And so unfortunately it's an industry that we've been plagued with human trafficking and all sorts of things in the industry. So it just simply allows the Department of Health to get the names of the people that are there, who's licensed, who's not licensed, who the owners are. So when a bad actor moves from one place to the next, they can keep up with them. And I can certainly be the department up here if people have more

House Bill 1677 simply allows a drug detox, drug therapy, drug detox unit to have an emergency medical kit like a nursing home would have. Some of our detox units going into my district were 45 minutes away from any medical care. This would allow them to have an emergency medical box on site behind a locked door and a locked cabinet and it would be filled by the pharmacist.
So I did some amendments to this bill to make sure the pharmacy board and everybody was on track with us again. We have some units that are 45 minutes away from getting an ambulance out there. We want to make sure they have an emergency medical box like many of our nursing homes have in rural parts of the state. So that's pretty much what the bill does. The amendment, if I can get my computer to
pull up, the original bill, which you may have heard about, changed the Antomical Gift Act to give next of kin the ability to revoke someone if they had decided to be an organ donor on their driver's license. This amendment takes that out. So this amendment simply provides that if you are a person's health care power of attorney, you do have the ability to revoke or amend a previous anatomical gift. In other words, if they put on their license, you would have the ability to step in and change that if you need to. It also provides that following a
donor's death, so after they have passed away and after organs have been harvested and things of that nature, the family's rights would then kick in in terms of being able to decline if they were to decline tissue donation or other further procedures on the body once death has already happening once the viable organs have already been donated. The last thing that this amendment does, actually this was in the original bill, is it also provides some reporting. It makes a few tweaks that were requested by industry just to make that a little bit clearer, that essentially that OPOs, organ procurement organizations operating in Arkansas,
would report annually to ALC, just kind of their stats of what's going on, because right now we don't get any reporting from them, and

Unfortunately, I had a situation where I had to deal with some organ donation issues last year in my family, and as part of that procedure, I was the power of attorney for my father, and at the time, I was not able to make any decisions on his behalf because he had put organ donor in his license, and so digging into that later, that's when I discovered that essentially under the law, your health care power of attorney can do everything in the world for you in terms of withdrawal care, agree to care, all those natures.
If they have your financial power of attorney, they can sell all your assets, mortgage your house, everything else. They can do everything for you, except the one thing in the law was is they could not say, hey, we're okay with organ donation, but we don't want to do tissue donation. Or, hey, we don't want to do organ donation because it's going to delay death longer than we want, which was in our situation, which was my father wasn't a viable candidate, and we didn't want to delay his passing any more than we had to. So this bill gives the health care power of attorney the ability to do that. As far as following someone's death, there was, in my opinion, a conflict between the Anatomical Gift Act and the Disposition of Remains Act regarding essentially who can control the body once someone has passed, is no longer hooked up to machines, and they're passed and they're dead.
And so this bill provides that following the Disposition of Remains Act that the next of kin would be able to say once someone is done, they've already had their viable organs donated, etc. if the family then wanted to say, like at the funeral home stage, hey, we're not going to do any more tissue harvesting. We want to have our funeral and bury our loved one. The family would be able to do that. And then finally,

the funeral director or whatever? So in this bill, it is two hours after they've

been pronounced dead. So that gives the organ procurement agency time to contact the family and say, hey, we'd still like to do tissue donation and talk with the family. But at some point, at two hours past the pronouncement of death, there is that cutoff of at this point now, If someone did say they had on their driver's license that they were an organ donor, then at that point the family would have the legal right to say, yes, they said that, but we're now going to take the body and bury it.
We don't want to do any further tissue donation. The reason why this is in here is that, like, for example, when I signed to be an organ donor, I thought that meant, well, first off, I thought that meant that this is my consent to donate my organs, heart, lungs, things of that to save someone. If, let's say I got into a car wreck out of state and nobody can find my family, of course I also signed up back in the days before cell phones and internet, so it was a lot harder to get a hold of people back then. But essentially that's kind of the default state unless my family were to change their minds. Well, under the Antiochal Gift Act, the family cannot change your minds.
If you put on your license, that's an irrevocable decision, cannot be revoked, except for by power of attorney should this bill pass. The second issue was, is I thought that meant I'm donating organs to save someone. That also means that the OPO, procurement organization, can get anything they want from the body, soft tissues, bones, even hair, skin, anything they want from the body and use it for purposes other than to save someone there that's waiting for a heart or something of that nature. So education, research, therapy, things of that nature. And so this gives the family, once someone's already passed, once the life-saving organs have been harvested or they're not already able to be harvested, it gives families the rights, once again, over the remains, should they choose to step in and say, hey, we don't want to do this.

And thank you, Madam Chair, for being the Senate sponsor on this bill. And I would just like to formally give a shout-out to the Florida Gators for tonight's national championship game. House Bill 1171 seeks to authorize an abbreviated independent assessment process for past clients. Currently, these assessments are required to have a third party conduct these independent assessments of each client. DHS has a contract with a third-party company that conducts these services.
The assessment has to be face-to-face, and it has to be completed every 12 months. It's a lengthy assessment, and in most cases, it takes more than an hour of the patient's time. The independent assessment involves a standardized functional assessment tool and asks a series of questions about the client's level of functioning. In almost all cases, the independent assessment determines that the client does in fact need Tier 2 or Tier 3 level services. Because this assessment has to be renewed every year, the approval rate is even higher.
We're asking that DHS continue these full assessment practices for the first time for these independent assessments. However, for reassessments, establish an abbreviated process, and DHS does agree with this approach. This would still involve a face-to-face reassessment because federal regulations require it. So the major adjustment in this bill is to allow for the allowance of this abbreviated assessment. And this abbreviated assessment lowers costs to the state by being able to complete two or three of these per hour instead of just one.

