First we have an agency request to codify some language the purpose of this agency change stagger Dalton is that page thirty six thirty six to thirty eight yes thanks sorry. So this is an agency requesting codified this this language with some changes to the existing language the purpose of the
agencies change here is to codify our start to add administration service services to The other divisions are allowed to request we are allocations within the department executive recommendation is for continuation of the current special language. Senate next we're gonna move to page forty one. So this language ensures any fund balance remaining in the county jail reimbursement fund at the end of the fiscal year is carried forward into the next fiscal year the agency does request to codify but executive recommendation is to keep the keep the section a special language in the bill.
next removing a page forty three. I said this is a this is the leasing of special language in the Division of correction bill because it's request to be codified in the community corrections bill so if you turn to page ninety six of your manuals explain that. On page ninety six we have a legislative recommendation to codify this language and this language simply establishes the required monthly report county jail reimbursements which is to be compiled into an annual port at the end of the fiscal year
because it doesn't need to be codified twice we just decided to codify. The language in the Committee corrections bill executive records also to codify this language just to clarify the language that we're deleting is the language that you will now find in page ninety six just for clarification thank you thank you. Hi here we have an agency request to codify this language in this language allows the agency to transfer general revenue appropriations funding to the county jail reimbursement
fund in order to meet reimbursement requirements. At executive records to just leave this a special language. Page forty five next page both legislative and executive recommendation provide for the codification this language this language requires the association of Arkansas counties to submit a report annually on the cost of housing state inmates in local facilities. At eight forty six our next section hi Leslie recommendation here's the codified this this language relates the
transportation of juvenile offenders the telling of the agency's rules provide reimbursements and grants to transport juvenile offenders the proper facilities executive recommendation also provides for the convocation this language. Next we remove the page fifty eight of the manual. So there's a legislative recommendation to codify this one as well this language requires agency to create a biannual employee compensation report.

Hi here we have a simple technical corrections you may notice on the second line that there's a double space after the common this this correction is fixing that. actually on page ninety eight I believe we have our last piece of special language. This is a legislative recommendations codify this language requires a quarterly report of the they can parole officer position along with an
average of case loads for each parole officer executive rag recommendations to codify this language as well. Why is that needed or necessary not necessary here. Separately the from this process the department is working with the office of budget in the office of personnel management all with under the direction of the board of corrections to submit a proposal to the next general assembly next administration that would take our hazardous duty from a unfunded compensation liability that we have to fund through salary savings and roll that
into the base pay for those officers the thought being that this is not really what a differential was entitled for because it this is a on going permanent part of their job working in a correctional facility so instead of having to float this and pay it through salary savings were proposing working on a proposal to roll this into base pay if that is achieved then this wouldn't be a of relevant part of this report because it would no longer be
considered allow a liability and be part of a spy. So Absent that happening this is only to stay in the language. Yes which is what from. Is absent that happening yes. so since since this is a code amendment this would be going permanently in the code I wonder if this is something we shouldn't. Hold off doing a code amendment

What is gap time liability I'm not familiar with that terminology. so gap time is also referred to as straight time this is the amount of time that we pay of four officers going to shift briefing clearing security that part so is actually eighty five hours six eighty six hours that's on a normal check instead of the standard eighty that
extra six hours is was considered gap time. Okay and the appreciate that answer that helps me understand it also it says hazardous duty compensation I I kind of thought the all of it was hazardous duty but yeah can you give me an and that would be our position were represented to us as a said representative dot send us while we're working on a proposal to roll that into the base pay because we think it is an in an inherent part of the job of a correctional employee.

What a transfer a hundred thousand dollars Show that you've got a deputy prosecuting attorney who I guess will handle all the prosecutions of offenses occurring at the Arkansas department of corrections yes Sir so.
How's that being handled now I'm just curious as to how differently from this was language that we worked on with the prosecutor coordinator's office in the twenty twenty one session so we're just got that off the ground at the end of FY twenty two we have established a imho you with the prosecutor's office where this DPA is alles with this does is a predominantly handles cases out
of Southeast Arkansas and has and also has the ability to be deputized to handle cases out of East Arkansas we realize because of how our facilities are cited it does place a significant burden on the prosecutor in Southeast Arkansas so this provides them additional capacity to handle our cases because we want this level of accountability for got criminal activity within our system we
had no objection when asked to pay for the position. Make sure I understand of. So this deputy prosecutor he will be a signage. Strictly to the department of corrections that are me is yes. Full time job is correct yeah I understand she will the current encompasses us a sheet but yes the prosecutor is assigned to handle cases originating out of the division of correction within the judicial district and any other incidents of offenses
occurring within side the US department of corrections yes other locations throughout St would if they were if they were to be deputized by that elected prosecutor yes Sir okay thank you. Thank you. A special language cannot as a code amendment until the Until the plan the department has is worked out during the session we can always make an amendment during the session and make this a code amendment or a strike that language but until that. Agreement is made or that language is put into place. I think we need to keep this a
special language as the current executives as the current agency request.
