Stu Smith state representative district sixty three. I'm Duncan Baird executive director of the Arkansas public employees retirement system. You're recognized to present your bill thank you house bill twelve seventy four would allow a member of a person to serve as a volunteer police officer in a lot the covered position without forfeiting. The apers benefit they're earning through a separate papers covered position. Currently the law does allow. Full time employees and neighbors to serve as a volunteer firefighter under lock the this bill would provide the same for volunteer police officers. There should not be any physical impact on neighbours and Lottie's actuary advise that there would be no measurable financial impact a lot the the. Okay Duncan do you have anything to add to that. You know the the only thing I would add is that you know this is a change that we're I'm supportive that something that we heard at the town hall said you know some of the town halls we heard from Bollinger police officers who were simply asking for the same benefit that the volunteer firefighters had so I was thankful that I represent Smith let us I work with him on this bill as he went through that process okay thank you. Thank you just for my clarification these are retirees that just want to volunteer their services that correct. They're not necessarily Retirees they could be working in another pledge working but they're not they're not volunteers in the a persistent in their employees of our retirees is that correct you know what what they would be you know like one example we have is someone who works full time for a city in an aper covers position and what they want to do is a they also want to be able to serve as a volunteer firefighter in a lot the covered position the apers low right now excludes someone who is serving in a position covered by another system from membership in a pers so we're really creating an exception to this exclusion so that and apers we don't have to disqualify that time where they were serving in two positions so it's kinda you I think it's very unique to you know this volunteer service just because you know it makes sense that you have a full time job that could be covered by a pers and then you you know you may want to do something volunteer as well in this case it turns out you may want to be a volunteer for a police officer and so it does align with what we do for volunteer firefighters which I I think people are very familiar with historically okay and that's. That's correct so we're talking about two separate positions covered by two separate systems you know we're not talking about bringing of a volunteer fire volunteer police officer position in the apers what we're simply doing is creating an exclusion and apers law that would keep us from having to essentially built them out or or I exclude that service because it was covered by another system at the same time and so so we're we're simply just updating this for volunteer police like we already have the existing law for volunteer fire. do we have any other questions. Thank you Mr chairman mark Johnson Senate district fifteen a I brought Senate bill thirty one I don't know what about five or six weeks ago a. And there seem to be so several concerns I tried to address those I appreciate to my co sponsor representative Richardson working with me on this I have amended the bill to where it only applies to elected officials if a if elected official breaks the law and creates what we more clearly defined in the amendment as a public trust crime which is a crime prohibited under the constitution article five section nine. Hi it would cause that the individual to forfeit their retirement benefits however they would still be entitled to repayment of any maps that they paid into the system. So that is the. Short and probably complete explanation of the bill it does no longer applies to to shall we say rank and file members of a retirement system it's only elected officials a I'll be happy to entertain esque answer any questions Mister chairman. Okay to any members at questions of senator Johnson. Okay do we have anyone signed up to. Hey. Senator Johnson are you ready to close for you I'm I'm close Mr. I'm sorry I apologize Sir Chesterfield A. L. there are. This bill punishes families does not senator Johnson as yes ma'am and and you came a little later I've already spoken to Senator Elliot about that senator from yes it will we are a family would lose the benefit just like a family loses benefits when an individual goes to prison while the person actually goes to prison the family suffers and that is true it this way if if an elected official. A commits a public trust crime. And of convicted of that public trust crime a felony as defined in the constitution even after he or she has Even after he or she has retired from the position. He or she could still lose. Their retirement right if you were related to their service so if I am that work for right if the let me let me finish if I have worked thirty years and in the classroom yes ma'am. And what I do has nothing to do with. My service as a classroom teacher I'm still going to lose my benefit no ma'am. It only refers to public trust crimes by elected officials. You know what I would otherwise and I know you never would but if you otherwise to speed in criminal activity that that a road to a a felonious level you would have to have created a public trust crime and that basically means you're an elected official you had a trust. Bye bye by virtue of that election to and serving in that position and then you violated that trust that would be the only instance you would lose it would have nothing to do with your service as as a teacher and a teacher retirement system or a a firefighter that to have retired with you know good service but when adding committed a a felon felony and some other situation if a it has to do with something related to your job you being in a elected official it and and to clarify again sooner just feel it would not in that same situation a non elected public official it would not apply to them either this is only about elected officials I say so if I am in a first for instance. And I have finished my time. And I ask that my retirement between my spouse and me. Which we are capable of doing. Everybody's going to lose because of my actions is that what you're saying. Only you and your spouse. But now it wouldn't well here here's the thing Sir I