HB 1383, uh, this is a bill, uh, We, we passed a bill last session. Uh, to approve a change to Arkansas code 87907B. Uh, to increase the maximum payment for a petroleum storage tank cleanup. From 1.5 million to 2.0 million. Um, we, we did not change. Code 87907E. Uh, which has the old number in it, so this is just a clean up bill uh to get Section E. To match section B, something that we overlooked. So with that, I'd be happy to take any questions. Are there any questions from the committee? We've got uh two other folks that are supposed to run a bill today. They're not in here. They got tied up into another committee meeting. They're going to be back in just a minute, so hold tight. I All right, members, if you will, take your seat. that We're prepared to reconvene. Representative Wardlaw, you are recognized to run Senate Bill 58. Thank you, Mr. Chair. I don't know if anybody's coming to the table with me, but it's not my bill, so I'm doing this for Representative Eubanks. Current law prevents nonprofit government-owned or tax exempt hospitals from holding retail pharmacy permits. This has been in place since the 1970s, since the mid-1970s. In order to increase patient access, this limitation should be removed. Senate Bill 58 is a compromise bill that does not give nonprofit hospitals the same freedom enjoyed by profit entities. But we'll increase patient access to help nonprofit hospitals be flexible with options address patient needs and changing healthcare environment that we live in today. And with that, Mr. Chair, I'd take any questions. Any questions from the committee? Representative Schultz, you recognize for a question. Thank you, Mr. Chair. Representative Wardlaw, do you have anybody that could come to the table and explain the protections that are going to be put in place for our. Uh, privately owned pharmacies out in the communities. I'm sure someone want to speak to that in a second. But I don't have anybody to come to for that. Is there anyone here from The pharmacy Association or from the hospitals. That would like to speak on this. He wouldn't if you don't mind, uh, uh, identify yourself for the record and you'll be recognized to speak. Yeah You wanna go for? Go ahead. John Vincent, Arkansas Pharmacists Association CEO. Thank you for having me here today, and um, like represented Wardlaw said it's a law that's been in place for 50 years since 1975. And um We're neutral on the bill. We've worked with Senator dismaying and other members on the Senate end before it's come down to this end, and we're appreciative that Senator dismaying has made some changes to limit the permits to on-campus of hospitals, unlimited infusion permits to help with oncology and some serious diseases to where there is a gap that our local small pharmacies don't provide those services despite the the loss of that will really help. And there are some other bills in the future, one of them being, I think HB 1150 that's outside the scope of this that I think we'll work on together that will help both hospitals and small pharmacies. So with that, and I'd like to yield to my on. So I'll bring up a close, the compromise was that there's only one nonprofit hospital can only retain one retail permit for each hospital permit. They can then obtain an extra permit for every 100 beds, which gives them more flexibility. The other thing about this is the Board of Pharmacy will report to ALC how many applications they receive and how many closures they're aware of. So as this goes forward, the board of Pharmacy will report how many actually exercised that above the one permit, so I guess that's where your protections lie because they're not gonna run rampant with pharmacy permits it's gonna have to be based on bed size or hospital size and all that will be reported to you in the legislature as we go forward. You can introduce yourself. Thank you. My name is Ryan Garri. I'm the president of Mercy Arkansas Communities. I, I really don't have anything to add to what was just shared. Hope, hope that clarifies. Well, I appreciate y'all. That answers my question. Thank you. Yeah. Representative Richardson, you're asked for a question. Thank you, Mr. Chair. So I just want to, I think I understand it, but when we talk about the the licenses is per campus, so uh Mercy, for instance, who has these satellite spots won't be able to have. Necessarily pharmacies in those satellite locations is based on the main campus, correct? It, it would be a license for each campus because each campus is a hospital in its own, but at a campus it's larger than 100 beds they could apply for a retail pharmacy license. Am I reading that correctly, John? Yes, the way I understand it, it would be restricted to the licensed hospitals that have a license with the Arkansas Department of Health as defined in the hospital licener Act, they wouldn't have them in their. Off-campus clinics that are not a hospital unless there is a provision in there that if there was a network adequacy issue where there was a pharmacy desert where there was a need. It does have some flexibility to do that upon if there was a need identified and then Senator Dimay also put some language in there that is around patient freedom of choice because the hospitals do employ both the prescribers and would have the pharmacy that to ensure um. There is freedom of choice. That language is Pretty simple. And so they're It's not exactly um I guess I won't say his testimony was he didn't address steering specifically in the bill, and if there's a need to address that further, that that would be done in a separate bill. Thank you, Mr. Gehring, just quickly, I, I listened to some testimony on the Senate and the first, the first time this came through, uh, I just wanted to give an give you an opportunity to speak to this being better for patients. Yeah Uh, thank you. Uh, and, and really that is the That's the first question and in the primary focus of this bill is looking at it from the patient's perspective. As you all know, um, The retail pharmacy hours of operation have been reduced. Um, it's a challenge for our patients when we discharge them from our ER and hospital settings, um. get the um Meds they need on nights and weekends in particular. So this really enables us to assure there's no barriers for those patients to immediately get on the meds they need. And Really, what our goal is, how do we make sure we keep those patients at home. Um, versus noncompliance with their meds, ending up back in our ER and back in our hospital settings. Follow up, Mr. Chair. You recognize. Could you also speak to the provisions for the infusion centers as well. I was just going to answer that question before you asked the follow up. I mean, to me, I see this as more about the infusions than I do pharmacy access on weekends and, and nights, which I agree with that as well. But more insurance companies are requiring non-hospital infusions, and one of the problems with that is access in rural areas and hospitals not being able to offer that service due to the way the permits are restricted today. This does open that up, so hospitals can can offer that infusion without them having to be in the hospital, and that's not a counter where you go to the counter and get drugs. I mean, that's a place where a nurse goes to a house, a home health, and infuses a patient with uh IV drugs. So I wanna be very clear on what we're talking about here, but thank you, Ron. I sorry I didn't get to that answer before you ask the second question. Mitty, any other questions? All right, I'll take your motion at the proper time. Just a quick follow up to Representative Rose's question, if a patient isn't admitted, say they go to ER, but they're in need of medication. Does this bill cover that through pharmacy access in your facility? Yes, it would. Representative Long, you're recognized for a question. Thank you, Mr. Vice Chairman. I just want to make sure I understood correctly a moment ago you were talking about when the hospital could have off-campus facilities in, in, uh, and I was wondering, it's like, is this like a separate standalone retail type operation or would it be like at a maybe a um Uh, smaller hospital that's, you know, has like you said, over 100 beds I believe. It would be limited to only um locations that had licensed hospital beds. OK. So, no. No ambulatory clinics or non-surgical centers that don't have hospital beds setting up just basically like a a retail place down the street from the local pharmacy. that's great. Thank you. Members, are there any other questions? Representative Henley, you're recognized for a question. I just need a clarification on, uh, nonprofit tax exempt or governmently funded hospitals. I'm just not aware of that difference. So, um, There are nonprofit hospitals and there are for-profit hospitals and then there are some governmental hospitals as well. There's a distinction in how they're Legally structured, does that and today for-profit hospitals can actually have a pharmacy location, and that's the issue that's what this bill fixes is it equalizes that playing field between all the different ownerships that take place.
