Once again, we find ourselves sitting here early in the session with the appropriation from the executive branch. As we look at it, we know that if we pass these bills early, typically calls get ignored, things change on how this dynamic
works. And I can't go into details today, but I anticipate that there will be some vital information by tomorrow by one of the top officials whose pay falls underneath this particular appropriation, and whether that official should continue on in that capacity for the state of Arkansas. As such, I will be voting against this bill. Thank you.

Anyone wish to speak in favor of this bill? Against.
Senator Dan Sullivan
Unverified
18:14
Senator Sullivan is recognized. Thank you, Mr. President. Friends, you know, my experience in the last few months has been pretty extreme, in my opinion, since I was elected and became a senator-elect. You know, yesterday we had a lot of fun with our Our colleague, Senator Gilmore, initiating him into the Senate.
But it does remind us that we don't act individually. It reminds us that we act as a body. And as colleagues, we can do those things and laugh about it and move on. But sometimes it becomes much more serious. And when we moved from phase one to phase two, or before we moved to phase one, I was contacted by a number of my businesses in town. said they faced either fines, closure, but they were about to go out of business. And I contacted the governor's office about that several times,
wrote an open letter to the governor's office, and eventually informed the governor that we in Northeast Arkansas would be moving to level, to phase two, because folks were about to lose their business. We had a phone call, conference call with the governor shortly thereafter. Many of you may have been on that, where Northeast Arkansas was called the Free State of Northeast Arkansas because we were advocating for representative government. A little bit later, the governor called for a community leaders meeting in Jonesboro.
Speaker 83
19:35
I was not invited to that meeting. When I called the governor's office, I was informed that
Senator Dan Sullivan
Unverified
19:44
my invitation was under consideration. When the governor gave a speech to us when we convened, The governor said he would like, that he had an open-door policy, anybody was welcome to come. Folks, I called the governor's office that day, and to the governor's credit, he invited me to meet with him, and we sat down. And I informed him at that time that I agreed with many of the decisions he was making for the safety of our state.
and to that end had filed about five or six bills that were in line with what he wanted to do using his language and said I would look forward to meeting with him on those bills to protect the citizens of Arkansas. I still haven't heard back from his office. Lastly when we as is the custom I think of our newly elected representatives and senators three of the four senators were invited to the governor's mansion for lunch
to discuss their constituents and what their districts needed. Folks, that kind of stuff just rolls off my back. I don't mind. But when we are ignoring the 90,000-cent people that I represent, when we ignore them, I take that very seriously. I'm not looking for any... What I'm looking for is a change in behavior, not a promise, not a, you know, we'll change this later, We'll move forward. Let's move on. And I've heard that today about this in Senate Bill 133.
Let's get these passed and move on. Folks, I'm not ready to move on until I see some change in behavior. You know, I know many of you, know most of you pretty well. You know that I don't surprise people. I don't come up behind your back and run something. I'm straightforward and straight honest about it. And that's what I expect in this situation. I expect for the governor's office us to come and talk to the representative, the duly elected senator from Senate District 21 that affects over 90,000 people.
For that reason, I'll be voting no on
Speaker 140
21:47
this bill. Thank you. I have a question. If the
Speaker 91
21:52
Senator Flowers, if he wishes to entertain
Speaker 140
21:56
the question, Senator Sullivan, is Senator Flowers
virtually? Yes. Thank you. Thank you, Senator Sullivan. You are a plaintiff in a lawsuit brought against the governor, are you not? I'm one of many, yes. Okay. Well, are there any restrictions on communications between the parties?
Do you have an attorney or what? I mean, do you have any conflicts with the lawsuit that you filed against the governor and people in the executive branch? I'm sorry. That would keep you from from speaking or communicating on certain items. Yes. And those issues are referred to the
Senator Dan Sullivan
Unverified
22:39
attorney general for a response and have been. And that's appropriate. I don't have a problem with that. That's what that's the right thing to do.
