And then also not having a mechanism by which a younger employee would be replacing and paying back into the plan so what we decided what we worked out is. At the city and municipal but the city and county level for those health plans offered to law enforcement officers who have been met the law the requirement the average individual being having served twenty eight years. That officer would have the opportunity to choose if they found out you in paying the full premium not the subsidized premium for that plan to stay on it until their Medicare eligible. This would allow the plan to benefit from a thirty year investment by that individual as well as allow the city to replace that employee with a new employee. At a younger. And Think that the senator and the Speaker for the opportunity to be here today I know that everyone in the room has probably seen or heard but a lot about name image and likeness as it's associated with our student athletes both in this state and across the country and the unfortunate part of this is we we would much rather I I think that the Speaker expressed this on the house side would much rather be in a position that this is a dress from the federal level. Cross the country but but much of what we've asked about this committee. And and the General Assembly as a whole to assist our student athletes with. Is. To to enact a law that's going to allow them to be treated like anyone else in the State of Arkansas to be able to be fairly compensated when their name image and likeness are being used or to give them the same opportunities that anyone in architecture engineering or anyone else on a college campus would be able to do so on behalf of our student athletes and the university and all of our institutions within the U. a system to say thank you for passing that two years ago it is not only put our student athletes in a in a position equal with their contemporaries but it's also put our athletic programs in this state in a position where they can fairly compete with all of the other institutions across the country. So with this bill in particular and there are three primary issues that we were looking to to basically update. And the reason for that is over the last two years state laws in those states that surround us have changed guidance from the NC double a related to most of of the rules that they previously had has changed or been repealed and and it changes daily it's it's dynamic and this may not be the last time that we we come to this Committee asking for some assistance but the the first section on it relates to. When student athletes would be able to receive compensation for their name image and likeness rights and several other states they have open that up. through high school one of the the the things working with the Speaker that we liked into wise what what is a. I time when a student athlete can fairly do that without receive that type of support and information that they need before they enter into these agreements and so it would. Change the definition of a student athlete to someone who has been accepted into admission signed a national letter of intent or another a agreement to enroll like I'd like a a financial aid agreement and the reason for that and and. Terry printers can speak a little bit more to this one it allows the institutions from a compliance standpoint to know who they are so that we're able to ensure that that's legitimate name image and likeness compensation not a recruiting inducement and it also allows are for example at the university of Arkansas our flagship Division to be able to provide education to the student athletes at that point and academic assistance and begin to provide them information about things like exclusivity clauses in taxes in those kinds of things that most seventeen year olds have never had to deal with. Until now. The second change would be to update some of the language that we had to make clear that institutions and their affiliated entities may identify create facilitate and otherwise enable opportunities that's really no different than the job fairs that are business schools provide it's it's inviting and the non profits and businesses to be able to share opportunities for the student athletes So that ones are pretty self explanatory the next provision within that section relates to the right of non profits to be able to compensate student athletes and the primary reason for that at least at the University of Arkansas. Third party licensees and what they call collectives. associated with many of our student athletes. Okay I would say ninety percent of those are to encourage nonprofit work and to ensure that their partnerships with United Way and boys and girls club girls on the run those types of relationships are allowed to continue because what we've seen is that when those student athletes help raise awareness and promote those nonprofits those. The these stakeholders individuals related to those in non profits younger by students eventually grow up and have an awareness for the institution and it's it's it's a circle they have I think several of them call themselves give backs. And then the last section states that no person or entity may promise or give name image or likeness compensation to a student athlete that is enrolled at an in state institution to recruit or induce them to enroll at another institution. That the Speaker it mention the S.. when he presented the bill on the house side and and and I agree with them this is. a more specific a restatement of what would normally be a tortious interference claim where third party licensees who invest in their ambassadors would and and have contracts with them and agreements with them to promote their organization that someone would come and give a recruiting inducement which is not what the NC double a would consider legitimate and I L.. And to breach those contracts and go elsewhere and if if you've. I've been online at all you see in that at least that's being alleged to have occurred every single day every time the portal opens so. The other piece to that is that's nearly a codification of the current NC double a rule it is A. pro pro there is currently a prohibition on inducing student athletes were enrolled at another institution in fact communicating with them outside of them being in the portal So we felt it was important to make sure that the state of Arkansas considers that is important to protect our student athletes and those who are investing in our student athletes. And with that I'll I'll take any questions you may have. Any questions for the committee. Senator Johnson. Thank you Mr chairman and Thank you for all of you Mr Speaker bring this bill Mister McElroy I am macrory McElroy we have either Mister mac or read. I'm not confused on this When this first started I was I was afraid that we had let this get out of the gate without any kind