recognized for a question thank you ma'am sharing your hand out I'm looking up says balance of. Should be targeted socially disadvantaged individuals who are those who have been subjected to racial ethnic prejudice or cultural bias because of their identities members of the group without regard for their individual qualities are you gonna go about establishing who fits into that category and why is that even mentioned in there okay that's a great question actually so I'm gonna answered in the. Little bit of a lengthy way so
the way this program works is there is a targeted audience for the first sixty percent of the funds to be distributed okay so the first sixty percent of the funds will be used for incomes equal to or less than a hundred percent of the area median income or. Of less than a hundred in the median income for the United States okay what does all that mean it means seventy nine thousand nine hundred it's going
to be the number in Arkansas so the first sixty percent of the funds we have to target household incomes of seventy nine thousand dollars nine hundred or below now as part of that sixty percent there can be socially disadvantaged persons in that sixty percent okay and if if I may I want to read the definition to you real quick because I want to be clear on this. And then I will go back to that
sixty percent so you fully understand socially disadvantaged individuals with those who have been subject subjected to racial or ethnic prejudice or cultural bias because of their identity as a member of a group without regard to their individual qualities the social disadvantage must stem from circumstances beyond their control there's a rebuttal presumption that the following individuals or socially disadvantaged black Americans Hispanic Americans native Americans and Asian Americans and Pacific islanders in
addition an individual may be determined to be a socially disadvantaged individual and cordons with the procedures set forth and then they you know give us a subset which doesn't provide provide a lot of detail so. First sixty percent of funds seventy nine nine and below as part of the seventy nine nine they can be socially disadvantaged individuals okay. When you get to the next group of funds so after we dispersed sixty percent of sixty three million then we can go between seventy nine nine and ninety one thousand.
Okay so when we move into the after the first sixty percent of the funds between seventy nine ninety ninety one thousand we're supposed to do our best working through different organizations around the state to target socially disadvantaged individuals okay we don't have to disperse a certain number we don't have to reach a certain amount of people we just have to make sure and our plan that we submit treasury that we're targeting those people okay then after we do that after we target
and do our best to reach those people we can go all the way up to ninety five thousand. Of household income and then once you get to ninety five thousand dollars I don't qualify. So it's seventy nine nine blows your first target there can be socially just imagine that people seventy nine nine to ninety one we got to do our best to target socially disadvantaged ninety one and ninety five it's wide open. Iraq Senator Pitsch you're recognized for a question thank you madam chair in my committee this last session we had an issue with geographical congressional districts do you guys have any overlaying rules or policies that you need to follow their legislators saw his G. Congressional District in his opinion short sighted and when you went over twenty years is pretty well dispersed do you have any policies that have come from that I know we didn't get that bill to the system but any
comments there to hire board works and how it functions yes so in regards to what you're talking about on geographic disbursement of low income housing tax credits that is driven by our qualified allocation plan that we review each year and that's it so great timing because that is actually the first meeting on that is this Thursday I'm sorry this Wednesday at one PM and so they'll start on the twenty two allocation plan and so yes they've committed to make a couple tweaks to make that were
we hope it will disburse those tax credits you know a little more equally around the state now one thing you have to keep in mind is when we turn the knob is a little bit and say we think this is what's going to happen it's a whole year before you know if it actually worked so that applications coming from from the next year for twenty twenty two and then you look at the map and say well yeah what we did work and sometimes you say well we didn't maybe turn this knob enough return. yes Sir so I'm gonna make sure that I do understand this this today you're just asking for the appropriation for the six point three million you're not asking for the second disbursement that appropriation is that correct yes that's correct and it It I mean the the funds for the initial six point three we received okay and then the once we submit the plan right and so what we what we would like to do is bring the plant back you guys could look at the plan right there we're gonna submits treasury and then we can or you
can a I mean you can appropriate the entire amount because once our plans approved and will get the remaining fifty six may. Okay but today you're having to ask for specific appropriation you're just asking for the six point three today's believe that's right yes okay that that's the first ten percent okay. So what is your intention to spend the six point three before you come back and request the other fifty six million or fifty seven million is that is that correct yet most likely yes and you can use this fifty percent
if you look here it can be used for a planning and community engagement we have vendors that we've apartment with so we'll have to start paying them at some point and then yeah before we get but and then what we're also going to do is we're gonna have a small subset a loans that's in our single family portfolio in a letter roll talk about that is we're going to do a small pilot program and the reason we're gonna do that is so we can understand how the system is working if it's working properly what are the bugs what
