, he announced his retirement on a Friday, 7 days later, the Supreme Court named me the administrative Office of the courts publicly, and it was a 70 vote. We will be here continuously. I know many of you have my cell phone number, um, Kristen Clark is our deputy director. We serve all of the courts in the state, and we do it. Amazingly, uh, the, the district judges, uh, circuit judges, the court of appeals, and the Supreme Court. So it's a privilege and an honor to to be there on a daily basis, and if you need anything from us anytime, you can text 24/7 statutorily. I also serve as the secretary treasurer of judicial council, judicial counsel, their board meets every Friday morning at 8 o'clock and if you need input from any judges about anything that you would like to do, let us know. They would happily come up here and and try to assist you, uh, do your job to help protect the great citizens of the state of Arkansas. This is my deputy director, Kristen Clark. Marty, could you also address, I believe there's going to be a new judicial council for the district. There is there, so Amendment 80 is finally fully constituted, so we have 70 full-time state district judges now, um, uh, the Supreme Court issued a procure him that said the district judges shall have the same organization as the Arkansas Judicial Council. We are having a meeting later this week to form that association, so judicial counsel is all of the circuit judges and appellate judges, the Arkansas district judges, judicial counsel will be the 70 district judges too. And so that PC was just handed down last week, so we're forming that committee, but also if you have anything related to district courts, we have a staff attorneys that represent district courts do. I know many of you all, and again, I think you know that I'm here to help you in any way that I can. I've been a licensed attorney for 27 years. Good morning, everyone. I'm Bob McMahon, prosecutor coordinator. I wore two hats when I appeared before the committee. We're as prosecutor coordinator's office or a state agency was created in 1975, 1 of our statutory duties is to provide opinions on criminal justice matters to the General Assembly. I also appear as the executive director of the Arkansas Prosecuting Attorneys Association, and we will obviously run a legislative package, but most of our bills will be before y'all as we have done in the past that association is made up of 28 elected. Prosecutors and approximately 300 deputy prosecutors who have been state employees since 1999. We'll have a variety of our prosecutors come in here with us from our legislative committee. Daniel Shu is our legislative chairman. He couldn't be here today, so he will be our legislative chairman, I think, for the 5th straight legislative session. He is the elected prosecuting attorney in Sebastian County, and I have a few other regular faces that you'll see here that would like to introduce themselves, but we're looking forward to working with Bob, I have one question. Um, who's the best softball? you've ever faced without a doubt, Dwight Tosh, thank you. It's on record, so, uh, Representative Tosh needed that clarified that. Sorry. Um, we have some staff attorneys from our office that I supervised directly that will be here based on their area of expertise and what the bills that are before you might entail, um, I have our newest attorney with us today, um, Kara Claypole, I'll let her introduce herself. Uh, Bob didn't tell you what, how many sessions he had been here, but I will tell you this is my 17th legislative session, uh, and majority of my time has been spent in this committee and Senate Judiciary. um, I know I don't look that old, but I have been doing this now for 34 years, um, and I will say it is my favorite part of the job, even though after every session I tell Bob that's it, I'm done. I'm not gonna do this anymore. Um, and one last thing I'll tell you, this would have been my last legislative session because I'm in the drop program, but you graciously extended the drop 3 more years, so I might have one more session after this one, but it's a pleasure to be here and to work with you all and anything that our office can do to help you or as Bob said to any kind of criminal issues, we are more than happy to do that. Um, I've worked with, with this committee for several sessions now at least, but this is our first session, uh, working with the bar association. My name is Melissa Weatherton. Um, I oversee a portion of Medicaid at DHS and look forward to being here. Thanks. Hi, my name is Paula Stone. I'm with DHS. I am the director of the Office of Substance Abuse and Mental Health and the intersection there is people with mental health conditions sometimes commit crimes and so part of our um office is working with people with the courts, especially courts, making sure that they are directed in the right direction, so I have a lot of services there and then also oversee the Arkansas State Hospital. I want to thank everybody for being here, uh, who came, as you can tell, we have a lot of folks who, uh, come to our committee, just the last few announcements that I want to uh make. We do start on time in this committee, uh, takes 11 of us for a quorum, and when we take a vote, since we have the Speaker on our committee, it takes 10 votes to get a bill out of this committee and The speaker is in attendance, and it will take 11, um, I've already talked to you about how we will be doing our agendas, probably the most important announcement, so make sure you know this. There is the member's restroom back here. Close the door when you go in. Leave the door open when you come out, because this door will lock and nobody else can get in. So that's the key announcement for this committee are, are y'all be hunting, uh, um, a facility off from here. So are there any questions from the committee members? Have I covered everything, Kobe, he's got more. Hang on. Uh. Yes. Oh, amendments should always be in writing. Let us know ahead of time if you're bringing amendment. There will be sometimes special order of business. Once again, I handle those. I tried to find a good date, um, photography, we're gonna look at maybe next Thursday for our house picture if we can get that done. Uh, so just kind of pencil that in, we'll show up a few minutes early. Um, I'm trying to think if there's anything else we will meet Tuesday at 10 o'clock, the Chief Justice of the Arkansas Supreme Court. is scheduled to be here. Uh, she would like to make a few remarks, and I'm anticipating that we may have a bill to run. And so if I get that, uh, notice and worked out with the member, then I will also let you know.
