comments that the gentleman he spoke in opposition to the bill said this morning about not being included in the process section of an email from him to a group of people in the industry dated may from twenty twenty two calling this for professional people working on this bill to fix an issue in their industry SKM and and I'd like to quote him we were recently notified about another PNB scam this scam Association is attempting to defraud and
mislead readers and he said using a similar name to his group and so he he was he didn't know about this proof formation working on correcting the issues from last session there was also the meeting last summer with the bill the board within the department of health and where there was testimony public comment through the rule making process on the issues at this bill created and he was there for that and understood the issues and where others in his industry were coming from so there has been ample time to work through and any concerns
from his and we have tried to work with him and try to come to agreements on some things where there were nine we all know this process about compromise and working through things with different parties and if that party refuses to work with you that you cannot work with them so there has been due diligence and through that over the last ten months and we believe that we've come to a place and that protects and people who are using the services of people in this industry it protects the industry and that's good for

Okay you're recognized to present house bill thirteen eighty five thank you madam chair I guess the two bills that I'm running and public health today come with a little bit of history this one has history of
its and its positive and history but I know years ago before I was in the legislature and Senator Irvin and represented Ferguson worked really hard on this long acting reversible contraceptive issue and finding state funding to be able to have a bank with and health departments to provide and this type of birth control for women and I think that's really important and it's let us to be able to do this work today and so I appreciate appreciate that appreciate the history as free
on this issue in this bill and members this bill it and. Allows it makes it a wraparound payment and for long acting reversible contraceptives and which I'll call lark and it makes it a wraparound payment outside of the global payment that Medicaid currently pays for and delivery. So if you look at the fiscal impact statement and there is a small fiscal impact to the state and and I can let the Department health committee and speak to
that but I do want to say that and Medicaid delivery is around eleven hundred dollars in the state pays twenty eight percent of that a lark a payment for a lark is a thousand dollars in the state pays ten percent so and that cost savings there are pretty substantial for our state and forty two other states have implemented payment improvements within their Medicaid programs which do carve out some portion of of this large cost so there's certainly other states that have been doing it for quite some
time as to the states in our country actually and we anticipate that as lark utilization increases and unplanned pregnancy rates will decrease and we'll see more of an increase in the entertainment C. an interval which is the time that that a woman has a baby until the next time she has a baby will see that and increase that span of time and so between and. Well I'll just say and repeat
Medicaid births and in Arkansas within eighteen months is it thirty five percent say reprieve papers within eighteen months of thirty five percent and states that have implemented this policy and their second baby or higher at birth rates were cut at about fifty seven percent so while you see a fiscal impact statement of a little over three hundred thousand dollars to the state itself and we've seen and states like Colorado a cost avoidance
of between sixty six and seventy million dollars and that's due to savings and averted births of unplanned pregnancies at ten if snap benefits and would cost so overall long term it's actually a huge savings to the state they just can't factor that into this fiscal impact statement I'm happy to take any questions or and I'm sure more fight with the department of health is as well. eight lines of different of of new language. And it deals with cemeteries that have. Not done a good job of keeping up their signatures primarily grass growing and things like that. What we've done. C. line. Twenty eight through thirty. Pretty much says that if you're going to hold a permit to own and operate a. Cemetery then you need to take
care of that cemetery. If you go to page two with that in line and we've already got some punishment such as suspending a revoking permits but we'll see if we don't do that we're going to find you five hundred dollars. You're recognized to present house bill fourteen sixty two thank you madam chair thank you Committee representative Jamie Scott from house district seventy two just to give you a little background about how this bill came about a representative will Speaker Shepherd selected myself representative Keith Brooks and represented the involved to participate in a foster care and homeless student liaison of fellowship last year so we were able to through NCSL so we were able to travel and
Senate sessions with policy experts that for experts on by securing homeless you to figure out better ways to support these these individuals in our state and this bill is a result of that working at fellowship so house bill fourteen sixty two clarifies the definition of unaccompanied homeless youth in our state currently that definition does not match the national definitions so that's what we're doing in this bill clarifies that an unaccompanied homeless youth as a young person between the ages of sixteen and
twenty two years of age and is not in physical custody of their parent guardian and is a youth who has run away from home have been forced to leave his or her home or have parents who have left the area or who have left them behind simply put these kids are young and they don't have an adult that's responsible for them during the ninety third General Assembly. We passed legislation creating a foster care and homeless UP laid liaison on our college campuses to support these individuals House Bill fourteen sixty two
will improve and provide support to our youth in foster care who have aced out in our homeless youth and provide the basic fees and documents for them to go to school or college to get jobs and contribute to our society this bill will but will waive the fees for our foster care youth in our unaccompanied homeless youth to get government ID's or driver's license a copy of their birth certificate and also to get a transcript from a public college or university if

