A committee sample or two if you don't you don't copiers for example we have multiple departments that have multiple copy your contracts we get a contract in from that contractor it's a total amount instead of copy instead of writing one check of multiple checks for that particular account will write one check coming out of that single payer account for that care thank you for the X. motion thank you a representative board also. And then we're going to run out of number three which is myself and if it's alright with their when I was gonna run it from right here. this is billed simply allows the motor vehicle commission to use our fund balance to fully fund the grant that they have for technicians that's actually a miniature through the department of education a career and I believe and this will just allow them currently do use their funds to fully funded up to two hundred fifty dollars two hundred eighty thousand dollars currently we have them cap that they can only use five percent of their fees to do that but they do have an excess fund balance and I want to be able to continue to find that fully so that we can get the grants out to the people that need to use it and that's really all that this amendment does. Senator Hickey recognized is there a maybe you can representive I'd like some little bit more detail on the on the program what exactly what exactly does this do and how much we've been Fund in so far so I want to know why I see that it's up to two hundred fifty thousand but what what is the actual increase from where what we've been doing. If you'd like to come at the thank you probably answer that if you don't want to come down my understanding is they had prior to a bill that we changed back. Two sessions ago they had actually been administering this themselves and have been fully funding it but when we change the new bill we capped at that five percent that they can send over to the department of education and career reading us I believe to actually fund it in the five percent of the fees was not able to actually Max out the two fifty but they had fun balance and they just want to be able to use their fund balance to make that out to what it had been prior but if your reckon you don't introduce yourself and you're recognized. Good morning my name is sandy stripping on the Director of the Arkansas motor vehicle commission and if you if you would and I hate to get up that needed elementary thing what I guess first of all the autumn automotive and technology you know what whatever that is you know what exactly are we doing with that. And then also how how's it been funded before because I'm looking at this five percent of fees so if you could just kind of give me the the total thing because I'm not I'm not aware of this program sure can go back to beginning on the on the funding of prior to twenty twenty one when the bill is passed that the established the fund that we are now going to be putting money into it we had appropriation in my commission for up to two hundred thousand dollars a year to put into training and education of technicians for the automotive industry and that was appropriation from the legislature and then when the bill passed in twenty twenty one change that it took it to the actual approval of spending that money away from the commission and put it over in the hands of educators and in the same time it put in the funding of five percent of the total amount of money that we collect and we collect in the neighborhood of four hundred and seventy five thousand a year in fees licensing fees from the folks we license and so with that is it limited us to below five thousand dollars a year going into that fund up commission of five percent of the funds so that limited us on the amount of money we could put in and what we're saying now is we do have a little bit of a surplus in our ballots and we would like to go into that surplus to add to the five percent this in the law and be able to fully fund the two hundred and fifty thousand. Okay but just to. So what your intent to it your intent always do a minimum of the two hundred fifty thousand it is just but there's also a cabbie out there and that we would always maintain at least three years operating fund but right now we actually have a surplus coming in each year because we've been rather frugal since we moved over into the department of labor licensing and we custom folks and so we have a surplus coming in each year we're gonna be putting all of that over into this to this fund was taking some from our ballots so for the time being in the foreseeable future we will be able to fund the full two fifty each year okay. I don't I don't know that that I have any issues with what you're doing I guess my next question is going to be why special language because we've we just went through a large re work of our total special language you know to try to things that need to be you know in regular legislation in code or whatever that we would do it that way why why are we here because you're going to have to be coming back year after year after year to do this. Okay I appreciate that Sir but We don't have a problem with coming back if you don't have a problem with this coming back we just want we don't have a problem with coming back in in letting you know that we're being in good fiduciary of funds we just have a. We just have a surplus in fund balance here this is an opportunity for us to return some of these dollars to the community and that's what that's best way we know how to do it and we don't mind the oversight on a yearly basis because you need to understand what we're doing with that that those fund balances I think we can do that in budget hearings but did respectfully but the you know I I appreciate your willingness to come back but the this committee for the last. All thirteen year or however many years that I've been down here has always has