just want to clarify it has nothing to do with your past service neither is it out its entity but back to applies to that you're you're talking about if the spouse did nothing and the retirement was split. And that practice and they have children. Both of this the person and the spouse will lose the benefit which means that the children will lose the benefit to you is that what you're saying that in that case yes ma'am that would be correct all right thank you. And let me add if I could Mr chairman. Many laws we pass that are have punishment are there to deter criminal activity in the deterrence at least partially in this case is that this will not just her you it would hurt your spouse and and you have young children course most people that are retirement age aren't that's another exceptions but generally aren't looking at having you have young children that are minor children that need to be sport okay we have one more question Senator sample. She is a no link to the official. This is convicted by a court of competent jurisdiction committing a public trust crime while performing his or her duties as an elected official. Any If you're an elected official and you've retired and you are committed you're convicted of a crime the way I read this you forfeiture or your retirement. I don't believe that's correct senator I think it ex post facto laws which would prohibit that. Just like last year. In in cases of the Well we all use the example some people said that this was the Nick Wilson bill and it was aimed at and it is it was aimed at situation outlined by former senator Nick Wilson who was convicted of corruption crimes went to the federal penitentiary and He received his pension while he was in the federal penitentiary which is anathema to me and to most citizens that I've discussed the issue with so we can but we can't make it retroactive on on Senator Chesterfield or anyone that is already retired and drawing that anymore than we can on the on a former senator Wallace so that's. That is exposed facto and certainly that's constitutional as all of you now okay we have another question Senator Ingram me take my shot at trying to get the get get the answer here. Yeah our let us is this would affect if they're found guilty will it affect the retirement that is created while they are serving in the legislature and not touch any other retirement that they may have accrued in in their lifetime that's what I'm trying to get that is my understanding senator has to do with that the point in time that you're you're looking at you couldn't go backwards and and let me throw this out if the no we're not we're not going backwards we're we're still. Listen to me let me let me see in fact separate we're where we're from what I think you're interpreting. I'm still working I'm still building of a retirement. And I'm also served in the legislature. In is it only by legislative retirement that it affects or is it a bad outside income by a map by a citizen legislature job of of whatever it is outside of the legislature is it only the legislative retirement that affects. Let me answer it this way Senator up let's say that instead of being a retired teacher center just feels it was a current teacher. Then it could potentially affect that but as a retired teacher it would not affect and apers pension or that now I'm I see exactly your point and that certainly was the intent but this I believe that the Expos facto requirement that everyone has retired one his vested one has filed then that is a point in time you cannot go before that because that would be were exposed facto law would well it can't. One final question I think there'd be a lot more sympathy for this I mean people come down here get elected they've worked all their life in the job they built it up and they've they've they've built their retirement without doing anything wrong they get down here and do something wrong get convicted I think most people would say well the the public retirement that they're drawn while they're in the legislature that's sort of tied to do what they've done but what they've done previous in their life maybe that should be in jeopardy I think that's the question we're trying to get a. I understand exactly what you're saying senator I think that the it's possible that the and I I have leaned heavily on the Expos facto issue that that what you did up to this time is insurers and even under case law you're entitled to a refund of what you paid into a system even in the case of a of a felony or a public trust crime that's that's established case law however and I in X. excluded in this bill but in the case of Something it's it's active and you're you have not retired yet I don't think it would apply. But now reasonable people can can differ in a you remember two years ago you and I worked on this bill or similar bill together and we split over the issue of of elected officials and and all the public employees and that's okay I mean you're my still my friend even though we don't see that the same way but I still hear from a lot of people that are are outraged that we pay pensions to Legislative crooks and that's a but that's something I can't let my people the I felt saying that I tried to fix and that's why I have this bill now certainly it. The the lawyers actuaries and look at it and that issued had not risen up till this moment. Okay we have two more questions Senator Hammer you're recognized thank you Mr let me ask you about this what if I'm a representative or senator I'm down here doing something and I'm using my position to intentionally favor maybe one of the retirement systems because that's a particular field that I work in all my life and now that I'm in a sitting position I want to use my my power to be able to influence decisions or do something would that have any effect on me being able to draw from that retirement system if I was found to have done that and be proven guilty that I did that. If it were deemed to be a public trust crime it possibly could Senator but that's the key thing is public trust crime I don't think that I think we all come into to this job with certain life experiences and that's what we bring to it I think it you for example of course Senator Teague is a insurance agent he understands insurance he brings that perspective to us in a person that's a retiree from one of the our state retirement systems brings expertise having follow that carefully since that has to do with their their