of regulation or I just saw a whole lot of problems I actually called my friend right Tucker on the drive time sports to talk about it because the Supreme Court correct me if I'm wrong they basically rule that you're free American you have a your face you have your name and you can sell that you're you know this is a free country we don't say well you're a channel of the University of Arkansas or any other school that you have to go to school with that's basically what they told us and now we're find her and play catch up to put some reasonable regulation in so a these young people are not abused and be that the it doesn't destroy college athletics or any other kind of an I'm not saying that about the way it should be I don't disagree with with what you said and the only thing I'm I'm I just wanna make sure of inputting these I know we need to do this statutorily and I appreciate Speaker bring this bill what I want to make sure is that from the university standpoint I'm not just course of addressing you but I'm not just speaking the University of Arkansas System I'm not speaking to Senator Broadway where he is and may issue and he's behind me yes but These are still in many cases the kids and I guarantee you if somebody tried to John. Session please. He's is he dropped this kind of money only one when I was seventeen years old it would have been a disaster is there a plan or something maybe already in place to educate the student athletes on the pitfalls of I'm good calling a personal finance course but personal finance is a lot different when you're talking about the kind of money that we're talking about and I I just ask you is that in place I hope it is maybe culture check comes up tick in response to that's to me my mind the I don't want these young people to be abused nor be tempted by some of the terrible things that can happen when suddenly a bunch of moneys dropped in your pocket. Absolutely Senator and I and that's a more than legitimate concern that I I think Mr your check will be happy to address he was two years ahead of that before they even removed the restriction on the NC double a he had already communicated he was ready to hire the position that Terry Prentice now feels to do just that to make sure that no one's coming into our program without a full education in what it takes to manage that world and I will tell you what is it what is created is a model that is trying to be replicated across the country I hadn't been done yet I'm I've been very impressed with with what they've done there it's something that we shared with our other institutions within that the system across the state to. But I'll let I'll let them speak to it it's remarkable thank thank you for the author any other questions Senator Hickey. Just just one as it relates to the bill on page two and nine. And maybe this is exactly is that correct for S. is as is as it existed on January first of twenty twenty three or should that have been on and after. Senator Hester I think that's more questions for you well this who is required thank you Sir that's what it was it's being land lines two nine nine nine. It may be. Well I think and I and I'm not sure that may be the U. of a there may be specific reasons for that but I think that normally when we would have a reference such as this is just for certainty that we understand what type of five oh one C. threes we're talking about because you know it as it existed on January first of twenty twenty three is a date certain if we were to say on or after that would really be no point to say on or after because the law is the law but I believe that probably the intent and probably why was written this way was we want to understand specifically what those five oh one see three organizations what those requirements are we don't control what ultimately is done by Congress obviously and so if there were changes made to title twenty six the U. S. Code we would want to know what those changes are before we would be agreeable to amending the law so I think it is intended to be a date certain okay so this is as it relates to the U. S. C. five oh one this is not as it relates to the exempt organizations well the the exemption is that it falls under section five oh one see three but it is it is referring to If my reading of it and I think what the intention of was was drafted was to say that section of code as it existed as of that particular day. Okay I go along with the code of I was actually wondering if it was as. It in other words you had to be an exempt organization as of Jan on January first of twenty twenty three. And what you're saying is is that if there is an exempt organization that comes in after January first of twenty twenty three and as long as twenty six U. S. C. five will or whatever that number is hasn't changed they will be eligible to that that would be my reading okay it is the code I don't know if if title twenty six is changed since January first of this year but if there was a new organization formed and they met qualifications for this section of U. S. Code as it existed January first and they would be eligible I think it probably relates back to it may relate back to some N. CA rules and other things just to know that like we know it's okay as to these organizations if they if they are consistent with with the United States code as of this state but if the code changes were not we would want to be able to look at that and that may be something that would have to come back for this body to make that adjustment okay that's fine I have no issues with it other than I just want to make sure that that is exactly what we mean thank you thank you senator share representative Shepherd for that I agree agree with you a hundred percent on that. The chairman and committee members thank you for the opportunity to be here today and thank you for your consideration of this bill I had the honor and privilege to serve as a director of athletics at the university of Arkansas have for six years and for the past three we have experience probably the most successful air and and our athletic programs history two top ten finishes in a leaflet Director Cup the highest ever in the history of our athletic program twenty SEC championship seven national championships thank you to the fact that we were at the forefront of name image and likeness in making some modifications to the prank paroles Act two years ago almost to the day and we're back here today with some more changes to that that will keep us at the forefront of name image and likeness here in the state of Arkansas and at the university of Arkansas and say it on that that's why it's important to the continued success of our athletic program and our student athletes these modifications to this bill are passed and Senator we we do have an educational program before in I. L. started we had partner with the Walton college of business