So I, I know I don't need to handle bill because you all have read the entire thing, but I probably read about as much of it as I have. It's, it's a not a substantive bill. It's not a technical corrections bill, but it is a code revision commission bill. What happened is Title 19, the public finance title of the Arkansas Code. As it developed over time, got complicated, and some things needed to be rearranged, and so that's, that's basically what it does. There's 3 big things that it does. The first is that it reorganizes Title 19 by subtitles, which allows for subject matter that's similar to be next to each other in the code. The second thing it does is it reorganizes subchapters dealing with state treasury funds that were running out of numbers and it reorganizes the Arkansas procurement law subchapter which has grown to 81 sections, and then the third thing it does is it transfers particular material from Title 19 that really belonged in other titles of the Arkansas code and moves it to where it's, it's near the other code sections for the subject matter it's dealing with, and then it makes grammatical, you know, and punctuation changes throughout Title 19, but there's, there's no substantive changes. The process for this was there was a Title 19 recodification working group. It consisted of the Arkansas Code Revision Commission, the governor's office, the Attorney General's office, treasurer. State's Office auditor's Office, legislative audit, the FNA trans transformation and shared services Claims Commission, Ethics Commission, and the Bar Association. There was a working group. They came up with this entire product. They recommended it to the Code Revision Commission. The other, just as a reminder of the other legislative members of the Code Revision Commission are Senator Josh Bryant and then Representative Matthew Shepherd and Representative Jimmy Gazaway, us and the other citizen members of the Code Revision Commission. There are no substantive changes, and Kevin Coon, who does a great job helping lead the the code revision commission is here and we're happy to answer any questions that you may have.

continually monitor what's going on in Washington with changes in terms in terms of the internal revenue code from time to time, DFA will have proposed legislation to adopt or reopt portions of the Internal Revenue code, so we're always keeping track of federal guidance and changes in um from from Washington. This bill would just require that this report that has been required to be submitted. To the General Assembly be discontinued, so we're going to still continue if there are questions that the General Assembly has about, you know, our view and, and our reading of tax changes that occur in Washington we're always going to be available to have those discussions. one in around this table is doing much tax work, and so at that point DFA is going to be the only one that's knowing what those changes are and if there's not a report to the General Assembly or to this group, then we don't know what's been changed or not changed that may need to be changed for conformity purposes for the benefit of the taxpayer or whatever. So my only what I'm understanding is y'all monitor, but for instance, the secretary is not getting a report on the changes that are happening in DC to federal. Tax laws. And so there's staff that's going to monitor, but there's no one higher up the chain that's been giving a summary report or saying, hey, these things are happening. We need to monitor this or we need to, I mean monitor may not be the right word, but, you know, how do we want to proceed? Or do we want to do anything, so there's not going to be any report generated whatsoever that monitors federal tax law changes. That's correct under this bill. I think that needs to be done somewhere even if it's only for y'all. It needs to be done somewhere that that's something. That's, that's monitored in a report even in your own hierarchy.

to be bigger question is, how, how do the decision makers at DFA become aware of changes. That's my bigger question. And then What process is in place for determining what we do about those changes. I mean, for instance, I mean back in um You know, COVID, federal government had policies that, you know, are ways that they wanted to handle the COVID relief funds or, you know, the PPP money and all that sort of thing and the DFA did not want to comply or do it the way that the feds were doing it at one point in time. That changed. We all got to a different position and we essentially conformed with the federal guidelines on PPP or what they were wanting to do their treatment. If that's not So that was a very public thing that happened, but there are lots of changes that aren't so public. That the General Assembly wouldn't know to engage unnecessarily that may be to the detriment of a payer or the complexity added to affair. I just want to know how does it go up your chain when changes are made. Without a report of some kind and we're saying we're doing away with all reporting. I don't want to believe this. I mean, y'all we can move on and just let the will of the committee do it, but I, I am concerned that there is no reporting now of federal tax law changes. That's, that's going to go through any system. This at least required a report to be made that would have been reviewed by supervisors before it was disseminated

And certainly to your point, Senator Disma, if there are, we do get feedback from the taxpayer community as well as taxpayer representatives and attorneys about important changes. Your, your example that the that Congress enacted the Paycheck Protection Program, loan forgiveness, that because of the way Arkansas laws were structured that we could not, we did, we had to actually have a bill to adopt those those really rapid fire changes that occurred during the middle of the pandemic regarding that specific program there was a there was a pretty substantial revenue impact that we had to calculate and provide to the General Assembly so that the legislation could be concerned, but I think the most important way that we hear about those changes, it occurs in real time all the time, particularly with a situation like the pandemic with the tax cuts and job Jobs Act in 2017 that was the first large scale overhaul of the tax code on the federal side since the 1980s, so we also when there are circumstances where we would as a department like to additionally conform to the Internal Revenue Code to make things easier on taxpayers. That's an ongoing process. What we do is we work with our income tax section as well as our Administrators and field audit to formulate legislative proposals that we can bring every two, every session that occurs that where we can conform conform to the federal code. It is challenging in the regard that a lot of these changes do have a revenue impact, so whether it's, you know, updating to conform to depreciation and expensing of property, you know, we certainly, we would love to have a tax code that is as easier for the the taxpayer representatives and the individual taxpayers to know if it's treated this way on the federal side, it would also be treated this way on the state side, but the Washington whatever goes on in Congress regarding the tax code because of our Constitution, it requires a legislative change that we would have to come to this body to approve that change as well as the process that we go through with the governor's office to have any type of legislation considered scored for revenue impact, and then made a to be made whether or not this is something that the department can pursue given the need to account for it in the budget, yeah, and the PPP money didn't have revenue impact because it's never been received before, but,
