So I, I know I don't need to handle bill because you all have read the entire thing, but I probably read about as much of it as I have. It's, it's a not a substantive bill. It's not a technical corrections bill, but it is a code revision commission bill. What happened is Title 19, the public finance title of the Arkansas Code. As it developed over time, got complicated, and some things needed to be rearranged, and so that's, that's basically what it does. There's 3 big things that it does. The first is that it reorganizes Title 19 by subtitles, which allows for subject matter that's similar to
be next to each other in the code. The second thing it does is it reorganizes subchapters dealing with state treasury funds that were running out of numbers and it reorganizes the Arkansas procurement law subchapter which has grown to 81 sections, and then the third thing it does is it transfers particular material from Title 19 that really belonged in other titles of the Arkansas code and moves it to where it's, it's near the other code sections for the subject matter it's dealing with, and then it makes grammatical, you know, and punctuation changes throughout
Title 19, but there's, there's no substantive changes. The process for this was there was a Title 19 recodification working group. It consisted of the Arkansas Code Revision Commission, the governor's office, the Attorney General's office, treasurer. State's Office auditor's Office, legislative audit, the FNA trans transformation and shared services Claims Commission, Ethics Commission, and the Bar Association. There was a working group. They came up with this entire product. They recommended it to the Code Revision Commission.
The other, just as a reminder of the other legislative members of the Code Revision Commission are Senator Josh Bryant and then Representative Matthew Shepherd and Representative Jimmy Gazaway, us and the other citizen members of the Code Revision Commission. I Gone on too long, Mr. Chair. I got cut off, but we, we voted for it again, it's all technical. There are no substantive changes, and Kevin Coon, who does a great job helping lead the the code revision commission is here and we're happy to answer any questions that you may have.
Speaker 14
3:18
OK. Thank you, Senator Tucker, does anybody have any questions in this Senator
Senator Jim Petty
Unverified
3:21
Petty. Just for the, for the sake of the audience and and those who may be listening at home. This is dealing with the issuance of bonds, municipal bonds, etc. and none of the substance of that is changing is what I heard you say, uh, and, and, and so cities and counties will continue to be able to do just what they've always done in the past in issuing bonds or or the state or whoever. That's absolutely true. The main takeaway from this bill
Senator Clarke Tucker
Unverified
3:50
is that there are no substantive changes to the law whatsoever. Thank you. Thank you, Senator Petty. Any