pretension would end up being I don't see anything wrong with that from a legal standpoint or a public trust as you know we have rules both in the house and Senate that affect those types of of ethical considerations in many cases we are required to give notice of a potential conflict of interest but that's as far as our rules go on that I think that as long as everyone acknowledge their background and their Hey I'm a member this system rom receiving a pension from this system then as long as acknowledge that then I think it would certainly meet our ours are at least are Senate rules I'm not intimately familiar with the House rules but I think they have something similar at the end of the day who is this bill going to affect. Only who it's going to affect. Elected officials who. Did something criminal in their collected position that under the constitution the state of Arkansas rose to the level of a public trust crime. Okay thank you. All right last question I see is represented Friday. Thank you Mr chairman of Senator Clark let's just say that a person was here for say ten or twelve years. And they didn't do anything whatsoever wrong within this job capacity down here. And let's just say that a person retired and they received a felony for something other than the work that was related within the job description that we have here what those persons be affected would it be just a faithful just a situation of of all of the job here if if. I just wonder if how that will be handled a representative right to to give you a direct answer it would have to violate the public trust crime provision of the constitution. So if you have let's say after your distinguished service the legislature you went back Poinsett County the side become bank robber. It's bad is that would be I don't think it this would would affect that because while bank robbing is a bad thing will stipulate to that it's not a public trust crime. I hope that answers your question. Okay Sir Johnson are you ready to close for your bill yes Sir I appreciate the questions and I also appreciate the fact that this committee has a a fiduciary responsibility to the systems just like the trustees have a fiduciary duty to the systems but we also have a fiduciary duty to the constitution and the taxpayers who support us and all these state employees in the system so when they see the cut level of corruption that we've had in the legislature and as I said when I first ran for the Senate this was my primary motivation at this stage of my life to run when I see people walking the halls of the capitol that have had a public trust and they violated that trust by taking bribes or similar type crimes then we have to punish that and I recognize any time you punish anyone in our society other people get hurt I think society gets hurt I think certainly the reputation of the legislature has been hurt tremendously I mean there are folks out there think we're all bunch groups of peers so I think we need to show that we're willing to at least take away the long term benefit of doing something corrupt and that's the purpose in the the thought of this bill and Act appreciate the opportunity presented I'm close on the bill. This amendment represents work by the directors of teachers sloppy Asher's apers as well as representatives of large groups of members in apers. It is an agreement on how to continue allowing members of the state retirement systems to combine years of service for retirement eligibility and address old language related to final average salary. This will grandfather state high final average salary for those who have served in two or more of the systems once the bill is officially a law it will also limit those who've only served under one system to have final average salary be determined by that system and any other system but may work under from there forward. So this is the. Work that we did to make it where everybody was like okay we can agree to that so that's the amendment that we came up with all right members any questions about the amendment. Pretty much we've done it the the the whole point behind this is to make it where the systems are not paying out unfairly if you work for two or three five years and one system at a lower salary you worked. Twenty plus years over another system and you increase your salary. You don't want to penalize the system where you started out at a beginning salary say you have to pay over here what your final salary was in this. System for the lesser system there's an example in the cost of the the Jodie's firm did just. One example that system would have had to a paid five thousand more over the life of each year so. You know we're we're just trying to make this fair to each of the systems and not over burden the system because of what someone did when they left that system so this I think really makes it fair to each of the systems. It basically stops of lead from here forward and I think everybody is content with this and had everybody in the room I don't know of anyone that objects to this but I think it's good moved from here forward and will help strengthen the systems all right members any questions to the bill as amended. They clean it up that would you thank you committee Clint Rhoden Arkansas teacher retirement system all right represent Murdock go ahead present to House Bill thirteen hundred is amended please thank you a chair and committee for indulging me on this this this this amendment road from of a bill that emitted from a a summer youth program that workforce allowed me to do back in my district and at that time we when we went to administer the payroll part of it in the in the area I represent sometime we don't have as many entities that have the capacity to do that so as we were searching for that we talked to the school district as one and we found out that the teacher retirement system there is statutes that require anyone's called the employee to have deductions taken out of their salaries per the statute as relates to teach retirement will of course fifteen sixteen seventeen year old that was not the intent of some youth program that we were doing and we do not want to be subject to that but at the time we could not use the. School district because that was statutes so that is where this came from the with this simply does is couple things and is agreed upon and worked with Mr Rowe now what teacher retirement and basically it eliminates the employee designation and makes