always tried to say well if you know we need to get rid of all this one this special language it keeps coming back and coming back and actually putting it in legislation so I'm just I'm real confused as to why we're not taking it through the regular process I mean. Maybe you'll get an update on something else. Getting that application out to the folks they can use it in that secondary folks that are training tax and that's also high schools their training text of so vocational education in high school and they will apply and then this group will take a look at it Cody weights is the one that's kinda heading that up and he will they will look at it and make recommendations on who needs to be funded and I know this doesn't sound like a tremendous amount of money but we've been doing it for several years and we've handed out over a million dollars over the last few years and in funding for special projects and what it really does is it takes solely a tech of program that's in hi I'm I'm from Harrison so that's out there it's community college at Harrison. And it allows them to buy some equipment that they would not have more funds to purchase and in a it's not huge things but it's things that really do help those instructors a tremendous amount of makes it easier for them to to do some things that they need to do. Senator Hickey. Just for clarification clarification. This is going to be a code amendment. And so they won't have to come back okay was as stated on the front end or did I just miss that no it wasn't stated okay okay yes it is it is a code amendment so it won't be I won't have to come back okay then I have no issue with that. All the applications themselves the the applications actually come from institutions not from individuals not from students to become from institutions institutions fill out the application sentimental us a committee will look at him and make recommendations on which ones to fund and then the money will actually go to the institution. Yeah but I've been so why have they not the institutions not come to us as soon as for more money or anything they're pretty good at asking money unless things have changed since four years I was going. Sorry I can't answer that one I don't know what. So all these surplus funds I mean I go back to back we had a budget before bailouts and you know just because you have extra funds doesn't mean you need to spend it I mean. If we are go back to the days I have a budget shortfalls which I guess you know seems to be a four guard conclusion that you know with the way things are done out here you just always want to give bail out the. I mean I don't see this work is it's not critical that. I mean I'm not here in my district I mean it's not. We just have to spend it because we got. No Sir not at all that's why we have a provision we want to maintain always three year operating of a fund and and of money to operate on a three year basis but when we do have access and fund balance we think it's only a property try to return those funds to the public where we received them from so it's a way to it's a way to continue to do that I can't speak to why they where the institutions or why they're submitting the applications in the way that they're doing we do know that we want to be able to spend the maximum of the two fifty and we think this is the best way to accomplish that well I understand that the the institution said provide any documentation Hey we've got a critical problem here we've got seventy six people wanted and we only have this eleven out of funds they haven't explained any problem to you to see why they need to have more money. Just for the record there is a bill that will be coming introducing and state agencies this morning that deals with fund balances and how they will be able to use those and what they'll be able to do with them and this particular is not and and I needed expenditure this is about education and from someone who's in the industry we desperately need trained technicians and this program has been gone on for ten plus years and has always been able to do that they have always been able to find it two hundred and fifty thousand unfortunately when we wrote the other language get limited then be unable to find it to the full amount all they're trying to do is to find out what they have historically funded at. Is is that whenever we're looking at the bill where it says code amendment I guess that's an inquiry to staff. Yes Senator Hickey anything that you see this is code amendment is going to be altering the code either adding a section deleting this section or just amending what's existing language okay and but I guess I guess my question after after this when when this one's past you know if something's going to be going into code like that why and why do we not take it to our normal normal process so why are these bills like this why are they not not going to be filed taken through the House taken through the Senate taken through whichever the appropriate committee is and then all on the floor I mean it just seems like to me that you know this special language was supposed to be it was always my understanding was supposed to be from year to year and that there was a possibility that that was going to change but to say that we you know we're just going to start to taking through something through this one committee which I understand it is a joint committee but it's really not the standard process done like me in establishing law so I guess a. That that's more of a statement I guess is an enquiring about I think that the I'd like to kind of know what this body would like to do with that and if I've got a missing something I'd like to know. Making amendment to a an appropriation bill that would after we. Approve the amendment will go back to joint budget will be voted on as the appropriation be voted on and then depending on whether to House or