All this is doing in regard to the administration of oath of offices, it's adding a couple of lines, uh, you'll see that we're going to include in there or asking to include any former circuit or chancery judge who's served at least 4 years could then administer oaths of office or any former municipal or district judge. served at least 4 years, so that
would be in regard to, um, Who can Obviously administer oaths of office, and we've made that change down in another section, very same language, uh, giving those individuals the opportunity to administer oaths of office to people coming into office. Representative Don Henley, District 88, Southwest Arkansas. Proud to be here today. Thank you, Madam Chair and members, um, excited to present bill number 1581. This bill will enhance the rights of victims of a crime by
recognizing two offenses within the legal framework as a sex offense to include trafficking of persons and grooming a minor for future sex trafficking. Currently there are 19 offenses on the list to define sex crimes. Rape. Sexual indecency with a child, incest. Sexual assault, stalking, and 14 more, but trafficking and persons. Trafficking of persons and
grooming of a minor are not on that list. The legislative session of 2013 passed the trafficking Act and the grooming Act. Of the grooming of a minor act passed in 2021. Neither of these had been added to the code with respect to rights of victims of crimes. Victims of sex offenses are entitled to be notified when certain court hearings occur. The request today is to add tea,
trafficking of persons and you grooming a miner for future sex trafficking. Members you've

However, by and large, most of the offenses brought under the trafficking of persons statute, uh, are sex offenses generally, and there is not a separate statute or separate offense that would solely deal with labor

and it wouldn't technically be a sex offense where somebody would, let's say, have to register as a sex
offender, that that wouldn't apply what it what it does apply is to the definition of sex offense under this Title 16 definition, which would give greater protections to the victims as it pertains to not disclosing their home information, uh, things of that nature. So it wouldn't always, if somebody were to be convicted of the crime of trafficking of persons and it were a labor offense, there wouldn't also be additional.
Requirements for them to be assessed by a sex offender, uh, manager or, or things of that nature. It just has to do in this code section with their notice requirements for certain hearings, uh, and then protecting some of their personal identifiable information in the court proceeding. I, I would say that the under current law, there is no delineation for a sexual offense of trafficking of persons versus labor, um, the law just doesn't delineate between the two in terms of what the charging instrument would actually read as, uh, both labor and sex trafficking would just be charged as trafficking of persons, uh, and as a practical matter, often the two are intertwined as well.

Recruited in uh From a, for a person that has been sex trafficked from a correctional facility. Uh, on the bill that we're discussing, House Bill 1552, generally what the bill does is it creates a classification for the encode offenses of the three offenses that we created in the fentanyl enforcement Accountability Act, uh, aggravated death by delivery, predatory marketing of fentanyl to minors and trafficking of fentanyl. And again what it seeks to do is to classify the inchoate versions of that, those offenses which are solicitation attempt and conspiracy.
That's what the bill does, and as we discussed, the bill lists those in coed versions as Class Y felonies and Representative Collins's question was, Well, if they're already felonies, why are you listing them as a Class Y felony because, uh, In traditionally in criminal law and in code defense is one step below what the actual offense is. Well, that's because and now I recall these particular offenses are not why felonies,
and when we ran the fentanyl enforcement Accountability Act. I've referred to him even then as super why felonies. They're actually unclassified felonies, uh, aggravated death by delivery, can carry. I believe 25 to 60 or life, uh, Trafficking of fentanyl is 20 to 60 or life and predatory marketing of fentanyl to minors is an automatic life sentence. And so the reason why we made
these ys is because those are unclassified felonies that carry penalties above the wife felony. So this would be like a step down from Uh, the penalties that are in effect for these particular offenses. I now in my office have um um uh resuscitation devices in in both my victim witness office and my main office. I have about 6 people who have Narcan and know

One of the things I would say to prosecutor Xu's point is, it is a policy question and it is, it's a question for the legislature to decide where these should be classified. I will say one of the distinguishing characteristics about aggravated death by delivery. So there's two different penalties for aggravated death by delivery depending upon essentially who the victim is. Aggravated death by delivery that involves fentanyl to a minor is an automatic life
sentence. There is no term of years. Predatory marketing of fentanyl to minors is an automatic life sentence. There is not a term of years that can even be considered. Now trafficking is a little different. There is no automatic life sentencing with trafficking, as I recall, trafficking is 25 to 60 or life. And so certainly with regard to the two that are automatic life sentences where a term of yours can't even be considered. I think it would be an appropriate step down to say the
appropriate next step down for an offense that's an automatic life sentence. Would be the Y, which is 10 to 40 or life, so it, so it leaves life, at least in the equation. But depending on the severity, but it also gives a term of years and of course the jury is not obligated or the judge, whoever may be doing the sentencing is not obligated to uh sentenced to the most severe penalty, uh, they could send us to the least severe penalty, which would be 10 years.
So I do think because those offenses carry life only. Uh, that it makes sense that the next level below. From a policy perspective, again, if we could make it an A, we could make it a B, we can make it whatever we want. But I do think that it logically it makes sense that the next step down from automatic life sentences would be alive with a term of years. Members, any other questions? Seeing no other questions, the