on campus and our student athletes have an educational program that they direct regarding finance responsibilities tax responsibilities had an appropriate negotiate a contract exactly what name image and likeness is and so each of our student athletes when they come on campus with their freshman or transfer student athletes goes to that program. Because we are taking name image and likeness in education of our student athletes very seriously because it really is for many of our student athletes a part time job. Thank you for letting any questions from the committee centerman. Thank you so much Mister attacked create all that you're doing I I really and and and I know this is not on the bill but I do think it's necessary to discuss can you share with me or with our members of the committee and also the public that's watching today just how much of a game changer this has been for individual student athletes if you know of any in particular of the things that they've done I think it would be a nice thing to talk about and to share because people just see the the big money side of it but perhaps lose the personal the personal benefit that it's happening for student athletes and I know as a tracking follows several of our young gymnast for instance of the University of Arkansas and some of the things that they're doing this nonprofit center do you have anything that you can share just of what it's done in their educational value of financial and financial abilities that have been improved because of what you've done but also what they're doing and how it's benefiting for them personally outside and off of the field of players or the court yeah absolutely because of the nature of being a student athlete most for student athletes don't have the opportunity to go out into our community and have a part time job or a full time job and this is allow them really to learn what that's all about to have a job in the responsibilities of the financial management of your income the taxes that you're required to file at the end of that year and just overall financial literacy and and and we're regards to what they've done in the community a great example of this is outside of our state the KD Jefferson are starting quarterback partner with United Way was able to raise money for flood relief in his home state of Mississippi through name image and likeness because he was able to be compensated to R. one Arkansas and I L. program that allowed him in turn to use his image to help raise money for flood relief in this state I anticipate that several of our student athletes will do a similar to. Apes of fundraising efforts for the people across our state who are affected by last week's tornadoes. Hello and thank you and I should have asked Mr current and at the same question and you and your happy to share that with us too because I'm I'm interested I know that there are some student athletes have actually created their own small businesses they become entrepreneurs which is which are so interested in which will actually kind of launch them past their playing years if if they go professional or not go professional I've I've seen some of these incredible like stories of just entrepreneurship and financial literacy in accu men so I appreciate that and I would just invite you to answer as well on behalf of your student athletes individually Intel Mr Jefferson we appreciate what he's done. Yes we're probably into earlier stage in terms of an aisle in the Sun Belt I think waiting to see what the larger conferences did in terms of the space but most schools in our conference now have and I collective involved and we're at a much you know smaller scale but the large majority of what we do will be charity based weaving of young man who doesn't have a car so hopefully if this moves forward will be able to create an opportunity for him so he will have a car and be able to support his family so worst early on but charity will be the large majority what we do. On lands what the Senator Irvin just asking with what you just said about the K. J. J. a Jefferson there to the U. of a I would respectfully ask the two of you all really consider without. Unforeseen issues that happen this weekend across the state of Arkansas last Friday to be exact with the tornadoes and stuff that you all would try to use that to advantage to to help some of these who were affected by the tornadoes in the storms that be graced graciously respected in in thoughtful four for the state of Arkansas and especially Cabot in center and we were already ahead of you a little bit on that we will use our baseball game on Sunday to launch United Way campaign with over ten thousand fans that we had on Sunday where they were able to use a Q. R. code on a video board as it came in a gauge to donate to the United Way for tornado relief and our student athletes will help us in publicizing that moving forward as well thank thank you for that now I was not aware that because of that run a chain saw this past week in trying to help neighbors out on that saw graciously appreciate that and thank you for that anything else can do because the people of Arkansas support both you both universities and and we did that the people are so need to have some given back to the for the support they shall and I just said similar to hunter will have a truck that were loading up going to be at our baseball game and throughout this weekend we did a lot of these things that Alabama when the tornado two thousand eleven came through so going to partner with the university and involve our student athletes well that's great thank thank you for that Senator Johnson thank you Mr chairman hi. Coach your kitchen your check thank you for coming and for your being proactive you just mention on the tornado relief As of old high school offensive lineman I keep thinking about you know the quarterbacks and get all the glory and probably will get most the and I owe money is there any formula or possibility that where the the coach or the guys up front the this athletes that are not quite the stars and certainly that extends to the the less publicized sports where they get the you know at least a small piece of the pie I've always felt that you know while certainly if you're a superstar you know you're gonna get the superstar money that's America I have no problem with that but I'm just we also have minimum wage laws of this state on the other side of that is there some way to do that where we just don't leave these kids I'm and not just the money situation but the the envy and the you know maybe disruption in the locker room when you're sitting there trying to just you know full of gas in your car and the guy in the locker next to you is just got million Bucks is there a way to address that within the law and within the NCAA regulation there is and we we don't have a magic for me but I will tell you that we have