Senator Senator Rapert is files legislation and all these bills came out of that task force they have been vetted by the farm bureau and a number of other agencies such as parts of counties Senate bill a House bill skis B. twelve forty eight. The world. Twelve forty eight. While there this this bill simply of talks about
consolidation of levee district within. Counties different counties well the well the statutory method for consolidation district twenty two or more counties there's no such provision providing medicines for consolidation but to of two more districts within the same county so this this bill simply will provide for that plus it provides for more transparency in reporting. A judge Hart from up in Conway
County came and testified before the levy district we send it only makes common sense for these levee districts Babel consolidate because in Conway County Polk County whatever happens in Polk County is going to affect Conway County whatever happens you Conway County it's going to affect Polk County so this allows you districts to come together and consolidated specially when you have a a a a levy that goes to multiple counties you have one district that is not active has not been active in decades another district that is functioning another district is not so
that's basically what this bill does. Right you ready for question senator yes sure Senator Elliot you have a question yes I do. I feel that I I was trying to pull up the bill on my iPad but it's just not doing that kind of function right now but I'm just wondering with this bill and the series of others
Will will this legislation and others with that lead to better integrity of the levees themselves as someone who's who's responsible for funding so that they can be maintained all all of those things entered in your legislation. What eleven districts are responsible once the Swansea's levies are put in place but even by the court they're turned over to local levee districts to
maintain those living district but over the years many of those boards have. Members have either died or retired or they just dissolved banded. So okay. The question I'm getting too when I think about what they're trying to figure out our our by the lead these cells are they in good shape but this is what I faced in two thousand nine when I was taking a look at this it
was not people did not want to have led these that were not in good shape and would do what they heard they're supposed to do. It wouldn't matter even and but then unless we are answering answering this this problem now it wouldn't matter if you let me districts consolidated if there is no funding to maintain the integrity of the ladies are make sure there is even a let me where somebody says there was a lady we're not any better off so is that issue answered.
And what and what you discovered and decide to do it with your study. Yes you entered whether or not there's a levy that saved in there. Eight no that was that was one issue back in two thousand nine when I was taking a look at this. Okay sorry about that Senator only would you let me just say
it again yes real quickly when I was looking at this back in two thousand nine and when it was definitely not taken seriously one of the problems was that is not that people did not want to have a lead is that what functional. Have the funds they don't have the capability of making sure the letters were functional and more maintained so it wouldn't matter unless that has been answered it wouldn't matter six districts consolidated.
They are not capable we are not answering that question of how we're going to build the land so that they are. They are functional and how we're going to keep them that way that's all I'm asking is there's two different ways to fund those levies one is to assessments and one is a five percent increase in the property values on the CPI so. You know it's up to those levee boards to make sure that those
assessments to put in place and by the way the the the assessment was was made at twenty five cents back in nineteen thirty seven so that's one of the in fact we cover that one of the bill Sir because twenty five cents an acre in nineteen thirty seven you're not going to maintain levy with twenty five cents and I computer most of us realize it so of but it but up to now you're with those assessments have been collected. And it's up to those living board to make sure that they use
of assessments to maintain those ladies I won't the last thing I'm I'm I want to try to find out if we're going to fund them through these assessments are those do those assessments yield enough funding so that they can maintain the Lebanese. A lot of that depends on whether or not those ladies have been attended to over the years let me boards is often those ladies go thirty forty years without
without being attended to and they've got trees growing on with with root balls down inside the ladies in animals that a bird holes in the levees and drainage pipes it rusted out no there's probably won't be enough money there. So you're looking at maybe getting a loan from a in our city are you know other avenues to try to get those levees back.
Within the guidelines of specialty court today what one sees ladies are are maintaining gotten within the guidelines of the of the corps of engineers they can be entered into a what they call re program right and that will cover in case there's a breach in or over top the destroys the ladies there their eligible for federal funds in what that that's the main thing I wanted to know if if the court engineers are working with them and making sure that everybody
understands what it takes for the labor the young lady to have the integrity it needs to work well right wing Corbin junior engineers guidelines that's a good thing. The court does work with those levee district all right.
Thank you Senator Stubblefield and I'd also like to thank senator Rapert and Representative Hillman for working on this. This is kind of a statement but I really appreciate about the three bill package they brought for as long as anybody can remember in Crawford County when we had a flood not even close to what we had last year the regular flooding of the river we flooded an entire six to thirteen thousand acres and it kept the longer in Crawford County rather than running downstream well our levee board working independently in Crawford County build up the levy.