bill and as outlined several ways in which and eight you could be identified as an unaccompanied minor so would be with either the school district's liaison and at the student has been identified for services under McKinney vento and you have several different and service providers who have knowledge of the user and there are safeguards in place and not just any you could come up and say I'm in a company minor you have and other people working with the youth providing services who document that.
Who says who actually says there are this is their status to certifies to sure so and again there are a few different ways that can happen on page two of the bill and starting on line seven it could be the school district's liaison for foster and homeless youth and moving down the line fourteen the director of an emergency shelter program funded by the federal Department of Health housing and urban development and moving down to one eighteen director of a runaway or homeless youth basic center transitional living program at and then and finally

its to DHS and so this this is for the. Basically the hotline portion the bill This section or change to delete section three in its entirety that's on page two. Change three insert some language on lines one and two. that that just instructs the Department of Human Services and how they do the contracting with entities change for

have it and it is adopted so we can present senate bill four sixty five as amended thank you madam chair so now that is amended what the bill does as a whole basically if you recall in the last general session we adopted something called every mom matters act imma and it was housed in the Department of Human Services and really was a effort to try to make sure that women seeking abortion
at least three thousand abortions in the state of Arkansas at the time were we're getting the resources available to them to make an informed decision and now that abortion is no longer legal in the state that piece of law is no longer necessary to be housed in the Department of Human server Department of Health and it's no longer at at the needed to have an active hotline
for them to call. Before they have an abortion so basically what this does is moved that over to DHS and puts a pause on it basically. To a point in time in the future if abortion ever does become legal again we've already got the statute on the books for the ability for DHS at that time to to reactivate program the second thing it does is it moves the loving choices lifeline that we enacted in twenty nineteen over
two Department of Human Services and that is a a hotline that basically allows for care coordination of services for women who are in crisis that are seeking help for. There's a whole list on. Page. Page three and for their so.
Services needed for support in the following areas of use assault education or training housing assistance employment resume development child care all that list that's on there those things are currently since we passed that in twenty nineteen under the department of health This would move it over to the Department of Human Services where it's more That kind of their their more experten and expertise in that field and so that's that's kind
of the the the two thrusts of the piece of legislation is to combine those two programs moved over to DHS and put a pause on the the part of it that's not actively necessary I think that you have anything else to add is that covers it pretty much so okay are there any questions from members of the committee Senator love. have to move it from eighty H. to DHS well is. The the the main reason in the last two sessions twenty nineteen twenty twenty one that it was housed in the department of health was because these related to abortion abortion clinics and those were all on licensed in under the department of health. But the department of health doesn't necessarily have. The the various Programs that they would be connecting women to resources with Medicare job training
services or that whole list that I just read their You know all those things are more kind of appropriately under DHS then department of health and and now that the abortion component of this is not active they're still need for that coordination of care for for moms out there seeking assistance. few sessions back we created a pilot program to see how ride sharing could work And in a way for non emergent transportation and so that program actually was in effect of course COVID hit it got shut down and and now we're trying to get it back up there a few issues they saw and so there is a grand this with DHS basically telling them to restart the program and they asked that we just do a working group instead to get the program up since they've already are authorized
to do the pilot program and so this isn't to just enabling language to let them do that to bring stakeholders to the table and kind of find a way to move forward and and that's it it's noncontroversial no no no opposition that's it okay are there any questions from the members of the committee. One of the proper as you know earlier in the session I ran the bill to allow for maternity leave benefits for those who work for companies that also pay for abortion
benefits as well I I've talked a lot of senators I've heard concerns about asking companies to do this you know we don't like to talk companies what to do and I would say that to that argument we're just trying to do is create a parity issue so they're choosing to offer one service we just ask that they offer the other and that's simply at you know the John from a call this Legislative trickery that I was trying to pool in reality what I was doing was trying to find a way to thread a needle I think