it involved a significant number of our female athletes who are one Arkansas and I L. and just sure and I'll program said that stretch from our software program down the gymnastics and women's soccer and women's track and field in and across our men's track and field program baseball men's basketball and football as well the football numbers are significant we have a hundred twenty student athletes on a football roster not all one hundred and twenty those receiving name image and likeness of compensation but I will say that probably gets into the the first and second string players on on both sides of the ball and all positions. Okay and and quick follow up I think about how far we've come in and have this is truly plowing new ground up my cousin was a manager on the ninety four national champs stay with the subject sender Johnson. Subject. Mr chairman I am honestly to go they went to Charlotte and he was walking through ball with the court was Williams and they had a thirty four Arkansas Jersey in a store and he said coreless look to him he says you know I can't afford to buy that and I thought that was the irony of the whole thing and we're I appreciate you this is a spreading it around because those days even the superstar wasn't benefiting this allows it but I just wanna make sure that we don't have so the seeds of discontent in the locker room so to speak yeah and in a big part of an I. L. is what companies across our state who who they want to support and sponsor to name is like this agreements and and with that one a car dealership here in Little Rock that sponsored our entire softball program it allows our softball program to be spokesperson for their car dealerships in so it's not all incumbent on us in the athletic department at Arkansas state I'm in the University of Arkansas but also there's business owners and how they want to if they want to a preference towards female student athletes marketing there. Businesses or if they want to football player basketball player baseball player would have you. And then one very short follow up Mr yes our and I want to use I will be careful out say this but is there any way to limit things like alcohol advertising or more controversial product advertising I. see the Speaker. Chiming in I I'll just throw that this that that is already in the law that was in our original bill and Matt would know the all the different categories but there were categories of or industries that they could not enter into an and I'll deal I believe alcohol tobacco gambling firearms firearms there one number of different things that were out there marijuana I hope I'm even legal I'm pretty sure that that was included okay we covered the waterfront as I recall all right thank you Mr Speaker thank you coach thank you any other questions the committee. If that's okay if that's okay with you yes Sir please please having he's not signed up here so please having a recognized in sales. good morning everyone my name's Terry Prentice service senior associate athletics director at the university of Arkansas where oversee name image and likeness activities initiatives former razorback student athletes so the privilege to to return to this position when hunter made the offer two years ago to lead up Our and I'll Division and I'll be very brief I just want to echo the sentiments from hunter and from Mr puritan and from that McCoy that our student athletes contrary to popular belief have been very active in the community but put to some examples I know some questions were asked earlier by by the centers of our softball players who've conducted camps in the river valley both in Fort Smith and in Russellville using their name image and likeness I think of baseball players such as Michael Turner who is a one year player the transferred into us here in Arkansas went on to have a tremendous season last year and now it's going Arkansas home and is able to monetize on his name image and likeness while bringing pride to the entire state that also point to some of our our student athletes such as our volleyball team all partnered with one non profit during the fall you were able to raise over five figures for area non profits in Northwest Arkansas and beyond so really just thank you for for having us in considering this bill name image likeness has certainly been a positive in Arkansas and we hope that it continue to be an advantage for us in this evolving landscape of college athletics. I'm not getting the reception is what can we do about that. I'm sure we'll find a way to get you in. We we can work that out. The center Murdock. Thank you Matt so as it relates to face value of tickets how does this. How does this affect that because we don't secondary market sometime we get these escalated prices and so that is there anything on that yes Sir they're they're actually two provisions one specific to higher ed institutions sporting events that requires a ten day window where it must be sold at face value to ensure that we don't have and and an institution of higher ed immediately going to dynamic pricing on day one so that gives all of our fans to any any of our institutions an opportunity to thank you say get those tickets early the other thing is an economic advantage right now because it is it is strictly reading on the law illegal to list on the secondary market we don't have as many people who do list. And we have empty seats you may see it at announce to sell out events a lot of empty seats on TV and part of the reason as people are not comfortable then finding a secondary market for it so if we can put we can flood the market with these tickets that will drive the price down so somebody who's trying to gala gin and sell it but thirty five dollar ticket at four hundred dollars is going to have to compete with fifty other ticket selling at thirty five or forty five dollars rule rule briefly we explain that for the people in the audience Senators watching online I have not seen the bill will you explain the ten day window you said from that from the day they go on sale or I went into it yes Sir it it does give discretion to the institution decide what day they're going to begin the public sale but it does require that windows tickets which are identified by the institution as being available for public sale. And that obviously would exclude contractual obligations that an institution might have with a sponsor like Nike or Gatorade or their own conference or their coaches and it would exclude. fund raising tickets that might be allocated S. as a component for their foundations but the once the public date is announced for any sport that would be a ten day window where the original face value price that is locked by the institution and I I will tell you there's really no incentive for The institutions that I've worked with to want to offer those they want those seats filled So they were that