heard a good part of the spill, but I don't want you guys to bring attention to the fiscal impact that's on your desk that was asked for by Representative Collins. I think I'm just gonna read what
they put on here because to me it's a great summary of our bill. SB 46 provides safety and privacy for an individual using or occupying a multiple occupancy restroom, changing room, or sleeping quarters, an entity covered under the bill, including domestic violence shelters, certain correctional and juvenile detention facilities, public buildings owned by the state of Arkansas and its political subdivisions. The bill would require covered entry to take reasonable steps to provide an individual with privacy in a designated multi-occupancy restaurant. changing room and sleeping
quarter and Brit B, it's used by a member of the opposite sex. It lists some some things that they can go on there for emergency situations and all that. So it's a very, I think it's a very simple bill again, very similar to the privacy bill that I passed last session for our kindergarten through 12th grade if it just follows it through for our universities, um, correctional institutes, domestic violence shelters, and those, so, um, Stephanie have anything you'd like to share? Thank you, Mr. Chair. Representative Bentley, when I was asking you about this bill yesterday, I asked you about um a member of um, Sorry, I asked you about. Uh, people who perhaps may present, may look like, um, the member of the opposite sex have been forced to use a restroom that matched their gender at birth. Your response to that was nobody's forcing anybody to use a restroom because there have to be reasonable accommodations made for another restroom, but when we asked for the fiscal impact, I was told actually the
only reasonable accommodations that have to be made have to deal with the ADA. My concern about this bill remains safe, remains safety, um, so I, I guess just clarify for me. If you are a Big burly bearded man with a female on your birth with the word female on your birth certificate. Um, I don't see any way in this bill, um, that you are not forced to use the women's restroom. If a public facility does not have a single
stall bathroom. In order to be in compliance with your bill, if they want to avoid that risk of violence, um, or that that dangerous circumstance, um, they will have to build a single bathroom. I don't understand how we get away from the fact that that will cost a lot of places money. My city reached out to me proactively. I didn't reach out to them. They reached out to me about the potential cost on them, um, so I guess my questions are too, um, well, really just one. Is it true or not?
That there will be reasonable, you kept saying yesterday there will be reasonable accommodations made, um, for people who don't want to use a group restroom. Is that required under this bill? The purpose that I'm clowning

Under this bill, those constituents of mine that very real circumstance, those people will be forced, whether you want to call them men or women. Those people will be forced to use the men's. restroom that is a dangerous situation and I would also like to add that last session, a version of this bill came before
us. Senator Payton presented a a version of this bill, um, when we presented some concerns about safety like I'm doing now. Family counsel came to a number of committee members and said, um, could we work on a compromise, and we did that compromise was to explicitly make it illegal for People to remember to enter the bathroom assigned to the opposite sex with criminal intent. So the circumstance that you just described is already illegal under Arkansas law.
Why wasn't the promise from last session. upheld and why are we coming back yet again if the problem that I keep hearing we're trying to solve is already illegal in Arkansas law thanks to that good compromise that everybody agreed on last session.

It's about fear, it's about targeting transgender Arkansans, our neighbors, our
co-workers, our kids. By policing where they can use the bathroom, change clothes, or sleep. We're talking about creating a system where a lawsuit could be filed for a trans person for simply using the restroom because someone didn't like the way they looked. people are not a threat. They are people, they are trying to live their lives like anyone else, and this bill makes their daily existence harder, scarier, and more dangerous. For what? For political points or to score a headline. Um, let's just not ignore the absurdity of enforcement, who is going to be the gender police. Are we going to propose that public institutions investigate people's bodies to make sure they're in the right bathroom, going to um representative
Clowney's point of if someone looks like a gender opposite. It's just bullying. It sets us up for national embarrassment and real harm, harm to trans youth who are already at increased risk of suicide and depression, harm to families that are just trying to protect the kids, harm to the reputation of this state. Um, I'm also opposed to this bill. I will not uh repeat what I heard, uh, Miss Stewart say, but would second her comments that this is a form of state bullying, and it is
also uh a solution in search of a problem that we don't have. To Representative Crawford's comments, um. With respect to men who are opposing as women, as trans women, or whatever to get into a bathroom to commit a crime that would be sufficiently covered under the present bill because there's clearly intent there. Secondly, if we're looking at the broader purpose of lawmaking. If a person is
willing to commit the crime of rape, which is already illegal, uh, in the state of Arkansas or To go in the bathroom with intent to commit a crime, which is also illegal. What's to make anybody believe that if this bill passes, such a person is going to stop and say, Whoa, I'm sorry, this new bill makes it improper for me to enter a restroom. I'm not going to do it. A person with mens rea to do something is going to do it irrespective of what the
legislatures, uh, passes. Uh, secondly, there are issues with the. in as much as the bill defines a person is being male or female based on their assigned sex at birth, which has nothing in many instances to do with what is on their birth certificates. The driver's licenses or documents, so shy of some gender police pulling their pants down and searching what their genitalia
looks like. There are oftentimes may be no way to prove. Or down what that person is, uh, there are many states who have issued birth certificates to trans people to conform with their gender identity and uh this bill does not address that issue. This bill would certainly be a huge burden on the trans community would also be a burden on the
population of intersex persons who according to this bill, have nowhere to go to the bathroom. Um With that, uh. I also would argue lastly that this bill is in violation of Bostock versus Clayton County, Georgia, which was handed down from the Supreme Court of the United States saying that discrimination on the basis of gender identity is sex discrimination and.
Flies in the face of what we should be doing here. With that, I'm willing to answer any questions. think Thank you, Mr. Tribble. We do have