And this time with a five hundred year flood we didn't flood over the levee and at some level without working in tandem with other levee boards down river we sent all that water all the way down towards Dardanelle Faulkner County Conway at center. And that's what I appreciate about these bills because they did look at. They've got to be a related and I guess I would enter that as a don't you agree so it's a question yes yes I do. And I'll tell you most of us drive by these ladies some of the server data on daily basis
and we and we don't realize that the structural integrity these ladies does much more than just hold back water it increases property values multiple times it also without the commerce city creates our economy would look much different today than it. That would have been without those ladies they do a lot of things and you know nobody thought considering the amount of water in that perfect storm that happened in northeast Oklahoma or northeast Oklahoma and southwest Kansas.
These Kansas there was an enormous amount of water that came down that river And considering that amount of water we fared relatively well considering the shape that are ladies warning and that does not mean if we do everything right we're never going to have an issue because mother nature is a formidable foe in. but we can do a lot I think these bills will do a lot to mitigate some of that damage it could come tomorrow Johnson your day.
Thank you Mr president Senator Stubblefield. I know that part of the twenty nineteen flooding Senator Rapert had done a great job of getting some work done in making sure that at least in Perry County our our levees were protected and word to the core standards and therefore they were eligible for FEMA finding that I think ninety percent or ninety five percent level hi my house because they were maintained we have some areas and I know some
down river from the Lasky county which was not it is hard but we're you literally have had the levee district boards age in place for twenty eight to play sometimes you pass away and you literally didn't have functioning boards. Is it my understanding that this bill would allow these neighboring districts to come together and kind of monitor each other both on the ministry well as the functional side of
the engineering of the levee and solve problems much is Senator Pitsch alluded to that they did in Crawford K. is that sort of the intent of the bill yes. Lousy lousy districts that to come together to consolidate work together. because within these within these levee districts there there's a lot of boards that are not active anymore haven't been for decades we learned about how to fix that last year when we knew we had to have a
functioning and this is a great bill I appreciate what you said about the economic development in Conway County how would out with judge chart to the levy and thanks to some local services and immediately went to work and fixed the breach we were able to keep the roads open to Green Bay packaging paper mill which employs over four hundred people plus a whole lot of lawyers and that was absolutely because that lady did not breaching if it had not only would we had all the other flooding problems we would
have a tremendous loss of employment there so thank you for this bill in the package that you work thank. Senator Blake Johnson. Senator so this can be a consolidation of districts between counties so in the bill is not they don't statement usually the the county judge. Or is the one who appoints those people to that drainage disturb
our levee district or drainage district so is this going to be split proportionally that in those you know those seats between counties so you don't know the taxpayer's represented equally and that'll I saying that will have to be decision might have to the county judge. And this might be a quorum court to make those decisions of how those boards we. And I'll put together thank you.

want to ask a favor is really to Senator Elliot it's question and that is he explained the way that the that the levee district Fund. but absolutely in the disaster like we've experienced a Senator Pitsch described many of them are just walked out. If they have to have help and here's what I want to ask and ask you to vote for the bill. We come to this pandemic we see this money that's going out to support. And I raise my voice a few weeks ago in objected to literally several billion dollars is being sent outside of our nation. To help people that are in our taxpayers. There were never going to get a return on. And I had one of our congressmen
that actually chastised me for speaking up and said that I was nitpicking. And I just want to you. One of the levees I know of in there several there are several levees that to this day if we had a major flood like we've had water's gonna port right through those levies because they've not been fixed and so when I brought my voice up and I said if you call nitpicking. Being concerned over mutual constituents when there's a levy that I know of and just one location that is waiting on a million dollar situation just on the red tape with the corps of engineers and you send seven hundred million dollars. To another country when Arkansas needs those funds I just wanna ask all of you members to please raise your voices that we've got to pay attention to
infrastructure and levies are critical to many states including our own thank you Mr president Senator Rapert as well before the bill is anyone will speak against the bill. represented Randolph County in two thousand eleven in my previous district we had a massive flood at the Black River in the levees you know broke and it was just such a mess and so you know this is just such important work and I think it's just so important that no we're talking about all areas of the state of Arkansas that truly can be impacted particularly when that water is collecting and slowing down down the river from our state to the east or west or
or to the north of us so I just appreciate Senator subfield lawyer work and and represent bill and everybody thanks. Now do I think you were outside the bounds by four dollars I just wondered you know to me back the in the late nineties we did four dollars and two dollars maintenance and but I think most of us remember early to a lot of us remember special goes up year round Pocahontas area that when the Black River breached that that lady Board dissolved in nineteen sixty and after forty years they came back together
and they raised to they raised it up to fifty cents per acre assessment to raise the level of that lady I think three quarters of the foot and then it was just a few years later at two twenty eight point seven five eight then for years later you know what happened they had a flood in the it overtopped in the major flooding up in that area. So yeah you you can't I mean twenty five cents the septic two
fifty cap can go about that that's very reasonable. I mean we we were doing it to ourselves so.
