Senate bill two sixty four. Senate bill two sixty four by Senator Irvin to amend the Arkansas social work licensing board removal racial requirement for membership of the Arkansas social work licensing board and declare an emergency. And Irvin you're recognized thank you members and this is an issue that has come up with in a court cases and is unconstitutional or maybe not language based on those facts be happy to answer any questions.
Any questions Senator Chesterfield you're recognized for a question yes thank you madam chair Senator Irvin when was it declared unconstitutional and that there are some issues that have been brought to light by our attorney general's office and and and some others that have been working through the language of of our current to make ups and this is something that may removing this quota would allow us to not be discriminatory in nature.
So there has been no. There's been no court ruling on this now there is there's the. Eighty Griffin. I think that there's a problem with. I think there's just issues with the way there have been other organizations as well that have pointed out some of the issues and some of the cases that have moved through the court system. Any other questions for Senator Irvin.
Anyone wishing to speak against center Chesterfield you're recognized to speak against. Thank you madam chair ladies and gentlemen this. All of my life I have tried to work for equity equality. In this great state. There is a reason that these requirements were put into place and that's because nobody ever seem to get around to appointing
anybody of color to any of these committees or commissions. I'm going to exercise my own hubris here. And say that I believe that I bring something unique to this body. The only somebody who looks like me and is that in my life experiences can bring to the conversation. Maybe what I say doesn't matter to you but it is important that people who look like me have a voice at the table.
We never had one before these were put in there nobody ever saw fit to appoint anybody of color to any of these commissions in spite of the fact that there are large numbers of minorities represented on these on these boards and also who are whose voice needs to be heard I think it's important for people to see folks who look like them. Maybe I'm foolish but I do. I believe it's important that people here a perspective in social work that is not your
own. Maybe I'm wrong but I believe it to be so. I believe that in this great state of ours it is important that the totality of the person to make it up I have a voice we never had a voice before those of us who are people of color that's why these were put in here there is no constitutional amendment there is no company or is nothing before the court.
Nothing this is there's anything untoward about and they have been here for quite awhile and now we're going around systematically removing anything that has anything to do with minority participation in this great state I think we're better than that I would urge a no vote thank you. Thank you senator Chesterfield anyone wish to speak for. Anyone wish to speak against. Four four. Senator you're pretty close.
Thank you members enclosing I don't disagree with anything that Senator Chesterfield side but the way the language in the way things are written do matter and have consequence and I'm just going to point to you to the emergency clause and I'm gonna read it for you it is found and determined by the General Assembly of the State of Arkansas that the current membership make up of the Arkansas social work licensing board contains an unconstitutional racial requirement that requires the governor to meet a racial quota when appointing members to the Arkansas social work licensing board when similarly qualified
Arkansas citizens would not be considered to fulfill any open positions until the racial requirement has been met that. And that the practice of social work affects the public health safety and welfare and the Arkansas social work licensing board is tasked with ensuring that the public health safety and welfare through the regulation of the practice of social work and that this act is immediately necessary to ensure that the open membership positions of the Arkansas social work licensing board be filled by a qualified citizen of the
state regardless of race therefore an emergency is declared an exist. Sullivan Tucker Wallace any senator wish to change his or her voter. C. nine please cast a ballot. By a vote of thirty forty eight zero nine. H. the eleven ninety one passes returned to the house H. the twelve twenty four twelve twenty four by representative Bentley Senator Stubblefield to allow a redemption date or sale of the the council and the penalty imposed if the payment and
instrument used to redeem or purchase tax delinquent property fails or fails or is this honored. Senator Stubblefield you're recognized thank you madam president. House bill twent twenty four cents to allow a redemption date for sale the to be canceled in a penalty imposed the payment instrument used to redeem or purchase tax delinquent property fails or dishonored. one of the growing problems with the Commissioner of State labeled lands is a number of hot
chicks that are being issued for delinquent parcels and partial redemptions in the last four years a hundred fifty for bad checks have missed have been dishonored submitted for payment needed or just honored for the payment was stopped by the purchaser purchaser our redeemer that added up to one million six hundred thirty seven thousand three hundred eighteen dollars of its insufficient funds are bad checks a growing problem seventy four those check for bad.