we need to fix before we just go out to the masses okay my my next question is this so before you come back to get your appropriation for the next one you we've heard some people here talk about they like to know you know the specifics of of where those were going yeah I would like I would like with as far as the six point three that we show the geographic locations and whatever other parameters that we need to put in there that we have that before the the second one but in addition and I know that you all are are are going to use this money so this is more of a macro statement I want
to make sure that everybody else understands also that that legislation the way that it was written. Says that that whenever you get an appropriation it has to be written for this specific appropriation if somebody doesn't use part of their appropriation with these American rescue funds that's not like excess appropriation like you've always had that you can can spend it you have to actually develop another planet come back before before so. Did you all understand that prior to today yeah okay yeah
right yeah right thank you Sir yes you will. What if you if you don't mind roll you speak a little bit about the pilot program that we're looking at and again this pilot program is we're trying to go out to the special subset borrowers and he'll speak to that it's so we can make sure the plan is you know on key before we roll it out to everyone mostly you may or may not know that the as a. mortgage administrator lotus we target low to moderate income mortgage holders that we work through a network of lenders we don't originate them ourselves
but lenders throughout Arkansas and essentially we use down payment assistance programs and other things to again target low to moderate income. Borrowers and we we that is a known captive a group and we probably experience hired fault and forbearance rates in that particular population you would the general mortgage population in Arkansas. Without having any outreach to
nonprofits winders whatever we know through our servicers who those people are what their needs are and exactly how much it takes to get them right in so we would. Like to have a pilot program as our peers in other states have a pilot program will target that population because it's known we can reach immediately and so that is what our first step will be and hopefully we'll learn a
lot about what our needs will be another thing that will wrestle with is what is our captain to be we would like to stretch it out to help as many people in Arkansas as we can and we believe that we will have enough money to take care of forbearances for the most part in this state and but we'll get a lot better Infor information said from that initial population. What we've got to use just just a no we don't we can't just kind of pulled us out of our hat we're gonna use data from servicers a national local and then also data that we received from the US treasury and specifically says in here that our plan has to be data driven
and so what what what we'll have data available that will let us know how four people behind how much help do they need how far behind they let utilities how many people are in for maintenance that type of information so we can be real specific about the program and make sure that the people need money can get enough to get themselves back on their feet and get hole with their mortgage and take the risk for clothes away. Senator Hammer you're recognized for a question thank you measure you mentioned nonprofit groups will you be working well well nonprofit groups like habitat
for humanity that have experience in working with this population be given any preferential treatment or they just be put in the hopper with everybody else on a case by case situation. I don't know how we would target any particular group it literally we are blasting out to anybody that wants to step forward and help us get there will be a portal website that people go to and I would envision to be a lot like rental assistance in that they go to the website they fill out an
application independently and it gets process to just like they applied for a mortgage with us in the application will lead to be approved or it won't and the disbursement be may how those people get to that portal. This is our first US treasury relief program we would like any input possible we want to blast it out to anybody who will listen any of the nonprofits that might be in touch with that particular population it can reaches are thank you and habitat is right. Yeah they're good part of ours And will be reaching out to

Are these people want to pay taxes on this money right now I'm I apologize madam chair no that's actually a great question you know at this time there have hasn't been any guidance released on that I can assure you that we have a pretty good relationship with about thirteen south the states that we work with on on issues like this and at this time the the guidance that we received is they're not going to have to pay taxes on this money but it's I I'm not sure it's been determined but you bring up a good question
about you know ongoing mortgage assistance and we have to prioritize in this plan about you know what is important meaning it you gonna target where where you targeting if you guys have any input on that and I was tell your thoughts after kind of going through this is we're looking at more of for people there in for Barron's people that are delinquent people they're looking for closure we're really looking at utilities I specifically you know with people being at home for school working at home you know internet if they don't have
