Thank you, Madam Chair. I'd like to ask leave for two special guests into the chamber, please. OK Senator Hammer, you're recognized. Thank you, members. It gives me great honor today to honor the
2024 Miss Arkansas teen Miss Bella Crow, who is with us today. Would you please express your appreciation. resolution is that whereas Bella Cro is a 17-year-old senior at Benton High School who assumed the responsibility and title of Miss Arkansas teen 2024 in February after her predecessor Peyton Boling was crowned Miss America's teen on January 4th, 2025 in Orlando, Florida, and whereas for serving as Miss
Arkansas team, Bella Cro will receive a scholarship in the amount of $10,000 provided by Jones and Son Diamond and Bridal fine jewelry and Miss Arkansas Scholarship Foundation, and whereas during the Miss Arkansas team pageant held on June 14th, 2024 at the Robinson Center performance hall in Little Rock. Bella Cro took home a total of 13,000375 in scholarships and whereas at Miss Arkansas Teen pageant, Bella Cro also won the overall focalist Award and the Kiss Heart Disease Goodbye Award
and was teen in action over all winter, whereas as Ms. Teen Arkansas Pageant, Bill Crow gave a vocal performance of a word that I can't say. What does it say? Obabino. There we go. And that's why she is who she is and I'm not who I who she is. Legenary Italian era. It goes on also to say that whereas throughout her year serving as Miss Arkansas teen, Bella Crow will make appearances across Arkansas promoting her personal
community service initiative, Healthy Choices for Healthy teens. The American Heart Association, Ms. Arkansas Opportunities and Miss America opportunities, and as Belcrow competed for 3 years as Miss Arkansas teen representing local titles of Saline County's teen in 2024, Greater Little Rock in 2023 and Metroin in 2022, and whereas throughout her time competing at the state level in Arkansas, Bea Crow has won a total of nearly 17,000 and scholarships and whereas after Belcro graduates
from high school. She plans to use the scholarship she has won through a Miss America Miss America opportunity to attend the College of the University of Alabama, where will pursue a degree in exercise and nutrition science with the goal of becoming a registered dietitian professional sports nutritionist, whereas Bella Crow attended the White House conference on hunger, nutrition, and Health during autumn of 2022 as a representative of the American Heart Association, and whereas Velcro started beyond fruit carts and organization that provides fresh fruits to
public schools in central Arkansas, and whereas at Benton High School, Belcro is involved in the National Arts Society, BHServe, pro club, outdoors club, and City of Benton Mayor's Youth Advisory Council, whereas Belcro is the daughter of Aaron and Amber Crow of Benton, granddaughter of Bob and Teresa Devine and Gary Burt and the late Keith Crow and has one older sister, Catherine, also to conclude now whereas be it resolved by the Senate of the 94th General Assembly of the state of Arkansas that the state
honor the 2024 Miss Arkansas teen Bella Crow and be further resolved upon adoption a copy of this resolution be presented to. Crow by the Secretary of the Senate. It's an honor to be standing in front of you today as your Miss Arkansas's teen 2024, and what an honor it was to be crowned that in this capital. I am ecstatic to be able to serve the state of Arkansas, um, promoting my personal platform, healthy choices for healthy teens, R I encourage people my age to make small choices every day to impact their overall health.
So I just thank you again for giving me this opportunity to come before you today and giving me the honor to thank you. We will now take up Senate Resolution 18. He, he helped me quite a bit. Her dad's a local physician and when, and now here
she's come to carry the tradition on being the salt of the earth, so right to honor Miss Arkansas 2024, Camille Cathy, whereas Camille Cathy. When Arkansas was crowned Miss Arkansas 2024 on Friday, June 15th, 2024 during the '86 Miss Arkansas scholarship pageant held at the Robinson Center Performance Hall in Little Rock, Arkansas, and whereas Camille Cathy won the title of Miss Arkansas while competing as Miss White River, whereas Camille Cathy won a scholarship for the
$30,000 from the TE and Shannon boysoka's Foundation and uh more than $75,000 in awards, wardrobe. ation and gifts and whereas at the 2024 Miss Arkansas scholarship pageant competition, Camille Cathy won several additional awards, including awards for her interviews, her evening gown, her talent, and overall arrival and whereas Camille Kathy proudly served in her role as Ms. Arksas with a commitment to community engagement and advocacy promoting important causes and
inspiring young people of Arkansas. Whereas Camille Cathy engages in a variety of activities that include school programs, public speaking engagements, media appearances and conferences and aimed at making positive impact in Arkansas via her platform, proudly volunteer and whereas Camille Cathy represented Arkansas at the Miss America pageant held in Orlando, Florida

147. Senate Bill 147 by Senator Dodson to amend Arkansas law concerning the Department of Transformation and Shared Services and to change the name of the Department of Trans transformation and shared services and declare an emergency. Senator Dodson, you're recognized. Thank you, Madam Governor. Members, Senate Bill 147 just changes the name of the agency, um, as the title reflects. It is a rather lengthy bill bill because it has to be changed in
all different areas of the code, so there's of the 104 sections, 102 of them deal directly with changing the name, just strike through, and then at the very end, it uh it it section 103 adds a deal if we happen to miss any sections in the code of where the name is being shifted. It allows a code revision commission to make those changes or if any laws that were passed. During the session, um, that didn't reflect that name, then the code revision can update it.