that was it was actually the speakers idea to include a window that would protect that door limit the value of that ticket and all of the institutions agreed because they don't have an institution trying to get out our our fans Senator Hickey yes or no along those same lines I guess it's on page four line eleven to sixteen you also have been there the may include but may include associated transactional fees and costs which I understand that question to you is is there anywhere in here or is that just shows that a direct pass through of your exact calls or you all pointed to make money on transaction fees are you gonna say because we're doing this we're gonna make five or ten or fifteen dollars per ticket how is did we have that defined well that the transactional fees and costs is actually the same language that's in the current law and under the current law if the if the University of Arkansas wanted to tell to sell a ticket for five hundred dollars about face value it would be legal they actually are the only one that has an exemption to do that and we've never done it So that this is actually giving citizens of the State of Arkansas the opportunity to be able to sell that and then not be prosecuted just because they included a shipping cost or a Yes Sir I fully understand that I was just I was just seeing because of the way it was written at that was going to be your intent of our during the ten day when the. Are they are they just go or they just always good to be true pass through calls the vote some Bender sentiment some vendors charging a dollar ticket or to making something up is that the only calls you are not planning on putting on any type of fees or anything from the university itself that would be included during that ten day period because that's a good that's a good question no Sir okay and and the fact that we're now able to send tickets directly to all of our fans online at four or over your phone means that we don't have those associated costs with which makes it a lot easier to facilitate moving those tickets thank you Sir thank you senator Johnson. Thank you Mr chairman of. Or I guess this really means that we basically thrown in the towel on stopping scalping I mean we recognize that all these ticket brokers are out there and you know we in Arkansas can't bear head in the sand and ignore them it but exactly where are we on what we used to call scalping is is there any prohibition anymore I mean I I recognize the fact that the university or any entity of would maintain their right to sell in an open market uses you a chosen not to do that but is there any restriction anymore I just want to see that you know we could potentially arrest a guy outside the razorback stadium hold a couple tickets to sale where you get this national organization online that seldom for way way above that I just where are we right now on that are so yes senator I would say Arkansas threw in the towel on that about twenty years ago because we've never enforced the fact that the scalping was going on and so you would see people with literally fifty tickets outside an event that's supposed to be sold out the fact that now I don't think you'll see a paper ticket to almost any event in the State of Arkansas whether it's an entertainment event or or a sporting event. And and what this bill does is realizes Parkinson's I've never really had a say in how that scalping occurred and now they do and now they're able to hold them accountable if they can't guarantee the ticket or if it's fraudulent or if you are a disreputable secondary ticket sales because it requires you to have a phone number and email address or have someone on site to be able to address that so that's that's why we had the support of large secondary ticket markets You do have to take those steps to guarantee the ticket. we we've we've had conversations with several other of both primary and secondary ticket markets thank thank you for that Sir yeah thank you answer that right there thank you seeing no further questions that I need one more if you don't mind Mr please make a Class quickly on the on the ten day. Or are you going to have like the whole season there so if you are are you gonna try to like post all the all the tickets like at the very front in so the ten days is going to expire and then if it gets to be day forty fifty or sixty and everybody's the team's doing good how are you planning on marketing that is going to be just a few days before each game or bill thought that through yes Sir most of that is dictated by the season what like we have to budget so we have to know what the sales are on the tickets so those ticket sales occur at different points for each sports we have nineteen sports and and so that'll that will precede each one of those sports okay so really the the ten days is not going to be that big of the I mean. And what does it do its and their exemption to the current code for someone who is over two years experience managing over fifty units or more for someone who possesses a national certification that is not a felon and requires a one hundred thousand dollar fidelity bond. It's simply help to fill a gap that we have a property manager specially on the lower end there's a huge shortage of property manager in Arkansas especially in the lower end there's also a large portion of property being managed out of state management. This would help the bill in this industry in Arkansas by allowing people already doing this work to grow their business people who are already in the community known by the community that are more likely to care about the community. What is this bill not due it does not change Arkansas River state law it did not let just anyone many property it is a very merry exemption that allows individuals who are already manage your property at a high level the Freedom of growing your business by filling in need and I want growing and in the industry it is not Grove government and I think that's very important when it does not Robert from that to. Almost no education on property manager is required to be licensed members this will will fill a tremendous need in our community All property managers are under Arkansas law we're subject to code enforcement we're subject to city occupation tax we're safety to the fair housing act the disabilities act and have built the act is that not enough agencies already. This is about property management not sales it is my. Give me is my. Educatee pain that we need to stop putting a private organization control the State Commission concentrate on growing in industry serving tenants and owners of Arkansas I'm asking you to stand up for the people of Arkansas this is for tenants and owners it's a very narrow the solution is letting people do it that are already doing it it's a line someone like a young lady that works for me this been manager property for over ten years at