Section twenty six thirty seven three seven three seventeen simply duplicates language found elsewhere in the Arkansas code it allows a commission state lands to implement a penalty ten percent or twenty dollars whichever is greater in the bill to pay or stops payment. Or the payment is is honored that twenty ten percent or twenty dollars that simply matches what D. F. and I. eighty currently has in its code it's existing language that DFA
currently has an immense prior stops payment or the payment is six honored this language is a duplication language found in department of finance administration. Primary problem is that when you write a hot check. You have a second chance of the pay he and all of a parcel up for sale at a TAXDELINQUENT our auction can redeem the property by check just prior to the sale. And then stop. The check will be good and then
the commissioner of state lands is stuck with that partial for no the here you cannot sell it for another year. Personal purchase the property tax delinquent auction travel to a partial side after the purchase and decide how to make the purchase one of the examples he gave was a purchaser from Minnesota purchased the property in excess of sixty thousand dollars travel to the property after the sale decided not to go through with the sale so the other state purchaser then stop payment on
the check. Let the Commissioner of State land with. Sixty thousand dollars worth property sped business for the state of Arkansas. Close would take any questions. Any questions. You're recognized for a question. Thank you senator Stubblefield opportunity bill that certainly sympathize with the Lancaster's office on the hot check issue
shares of ever had US currency or cash balance. Not that not yet thank you. We get going on this little bit options. Any questions. Anyone wish to speak against her for. Senator has closed. Any objection rowing the boat. Madam secretary please well that Boyd Bryant's Caldwell

Any senator wish to change his or her vote. Dotson president. The other senators. C. nine please ask the ballot.
But at thirty three eight zero nine am one president. H. the twelfth twenty four passes and returned to the house. H. B. twelve sixty three. House bill twelve sixty three by representative Richmond center Stubblefield to amend the law concerning the sales and redemptions Tax delinquent property and declaring an emergency. Senator Stubblefield you're recognized. Thank you Mr president. House Bill twelve sixty three.
Let me give an example if you senator senator Dismang goes to the sale. And he takes a million dollars in cash with the. He buys a piece of tax delinquent property he paid for with a million dollars. Then he goes and helps the guy who owns the land redeem the land back. Then the commissioner of state lands has to send it is dismaying a million dollar check. So he's paid a million dollars. Could be stolen money the next
way to launder money even the feds and state of doctor Commission state lands about this problem. They don't have to by Senator Dismang back million dollars which they do not report to the IRS. But then the guy who owned the land. Can can stop his check. The reading the land for an the state has to hold the land for now the year before the seller. This will stop at. Second even as you were individual what to see if parts
settlement for the routing property doesn't property selling today could be redeemed by redeemer who simply want to see if the property sold at auction or not. Of. Up to a hundred fifteen thousand one and thirty five parcels it's going through the process of being retained within the ten day window at least once and then return certified to the commission state lands as tax delinquent. One parcel has been certified here's TAXDELINQUENT ten times and has been retained in the ten
day period every single time the next nine round trip parcels it gone through the process the same way nine times. Commission state lands is a budget to process a refund of somewhere in the range of twenty five million dollars simply too large part just a money transfer process that can be totally eliminated by the passage of this bill. But for some of a field center Chesterfield you're recognized for a question.
Thank you madam chair currently centers to help me. We have a problem. From the country my. Land say and pulled off the Arkansas state out of state and state so people from out of state can't buy land here is it what is like to buy land. Okay I'm just totally can know people from out of state but later. People from out of the country.
I think so yeah. Forgive Ballinger already current law we creating this. And what is the problem. What is the problem yes I'm trying to fix the problem the problem is if someone brings a million dollars to a TAXDELINQUENT sale. Page the auctioneer commissioner state lands a million dollars and then backs out of the sale the commission state lands has to pay him back with a check.
With the Commissioner state lands transfer million dollars back to little rock. Okay. Not me one thirty three an individual entity whose home of record is outside the United States is prohibited from purchasing a tax delinquent parcels. That's all that's all in all it already and what you're doing is what.
Just keeping somebody from being able to launder large amounts of it through the state lands. All right thank you and tell the conviction. Thank you senator any other questions Senator Tucker you're recognized. Thank you madam president. Senator these are options only for people who haven't paid property taxes rise not for a loan or anything of that sort Tax delinquent property. so my understanding is that
currently a homeowner they can redeem the property for up to maybe ten days after the option that that's what this bill is address correct two names that so what what I was made aware of is that somewhere in the neighborhood of a third. To half of the people who within their homes do it in that ten day period after the auction have you have you learned that are that but for those who don't. And they can't select checkers both payment on it check the last day.
