Speaker 39 8:07
is a, in your packet, there are items C. There's a C1 and a C2, but item C is a summary sheet, and you can see on item C, Senate Bill 633 is summarized, And you can see that's the bottom box there where $330 million is already in this set-aside for correctional facilities, as everybody knows. This bill transfers an additional $250 million to that same set-aside. This bill is a majority vote bill, but to get the money out of that set-aside is the same three-fifths restriction that it's always had.
▶ Play Suggest a correction Report an error
Speaker 42 8:51
So it's lowing it to three-fifths. Well, it's not
▶ Play Suggest a correction Report an error
Representative Lane Jean Chair Unverified 8:56
lowering it. That's what our rules are in ALC. Thank you, Mr. Chairman. All

right, let's see. We've got Senator Hickey. You're recognized. Thank you,

Senator Jimmy Hickey, Jr Unverified 9:12
Mr. Chair. I just want to have a little bit broader discussion about that. I have no problem moving money into this account, But I think that, you know, that we kind of need to have a path of where we think we're going because DF&A does have a $350 million miscellaneous appropriation bill that we all know that we give them so that, you know, if agencies need additional appropriation or whatever may occur during the offseason, of course, that we can come through peer and ALC to do that. So, and I know that we give the $75 million, and it's kind of my thought that if we're going to go forward with that, that we were going to use that money or they were going to use that money to try to get some more detailed cost numbers for us, and then we were going to take a look at it. I guess my, and again, I want to vote for this moving the money around because I have no issues with that. But what I want to make sure is that it's not our intention that we're going to use a large part of that miscellaneous appropriation that we give through DF&A to fund this prison and say, you know, we're funded $300 million of it and then we've got to go forward. So, I guess I just would like to just state publicly that it's our intent that we're going to get some more cost numbers off of the $75 million, or hopefully less, of course, that we've done to be able to make a good decision on that.

Senator Jonathan Dismang Unverified 10:43
Sir, does this make you get something to add? I just recommend that we pull it down. There's $330 million set aside. There's already been $75 million sent over. There's no way that we spend above those amounts between now and we go in fiscal. This money would just be parked into general allotment fund. We'll just, let's just move down, pull it on. There's no reason to have a continued debate this morning with where we are in the session. Thank you. Can I ask
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 11:11
another question then? Go ahead. So again, that's already available because I guess we've already passed the DF&A appropriation bill. So is it our intent to try to spend more money and use that appropriation before we get those cost numbers? And again, I don't think there's any way we're going to
▶ Play Suggest a correction Report an error
Representative Lane Jean Chair Unverified 11:28
spend over $400 million until the fiscal session next year. That's
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 11:32
not what I was asking. I guess my question, since I understand we've pulled this bill down, that's what the discussion, but again, I ask my question of that. So, again, we've got $330 million already left in that restricted reserve account for prison. So I voted for it. I also voted for the DF&A appropriation. I think it's already came through, which has the additional $350 million for excess appropriation. Is it our intent to use that excess appropriation to fund an additional $100 million or $150 million or $200 million of this prison? Or are we going to let that $75 million be used to try to get this some more detailed cost numbers like that some members of the body have
▶ Play Suggest a correction Report an error
Representative Lane Jean Chair Unverified 12:23
been requesting? Our goal will be to spend the $75 million down first. Thank you, sir. All right. We're going to pull this down. Do

Representative Jim Wooten Unverified 12:42
you have a question? All right. Like Senator Hickey, you know, I look at this, and I see $822,794,000. Is that the total projected funds available? And that comes off of close to being $825 million. Now, I want some satisfaction that this bill is going to be pulled down, but we're not going to be confronted because 633 to me looks like a backdoor way to be able to fund the penitentiary. Is that a fair assumption? I mean, can this funding be changed by the chief fiscal officer at the request of the governor's office to make funds available for the new prison? No one's answered that. No, no, but Senator Dismang,
▶ Play Suggest a correction Report an error
Chair Unverified 13:32
you're recognized. Thank you, Mr. Chairman. Uh, this committee back when we
▶ Play Suggest a correction Report an error
Senator Jonathan Dismang Unverified 13:38
very first, you know, there was an appropriation for $330 million. We had the $330 million with the funding that's already been set aside. This committee as a whole was my understanding. It said that they wanted to know what the full cost of the prison was going to be. And then, so we, you know, there was an appropriation, uh, that was, you know, presented for the full cost of the prison prison. Uh, then there was a request by this body that we go ahead and set aside all the funds needed to construct their prison. This bill is a reflection of that request. I would argue that none of this is needed within the next year. We will come back here. I guess it's next, uh, April and we can have this full discussion all over again. There has already been $75 million appropriated. It was passed, uh, and funded. It was previously funded. It's sitting over the department corrections. There's a $330 million worth of funding that's been passed by this body in the past. And if they would, you know, if there is a request or they need additional money between now and when we come in in April, they have the ability, as they've had for many years now, to come in and ask for a temporary appropriation increase to be able to have those additional dollars. That process stays in place,
▶ Play Suggest a correction Report an error
Representative Jim Wooten Unverified 14:55
as it has been in place. Okay, so your answer, Senator, is that this will be covered in the fiscal session next year?
▶ Play Suggest a correction Report an error
Speaker 65 15:03
That is my assumption. Okay, thank you. Thank you. All right, we're pulling this down,
▶ Play Suggest a correction Report an error
Representative Lane Jean Chair Unverified 15:07
and we're going to move on to the other one-time funding bill, 636. Do we have any questions on it? Seeing none, do we have a motion? Do we have a motion and a second? Any discussion? all in favor say aye any opposed it is adopted I know we got committee six to start working they'd be if we need to come back here be a call the chair we appreciate you we are now adjourned Thank you.