Senate bill it goes respective and then goes through the process and so I mean I think that's that's my understanding of why language like this language that is modifying an appropriation that is setting announcmenet that is directing or limiting uses of appropriation that's why it comes through budget as opposed to being a piece of substantive legislation that would go through the other standing committee process. So. Thank you for that Mister Speaker but the from you know from my from my understanding you don't that affects whatever that code section is you know that that would come through education in the Senate I understand this the appropriation but I guess if staff I mean is is this normal is this the way that we've done this for years or. Thank you madam chair Kevin Anderson pure of Legislative Research yes Sir there's there is some history with special language in amending many code and special language it is a policy decision of how the committee wants to handle it it's it's been done both ways there is there is a long history of amending code and special language when when the fiscal session was first started there was some fear that substitute language would be you know what they're not supposed to take at any any substance language in a fiscal session right except unless unless they get a denticle resolutions prepared by both houses the first a fiscal session so there was some fear that point that substantive bills would be run through special language as a work around. they they history is that. The that when I had it happened you know there was there was nothing preventing that so code has been amended in special language It it really is a policy decision if they want to say no if you're going to amend code you need to do with a substitute Dale but like I said there there's nothing preventing what you're talking about eighty we when we do get that we advice legislators that you know this could be done to see substance language a lot of times when it does deal with like just like the Speaker says specifically like this piece of language does without balances or appropriations it is appropriate to be in special language. And then also if the if you amend code you get it out a special language so it's really a conundrum there's you can do it both ways and it's a policy decision. there's nothing preventing amending code at special language unless the committee just says we're not doing that you got to do it a different way sure and some of that I knew of course and yes yes mother members here that I want to want them to fully understand this to an ice I mean from my standpoint I just think that we need to be very prudent very very prudent with the what we're gonna allowed to do that way and I think at the very least the madam chair of the. Before the start of that if this is something that will be amended into the code will be a one time thing that we just kind of bring that bring that to life for the for the committee as we store so that if there is a particular bill that we think needs to be run through the entire the entire process I'd like to see as to the. Representative Jane you're recognized I just if you've got a substance bill sitting in state agencies that hasn't been run yet and that will be granted without dealing with funds in the past a lot of what times we done we we waited till the substance bill passed before we pass the appropriations of we get this out today we can put a hold on the S. to the substance bill goes through both chambers yes Sir okay thank you. Thank you madam chair committee representative Lee Johnson district forty seven I. see give morning to learn some things today good to be here so as I understand it. this is not to be incorporating the cat so this is special languages I understand the Amendment that I have in front of you so there there was established sometime in the eighties I believe the Arkansas impaired physician and dentist act which was designed to try to address impaired healthcare professionals impaired meaning addiction alcoholism and or mental illness as part of that process the established the physician health committee to the Arkansas medical society those all status it statute the Arkansas medical foundation is a not for profit institution that is always been funded through a portion of the medical license fee collected for physicians we've we've tried traditionally always collected twenty five dollars and set that the Arkansas medical foundation the medical foundation works in conjunction with the physician health committee a committee to provide recommendations for treatment and to help with ongoing monitoring of health care professionals who were in some sort of Treatment process again most of these end up being something like alcohol is a more or some sort of drug abuse issue and and so they help make recommendations regarding treatment make sure that providers are following through the treatment and make sure that they're keeping up with the testing and then you know when they are ready to go back and practice they're part of the group that makes those recommendations they are to the F. position health committee as as we all know you know the addiction opioid crisis is gotten. To be a bigger problem there was in this act was established in the healthcare profession is not immune to that it's important make sure that our healthcare providers or appropriately treated in and we want to try to get them back in the work force if we can set up the funding for the Arkansas medical foundation it really needs to be increased their the burden of work that's been placed on them of the last two decades has markedly increased initially it was mostly physicians and now they have extended to treating quality dentist podiatrist sometimes nurse practitioners or getting involved in nurses this bill the minute you have before you at it it. Collects the fee from the add