internet or they had to cancel because they can afford it and so those are some of the things that we develop in this plan we wanna hear from you guys people that are in your districts in your areas what do I need help with are they behind under taxes utilities home insurance those types things because we have prioritises things you know so but to and to answer your questions at this point no I don't think that this is going to be taxable income but you know the final guidance hasn't been released by the US treasury I I assume that there's multiple

Thank you ma'am chair C. one or the cash fund appropriation increase request these request by agencies increases spending thirty four line items they're supported by cash fund account examples of cash funds are permanent license fees receipts from sales tuition and other revenue agencies collect that does not come from a general or
special tax request for proportionally the agencies have sufficient existing funding to carry out the request the following quest receiving approval recommendation from the if they were census committee for review. The first item is a letter from a issue Beebe it's requests increase appropriation by half a million to the capital alley line item the letter says distal federal funding was allocated from the higher education emergency relief fund our analyst rejects the school learned appropriation would be for technology and remote learning to cope. Next item is a letter from
national park college it's requesting Peace appropriation by three point five million to their operating expenses professional fees and Caffarelli line items some of the less item this request is also to gain the spinning at three needed to expand the positional federal funding allocated from the higher education emergency relief fund the same analyst resuscitate college learned of these funds will cover the costs of virtual learning. Our next item is a letter from the department of education Arkansas PBS it's requests increase appropriation by four hundred fifty thousand to a capital alley line item you
spent thirty will allow the division to replace end of life broadcast equipment this item supported by supplemental grant from the corporation for public broadcasting. Next item is a letter from the Department of Parks heritage tourism it's requesting fees preparation by eleven thousand four hundred fifty two for the mosaic Templars cultural center the speed three will allow the Senate to expend funds on the traveling exhibit the Negro motorist green book this item is supported by a grant from the Smithsonian for the committee's information center received a six hundred thousand increase
last June to the same phone center to allow spending from their capital campaign that was developing renovate educational exhibits. The next item is a letter from the department of labor licensing this is for the state board of barber examiners this is requests increase appropriation by fifteen thousand eight hundred and is being thirty allow the board to modify their existing database. And as reckon that was recommended by legislative audit I spoke with agency learned that due to the age of their equipment computers were no longer being supported by Microsoft legislative audit
meeting objective for the board to upgrade their current system to stay in compliance with the financial duties the board supported by fees collected from barbers barbershop colleges instructors and students now manager will go to the supplemental agenda. That is outside of your regulation the packet. There is one catch for an increase request on the suburban agenda and that's for the department of agriculture. It can be found on the third page of that packet. This is a request to increase appropriation by two hundred
seventy five thousand new spending thirty will allow the department to provide appropriation to the Red River commission for expenses associated with the Red River feasibility study I'm sure those are the cash center request on the agenda. Representive Eubanks thank you madam chair on the National Park college on their operating expenses as it is safe to assume
that was a math there. The increase they're going from three million. They said the increase was one point two and they still have three point two on that cell. I would say that safe to assume that just a clerical error. Yes we're getting confirmation of that thank you any other questions. All right without objection these items will stand reviewed. Thank you ma'am chair with the C. to this or these are the miscellaneous federal grant preparation quest he's requesting agencies to increase spending authority of federal funds resulting from an unanticipated federal grant award it's for a new grant programs or for large increases where appropriation was not previously incorporated into budgets during the biennium budget process into additional spending authorities need to spend the new federal dollars if a grant expires state state funds will not be used to replace federal funds unless it is later perforated authorized by the legislature each item has received approval recommendation
from the FDA and this is and they are sent to this committee for review the first item. Is for the department of finance Administration Management Services Division this is a request for thirty four thousand in preparation to spend federal funds they have a grant for the department of health and Human Services for activities of the State Council on developmental disabilities and this item is one hundred percent fairly funded. The next two items are for the department of health the first request for three point eight billion and the second quest that's in the next pages for
twenty nine million both are grants from the CDC for the Arkansas immunization program to work with the community to provide a vaccinations bonds for COVID nineteen and both were hundreds in fairly funded. Next item is item number four. This is for the DHS division of aging adult and behavioral health. It's request for thirty six thousand appropriation and they have a grant from the administration for community living for on button programs to investigate abuse neglect and exploitation in the context of COVID nineteen this item is one