8:07
You know, the drill, Mr. Gering, if you would introduce yourself and you'll be recognized to, uh, answerenator Dismay's question. Yes, sir.
Speaker 32
8:14
Thank you, Mr. Chair and members of the committee, Paul Gehring,
Senator Jonathan Dismang
Unverified
8:18
DFA. Yeah, and so in the Uh, in your green sheet here it says that y'all would still be required to monitor changes federal income tax laws to determine how those changes may affect Arkansas income tax law. My only concern is, I mean that that does impact what we do here and how we make decisions of do we conform, do we not conform,
and if the members don't have that information, so you,
Speaker 32
8:41
are you creating a report either way? Uh, no, sir. So we, we, we
Speaker 34
8:46
continually monitor what's going on in Washington with changes in terms in terms of the internal revenue code from time to time, DFA will have proposed legislation to adopt or reopt portions of the Internal Revenue code, so we're always keeping track of federal guidance and changes in um from from Washington. This bill would just
require that this report that has been required to be submitted. To the General Assembly be discontinued, so we're going to still continue if there are questions that the General Assembly has about, you know, our view and, and our reading of tax changes that occur in Washington we're always going to be available to have those discussions. My only concern is No
Senator Jonathan Dismang
Unverified
9:27
one in around this table is doing much tax work, and so at that point DFA is going to be the only one that's knowing what those changes are and if there's
not a report to the General Assembly or to this group, then we don't know what's been changed or not changed that may need to be changed for conformity purposes for the benefit of the taxpayer or whatever. So my only what I'm understanding is y'all monitor, but for instance, the secretary is not getting a report on the changes that are happening in DC to federal. Tax laws. And so there's staff that's going to monitor, but there's no one higher up the chain that's been giving a summary report or saying, hey, these things are happening.
We need to monitor this or we need to, I mean monitor may not be the right word, but, you know, how do we want to proceed? Or do we want to do anything, so there's not going to be any report generated whatsoever that monitors federal tax law changes. That's correct under this bill. I think that needs to be done somewhere even if it's only for y'all. It needs to be done somewhere that that's something. That's, that's monitored in a report even in your own hierarchy.
Speaker 32
10:44
I would think, who's charged with monitoring the federal changes right now. So we have individuals
Speaker 34
10:51
in our income tax section. We have administrators that we have one administrator that we have assistant administrators that are over individual income tax as well as corporation income tax. And then we also have our audit staff that will in field on it that that performs income tax audits of taxpayers that continually attends continuing
legal education courses for CPE as well, but I understand the point of the question is, is that how would the General Assembly be aware of things that would need
Senator Jonathan Dismang
Unverified
11:27
to be bigger question is, how, how do the decision makers at DFA become aware of changes. That's my bigger question. And then What process is in place for determining what we do about those changes. I mean, for instance, I mean back in um You know, COVID, federal
government had policies that, you know, are ways that they wanted to handle the COVID relief funds or, you know, the PPP money and all that sort of thing and the DFA did not want to comply or do it the way that the feds were doing it at one point in time. That changed. We all got to a different position and we essentially conformed with the federal guidelines on PPP or what they were wanting to do their treatment. If that's not So that was a very public thing that happened, but there are lots of changes that aren't so public. That the General Assembly
wouldn't know to engage unnecessarily that may be to the detriment of a payer or the complexity added to affair. I just want to know how does it go up your chain when changes are made. Without a report of some kind and we're saying we're doing away with all reporting. I don't want to believe this. I mean, y'all we can move on and just let the will of the committee do it, but I, I am concerned that there is no reporting now of federal tax law changes. That's, that's going to go through any system. This at least required a report to be
made that would have been reviewed by supervisors before it was disseminated
Speaker 34
12:55
to the General Assembly. And certainly to your point, Senator Disma, if there are, we do get feedback from the taxpayer community as well as taxpayer representatives and attorneys about important changes. Your, your example that the that Congress enacted the Paycheck Protection Program, loan forgiveness, that because of the way Arkansas laws were structured that we could not, we did, we had to actually have a
bill to adopt those those really rapid fire changes that occurred during the middle of the pandemic regarding that specific program there was a there was a pretty substantial revenue impact that we had to calculate and provide to the General Assembly so that the legislation could be concerned, but I think the most important way that we hear about those changes, it occurs in real time all the time, particularly with a situation like the pandemic with the tax cuts and job Jobs Act in 2017 that was the first large
scale overhaul of the tax code on the federal side since the 1980s, so we also when there are circumstances where we would as a department like to additionally conform to the Internal Revenue Code to make things easier on taxpayers. That's an ongoing process. What we do is we work with our income tax section as well as our Administrators and field audit to formulate legislative proposals that we can bring every two, every session that
occurs that where we can conform conform to the federal code. It is challenging in the regard that a lot of these changes do have a revenue impact, so whether it's, you know, updating to conform to depreciation and expensing of property, you know, we certainly, we would love to have a tax code that is as easier for the the taxpayer representatives and the individual taxpayers to know if it's treated this way on the federal side, it would also be treated this way on the state side, but the Washington
whatever goes on in Congress regarding the tax code because of our Constitution, it requires a legislative change that we would have to come to this body to approve that change as well as the process that we go through with the governor's office to have any type of legislation considered scored for revenue impact, and then made a to be made whether or not this is something that the department can pursue given the need to account for it in the budget, yeah, and the PPP money didn't have revenue impact because it's never been received before, but,
Senator Jonathan Dismang
Unverified
15:24
um, what I mean, I'm just concerned that this point if if there's not a comprehensive report, then the only thing that comes before us for potential change are the things that y'all want to change or DFA wants to change, and so the legislature wouldn't have that comprehensive list to also be able to look at it and say, hey, you know what, we think that these 4 other items deserve merit and attention, uh, you would be essentially throttling back what is going to be presented. I'm also apprehensive that there's not an overall report that would be given to someone.
In leadership at DFA to help make that decision. Um, again, I'll stop laboring and I know we, we're
Speaker 18
16:02
trying to move quickly. Senator, Senator Hammer, you have a question, sir? And I may be
Senator Kim Hammer
Unverified
16:08
on the same horse that Senator Dimas on, but when I read it said DFA would still be required to monitor changes in federal income, and how
Speaker 34
16:16
would you report those changes to us again. So, uh, Representative Senator Hammer under this bill, the report that's required would be repealed out of the statute, but the statute would still continue to require the
Senator Kim Hammer
Unverified
16:26
department to monitor those federal changes. OK, but that gets communicated to us through what, what method we asked for it or correct, yes, upon request, but we would still have the legal obligation under the statute to
Speaker 34
16:39
continue to monitor those changes on the federal side, so the burden would be on us then that if we want to know, we
Senator Kim Hammer
Unverified
16:46
would need to ask you. It's not that it's not available, it's just now we would have the burden of needing to ask you for it, and it should be available what annually or
when, when does that come out? Is it
an ongoing recurring situation or is it annually? I believe it's an annual report. And when, yes, annual report. Yes, sir. When, when is that produced? This, uh, sir, when we had

discussions about this, this report. This was put into the law in 1989, um, we, we have not produced this report in a number of years we couldn't even find
the last time it was done. So at some point when this this process began, we became aware of the of the need for that there was a legal requirement for this report. What We couldn't find and speak to any of our senior people that have been here many years to be able to figure out exactly when that report was last produced. So real quick, how, how intense

just depend upon the whatever is going on in Congress when you have a year such as the tax cuts and Jobs Act in 2017 17 that had pretty substantial changes to the Internal Revenue Code. We did have the interim committee to study tax reform during that interim period before in between the 17 session in the 19th session
where we met throughout that interim period. To talk about the changes that occurred in the in the tax cuts and Jobs Act where we met continuously at the General Assembly with that special committee that was formulated to as a part of that study to see anything that was in the tax codes and Jobs Act that that Arkansas would potentially potentially would like to consider. OK, I'll just hold up with somebody

else. Senator Petty. Thank you, Mr. Chair. So I, I
have a recommendation and, and, and I think maybe Senator Dimain wasn't in here when we had the discussion. The first time he he brings up some very good points and and some perspective that that his experience down here brings to the table. Um, I would like to see us maybe pull it down, talk about it, because if we are going to talk about comprehensive reform. I think having the differences once you have it captured, it should be relatively simple. At least
there doesn't seem to be anything significant unless the tax cuts expire or something like that, but, but I think maybe just have a pull it down, just have it off the offline conversation about this particular report, uh, that would be my recommendation at this point. It's just, if you don't mind. Let me just go one step further. Is there any
