No, I don't. Okay, I thought it was coming from somewhere else, but it has quit wherever it was coming from. Okay, let me tell you, first of all, for anybody that is here or watching for Senate Bill 18, late yesterday evening after staff had left or at least we assume staff had left because it was
after hours we know sometimes they work into the wee hours of the morning the an agreement was reached with the judicial council to wait on an amendment from them early next week so that is not going to run today that couldn't be helped and our apologies to anyone who came for that but we will be running SB 87. Senator Hester has let me know
he's held up in House Insurance and Commerce but I believe Senator Johnson has the pleasure of running his bill. Senator Clark, can I do a point of order real quick while

he's moving back there? I'm sorry? Point of order, excuse me. So for SB 18, since this is kind of the new rules it will go back onto another list, correct? and then have to be called back up at a separate time. I'm just talking about in general, not specifically that bill. Correct. Yeah, okay, just making sure for procedural reason that's how it works. Yes.

Yes, it will not automatically stay here, but I would look for it next week. There's a
general question about it. Sure. Yes, any bill that doesn't get heard like that will not just stay here. It will go back to the other list unless somebody gets with the chair, unless the person, the sponsor of the bill, who happens to be me, gets with the chair and puts it back here again. 18 hours before we meet.
Senator Johnson, you are recognized.

Thank you, Chair and members. This bill simply clarifies the criminal offense that would cause a denial, suspension, or revocation of licensure of massage therapy. it it's already in code where if you're convicted of of prostitution in this state this this clarifies it to states outside of arkansas if that if there's a conviction there also if there's any questions i've got some guys here from the department of health to answer anything
Speaker 15

we need. Senator Stollfield? I've just got one question. Have we had an issue with this? Can I get the department to come
Speaker 1

up? We'd like you to take a stab at it first, but I'll defer, Chair. Thank you, Mr. Chair. Members
Speaker 19

of the committee, with your permission, may I remove my mask? Absolutely, please. Thank you. We're here today to help with
Senate Bill 87. And with regard to the question from Senator Stubblefield, this is not a widespread issue, but it does come up. And I did a little research on it to present today to make sure that you all were aware. In November of 2014, there was a Little Rock massage therapist that was arrested for prostitution under an undercover operation in February and March of 2017. LRPD vice arrested two massage therapists for prostitution and businesses that are no longer operating and in January of 2018 there was an undercover operation that
arrested three women in Sherwood so this this does occur but it is rare and it's important for sexual misconduct to be prohibited in massage therapy facilities and it's an important part of their practice to make sure that everybody is aware that it is prohibited so we're just trying to clarify with this bill that it is prohibited as for an applicant and for disciplinary purposes. Does it,

Mr. Chair, I have one more. Sure, Senator Stubblehill. Does an applicant have to, does an applicant have to have a background check
Speaker 19

before they receive their license? Yes, sir. As a part of the red tape reduction acts that were passed in 2019, Act 990 requires a criminal background check. And this is a part of that. And just clarifying that it's for the applicant and also for disciplinary purposes. Okay. All right. Thank you. Thank you,

Mr. Chairman. Senator Ballinger. No questions. Any other questions from the committee?

If for some reason we saw a reason to meet earlier and there was an opportunity, we might. But Wednesday morning at 9.30, right here, is when we intend to meet. If anybody's got anything they want to get on the agenda,
they should contact myself or Allison, who will then contact me. Okay? All right, we're adjourned.