hundred centrally funded. The next two items or for the Arkansas crime information center the first request is for a hundred twenty two thousand and the second quest that's item number six on the stage This for a hundred and ten thousand both are grants from the US department of justice to maintain tracking systems as part of the sex offender registration and notification act and both items are hundreds in fairly funded. The next item is item number seven it's for the department of education education television vision that's Arkansas PBS this
is requests for six hundred thousand in preparation to spend federal funds they have a grant from the US department of education to help mitigate learn lost during the summer because of COVID nineteen closures and disruptions and school schedules this item is one percent funded manager those are all the images in today's gin. can you go into a little bit more detail on what exactly you anticipate using these funds on and how long a period of time they're supposed to last yes Sir the first of four three point eight million is a supplemental to a previous funding award and this funding will be used to supplement salary support for existing positions within the department so M. it'll support positions in our office of health equity the office of information technology the office felt communication and then our center for local public
health which is our local health units it also will support efforts that were previously initiated under the initial funding award that was presented Earlier this year I believe in January February I don't know after the session I'm in my timeline memories shot I'm sorry but earlier this year so this will be a supplemental to that award it's primarily salary support the second award the twenty nine million is also specific to cope with vaccine efforts and this is additional
funding that we use to support capacity development eighteen point five million of this funding will go to private providers this is to enhance capacity it's to recruit new vaccine providers family practice physicians and pediatricians are targeted with this funding additionally with this we also have funding for EMS providers and we have a number of providers that would like to be able to provide vaccine when they're out doing events in communities you know when their
ball games in the fall different events that they've identified also freezers for local health unit some of our local health units need to be equipped with the ultra close cold freezers so that they can be vaccine distribution hubs so they're spending their and then also some vaccine coolers that are appropriate for use when they're transporting vaccine to local community events additionally we will have some funding to support staff audits that have
to be done for federal compliance purposes to monitor all the providers that are receiving vaccine and then also the committee sub grantees that are receiving allocation and I believe that that's the high level overview okay in so all that is strictly related co in nineteen yes Sir vaccine distribution yes yes our it's all related well it's not all distribution because some of it is so some of the money that the
providers can utilize they can buy freezers they can DO software upgrades to their electronic health record so it's not all staff and direct delivery some of it is infrastructure okay and and none of it has anything to do with that spread mitigation like contact tracing or anything like that Sir. to put the low temperature coolers in the health unit's there's three vaccines are available now if I'm. Right yes Sir only one of those require the low temperature. Of preachers right Sir the files are faxing is there a reason why Pfizer would not be funding that themselves see how they're selling the product so you could take that money and do something different with that. know enough about the agreements with files or to answer that question I have I really don't know how what arrangement they have with the federal government we receiving all of the vaccine free from the federal government so we don't actually purchased the vaccine from father that's all done at the federal level. Okay I wish you just maybe explore that question apply because of four metres three. Good vaccines out there now and we're and I noticed money come
down from the feds and but it just seems to me that that was something that files right to be paying the cost of that they want to get their products used and then maybe you could re direct the usage of that labor that otherwise would be for those preachers and and do something different I just wish you yes Sir I replied ask questions thank you. helping in this pandemic for education for our young people. Can you give us a quick bill what strings come with this before what you is there any particular criteria you have to push. Or things outside of what I would consider that normal education because we're saying this from the federal government a note no Sir this is the. A will be approved by the Arkansas department of education
and there's no there's no. The base is a requirement or instruction outside of the normal Education Arkansas educational programming that we would we would have to abide by thank you that's what I wanted to clarify Richey yesterday. These request by agencies to make a transfer among the five sub items of maintenance and general operation this is the event a certain item does not
have enough spent forty four inspected expense but another line item in the middle has excess or spare appropriation request for permission only the agencies have sufficient existing fan to carry out the request there's only one requesting the gym to receive an approval recommendation from the if name essences committee for review and that items for the teacher retirement system. This is requested transfer nine the nine thousand eight hundred from operating expenses to capital outlay the transfer will allow the system to replace the failed document scanner.