certification and in the fair housing act that knows a tremendous about. And I'm getting old and I'm quitting she can continue on you hear about a waiver. But the real estate commission is freely admitted to me that waiver does not work it's been used only eight times in the last five years. And. One of them times which may one time for the nother legislator to a more out of state and I couldn't find out about the other four but it's obvious that the waiver is not working. What other industry are you required to have two years in an area that has nothing to do with what you're doing. You know it's it's so I'm just asking that you will take your consideration this is a very narrow thing that helps the industry in Arkansas I'm also point out that the the real estate commission is being charged with lasting this for years but yet they're not advancing it and not doing anything with it. My daughter for example who has passed rules that she is a real estate license sales license and if she if the HVAC system went out in her house which it did recently of. She didn't know what to do these are property manager I mean she calls are dead you know which is fine I get that and but when you have a it to me we're talking about totally different skills here in my. Am I missing something or is that to pretty well what we're talking we're talking about this skill over here it's like a you know the a Dennis versus podiatrist I mean not saying that anyone who went to medical school some cabinet that know something about it but I don't want this working on my foot and I don't want to but I interest you know working on my teeth if I. Am I seeing this correctly I would say yes I said there's an extreme difference between property management and sales and if you look at what we're requiring of the state of the real estate sales for for Alaskans I have to look in the test I found out about the waiver only after I become state Rep or when a commissioner tell me we don't want you to know about it but they allowed me the waiver so I took and the test is so that it took the test to the broker nothing absolutely well let me be completely honest there's a smidgen about fair housing act there's nothing about best practices there's nothing about the happy bill the bill there's really nothing in that it helped me be a property manager I created to a car dealership in a car dealership you have a sale car salesman and you have a mechanic they both work they both deal with the car so the car is the Adam. But would you rather have the guy working on your car that has two years of experience or would you rather have the sales person did mechanic work on your ear then this is a simple exclusion it helps there's so many people out there that already managing property but they're blocked for managing other people's property because they will spend two years of their life being a real estate sales person. You mentioned that this waiver and that he just found out about it after you became a legislator with this is something through the real estate commission yes Sir I had you know I had over four hundred rental units it might have them selling off I'm getting old I'm this is not for me it's for others that they want to do what I wanted to do I have over four hundred units and people every week asking me to manage your property but I couldn't because I was one of the bigger if not the biggest in garland county and I did the best opinion a really good job that the so when they asked after so much I said you know this makes good sense for me to management I have I have a maintenance crew for a ready crews owned Electric Company HVAC company I can manage to provide the services better than anybody else so I said I'll go ahead and take this sixty hours of education and test to get the agent's license and I did that and I will say in that there was a small booklet on property management in the course and I took the course twice once because that eighty years ago then I decided to go at it again both times they said except that book you don't need anything about property mentioned nothing about that is on the test so I took the test pass the test when I went to a broker because then I found out in an education that I had to take that license and put it with the broker for two years and take continuing ed on sales. That when I went to bed with a broker they wanted a piece of my property a piece of the money and so I chose not to do it so after I became a state rep I went to check in to effect this law and at that time they tell me there's a waiver and I said I know anything about waiver what waiver tell me they tell me and I said well with all due respect thank you Richard McGrew not find out about this waiver but state representative Richard McGrew could and that person told me we don't want you to know we have more property with property management and anything else in my answer to that is then why aren't you requiring education why aren't you helping to grow industry because you're not. And who said if you we don't want you to know I don't when I'm at this dance being quite awhile back I didn't write down the name and what was his position I believe is one of the commissioners on the restatement on the state real estate I believe. Yeah I also worked hard with three State Commission and and and the Redditors. To try to get a bill that helped develop read a property management licensed. And I mean I spent hours and hours months on this family turning over the bill to it I want to thank Dan Parker who was a great help in getting with the real estate commission to try to create this bill which they added twenty pages to my bill and in that one of the person is a did was take the property management out of the recovery fund and require this fidelity bond and I didn't like some of the content in in that bill at all but I was trying to get the bill passed a state okay guys if I'm okay with this are you okay with this and the answer was no we still have the power and the money to queue your bill. And at that point I went went to this was extremely frustrated I tried very hard I think we need to build industry we have a lot of problems in Arkansas with tenant landlord relations we need to work on a lot of those come from out of state you know and we got those now the big one here in North Little Rock I can't remember the name of it did made the paper a Wynn and receiver shipped it to the Attorney General we got hot springs Housing Authority in hot springs seven both of those are last and by the real estate commission but to really take mission didn't do anything to solve the problem you know we have a lot of problems in landlord tenant laws and we need to work on those but at least what this does is let professionals that are in the business that are managing property that understand and no property if you manage fifty units for two years you know what you're