It was a little boy little boy in Missouri that when Simon was born had a heart defect in his parents and brothers fell in love with them despite his life threatening diagnosis in the medical community's opinion that it was incompatible with life. However just days before three month old Simon was scheduled to see a cardiac surgeon his parents begged for help at the hospital treating Simon when his condition started to deteriorate. They were shocked when the staff did not intervene. They did not know that the hospital had made their baby a do not resuscitate and that Simon was only. Was given only so called comfort feeds due to a secret fertility policy. They had to helplessly watches Simon died in their arms. As far as I know this is never happened in Arkansas But. That was in twenty ten I became aware of this you're in a half or so ago when Missouri passed Simon's law it has passed in several states since then worked very hard with all the very stakeholders to make sure that all the teaser crossed and I's are dotted. Is this is a very sensitive issue but as far as I know there's no known opposition to this this is just one of those. Good pieces of legislation have on the books to give hospitals doctors and all medical community directions so that End of life treatment can't be withheld. So that the language aligns with the requirements listed in federal law. And it also clarifies the conditions under which a youth may return to extended foster care if they have elected to leave care at age eighteen. It clarifies the land the agency to which referrals will be made for juveniles who do not have the capacity to transition to adulthood independently and that would be the office of public guardian rather than adopt protective services and finally this bill says that a youth in the custody of the Department of Human Services may share information about his or her experience with the Department and his or her discretion after consultation with an attorney or an attorney ad line item this bill was vetted through many agencies and organizations having to do with you Arkansas advocates for children and families Arkansas children's hospital Arkansas Commission on child abuse rape and domestic violence Arkansas court improvement program Arkansas state police. Existing law. On the allows for this type of a release of information for children currently placed in the home this legislation will give the agency the ability to provide limited information to the foster parents who have a legitimate need of such and it has been that it to the same agencies and stakeholders that I listed for the previous bill they are all in agreement with this. Currently in current law a child maltreatment investigation can only be determined in active if the alleged offender is an able to be located or identified because that alleged maltreatment occurred more than five years ago or in another state this current definition is too limiting since there is not another determination type to accurately capture situations in which the alleged offender or alleged victim cannot be located or identified if the alleged maltreatment occurred within the past five years and in the state of Arkansas and finally this will not be a requirement it is only an option for investigative staff if the truth or unsubstantiated determination cannot be established without interviewing the alleged offender are alleged victim and it includes some minor language clean up around enacted investigation determinations and prior to the legislative session the CFS met with representatives from Arkansas advocates for children and families Arkansas children's hospital Arkansas Commission on child abuse rape and domestic violence Arkansas court improvement governor's office state police attorney ad litem program costs a child advocacy centers juvenile judges parent council program and there was no opposition to this bill.