It has to go back to auction. Right but I'm just. People in their homes through this process because they have to pay property taxes and so I'm just concerned about people losing their homes and a lot of people with the the taxes after the option up to a third up to I have we're getting rid of the opportunity for them to do that with this bill and and we're gonna be putting some people out of their homes they still have Senator to the Steelers for for half years.
To redeem that property. The sale of our forty four half years for for that yes before the auction. Yeah the red they are notified for forty years that's plenty of time okay so this is this is the anti Christ look at I did. Anyone wish to speak. Okay.
Senator Hammer you are recognized for a question thank you Senator Stubblefield as this bill in reaction to something that is actually happened either in state or as happened in other states and by any chance that the land commissioner weigh in on this bill. Well this is our land commissioner bill because they've been spoken to by the fed in the State. A law enforcement about transporting large amounts of money okay so this is all a commissioner bill you're correct. Okay. Anyone wishing to speak against
or for. Well I'm gonna go ahead and do this for I thought so I'd admitted disclosure in committee that I do work for a company by sales tax on the properties you have all heard this before for quite awhile now I think it was not at the top of the notice packet so they're gonna read that best wanna make you aware that I do buy sell tax on property via some particular questions of a bill to help with those two but. Thank you madam president so we have nine technical corrections bills on the calendar for today I'm happy to address any of them individually just like with the budget bill if anyone wants to pull a bill out of the batch then we can do that but again I don't want to get too nervous about me sitting here bashing bills these are only technical corrections bills so the for mortgage support we're doing two batches one of five bills and then want to for the the first batches as the total corrections bills for titles five ten twelve
sixteen and twenty one if anyone wants to pull one or have voted separately or have a question be happy to take a. Okay. Senator Rapert you're recognized for a bill or you have a question I just I move that Senator Clark to go through this process a little bit for the. House bill twelve eighty seven by representative Gazaway Senator Tucker to make technical corrections title twenty one of the Arkansas code concerning public officers and employees.
Twelve eighty nine the last one. Any questions for Senator Tucker center love you're recognized. Thank you Mr president. Senator Tucker Mr came to me so I know that we're we're talking about technical corrections. In C. was passed this service in the constitution but upon further review what if something was found not to be technical correction maybe with
substantive in nature what what's happening. Member would have to introduce their own bill to change that but that's that's really the vetting process you know with the code revision commission So there's for legislators who serve on the cover version commission the two House members or Speaker Shepherd and represent Gazaway the senators are senator Bryan myself during the last interim period when we really went through a lot of these bills it was senator garner all on the Senate and and then there's a number of attorneys in.
Other members of the public who are on the code revision commission and will the number one question that we have that we're trying to to go through is whether the changes technical or substantive in nature if it even gets into the gray area of a substantive change we say someone's going to have to introduce a bill not a technical rex's bill in order to make that change so I mean that's the vetting process that it's been through if if any member has a different opinion which obviously you're you're entitled to to change something that's in a technical corrections bill I think you would just have to fire on separate piece of
legislation to change the thank you. Any other questions for senator Corker homes first bash. Anyone wish to speak against or for. Senator as follows any objection to rolling. I'm secretary please rowboat Boyd Brown Caldwell Chesterfield Clark Crowell Davis these dismaying Dotson English Flippo

Any questions Senator Dismang you're recognized for a question and so I'm and I'm sorry I didn't catch this until you're walking up and up so this is for you as it stands right now they're able to the mayor on its own or with the representative can award. To the lowest possible better this opens it up so it's going
to me to for test I thank and my question is is so. Who is who is that reported to me says it all post purchase they're going to take this case to the council does and say I'm a determination that we should buy these this item based on these two things. So it's a. Is that in my reading yes to the mayor the mayor or his representative have exclusive power and and typically they'll go through that on the Council whenever they're going through their their budget items so the
council's ability to say time out. Let's let's check that again but at the the mayor has the authority they do have the because this is what and that's what I'm under that's what I guess I understand it all has to go to the council anyway. Are you saying the council could only Wardlaw most prized prior to prior to this the mayor had to pick the lowest bid on then seal the biz it was a slow speed. Okay thank you.