dental board licensure fee and collectively now from the podiatry a license fee is not an increase in fashion really say that it just takes a portion of the fee that's paid input set towards the Arkansas medical foundation and that's what this amendment does and I'd be happy to take any questions on this amendment I have a question. It says delete twenty five and substitute thirty so are we not rights in the face not on my understanding on that so it depends on which one you have one about president I think this this is I may be present in the wrong one I have to this is. Wait no sorry there is there is a raising the fee for the medical physician search going from twenty five to thirty six in duty they were collecting and again it's not a fee we're taking a portion of the last B. we are to collect on the doctors and dentists but we're increasing from twenty five to thirty the current collection positions yes you're correct. But down there it says that for the treatment and monitoring of health care professional professionals is that just dentist or is that any and all for healthcare center so the fees are only collected currently from the medical board from the physician fee okay the board that medical foundation self treats a variety of health care professionals not just physicians and they continue to intend to treat any physician referred to them from or or any healthcare provider referred to them from whatever board happens referred to we're only gonna be collecting fees right now we're only collecting twenty five dollars in a fee from the medical board we're gonna be adding a fee from podiatry and dentistry to help support those the bulk of the providers but they're not going to turn away providers that are sent to them from the nursing board or somewhere else but we're not collecting a fee from the sports okay so it the America Foundation self will continue to treat any impaired healthcare provider this referred to them that the fees are only can be collected from these three entities okay and the date dental they're all they're all okay with this there's no or the neutral or they in support of it or what my understanding is supported by a I defer to Mister Gilmore from the parks felt that your skin is going to come stay will recognize so please and may I ask a question real quick representative my understanding is that this actually says fifteen but you're wanting to make a verbal amendment to ten is that correct. Representative Johnson is correct this was something that the this is totally been done in the past the medical licenses for doctors and. A physician's deos have paid for the bulk part or all of the treatments have been provided to this foundation and I think the thought was that there now also treating Dennis they're treating some podiatrist all other physicians and healthcare professionals in those licensing boards I think the thought was to kind of make it more uniform and share those costs across those different professions and those licensure fees as far as supportive I thank the boards or neutral they understand they have fund balances and they need to try to get back to those professions and be supportive of the where those licensing fees a come from and so up I don't that helps answer any running clarity there. I'm back in the by questions was are they if they are the dentist are they neutral owner in support of that are we not that there's I have talked to the boards in there they don't have an issue with it is not in opposition to it so I think they see the need for thank you Sir yes Sir. Thank you madam chair I think some of this comes from and representative Johnson please correct me where I messed this up but we've been meeting for since budget hearings over these fund balances and how to get him down and how to give that money back to the professions of whether that's through a cut in the fees are through something that's beneficial to that of that group whether be the Dennis with doctors or and I think this was an effort to do that and they're already getting the good out of this are just now going to share and some of the cost. Free representative Cavenaugh and senator Hammer have a bill later today I think it's coming state ages and house first today that allows the boards and commissions cutter fees up to ninety five percent so a couple of these amendments needed to come through. In order to to get that call spin out so that they didn't cut those fees up to ninety five percent and not have the money for these things I think the next amendments moved five hundred thousand thousand dollars for education scholarships. Those things are to take place so that after that they can be assessed on the three year average and then move forward did not did I miss you a representative that's distinct Committee need to understand the whole picture here to serve what's going on I think that's exactly correct I don't know the exact fund balances in the three different boards were dressing here there certainly are fund balances and all three of those boards in excess to the point that we want to try to find constructive ways to spend that money in this is certainly in my opinion a very constructive way the service that the Arkansas medical foundation offers is unique to the state there's really no one else in that space offering this kind of service and as we mentioned before you know it's just unfortunate the number of people across the board struggling with this issue is gonna happen with the workforce shortage we have and healthcare we certainly need to try to get these physicians and doctors and dentists don't the back of the work force if we can and the foundation is the key to that. Back on the court health you mean as far as the actual renewal for those licenses yes or so thirty dollars for medical I sense out of what. I'll let you look at a physician like I know my it's that is somewhere in the