doing. If you're worried about you know. Of them going out and tearing up the industry they're already out there already doing it they're just doing it for somebody else now or they're doing it for their own properties like I was you know it said and you know if you understand the fair housing act if your landlord you understand that because you realize it's if you don't if you discriminate get someone or you do something wrong then go to that fair housing act and they'll be on you in the government will pay for the attorney to come after you there's there's lots restraints already on this Senate benzo. Thank you Mr you you mentioned that you had to do a different job for two years before you could do property management I just just want to correct you on that straight out of real estate school you can be a property manager you said that in committee on the other side you sitting here that's not an accurate statement you can come straight out of rules state school and to property management you can do residential you can do commercial you can do land it's up to you to diversify it's up to you to get continuing education that That you need so I just want to clarify that before I get started you and I have had many discussions on this and I guess you know met with you in the real estate commission of rules the Commission and then the realtor association separate time and there were some compromise language that we came up with an you initially started trying to create a new license why are you trying to just doing an exemption now. If if someone's lost their license. Due to. Being a bad actor in the property management world. Your bill allows them to come back in if they meet the requirements of the the Two years and fifty properties is that not correct. I would say if someone at the end of your question I believe it would but I also believe that the free market. Dictates that you know the freedom you know also my they sent in this also has to do with that with property manager at should we have the right to choose there's no regulation under short term rentals in their flourishing in Arkansas. So yes the free market the lawyers are out there to protect the public about those kind of people okay so that they can come back and still or manage property after they've lost their license for stealing money as long as it's not a felony okay so to make sure that you have the ball and you said that there's several things in there who who's going to make sure that you have that long. Okay let's try this again stazi Hamilton I'm a real estate broker in Little Rock Arkansas also been a property manager for fifteen years. I would like to speak against house bill seventeen hundred prior to being a realtor I worked at the attorney general's office so public protection is F. for most my most important concern regarding this bill by removing the requirement for ledges for licensure you are disrespecting the professional property managers that are working hard every day in their field to do a good job by the public imagine being an established attorney and all of a sudden you're license means nothing and anybody anywhere can start representing people regarding their legal cases real estate school does not teach you how to sell property real estate school is not focused on sales real estate school is focused on how to protect the public in the real estate business property management and real estate sales are exactly the same business in regards to their responsibility to the public for fair housing financial fiduciary duties and disclosure. Today property management issues can be heard at the real estate commission. My biggest concern is protection of the public in this regard by removing the opportunity for tenants and landlords to file complaints at the Arkansas real estate commission you are crippling the opportunity for the public to be heard. By removing the licensure of large property managers you are increasing the opportunity that more will stand to be hurt this state oversight of these cases is absolutely necessary to protect the public's ability to find a home and be treated fairly by all parties involved. If you remove licensure who will oversee future complaints and cases to protect the public do you understand how this will affect the minorities and low income tenants in our state similar to real estate sales license property managers are trained to protect fair housing first and foremost and we are continually reminded and studied in these areas are licensure confirms that we are trained consistently on fair housing and how to follow the fair housing laws the public will receive a huge disservice to not have a professional who is consistently trained and mindful and fair housing representing them on their behalf do you expect to ensuring property manager to respect and enforce fair housing appropriately. Similar to real estate sales a license property manager has a fiduciary financial responsibility to manage the fines of the lease. They're real estate license educates them on how to manage the moneys of the lease agreement responsibly without this training financial mis handing mishandling absolutely will increase significantly. Similar to real estate sales disclosure of the condition of the property is absolutely required do you anticipate an unlicensed property manager will disclose issues manage the condition and repairs to tenants appropriately when one is not consistently trained on the rules of disclosure how can we expect them to act really provide this information to the public this bill removes the progress that we have made and it sends us decades backwards in regards to fair housing. Most specifically removing professionalism in this industry will be a huge mistake to the our Kansans that are licensing protects the most. I'm from hot springs and I am speaking on behalf of for the bill house bill seventeen hundred very briefly let me tell you my story in two thousand eight you want the youth pastor of the church bought a little duplex since got into the rental business I just by myself I kept working hard for the next eleven years agreed that a little over three hundred and fifty dollars and hi I was at a church function and there was a man that came to committee said Hey I've got over fifty low income units he said I'm having some problems with my property manager they just don't really seem to want to mess with the low income units so I said oh yeah I would great I'd love to do it I've got over three hundred doors I've got maintenance staff I've got in office Page no problem couple weeks later I was that does a family get together and there was a a broker friend of mine there and I was all excited telling him that Hey I'm going to be able to help these people and he said oh no you can't do that and I said well why can't I do that is we are not a real estate agent and I civil I don't want