performance fun and there are five agencies requesting a total of five hundred thirty nine thousand and speeding at forty all agency site the both the appropriation and funding transfers are due to fiscal year twenty one performance increases and other salary imagine Justin's manager we do have more questions the supplemental agenda. There are two agencies on supplement agenda requesting pay plan preparation and those on the last page of that package. The social work licensing board and the board of optometry
request nine thousand one fifty five an additional spending authority both agencies say performance increases and salary adjustments as any for additional appropriation. All right do I have any questions on any of these PAYPLAN holding account transfers. All right. Seeing none will without objection will consider these reviewed I move on to reports. raise provisions of law either in Arkansas Code or an agency's appropriation bill requirement can report stale C. for information purposes in some instances a member of this committee may request agency at request the agency to submit a report regarding the matter to keep the committee better informed and updated. The first item is for the annual port for the higher education certification adequate funds Arkansas Code institutions of higher education required to provide any certification of these funds the LC this report shows the status of each
institution Henderson was not able to certify the next pages a letter from the Henderson university explained the inability to certify and what actions they are taking through to read solvency for the committee's information the university is not able certify last year either. President Dotson good morning everyone So I I guess I have two questions basically one with regards to the The certification on whether or not I understand where you're at and where I come up to do you anticipate being able to certify next year and then secondly is on that six million dollar loan is there any chance that we might be looking
at early pay off on that before the time expires. to your first question our hope is that yes next year we would be able to certify this. Still we're not comfortable at the time we had to submit it this year obviously that that we could certify that and that actually just FYI for all of you members next year the certification will change as a result of some of the issues that came about through Henderson legislation that you
passed early on in the session this information when Allen including the future the number of days cash on hand as well as some other information to try to prevent. The situation that occurred Henderson from happening again in the future you will have more information than you've ever had for me to institution going forward in regards to that so something did come out of the situation and hopefully will help prevent others but our hope is an act I give the cabbie ought to that Richmond Dotson.
In Rome it's going to be the challenge for everybody next fall coming out of the pandemic every institution across America took a hit to enrollment our hope is that it's a little more normalized this fall which obviously that's what drives your budgets is enrollment us our hope is to be able to certify the. Next year in regards to the six million dollar loan from the state obviously there's still a month and a half left in this fiscal year. But our plan is at the moment depending on how we in the
fiscal year to make an initial payment at the end of this fiscal year that would not be the six million dollars but it would least be a good faith step forward and shows that certainly we've come a long way in the last year and a half since the the issue system's been involved with Henderson and that's a credit to our staff finance officials and Henderson staff for the work they've done and I will remind you did Henderson employees are
still receiving a cut to their salary and to their retirement benefits that resulted as of all of this last year that's still is in place so we have a number of things we hope to be able to restore one is to pay the loan the others to restore their loss of income and retirement benefits. and also have reserves going forward where we can address situations on campus so our hope is that in this fiscal year to at least make a payment which. You asked me the question this

Thank you measure the next section are are quarterly reports first we have on this agenda will be the Office of Attorney General cast settlement fund this report that shows quarterly cash account activity report details eight settlements and shows the balance of the cash fund cash receipts

Is a DTC the state police this is report shows asset forfeiture expenditures for each quarter of the fiscal year the first page report shows thirty seven thousand expenditures for the third quarter out of the TPC zero one hundred fun this is the phone for federal asset forfeitures and on the next page of the page behind it it shows seventy eight thousand expenditures in the third quarter out of the TPC zero two hundred fine and this is the
phone for state asset forfeitures. The next two items or reports for federal grant applications and awards these reports show all federal grant cations ward by state agencies in the third quarter of the fiscal year twenty twenty one. The last report is the eighty Q. status report on Bellavista hazardous waste removal and the support of our by special language agency or C. twenty million additional preparation
and the ability to receive ten million in loans from the budget stabilization trust fund to remediate the underground fire site in Bellavista according to the report total expenses incurred by state today are one point three million hundred thirty three dollars of that were expenses made the last quarter all expenses have been paid out of the hazardous substance rebuild trust fund and a loan from the budget stabilization trust fund is not required the Bella Vista property owners association assumed ownership over the project and completed fire suppression in June two thousand nineteen and is currently
working on restoration plans. Reports state agencies actively investigating potentially responsible parties who could be held liable to the state for costs of remedial recovery actions at the site.
