Uh, this bill's an agency bill coming to us from the Office of State Technology or newly will be named Office of State Technology, um, this is uh specifically To amend the responsibilities of information technology and response to um a a number of different areas that need to be refined, realigned, and provided, uh, a little bit different structure um specifically we're dealing with um Now, these agencies Work together. This is also part of the Arkansas Forward, which was uh a review from the governor's plan to provide a significant and efficiencies and cost savings and how we work things. One of the areas that I like to talk about uh when introducing this bill is The project management and if you were in the, in ALC this last couple of years, you notice that I spent a lot of time asking questions around project management, who's responsible for projects coming to completion, who's responsible for making sure that the state is getting the best bang for their dollar, how are we prioritizing projects and uh that's a that's a significant gap in our current technology environment. This aligned project technology project management underneath the office. of uh of uh state technology to ensure that all of our technology resources are focused, that we're doing the best we can to get the best money for excuse me, get the best product for the money that we have available. We don't have endless funds, so we need to prioritize and make sure that we're spending those funds in the way that most makes sense, um. Additionally, we make sure that we're doing a better job of reporting the agency will be responsible for getting reports back to ALC and the members to make sure that we all know where their dollars are being spent, where their focuses are and priorities and publish those lists and to ensure that we're we're we're managing the limited funds that we have in a productive manner and

Right, so currently there's really no IT governance across all the 15 executive branch departments, and so we'll be setting those standards and policies, um, and guidelines for the procurement of any IT product. So currently, like right now, any, all the 15 departments can go out and buy any PC that they want that's on state contract at any configuration, however, you know, there should really be a standard configuration so What we've seen, um, is, you know, a standard laptop should be about $1200 but sometimes we see people purchasing laptops that are 24 $2500 so we'll put some governance in place that they have to, you know, basically come to us and explain why they need to spend more than what the standard basis

With their uh department and then they will be um working directly with our AR data team to be able to do that data sharing agreement and it puts DIS in charge of those DIS sharing agreements so that um we can better have control of it and and have that, OK, all right. representative District 13. This bill, um, of course, is another agency bill and something that I've been in conversations with the agency and uh for I don't know, a year and a half or so. The conversations revolved around how do we better align the overall security posture of the state, and one of the challenges you have with a large environment is you can create a lot of different A very large outward facing footprint for those that would do bad things to attack, and you need to ensure that you have a very clean front end. I used the analogy in the in the House Committee of of a football team. Um, you, you, you place a football team, you have a variety of offensive linemen that are there to establish your front line of defense, and then you have a quarterback behind that or or potentially coach or whoever you want to call that's calling the. and making sure that everybody is doing the same thing and moving in the same direction so that you're your defense, um, uh, of the uh of, of your outside influencers to your play can be effectively managed right now we have none of that. Um we uh we have some interconnection and conversations, um, but really the overall governance of how we're going to establish that frontline defense and the internal alignment of that is uh is. This bill puts us in a position so that the department has the responsibility of ensuring that that front line is well coordinated, that they are in the places that they need to be using the right kinds of tools that they need to do to face these outward. Challenges that are coming, um. a couple of pieces of that um that I want to point out that are in the bill, um, and then I'll be ready for questions. We do um make sure that within this we um. Have The agency reporting to us our security posture on a regular basis to the technology team, the technology advanced communication technology joint committee, making sure that we have that um. Oversight as the as the people's representative to ensure that we know what's happening there. And so this task force would, would, would be made up of, of, of, of a number of entities, state, local, K-12, uh, our National Guard, uh, we, we work with National Guard, uh, with tabletop exercises on incident response, but the idea there is to stand up a formal Uh, state cyber response task force that we could use to represent the state as a whole, uh, it, it's, it's part of the bill, uh, and it's something that we're focused on and, and we want to use that same functional alignment, if you will, to help to create that. I know that a lot of this has to do with uh uh we wouldn't want disclose any methodologies that allow these folks or others in even in other agencies that are outside the executive branch to, to put up defenses against things just like we, we exempted the things that the state police does to secure the governor and her family from, from FOIA because we don't want the bad guys to have access to their methodologies, and I assume that's why we do it this in this closed meeting, but, and again, Methodologies might not necessarily need to be disclosed, but, but I am concerned that You're going to tell us how many incidents, for example, happened and how they were not the details hopefully, but we resolved this one, this one popped up and and and Senator Lott and I've served on uh uh I thought it And you have two senators subcommittee where we have uh had uh The, the, the board is escaping me for a moment. ransomware attacks, and we, of course that becomes an audit issue when they actually have to pay some of these crooks to get their data open back up again. 498 is a law that will be amending the disclosure of driver and vehicle records and, in short, there's a conflict between the federal and state laws concerning protection of motor vehicle records, protection of our records, Arkansas declares in public records while the federal government requires substantial protections and so SB 498 resolves this conflict and provides additional. protections to our driving records here in Arkansas. Under the Arkansas law. Currently the Arkansas law Restricts courts and law enforcement officers to receiving driver's records for the purpose of enforcing traffic laws, SB 498 allows more access to those records for courts and law enforcement who need those for other crimes and uh SB 498 498 creates a single standard of releasing those motor vehicle records and drivers' records rather than having multiple standards. In different code sections and then finally this current Arkansas law prohibits the disclosure of digital driver's license photos other than with the approval of the driver and SB 498 allows that disclosure of the digital drivers license, uh, photos to courts and law enforcement agencies, and I have DFNA here if you want to add something to that, um. But that doesn't stop an individual from thinking that they can, they can get access to all of those records and so we need to make sure that that our code is, is compliant with federal law, that everything's clean, and if you look at the actual bill, it's just very, very straightforward as to who's going to be able to get these records, you know, the essentially the first half of the bill talks about the, your motor vehicle record. So there's a difference between, you know, the, the registration record of your vehicle and then your driving records. So the first part is, is talking about who can get access to your motor vehicle record and that's going to be very limited to yourself, the person that you've authorized a court, an attorney with a subpoena actually in a court action or government agencies and law enforcement agencies. So it's very, very streamlined. It, it provides clarity for the public. It provides clarity for our employees as to who is exactly is entitled to that information and then same thing if you go. Down to the driver services record which really starts on page 4. This is your actual, you know, driver confirmation record or your abstract of your information. Same thing, you know, your, yourself, the person that you've authorized a a court an attorney with a subpoena, um, it does not change the law about your employer has access to that information if they're employing you in a driving capacity, um, an insurance company, those sorts of individuals. So it's really just cleaning up what we're already doing right now. The only thing it's actually adding to the law is right now law enforcement they can get a copy of your digital driver's license photo under the Arkansas. Information Center ACIC, but if that goes down, we need the ability to share that photograph with law enforcement. Usually they're, they're working in real time and you know, you think about an Amber Alert or something like that, we need to be able to provide that to them, so that's the only thing that the bill is adding that we do not currently have and we're happy to answer any questions.
