Thank you thank you committee thanks for having me back at this time I'm here just for a quick amendment representative Collins asked me to clarify a couple of words in this bill just to make it a little bit tighter and so I made that amendment yesterday on the floor

Thank you madam chair I met brown District fifty five Conway colleagues said house bill fourteen ninety eight is a I think in a way kind of a cleanup bill this involves microbrewery private club microbrewery restaurant in dry counties the bill does four things the first thing the bill does is in the case of a private club microbrewery restaurant it would
amend the law to allow such restaurants to be able to sell beer wine and liquor and the reason for that changes under in our dry county such as far County a private club restaurant may sell beer wine liquor a private club microbrewery restaurant can only sell beer wine and the region statute and so we're simply amending that. Simply to make it Perry what we want to be able to compete with Chiles across history is what it is This bill doing so I think this supports our our local brewer homegrown business versus a corporate chain gone right down the street.
Second thing this bill does is it changes some language in the existing statute which provides that in the event of a violation of the law the law is currently read says that the permit shall be revoked this changes this to a may be revoked in order to give the ABC limited discretion in addressing permit violations the reason for that is we can have a very technical violation or very minor violation of the law is written your permits gone whereas in case like private clubs and stuff the ABC has some discretion to look at the violation into an appropriate
sanction which may be up to and including revocation but may also be a fine or maybe a warning or caution and I think that if anything by doing this we will make probably lead to better enforcement when it comes to microbreweries because right now inspector could very well be reluctant to write you up on a very technical violation because they know the penalty for that is you just lost your tire permit verses I mean rights of this violation because the penalty is a hundred dollar fine don't do it again kind of thing. the third thing this bill does
is some cleanup language you may recall we had a bill earlier in the session where an issue came up with if you can observe someone drinking a beverage through a window is that advertising we pass a law that says that's not advertising well this doesn't clean up on our entertainment districts and provides that if a microbrewery restaurant is located in a legally established entertainment district then it can participate entertainment districts as well just like the private club across the street again and finally some more clean up for the bill of existing law is under existing
law a microbrewery cannot advertise in terms of promoting the consumption of alcoholic beverages and this is a clean a provision which would provide that a microbrewery if it advertises just using the name of its restaurant that is not considered advertise promote the use of beverages I think example might be there is if you had advertisement the said come drink some beer at Bob's cafe still illegal but if you wanted to sponsor something in your name is listed name your business listing or program you know sponsored by local businesses such as Bob's cafe was clarifying that that's not
consider promoting the consumption of alcoholic beverages it would be permitted in the statute currently we believe that there are three permittee's of this would actually affecting the state's microbreweries are so new we have worked with the ABC mystery injured before she left A. C. to get some language from them their blessing my understanding is I think all the groups now are good with the build some changes we made and I don't think there's any known opposition and with that I'd be glad to take any questions.

get represented by the floor is going well I can't say that so if I can just just quickly the things that this bill does number one the way that works for their campaign contribution limits right now that is the dollar amount is actually set in statute that we've authorized or told the commission they have to adjust that for inflation every two years so it takes not just a rule change within a law change which could depend on where we are in the cycle you know delay the ability for that amount to be increased or decreased whatever happens with the
