I don't know if you guys remember, in October we had a procurement issue with a particular rule over at TSS. We hired a consultant to come in. It was the same consultant at TASCO that we used years ago. They proposed doing this legislation, which requires a department to reissue that rule correctly over the next 120 days. And with that, I'd be glad to have you if any questions. Council pushed this out unanimously in December as a recommendation. Representative Ward-Law has explained the bill.

We've already heard a good part of this bill, but I want you guys to bring attention to the fiscal impact that's on your desk that was asked for by Representative Collins.
I think I'm just going to read what they put on here because, to me, it's a great summary of our bill. SB 486 provides safety and privacy for an individual using or occupying a multiple occupancy restroom, changing room, or sleeping quarters. An entity covered under the bill, including domestic violence shelters, certain correctional and juvenile detention facilities, public buildings owned by the state of Arkansas, and its political subdivisions, the bill would require a covered entity to take reasonable steps to provide an individual with privacy in a designated multi-occupancy restroom changing room and sleeping quarter
and to prevent its shoes by a member of the opposite sex. That lists some things that they can go on there for emergencies, situations, and all that. So it's a very, I think it's a very simple bill. Again, very similar to the privacy bill that I passed last session for our kindergarten through 12th graders if it just follows it through for our universities, correctional institutes, domestic violence shelters, and those. Thank you, Mr. Chair. Representative Bentley, when I was asking you about this bill yesterday, I asked you about a member of, sorry, I asked you about people who perhaps may present, may look like the member of the opposite sex, have been forced to use a restroom that matched their gender at birth. Your response to that was nobody's forcing anybody to use a restroom because there have to be reasonable accommodations made for another restroom. But when we asked for the fiscal impact, I was told actually the only reasonable accommodations that have to be made have to deal
with the ADA. My concern about this bill remains safe, remains safety. So I guess just clarify for me, if you are a big, burly, bearded man with a female on your birth, with the word female on your a certificate. I don't see any way in this bill that you are not forced to use the women's restroom. If a public facility does not have a single stall bathroom, in order to be in compliance with your bill, if they want to avoid that risk of violence or that dangerous circumstance,
they will have to build a single stall bathroom. I don't understand how we get away from the fact that that will cost a lot of places money my city reached out to me proactively i didn't reach out to them they reached out to me about the potential cost on them so i guess my questions are two um well really just one is it true or not that there will be reasonable you kept saying yesterday there will be reasonable accommodations made um for people who don't want to use a group restroom

right? We have two sexes, a male and a female. No matter how much drugs you take, no matter how much surgery you have, there's two sexes. And we're just trying to get back to simplicity. And just like we did with K-12, we're providing a reasonable place for them to go that's not male or female for them to use the restroom. When we presented some concerns about safety, like I'm doing now, family counsel came to a number of committee members and said, could we work on a

So the circumstance that you just described is already illegal under Arkansas law. Why wasn't the promise from last session upheld? And why are we coming back yet again if the problem that I keep hearing we're trying to solve is already illegal in Arkansas law thanks to that good compromise that everybody

I'm here to speak against SB 486, not just because it's bad policy, but because it's mean-spirited, cruel, and frankly, a waste of everyone's time. I don't think this bill is about safety. It's about fear. It's about targeting transgender Arkansans, our neighbors, our co-workers, our kids, by policing where they can use the bathroom, change clothes, or sleep. Now they want to open the door for lawsuits if
someone dares to exist in the wrong room, according to the state. We're talking about creating a system where a lawsuit could be filed for a trans person for simply using the restroom because someone didn't like the way they looked. That's not public policy. That's state-sanctioned bullying. Transgender people are not a threat. They are people. They are trying to live their lives like anyone else, and this bill makes their daily existence harder, scarier, and more dangerous. For what? For political points or to score a headline? Let's just not ignore the absurdity
of enforcement. Who is going to be the gender police? Are we going to propose that public institutions investigate people's bodies to make sure they're in the right bathroom? Going to Representative Clowney's point of if someone looks like a gender opposite, it's just bullying. It sets us up for national embarrassment and real harm, harm to trans youth who are already at increased risk of suicide and depression, harm to families that are just trying to protect the kids, harm to the reputation of this state.
I just want to ask you all if we can do better. We all deserve to live with dignity, and that includes transgender people. That includes everyone in this state. So I urge you to vote no on this bill.

at law in the state of Arkansas. I'm also opposed to this bill. I will not repeat what I heard Ms. Stewart say, but would second her comments that this is a form of state bullying, and it is also a solution in search of a problem that we don't have. to Representative Crawford's comments, with respect to men who are opposing as women, as trans women, or whatever,
to get into a bathroom to commit a crime, that would be sufficiently covered under the present bill because there's clearly intent there. Secondly, if we're looking at the broader purpose of lawmaking, if a person is willing to commit the crime of rape, which is already illegal in the state of Arkansas, or to go in the bathroom with intent to commit a crime, which is also illegal, what's to make anybody believe that if this bill passes,
such a person is going to stop and say, whoa, I'm sorry, this new bill makes it improper for me to enter a restroom. I'm not going to do it. A person with mens rea to do something Nothing is going to do it irrespective of what the legislature passes. Secondly, there are issues with the bill in as much as the bill defines a person as being male or female based on their assigned sex at birth, which has nothing in many instances
to do with what is on their birth certificates, their driver's licenses or documents. So shy of some gender police pulling their pants down and searching what their genitalia looks like, there oftentimes may be no way to prove up or down what that person is. There are many states who have issued birth certificates to trans people to conform with their gender identity, and this bill does not address that issue.
This bill would certainly be a huge burden on the trans community, would also be a burden on the population of intersex persons who, according to this bill, have nowhere to go to the bathroom. With that, I also would argue, lastly, that this bill is in violation of Bostock versus Clayton County, Georgia, which was handed down from the Supreme Court of the United
States, saying that discrimination on the basis of gender identity is sex discrimination. And it flies in the face of what we should be doing here. With that, I am willing to answer any questions. Thank you, Mr. Tribble. We do have a
