This to the concurrence on three fifty three. This B. three fifty three. Mister chair I make a motion to concur in the house amendments to SB three fifty three of the committee didn't have a hard time with the. All is just an echo sponsor. What is to. Amendment one. We have a motion to. Concurrent amendment one. Second any discussion hearing none. All for the motion to vote Senator hi opposed motion carried we have concurred an amendment one that was an easy amendment yeah. Two looks a little bigger yeah it does so the question is from a if you have I would assume that the the bill sponsor would not have a problem with us doing this however I'm not you know not knowing that for sure I'd hate to move forward without. Without hearing from her. No. I've Senator tech so we'll see if. Okay well we're waiting. A search and if you will take a chair. I will run House Bill. Nineteen forty three which just came over from the house and the supposed to be. What is now referred it just got referred. Barton it's not it's not. Yeah. About two. Thank not released yet let me run out there and. Okay it was. Why don't we just not vote on that item will get an explanation everything done. Okay she says it's great. Close. The Amendment is basically the the bill so. Read about nineteen forty three U. Talbot centre Irvine's bill yes Senate bill three fifty three. All right. And that is you guys wanted to wanted to kind of explain what the what the amendment is what the bill does if you think you can do it. Yes so so when when I was over there presenting another bill and she present originally is she she thought that anyway was confused about whether she during the interim study essentially creates a task force to study the fees and the impact of fees on on individuals so rather than rather than reducing the the fees of people charge of change outs paid it's just basically you know the intent is to work over the next two years on looking at how fees impact individuals how to collect the fees and then the. How to make sure they don't don't burden a person is trying to create or back inside to. I know that task force to be not real popular but if you look on page three it kind of goes out the task force to be set up. Okay we're looking at amendment to. Four Senate bill three fifty three. She hasn't responded to me So. It is what it is. Any questions for Senator Ballinger. I can't answer to make some of. They will make a motion on this or anybody or you want to wait. I make a motion to concur in the amendment it if the Senator Missy Irvin doesn't want. It then she always can decide not to or on the floor. The motion from Senator Ballinger to concurrent amendment to honesty three fifty three. Second from Senator Hendren during discussion. Hearing none. All for the motion signify by saying aye. All opposed motion carried. The concurrence for Senate bill three fifty three amendments one and two is done. And so I now need to run house bill nineteen forty three correct. The staff. She's going to check but they would have and had it in her hand getting ready to read across the desk of. Yeah I think by the time. We get it done they'll have. Senator Clark you're recognized to present house bill nineteen forty three. What's that. Yeah we're not going to vote on it yet we're just going here and hopefully they'll get over. Nineteen forty three. Reduces the of. For only classification. Where if you produce your own. Are the to try to obtain alcohol of. From a Class C. to a class or a class C. felony to a Class C. misdemeanor this water standing at this is to line up with federal law and also. Because normally when somebody does that it's a teenager. Of and it's it's currently at the same level as somebody who is making false ID's. Of as a business. And so it says if you're. The Page two. Five. One five however the person manufactures produces his or her own personal identification document or alters his or her own personal identification document for his or her own use in obtaining alcohol processing of venue which are call sold a violation of this section is a Class C. misdemeanor we're we're charging teenagers with a Class C. felony for making a fake ID for themselves. which seems a bit excessive and federal law. definitely. Would agree with that I'll be happy to any questions. Senator Rapert you're recognized for a question. What does not say how are you for a person fraudulently. Manufactures or produces his owner it sounds like a rather producing it I there's nothing wrong. Does not. I mean I can produce something for my own use or whatever but. This is. Knowingly. Producen something fraudulently. Then then we're determining how how illegal it is. I can't disagree you know if you look at. Page one line twenty six manufacture is unlawful for a person manufacture produce a product personal identification document. Well it does in line thirty one say alter a personal identification document versus. safe using the word pro wrestling. Thank. I think fraudulently is implied yeah okay I can't say it would be better if the word was there. But it is yes thank you and also missing not on purpose for missing section two of. It will not. Senator Clark isn't that he's basically making a distinction between somebody's doing it for somebody else or to sell to somebody else and somebody does it to their own ID correct this is making the the distinction between those who were doing it as a business on a teenager doing it for themselves right Senator John someone under twenty one doing it for themselves. How can how can you tell the difference. I mean technically I've seen a lot of eighteen year olds nineteen year olds that is just as proficient and making the signs are self is. The someone else and how in religion. Rubery Senator Johnson I don't know that you can tell the difference but what it does is it says that to the law still says that if you are. A minor makes ID's for somebody else is a Class C. felony but if the minor is making it for themselves or altering. Their ID to make it appear that they're older so that they can drink or get into a place that normally requires you to be twenty one years old that because what's currently happening is are being charged with a class C. felony and the the law enforcement a grease from what I can tell they're not here that this is excessive for that person. Again if that person makes it for anybody else. Of their still guilty of a Class C. felony. Even if it was their brother or sister but. it's it only distinguishes if you make it for yourself. Any other questions. Does anyone here to speak for against The bill still at the house so Senate. So what I might suggest is we've heard the bill Mister chairman if you want we can just haven't signed out when it gets over to to the Senate that way we have a taking a vote when the bill is not in our possession. I'm good with that. We thought we would have that read across one now. Any other business for the committee. C. none of we of. We'll keep our eyes out in case something comes up that has to be fixed but we will be adjourned for the day and
