right into this. Representative Richardson, you are recognized to present your bill. Good morning, committee. Thank you, Mr. Chairman. I am Scott Richardson, House District 13. I bring for your consideration House Bill 1876, which is a fairly simple bill, and it's a common sense bill. The idea behind it is that what's yours is yours and should be yours, and what's not yours shouldn't belong to you. When we're dealing with generative AI solutions, there are a number of players in the market that have provided what we refer to as an open-source AI tool. In order to explain this, Bill, I'm going to use three buckets and describe these three buckets to you. And then hopefully that will help with the explanation of what this bill does. In these three buckets, we would have one bucket that has the tool. This would be your chat GTPs or your other open source AI, generative AI solutions. And then in addition to that, you have your second bucket, which I would call the modeling. Now, most all generative AI solutions already have a bunch of modeling on the back end that they have and they've used to get to a certain degree. You also can do modeling to help the generative AI tool get to a particular solution. So we're going to use the second bucket as the modeling, the portion of the modeling specifically that you're using to help that generative AI tool come to that solution. And then the third bucket would be whatever solution or output that you're leveraging the tool to get to. So then we have these three buckets. The two buckets that this bill addresses are the last two. The tool itself is an open AI source. It has its own set of parameters, requirements, and copyrights. And that can't obviously be, that's not something we want to address within the framework of this. However, the modeling that you do yourself, the parameters you define, the things that you put together, those special pieces are intellectual property. And those pieces should belong to the person who created them to generate the output. Now, the output itself should belong to you as well. Now, that doesn't necessarily mean that someone else can't come to the same level of output, but once you use this generative AI tool to create and hand it this set of modeling to get this output, then those things should belong to you. And that's what this bill does. And why this is important, I'll give you a real-world example. I know of an engineering firm in northwest Arkansas right now that also has a survey group, and they are leveraging an open AI source tool to provide it a set of modeling or parameters for it to spit out a legal description for them to use on their documents. Legal descriptions are fairly common. They're all over the place. You can get those through a variety of different methods and mechanisms, but that process by which that they come to get that should be their process. It's a competitive advantage. It's good for their business, and as they continue to invest in that, we're going to see more of those kinds of competitive advantages coming out of this. I think this bill encourages market investment in these tools and adoption of these tools because it gives businesses a little bit of protection, a little bit of oversight that says, hey, if you spend thousands of dollars or more in creating a modeling for an open tool, that modeling should belong to you and your generative AI output should belong to you. are recognized to present your bill okay I've got two bills colleagues first off we'll start with house bill 1957 currently in the state of Arkansas and you probably couldn't tell this by checking your email it's actually illegal to receive unsolicited commercial or sexually explicit email so you know if someone wanted to send you inappropriate photos through electronic email that's currently illegal and basically all this bill does is it adds text messaging to that currently existing code my concern is is you know when email first came out and we logged in you know you've got mail we were all excited to get an email from grandma or from our aunt you know family members nowadays it's almost impossible to go to your email because you get so much junk that it's hard to find the actual what you want and my fear is is that um if we're not careful the same thing is going to happen with text messages and our phones are going to be filled up with all sorts of junk that text messaging is going to become burdensome so this is to try to present to prevent that and it does so by simply adding text the words text messages into the currently existing law outlawing unsolicited and sexually explicit emails it does add some you know provisions to clarify some things but that's what the what the the bill does and be happy to answer any questions are there any questions by the committee seeing none is there anyone here to

in favor say aye anyone opposed congratulations you have passed your bill thank you madam chair there you have ready for the next one yes okay uh the the next one is a little more substantive um if you're on the committee last go around remember we passed a bill that required state agencies to develop technology use policies so that employees knew what was permissible what was not for example could you check facebook on your lunch hour on your work computer things like that. Since then, artificial intelligence is basically taking the world by storm. And so what this bill does is it proposes to update that by a couple of important things. It says that in those technology use policies, we will include policies on artificial intelligence and automated decision making tools about how we're going to do that, how we're going to allow for training. And then I think the most important part of this legislation, if I can find it here, let's see, is on page four, and it says, it requires an authorized human employee or designee to make any final decisions in the course of his or her employment, regardless of what artificial intelligence or the automated decision tool the employee or designee recommends. So in other words, we're going to make sure that it's always a human making the final decision. We're not going to run an artificial intelligence. It's going to spit out something, and we're going to say, well, the computer said we have to do this, so this is what we've got to do. I want to make sure it's clear that, no, the computer doesn't get the final say. There's always going to be an authorized human who's going to get the final decision in what we do when we move forward with using artificial intelligence. That's what the bill does and be