But these issues that I'm discussing here didn't fall within the purview of
Speaker 96
22:56
those requests. please proceed sir flowers i'm trying
Speaker 140
23:02
to understand what issues are you upset with the governor about in terms of communicating sure when
Senator Dan Sullivan
Unverified
23:12
he has a meeting in my town my district and invites the community leaders and doesn't invite the sitting senator i've got a problem
with that. And when I was asked if I was invited, they said it was under consideration. You know, when the governor traditionally, not just this governor, but other governors traditionally invite new members of the elected assembly to the people's house, not his house, to the people's house, to welcome them and talk about issues relevant to their district. and I'm the only one excluded however you want
to put that I don't think that's the right way to do business. I've got a meeting this Friday with quite a number of people who were in opposed to my election donated other things to my opponent that's over, that's fine and I called a meeting with them
Speaker 66
24:21
to go down that line Please proceed Senator Sullivan So
Speaker 140
24:24
so you want you want to vote to disrupt functioning of the governor's office because you're angry because he didn't invite you to a meeting after you were elected?
Senator Dan Sullivan
Unverified
24:35
No, I listed several things there. There are more. And I'm not angry. I mean, it takes a lot to make me angry. I'm not angry. I'm just not going to vote for an appropriation when the people of my district are being treated that way. Not me. This is about representation for the 90,000-plus people who expect to have a liaison between the governor's office and who expect the governor's office expenditures to be equally represented among all districts.
Speaker 102
25:11

Senator Trent Garner
Unverified
32:18
the prevailing side of SB 96, I want to do a motion of reconsideration
to hold the bill up. And since I was on the prevailing side of SB 133, I wish to make a motion of reconsideration to hold the bill up for three days. Thank you. You
Speaker 71
32:32
mean a notice of reconsider? A notice. Notice. Okay. Excuse me. If I need to remake that, I will.
Speaker 126
32:37
You said notice on the first. You said motion
Speaker 71
32:39
on the second. It's a notice on both, which holds it for three days. Yes. That's not. We don't vote on that. Move over.
Speaker 130
32:50
Senator Hickey. Has it already been transmitted to the house?
Chair
Unverified
32:57
No, that was my, that was my instruction, but it has not been transmitted to the house. any Senator Dismay is recognized Senator Dismay is recognized it's also a question I think this
Senator Jonathan Dismang
Unverified
33:23
is what Senator Hickey was asking, I think when we concluded that vote
we said transmit to the house at the conclusion of the vote, so if that's already been transmitted, can that be held or
Speaker 91
33:36
is it? No, that's my, that's my order to transmit, but it has not actually left out of the Senate at
Speaker 136
33:42
its top. It has to be physically in here before he
Speaker 140
33:47
met that motion. Point of information. Senator Chesterfield. In most motions to reconsider, I guess
Speaker 142
33:52
Masons allows you to just sit on something for three days and do nothing. And we don't get to vote
Speaker 125
34:00
up or down on the motion to reconsider? The motion to reconsider would be out for three days, but that's not
Speaker 109
34:12
what—this is just the notice. It delays for three days before there's any sort of— Would you read that part to
Speaker 142
34:18
me, please, Steve? Through the chair to the parliamentarian. I'll have to read it to you. He can point out— Because what you're doing is holding, so what you, so what one person can do is hold a B.O. hostage.
Senator Chesterfield's got the floor. Please proceed. So what one person can do is hold a B.O. hostage for
Speaker 150
34:47
three days just for the hell of it. If you vote on the prevailing side, the side that, that wins, the side that carries, You can give notice of reconsideration, which holds the bill three days. And at that point, on the third day, the motion can be made to reconsider or not.
If nothing's done, then the vote stands, the vote stands that we just took. But it's three days. Any senator can hold that for three days to give notice that I'm going to make a motion to reconsider. Are the days, would the days start today?
Speaker 152
35:30
It's three days after today. So it is Thursday, Friday and Saturday? You don't count today,
Speaker 150
35:37
you count the third day, which would be Thursday, Thursday, Friday, Saturday.
Speaker 153
35:43
Okay, and so Monday we would be able to reconsider?
Speaker 140
35:47
Monday would be the third day. That's what I needed to know. Thank you so much, Mr. Chairman. Senator, it will be automatically transferred on Monday, barring some
Speaker 150
35:55
other sort of action. Yes. Yes. If he says no action, it's automatically transmitted. Any announcements? Any announcements?