the student or participant basically S. that that's one of the main things that it does so that we don't have a conflict of an employee we take the word out in the is subject to civil to participate and then secondly what it does is it allows for a memorandum of understanding to be put in place at the request of teacher retirement in a situation where the school district is going to be the right checks the payroll in this particular case so it what it does is just trying to get to get around that situation in the unique circumstances and allows for us to develop our workforce in areas where by we otherwise may not have the capacity to handle administratively that's what this is all about okay. Clint anything you wanted of. I would add that you know representative Murdock and and myself and general counsel of a TRS and you know work through this program we've narrowly decide to define this down for this exception to be just a very small of work force our youth program and we're we're happy to work with the representative on this. Okay all right Senator Elliot you're recognized before I take representatives motion okay all right thank you representative Murdock for for the Memorandum of understanding is there or Mr rove who will answer this is there some kind of standard document we can use or who is going to work that out actually sits down and comes up with the language with them right of a bunch of what is that it would be at the request of the ATR S. and this is something that they want I I probably that would be developed Senator Elliott as to what that would look like in I think between a TRS and of the school district if you will that would be worked on I don't know that we have that developed at this point but I think it was simply just more lies the agreement of what this is a participant in that it would not be subject to be documented that is not subject to those deductions of teacher retirement so I think it would be I'm sorry thank you representative Murdock do you anticipate this will be filed with anybody with the school district and maybe with AT R. S. or anybody else those would just be the two parties that would be involved in I assume riding the MO you and is there a third eye on it anywhere is what I'm getting at besides legal of both entities to legal of the school district maybe the legal with a TRS I would think those would be the only to involve Mr okay all right thank you. Okay. Senator Chesterfield yeah thank you thank you representative Murdock and thank you grant. Right now I'm trying to understand right now the children are treated as non contributory members is that what is going on if they if they engage in this in the summer programs are they considered non contributory members. That would be correct right now but the most important thing is the employer the school district right would actually have to pay back in two hundred fourteen of fifteen fifteen percent contribution on this nontraditional you. But that's not really generally has in the past been considered an employee so okay thank you that that helps to clarify. All right any other questions for members. You'll get the rules promulgated in time for the summer program start. Yes I mean we we essentially in the bill put the main the main provisions we wanted to have an rulemaking was the ability to have the memorandum of understanding main made known to a terrorist ahead of time so essentially the rulemaking issues that we brought up with representative Murdock we've essentially put into the bill itself but we have rate brief we've retained that rule making of authority since this is a new program you know we would want to bring any issues to this committee and to the A. L. C. and and have the ability makes rules if we need to that's great I just wanna make sure you had enough time between now and when because I saw the program as got a certain date in it I make sure the rule making authority that's gonna allow to go forward and you're comfortable with that representative Murdock yeah and what you see is something that what we did the last time we have not actually consummated this time those bills date certain so we're still working on that with work force or searches for you on a question. I haven't had a chance really to read The Amendment. As I'd like is there a time certain for it's only for the summer is that what that is it you know I want to make sure that we are not working he adds right four year. Under the guise of it being a program there is a space there is a specific amount of time that they can work is that right what. A brief explanation of the amendment please for take the motion brief explanation the this bill has has been through here before went to the house did not make it through the Senate so what we've tried to do is make it a bill that is a little bit of. Less specific gives the Speaker two appointments to the apers board and the President Pro TM two appointments to the apers Ford one of which on each in has to be a retired law enforcement person and that way that gets us where we have held up our end of the bargain where we went across the state with meetings and we kept hearing we just want a an Avenue for representation so it will be the Speaker and the president pro tem who get to make those appointments. Only reset and that's that Senator sample was was covering my back making sure that we had gotten the body of twelve eighty three into here because it looks so short he was afraid we left out some stuff but we we've checked in we we've got the body of twelve eighty three and here so plus the new new language for the four point which are represent right you have a question yes Sir a representative list is is dealing with those two new appointees well the four new appointee for new a previously it was going to be one from municipal league one from association of Arkansas counties one from A. S. C. A. and then one by the President Pro tem and Speaker of the house that was a law in fort retired law enforcement person. pharmacies yes yeah how will those for being now representative way with with this amendment the Speaker will get to a point to and the president pro tem we'll get to a point two. Each of those individuals will be required to have one that is a law retired law enforcement person and then the other one it's it's open to whoever they want to appoint thank you represent what thank you Mr chairman well as long as they're retired a person plea all right of.