we all want maternity care and maternity leave for for women but we don't wanna force companies to do it and so I found a way to say that if they have this marginal dollar offer one benefit I just simply ask that they offer the other and and I worked with Walmart and I worked with other companies that offer this to try to get them to be neutral and they are neutral on this bill because I've been talking to them since last August I think is a step in the right direction you know I think I did I told a story about the vin diagram about state that bans in states that have have leave and
there's no stay in the middle and I would Arkansas to be that say in the middle you know we passed the learns Act in the interim we went between when I first ran this bill and now which had a component of twelve weeks of maternity leave and I think you know that was a great component of the of that bill and I just simply want to add this to it it doesn't cost the taxpayers single dime I think it's a great experiment it's a great way to show people that here in Arkansas being the most products in the nation we want to make sure that women have that option if they want to take maternity leave and so.
I just ask for another shot at it that's all I appreciate the opportunity to come presented again thank you Sir and is that either questions from members of the committee. And I'll just share my again my concerns about the enforcement at this and think you know my concern is again and. My concern is telling private businesses and I realize that you worked with Walmart but I have small businesses I have all kinds of businesses and they're not the only business in the State of Arkansas that matters sure not of them are that do matter and so I I personally
just don't feel like the government should be trying to interfere with and private businesses and telling them what they can do I don't like that they would do this but there's really no way to enforce this and there's really no way in my opinion to say that you can you know whether you go and take a week off of vacation at grandmother's house or whatever then or whether you're leaving to go have an abortion different state there's no way for us to really know that and force that were for that business and those are going to be violations I can't ask those employees whether they're going to have an abortion or not because that
would be a have a violation so I just have major concerns about that and I've had a lot of of members of the Senate expresses those concerns to me as well so I'm expressing those concerns for myself and for many many members of the Senate that we we have actually pulled and have at we have pulled those numbers many of them and who have the same concerns but and I'm I'm here I'm just let us be to that sure Inc and can address those concerns report Sir you know
when you're correct that's not the only prison state I talked to others as well as what the chamber of commerce is neutral on this they did not come out against this you know whether an individual employee goes and and receive an abortion other state is it is unrelated to this bill this is only if the company is paying for that to to happen so whether at an individual goes and and and received that in illinois' or another state you're you're totally right that they have no way of asking us but it's only the company is saying that we
are offering this benefit and that's why I think I refer to as a benefit parity issue we're just saying if you offer one off of the other so I I just wanted to to make that clarification on those and like I said the reason why. Why I think the chamber's neutrals because we've it would take this consideration it's it's not all businesses we we try to model a lot of it off and sent away that's why it's only fifty employees or higher because a lot of them already have this framework and that was to suggest from when the companies we talk to so

fifteen seventy five is a very simple change to our current unemployment benefits law right now if you lose your job through no fault of your own you may be entitled to receive unemployment benefits One of the things you have to do to maintain those benefits is performed to work search activities per week and that's monitored by DWS this bill simply change that to five work search activities per week that is something like turning into resume filling out a job application going to a job fair
I visited with Dr shoulders and David sterling about this in there okay an absolutely fine with the language of this bill in fact adopted some of their recommendations all right are there any questions from the members of the committee on this bill. while it did become over the counter today there are still other and naloxone is that are not necessarily so the brand name nor can became over the counter today but there are other naloxone is that are not so if it made sense from a financial standpoint practical standpoint to for you know a police station or a you know homeless shelter a hospital or clinic to stock more these one of the the prescription versions this would still be the right thing to do so there's.
You know it's not controversial or there's no no no opposition and it helps protect people it's one of the things we can do on the Sentinelle and.