There is an emergency clause in Section 104 at the end, so it will take effect at the beginning of the next fiscal year, July 1. The reason for this is just for the name to more accurately reflect the role and function of the department and more than happy to answer any questions Any questions for Senator Dodson. Senate Bill 165. 165 by Senator Dotson to amend the law concerning competitive field proposals under the Arkansas procurement law. Senator Dodson, you're recognized. Thank you, Madam Governor. Senate Bill 165 has a, is a very small change, but it is important in our procurement process to allow for um best and final offer proposals for um so if a vendor submits a proposal and the department. needs to make some clarifying change to the offer that's minor
in nature, they don't have to go and put it all out a second time and restart the entire process, but they can put the the request out for best and final offer to all vendors that are, are eligible would be able to actually make an offer on that particular propo or who have already made an offer and want to revise their their offer based off of the clarification from The department before an award is given.

of these bills that I'm aware of as far as a dollar figure, um, of course, the fiscal impact on best and final offer hopefully would be that It would be positive that offers would offer less through negotiations, but. Well, it's gonna be like Shared Services on the previous bill, well, the previous bill, yeah, you would have whatever the the renaming of
An agency or department happens to be. I did not. That, that didn't come up in discussions. And there's no fiscal impact on this. On Senate Bill 165 that we're considering right now, the fiscal impact would basically be on whatever the uh as procurement's offering or putting out proposals, RFPs, uh, the, the fiscal impact would be unknown. I don't know how you could know what the fiscal impact would be on something that hasn't been offered yet.
So this would just be on anything going forward in the future, they can make clarifying proposals. So Theoretically it would actually lower the fiscal cost of something because we know without a doubt there will be something offered. So that will happen that's gonna be on a case by case basis with each request for proposal or request for qualification or sealed bid that's put out there and so I don't know how anybody could.
Predict what future offers are going to be in any given period of time, whether it's 1 year or 10 years based off the ability for them to give a best and final offer offer which would likely be less. OK. Senator Irvin, you're recognized. Thank you, Senator Dodson. Um, I just Adding the word clarify, does that change, um, What they can or cannot discuss after the deadline for the proposal.
If discussion. I'm just trying to understand the need, uh, the need for the language addition. So this was actually brought to me by the department, so when they go and they put out the the clarification, um, would be after they've already received all of the proposals. And then if they, after that fact go and say, hey, we need to clarify this point because it wasn't clear. We've looked at all the proposals and so we want to make
it, you know, clarify it, and put it back out amongst the the eligible offers that could be awarded the bid and give them all an opportunity to to do a best and final offer, um, that, that would be the for minor changes, not for substantive changes where they'd have to go out and rebid the entire thing, OK, so basically if one gets to clarify their proposals, others would be able to also clarify the same point
eligible, all eligible proposals, so they wouldn't put it out for someone who's ineligible for that particular proposal. OK, OK, thank you. Thank you. Anyone wish to speak against. Thank you. Um, just a clarification, are we talking about a clear it says something about one that necessitates a material revision. Is this going to happen after the bids are opened and then available to the public. No, it would be only, while the department is still looking through them if they, they say, OK, uh, you know, obviously this wasn't clear when we put this out. Um,
you know, there's a minor update or change, we don't want to trigger a complete reboot of the entire thing, backlogged the process, take, take everything back, but we need to make this clarification, and we're going to let everybody who is eligible to a best and final offer, OK, so, so somebody we're, you know, they, they offer a proposal that it's, you know, $10 a widget. They're not going to the other competitors are not going to know that the one the clarification was $10 a widget and then it could say,
well, we're going to do it for 9. This is our final best offer. Well, correct, they're not going to know who was a who was, who was in position 1234, or anything like that. What they'll know is that there's a clarification on whatever widgets it is, they could, in fact, after the fact, lower their, their proposal. It would allow them to say if they, if position they wouldn't know what positions, but say they There's 5 offers, and they'd all
offered $10 or $11 or whatever a widget, and they wanted to, hey, we've got another shot at this. We've cut our prices. We want to lower it down to $8. Everybody would have that opportunity to make that change before final consideration on who they're going to award the offer to, OK, I'm I think I might have pausing muddied the waters it seems like that our sealed bids are gonna be sealed, but they're gonna be in see-through envelopes and everybody at that point can say, gosh, I'm losing out. I I'll lower it 50 cents a widget or
