number and the governor's office as let's change that where we give the DQ authority through rulemaking to set that fee so long as it is still just the actual cost of the test I think the idea they're being is that we don't come back every couple years and redo that figure if inflation makes the feed to test go up in price and so they requested that amendment to allow that the Cuban authority to set the fee by rule. simple bill of. Currently there exists an elevator safety board in the state of Arkansas and as things are now written. The secretary of the department of labor has to serve on this board all this does is change the language where the Secretary can have a designees serve on that spot on the board with that I would ask any questions or answer any questions. Thank you Mr chairman. Our colleagues this is a slightly not so simple bill. Currently in Arkansas. We have a process I don't know if all you guys know what naloxone is more commonly known as nor can it's something you'd Mr when someone has overdosed on opioids. there's been a health public health emergency in effect since October twenty sixth two thousand seventeen this is a
very good program what it does is it. It gives more access to naloxone for people to administer to someone who's possibly have an overdose. All this does is it's trying to He's the process in which one would go about getting more naloxone. Whether you're a first responder or. Police officer. For someone that works at a homeless shelter where there's
risk for overdose successor all this is doing is a. Even up that process a little bit. Making this knocks on easier to get with that I would to take any questions members of any questions representative rose you're recognized for a question. I'm just I'm familiar with it as in the lifesaving side of things but are there any negative like side effects is there any danger of people having more access to this no there's not if if you think someone have an overdose and and I'm not a doctor how many anti
but if you think someone have an overdose. You give it to him and they weren't have an overdose it doesn't hurt. it's it's very simple this is a a nasal spray form in which they're given it it's very simple to give you don't have to have. is with this is there still something that would be offered for those that would want to the virtual training or something like that well on the initial rollout that was a training but but since that time there there really hasn't been a structured training I mean it's. It's just a very simple process to administer so. Really I don't I don't think there is technically a a structured training for represent sources Jr understanding that we currently have a law in Arkansas that requires co prescription so that if you prescribe an oral opioid of a certain amount of milligram
strength you have to prescribe with that nor can for the family members to have been used without any training it is your Mr saying that current I think that's right. Laws might need to be changed to better help the people that are living in this world of mental
behavioral health this is just a continuation of this working group and and I would appreciate a good vote Sir. Members have any questions representative bought. The the commerce it affects commerce if I remember what Mister chair told me so and this is a a resolution asking for them to look into doing single dose packaging for narcotics it should help with overdoses I would I take my medicine yeah the day is gone she referenced maybe even packaging like what they do for birth control it's a one day pop out so you would can kind of keep up with what you have taken she she is.
Very adamant on trying to help with the opioid addiction process that we have this horrible epidemic going on with opioid addiction as she also suffered from opioid addiction she did pain management with opioids this is very dear and near to her heart I couldn't pass a bill for so I thought we could do a concurrent resolution do one on this house when the Senate and then ask for the governor to sign it and send it on to Congress and that's what the resolution does not appreciate a good vote.

You're recognized to present your bill thank you members you all may recall that we were the very first state to pass no patient left alone so we were starting from scratch when we wrote it basically the the reason why we had this bill was to make sure that someone who is sick in the
hospital or in a doctor's office or in a nursing home could have a support person with them at least one hopefully things are much different. now than they were two years ago when we were originally presenting this bill and that we don't have problems on down the road but there were some things afterward that came to my attention that I really wanted to fix just in case we have another scenario we can't predict the future we don't know what may happen on down the road
so I had someone come to me. In twenty twenty one I mean in twenty twenty two who had a. Husband who is getting ready to have a colonoscopy. And she was told that she could not join him inside the facility. And came to me and said are not allowed to be with my husband and in the waiting room there and I said well yes well I went to the health department and also spoke to that particular clinic and they said because I
did not specifically state outpatient clinic. That those outpatient clinics did not apply so I wanted to make sure we had that in there because especially when you have a colonoscopy or one of those in and out procedures you're put under anesthesia and you are actually required to have someone there with you to drive your home yet they weren't allowing that person and so I wanted to make sure that that was very clear while I was working on it we came up with some other things and that's one family council approached me and
wanted to make sure that we had our clergy information a little bit more clear and I'm gonna I'm gonna let Erin explained a little bit about that. Thank you Committee thank you represent Mayberry Mister chair I'm of course talking with family council again I just be real brief representative Mayberry has been a great advocate for patient rights in the aftermath of Kovin we had a lot of people calling our office saying help we need help and a lot of times we would direct them to represent
Mayberry and she would do everything she could to help them thank you very of record Mayberry said we did help some of the clergy language we receive that language from alliance defending freedom and we just feel that it helps strengthen that part of the code expands a little bit too of just give our clergy members extra protection and also our patients you know just that extra right to have a clergy member with them especially if there at the end of their life and so we're grateful that she is brought
this bill before you guys and we had a percent supported. One other aspect that's in there too is we had a lot of people who were told that they could not stay overnight with their family member and it didn't really make sense to me that you would be told at eight o'clock at night that you have to go home and my situation if I had to go home with my daughter was in the hospital I would go home to a children who've been at school all day and possibly exposed to something and I would just be bringing it back to the hospital the next day it really didn't make sense so we wanted to clarify that again someone could stay overnight with their