to be a real estate agent I want to help manage these real properties he said all but you've got to be a licensed real estate agent so whether two totally different industries why would I need to be a licensed real estate agent to help them out. Anyway so I went ahead and I just told my friend I said I'm sorry I can't do it I don't wanna get in trouble so I can't do this over the next eleven years I had I'm at that point over four hundred and fifty dollars brought to me units that they wanted me to manage almost all of those low income units and I kept saying no no I can't do it I can't managing mine finally in two thousand nineteen I said you know what forget it I'm gonna go get my license I went to the I really want to real estate school did that the sixty hours this here represents the book from the state and it represents the book all the materials that I was giving in my class on learning to be a real estate agent this represents everything in this book having to do with property management this was four years ago when I went to get my book out there's a big tax across this that I wrote four years ago when my instructor said we're running out of time we'll come back to this just exit out and if we have time we'll come back to it later and I didn't but if I had got the training on property management. There's the training on property management there's the training on being a real estate agent I don't want to be a real estate agent I want to be a property manager but I did it. One hundred percent correct on and after I graduated I passed the the law portion pass the other portion I went straight to a broker in town and I said Hey I've got over four hundred and fifty dollars I want to put these I understood I had to put them under a broker ship for two years he said why don't management statement yes you can use my broker ship but he said I would want four to five percent finally getting ten percent that's forty to fifty percent that that broker was going to get of what I was going to do all the work because I knew I'd been doing at this point for eleven years he hadn't done it at all I went to another broker another broker three different brokers with fifty years combined in real estate none in property management and they said Hey yes you could use us but anywhere from three to five percent as what I was given which is thirty to fifty percent of what I was gonna make I was very discouraged I said forget it I just put my licensed and active since then I have and I went back to when I testified before the house that went back and I got actual numbers I've had over nine hundred and fifty dollars brought to me because I what I do is I do it very well this is my life this is what I do every day I bought hundreds and hundreds of real estate deals I've never brokered one deal myself I let the professionals do that I use realtors today I was a licensed realtor number one time and I collected a rule the Commission real estate check. Nine hundred fifty eight of fifty dollars seven hundred and twenty eight of those doors were low income divorce as as of last Friday six hundred and eighteen of those door still do not have a property manager nobody wants to manage the unit that six hundred dollars a month that sixty dollars and we all know that takes a lot of time and effort to manage those that those type units. Big concerns that I'm hearing and I agree with education is a very big concern under the current level right now I could go take all of this for sales get this for property management the real estate agent for two years not manage one realist state piece of property I have nothing to do with rentals get my broker's license and all of a sudden I am a legal authority on managing property that's perfectly legal never having done one bit in property management but now all the sudden I legally can manage property. The guy that for me it's been doing it since two thousand eight with hundreds of doors I can't. Who is that hurting. That's holding the low income housing nobody wants to manage I have the experience. The second issue well and let me be very briefly say I called the Arkansas real estate commission on this past Thursday I asked to speak to whoever was in charge of continuous education I've got the name and the phone number I won't say it here but if anybody wants to tell you who I spoke with I said Hey I'm a realtor I just passed my class what is the required training to become educated on property management the head. They tell me the head of continue significations that there is no required training there's three opportunities there's online classes and she specifically by recommended Kaplan online she said that's a great place there's study schools on the website I called three of the schools to verify this and they offer a workshop she couldn't tell me when the workshop was but there is a workshop none of those are required and three of those are open to the public I can go without a real estate license I can go get that information to education this bill would require more education this bill would require that you have experience or accreditation from a nationally certified accreditation company the last thing that they're concerned about that we all are concerned about is representation. I called on Thursday and ask very quickly I called on Thursday and asked to speak to the fair housing commission and in one minute and twenty eight seconds I had somebody ready ready to represent me as a tenant that had been written down wrong. Twenty eight seconds as it I did go through a wreck I went straight to the fair housing and all I did was Google I just the phone number I also the fidelity bond the two big issues as we heard last week eighty percent of all complaints that come to a rack or have attendance and have to do it to issues according to what the president of the Arkansas real estate realtors association said last week two issues for housing and money so the minute twenty eight seconds I got representation as a tenant who'd been done wrong the second is the money issue the fidelity bond will cover the money issue the third any other issue I called okay again that Arkansans want help in five minutes and thirty two seconds I answered some questions and an attorney called me back the same day. And wanted to hear my case of of what was going on with me as a tenant I have complete representation without a wreck for housing was a minute twenty eight seconds for representation the fellow fidelity bond covers any money issues and the Arkansas law help covered all of that. I want I'm gonna get out of order we've got a so I'm so sorry we we are scheduled to go in at twelve o'clock at the Senate and I it's it's not allow that we're having this committee meeting during that time I so apologize but it's for you or because our agenda says twelve o'clock so I don't think that we can continue pass at.