whatever if, if, if it's just clarifications before the prices and things are, are out and available. I, I'm OK with it, but If it's, it includes the numbers that's part of the bid, and they can do a final best offer, it seems like to me that would kind of circumvent the sealed bid process, but I as I understand it, no one will know what the offer is, but everyone will have the opportunity to modify their original proposal based off the clarification up to and including lowering their price if they choose to at that time. Senator Murdoch, Thank you, uh, Senator, so the fundamental problem that I'm having and maybe it's just I'm having it with you explaining it and let's see if we can work our way through it. Would still beds typically wants the numbers in, then that's the number everybody's numbers in and it's sealed. And the process now as it stands with sealed bids if there is technical issues or even questions, the architect, the architect or the administrator
of the bid calls, will call you and ask you, hey, here's the situation that we weren't concerned about to make sure you hear this I dotted Tro something very minor, not at all, not at all changing of any numbers because once those sea bid numbers are in, those still number Vietnam can't change unless deductive alternate or something such as that as part of this bid process is taken. What's critical in what you're saying, the way you're presenting it, that that causes
a problem is if you don't have a total rebate, nobody can change numbers. You can't, everybody can't come back and change the widget price. Like you said, that's called a rebi. Now, if it's just a technical situation and I've had this happen many times. Architect will call, ask a question, um. Maybe about a subcontractor listed maybe about something that you had to list or provide, but when it gets to the numbers, the cost, those critical items
as a part of a bid. We don't get those to do over and once they are sealed and you receive them. That's it. So let's uh I'm receiving clarification as, as you're talking here and my understanding of it is no one will know what the offer is. Those remain sealed, um, but allows for the department to provide clarification after the bids have come through, and of course if they want to resubmit uh, a different number that would still remain sealed but no
public information would be released, OK, here's the problem with that, and whoever clarifying. Make sure to answer this. You can't change numbers. You can't change the sealed number for various reasons. Once that comes in, ask them to give you an example of what they mean by a clarifying change. What, what, what are they talking about? So it says under the current law, the best and final offer allows someone to lower the price, just
not change the type of widget that they're they're bidding on. So we already have that where when you're doing a best and final offer that obviously is lowering the price. It just gives them the opportunity to put it out for every eligible contender to to make a best and final offer. So are you talking about a bid process or you're talking about a negotiate. Talk to me about when you say procurement, there are various forms of procurement there's bids and negotiations. Talk to me.
So this is This is specifically related to proposals. So it's in the RFP, so request for proposal. So it's not a sealed bid, I guess as far as the the sealed bids are concerned in this section of the law. Now that's totally different. I understand that a lot different. That's much, but you were using the words be those words were
being used and that's much different than the procurement process, sealed bids and the RFPs, that's, that's section is specifically related to RFPs RFPs don't always come with a number. The number comes after sometimes the choice is even made, so RPs don't necessarily come with a number so I can see an explanation being needed possibly in that scenario. I. apologize if my language said bid and it didn't actually say that in that section of the law is referencing requests for

This Senate bill 166 is to expand the definition of critical emergency to include the Declaration of an emergency by the governor.

Not, not everything, however, the change amends the definition to include an emergency declared as a state of disaster by the governor, um, uh, critical emergency procurements would be
limited to those related to declare, declared disaster and would include services such as debris removal and commodities like sandbags. Are the questions I see Senator Stubblefield, you're recognized. Thank you, Madam Chair. Uh. So, uh, who's who's behind all these bills? Well, this is a request by all four of these are requested by the department of Shared Services transformation and
shared service as its name today the geographical, yes, that includes the building authority information technologies, personnel management, procurement, employee benefits, and geographical information. So these are all tied directly or indirectly to the 3000 bed prison, correct? Mm. Not that I'm aware of. But they could be tied to because all three of these entities work for the prison, uh with the board of Corrections.
Well, as far as I know, this has absolutely nothing to do with the Board of Correction or the the prison that you're talking about. Senator King, you're recognized. So all this stuff on procurement contracts is any of this, the fruits of paying millions to these out of state consultants to advise us on procurement contracts. I do not believe so.