loved one as well we have worked with DHS on this we've worked with the health department on it we've had other people come to us with some concerns well I made some amendments I don't know of anyone right now who has any concerns with this bill moving forward and I appreciate a good vote members of any questions for the. didn't require a collaborative agreements of the waiver of the bill last session if you were practicing somewhere like California maybe that didn't require a collaborative agreement and you practice for ten fifteen years there if you move to Arkansas you would have had to find a physician and spend six thousand to forty hours under collaborative practice agreement that was not our intent when we pass this legislation we certainly intended for someone who have been practicing fully independent for many years to be able come right in the state of Arkansas and apply for autonomy the language the other language
using the built cleans that up clarifies that I'd be happy to try to answer any questions. The questions from committee. for many years in Arkansas rule practice loan forgiveness scholarship program through the medical school at you and mass over the years that the dynamic of that program has changed to to meet different requirements currently the way the the law is written the programs designed is to to to to it says a rural and under served program so underserved you can read the bill with the struck out language was underserved is fairly subjective
and left up to the ultimate left up to the board to determine what is underserved based on this criteria were striking what I'm trying to do is clarify that underserved is defined federally and so I'm adding some language that very clearly says what is underserved in Arkansas on what is not under served in the way physician population this is the same regulations that govern where if you agencies can locate where rule Medicare clinics can locate so we're just we're taking away the subjectivity of
underserved in making it defined and then we're also striking the rule part now what I'll say to that is that to me as it currently stands role in this bill is any community under twenty thousand and within twenty miles of any community twenty thousand you look at Arkansas I think of the cities in Arkansas that are twenty thousand or less. A wide variety of communities and I would make the argument that many of these communities are not what I would consider under served so if the idea behind this bill is to take in place physician in under served
communities in Arkansas to me it doesn't matter if it's rural Arkansas or if it's urban Arkansas it is under served is underserved and we have that definition if the goal of the program is to push more physicians to the underserved areas that I would like to try to make that clear and clarified this language there has been some discussion from our rural hospitals in from the medical schools about is this going to discourage people from going to rural communities I would argue that it will not I would argue when you look at the rural
communities that need physicians and consider that they're now competing with communities in Arkansas with populations of eighteen thousand twelve thousand fifteen thousand if our rural community with a population of eight thousand or less I would rather compete sometimes against an urban community which that which is underserved so I think this makes it very clear fair playing field for how we administer this program and I'd be happy to try to answer any questions. to create a program for DO schools we're gonna try to fill that program and you a message program it makes sense because you're blending private schools which the DS was a problem with the public schools we have to set up a separate program for the DO schools to mirror the programs you a mass that's a program that has the same language I'm just changing that language in the DO program to match the language we just discussed in the program at UAMS the only other thing we're doing in this bill is when I set up that bill I did virtually I
created some language with regard to how the board was appointed that needs to be clarified so there's some clarifying language in this bill as well to make sure that we understand the governors appointing members to the board to oversee that program and I'd be happy to answer any questions. have worked with the hospital association also with the healthcare association other provider groups one of the things that we realized in the environment that we live in today in fact as specified on the bill on page two is that on average to nurses are attacked every hour nationwide with the database of nursing quality indicators showing that more than five thousand two hundred nurses were attacked in the second quarter of twenty twenty two that's just the nurses that doesn't mention everybody else but this is our benchmark because what this bill is
intended to do is to require institutions to provide medical care to individuals to post a sign and it is framework within the bill as to the structure what the sign needs to say so there's uniformity across the board that just advises the public that if you attack a healthcare worker it is a felony and you will be charged for one of the things that we're seeing that is causing I think a contributing factor to are shortage in the medical world is that people today our experience a high level hostility expressed
toward them in the E. ours in another places and so the signage is intended to make public blatantly aware that if you attack one of our health care workers you will be held accountable to high six in the law the other thing it does that is very unique in the bill we would think that all those things are common sense and they are but one of the unique things that's in the bill is that the healthcare worker is able to utilize the address of the place where they are employed on the police report that is filed because one thing we have found and has been determined is that
they're apprehensive to file reports. Because they would have to put their home address on there and there been cases where employees have been stalked attacked because our home address was on there so what this bill will do is allow them to put their workplace address on the police report so as to eliminate that potential and hopefully will increase the number of reports that will be filed this bills agreed upon we've run it through all the traps and as a mention is agreed upon bill and I'll be glad to answer any questions Mister chairman I don't know if anybody's in the room speak for

B. eleven oh two is the next great universal newborn screening act teacher the newborns are screened for conditions recommended by the United States part of health Essentially what we're trying to do is something that a lot other states around us like Kansas Oklahoma Mississippi Alabama Florida and Louisiana done as well what we're wanting to do is tie the newborn screenings to the recommended panels by the United States secretary by but
with the federal government says we need to do so you look at the bill or taking out some tests that we say that need to be screened for because they're already in the uniform screening panel that we're currently doing so we got the fiscal impact for the waiting so long to do this bill and there's no fiscal impact of the sick or poor came back and it also had no fiscal impact as well on a current health plans and with that I'll take any questions. representative Pilkington just
curious yeah is this part of the our homes suggestions to improve the infant mortality rate that we discussed in the interim may not be specific but is that what it would do what the reason why I'm writing it is to improve Approve those outcomes I don't know that necessarily was a recommendation there was a lot of things they recommended but just and you know what I've seen with improving or county rates among infants doing the screenings and we travel to screen for rare diseases using
the same blood draw that were already currently due to begin with helps I spot helps as potentially find diseases and treat those before they become life threatening and therefore a number of health outcomes so.