ballpark of five hundred dollars yes this and that and annually yeah and Dennis is going to be I think around two or four hundred and I think but I addresses quite a bit less like seven five hundred okay in in S. as far as the verbal mimic cares I'm I'm fine with that that's what Joe it's exactly what I wanted if I understand the verbal memory correctly we're changing the fee from fifteen to ten for the but I've got to report. I think the thought with that was just because it's such a smaller group of licensees and they haven't had as much interaction with the foundation so just make a smaller amount and if they're if they're overall number of smaller makes some other questions are really answer which is what was this money being spent on but it sounds like it would really be expense so this is what it is it's in their fund balance in this will help get that are thank you. Senator Keith you're recognized thank you madam chair so like in special language if you go back past history thing mean people's with freezing over special language probably know a lot of things have happened we had a big court battle case up in my district that was over initiated from special language I mean is it to mass asking the committee that if before you present these amendments whoever it is or whatever agency that you provide more documentation rather just walk in and say something and give us ahead of time I mean like Senator Hickey trying to bring up the past information about the program ask questions me my question like this is like you know simple things of how much money is going to bring in I mean how much where is it going to be spent specifically not just put into a fund I mean most the time when people come and say it's gonna be put in the fund I mean let's just be honest they know where they're going to spend it ahead of time this may not be the case but. and how much is it to say just come in here and give us some past history you know provided today at two at a time you're going to spend money increase a fee which I voted for fee increases before sometimes are needed I mean we had a question of like didn't Attorney General turned back a bunch of money to general revenue over opioid settlement money for remember that right. Yes. Four but. There's a lot of avenues out there in the open settlements you haven't looked at trying to get some of those funds to do something. So that just to be clear we're not raising iffy so the fees stay the same we just re apportioning a part of the fee out of the fund balance out of the out of the fund it would normally go into towards the medical foundation as far as what we spend on any specifically spent on the operations of the have the marks on medical foundation is a nonprofit entity doesn't have any revenue stream the only money they get is either from donations are from this allocated funding from the portion of the fee that's allocated currently just medical board so we're not really increasing the fees were just reapportioned UP that's there and that money's is pending again on the operations of of this entity that's required to monitor impaired healthcare providers across the state as designated by the Arkansas appeared position and then the stacked up the the money I think your your question on the moneys be reason why politicians for not having that information to that welcome back before this committee I'll have those kind of details before us and present and for the overall presentation I guess I would defer to the chair of the committee to decide what what to send out. Members that's this is amended to the same bill Senate bill and thirty one this is also a special language not to be coded this is a one time transfer currently right now the medical board does have a pretty large fund balance until this round fourteen million right now some of that is tied up in operational fees that will be spent over the next year as a part of the operating budget I think at the end of the operating budget last year we had around four million. Some somewhere in that area but that there was it excessive balance part of that is because the way we change how we practice medicine you know medicine is move towards more telehealth and so the way telehealth is set up you have to be licensed in the state not where the physician resides but where the patient is receiving care and so because we use a lot more telehealth now in Arkansas we have a lot of physicians getting license in Arkansas that don't live in Arkansas and that's happened in the increasing volume over the last five years to the point that we are collecting more money than we traditionally collected from the medical board fees just because we're licensing more physicians to so we do need to look for good ways I think I look forward to seeing representative Cavenaugh center hammers bill to try to spend down some of these fund balances in a constructive way this is a constructive expenditure that money this is transformed five hundred thousand dollars to the graduate graduate medical residency expansion program is a program set up in twenty nineteen to try to find funding for graduate medical education graduate medical education as part of physicians training you have to do essentially percent apprenticeship which is a residency program this unnecessary step to become a fully licensed and practicing physician we've done a lot in the state over the last five seven years to increase the number medical students were training but we're struggling to keep up on the backside with the residency programs these medical students need to finish their training so this was an opportunity I think for the medical board to take a portion of their money and put it towards this purpose which I think is very good purpose to help bill more physicians in the state and I'd be happy to try to answer questions about this transfer were any questions the committee ****.