And so me and my wife, obviously that was a concern for us. And so we go to our pediatrician in town and he says, oh, no, we don't have that. really new. Insurance plans don't cover it yet. this shot? Why is someone, even in my position particularly, if it's just hard for me to be able to find access to this shot, it had to be this hard for other people. So I go down a rabbit hole. It comes to find out that there's just a lot of clinics who they cannot administer it without losing money. That's the whole deal. That's what happened. And so what I've tried to do is I've worked with pediatrics, I've worked with DHS, and we've tried to come to a conclusion, and this is what we've found. So what this will do is it will put this particular shot with the vaccines for
children for the reimbursement program. And it'll increase the cost from 1314 to 1954, which is about a $6 increase. Now, because of Medicaid match, it'll be less than $2. Even at a very conservative estimate, per hospitalization, if it's $5,000 per hospitalization, if we can keep one kid out of the hospital out of 128 shots, it's a 610% return on investment. And so my goal from this is to keep kids out of the hospital, keep kids from safe,
and keep kids from, you know, save money for the state, ultimately. It's really threefold. And so that's where I came from. This is how it's affected me personally, and that's what I'm setting for you today. I appreciate

you're recognized for a question. What is this shot? So Niversivab is a monoclonal antibody. To give you examples of other monoclonal antibodies, During COVID, it was one of the first things we gave to people that would help to alleviate symptoms.
And what it is, it's just an antibody. An antibody is what you normally get when you react to an infection or a disease. And what it does is it attaches itself to germs and kills said germ. And so what happens is when we give infants, like my daughter, a monoclonal antibody shot, it's really just putting antibodies in their system. And so if RSV ever gets to them, it sees it immediately. It grabs onto those RSV, which is a virus virus. So it's an RSV vaccine. Yeah, but it's not a vaccine like a COVID vaccine. It's not mRNA, and it's not a vaccine like a traditional flu vaccine.
So it's really kind of a totally different thing. It's a passive vaccine. Thank you from a pharmacist just whispering in the corner of the room. So it's very passive immunity. The body doesn't really have any immune response to it because it's just like putting flags that are looking for RSV in the body. So how often do they need the shot? Once. Just once. It only is for, well, yeah, mostly for infants going into their first RSV season, so from October to February.

it's a measure designed to protect the health and well-being of Arkansas youth by prohibiting the sale or transfer of over-the-counter diet pills for individuals who are under the age of 18. And this bill has already passed the House, which you know with bipartisan support, and it addresses a public health concern, increasing the misuse of diet pills amongst our teenagers, which could pose a serious health risk. As we know, the studies show that our young people, particularly young girls,
are now at a high risk of developing unhealthy relationships with food and their body images. And diet pills are often marketed as a quick solution for weight loss and are widely accessible without prescription. However, many of these products have high levels of laxatives and ingredients that can lead to high blood pressure, liver damage, increased anxiety and depression, and eating disorders. The American Academy of Pediatrics and the National Eating Disorder Association warned that the availability of diet pills contributes to dangerous eating behaviors.
And a recent study showed that young girls who actually participate or use diet pills are four to six times likely to actually develop an eating disorder. So what this bill does is this legislation is pretty straightforward, and it aligns with the existing consumer protections for our minors already in the state of Arkansas. It prohibits the cell distribution and transfer of over-the-counter diet pills for anyone under the age of 18. It requires that our retailers to verify the age of purchasers do identification checks
similar to those who buy tobacco or other restrictive products. It imposes penalties on realtors who violate the law while escalating consequences for repeated offenses. It ensures that public awareness through retailer notifications and education on the dangers of these products for our minors. This bill does not prohibit the use of medical prescribed weight management treatment under supervision of a health care provider. It specifically targets the unregulated and often misleading products that pose a risk
to our youth. And I ask for a favorable consideration and do past recommendations so that we can keep dangerous unregulated diet pills

bill does is it strives to give more people more opportunities and pathways to meet their work requirement for SNAP benefits. I want to be clear, this does not apply any new requirements to obtain SNAP benefits. Able-bodied individuals are already required to meet a work requirement and this bill does not change that in any way. Instead, it just gives them an opportunity to volunteer, which would help them meet the work requirement. So, for some context, Arkansas already passed a law for mandatory employment
and training in its food stamp program in 2019. And as part of that implementation, this just allows state agencies that receive state funding to accept volunteers who request the opportunity to comply with the ENT requirement. I do want to stress that it's permissive. So anybody who has a work requirement and the volunteer hours may help them meet that work requirement, they don't have to do this. It's just an option for them. In addition, state agencies, it's permissive for them as well because the bill, in fact, it says that government entities
can only allow volunteers to the extent the observation does not interfere with essential functions or the health and safety of employees in the public, and they also may prohibit volunteers from engaging in activities, and they are prohibited from accepting and accommodating volunteers who negatively interferes. So I think this just gives an extra opportunity for some folks to develop some soft skills

I mean, there's a lot of hair products that have a lot of different chemicals in them. But this one is one that really impacts the African-American community specifically,
and I just wanted to deal with that. You know, when I first started on this journey, I can tell you, I had a lot of pushback in my own house about this. And so I was really talking about banning because FDA, if we took a step back, FDA wanted to, 18 to 24 months ago, they were going to do a ban on these products, hand down a ban on some of these hair relaxing products. And as you know, there's been a lot of lawsuits filed on it and different things.
So I was trying to work through the ban issue, and I was just like, all right, the ban issue is not working. And so then I went to, hey, well, you know what? Why don't we have the products that have the formaldehyde and things that really cause very harm to kids? why don't we just put a band, not a band, but a warning label on these products. And so I just wanted to start with the hair relaxing products. Obviously, our hair got really relaxed.
