I believe the report we've had the same under consideration and herewith return the same with the recommendation that it do pass as amended. Respectfully submitted, Darren Williams, Chair. Any unfinished business on executive communications? All right, members, we'll go to the red calendar. Mr. Clerk, read House Resolution 1003. House Resolution 1003 by Representative Pennartz and all to honor the United States Marshals and their role in Arkansas history and to support the United States Marshals Museum in Fort Smith, Arkansas. Thank you, Representative Pennartz. You are recognized to explain House Resolution 1003.

Representative Tracy Pennartz Unverified 9:42
Mr. Speaker, be recognized. Ladies and gentlemen of the House, it is my great pleasure today to stand before you to ask for your support of a resolution for the United States Marshal Service. As many of you know who have served with me these past several years, the House of Representatives gave their unqualified support for the U.S. Marshals Museum by actually providing some seed money for them to get started. So to all of you who were here then, I say thank you again to you and ask those of all of us who are present today to support this resolution. As many of you know, the U.S. Marshals Service has a long and illustrious history. They have given their lives in service to us as private citizens. The work they do is important. Every day they go to work not knowing whether they're going to come home at night. The work they do with helping children who are preyed upon in more recent years is outstanding. The U.S. Marshals Museum, which will be located in Fort Smith, Arkansas, is currently underway with not only a local campaign but with a statewide fundraising campaign and later this year we'll be raising private money nationally. So I ask the House's support of this resolution, I would be glad to answer any questions. If not, thank you ladies and gentlemen of

Opposed, no. Mr. Clerk, let the record reflect. The vote was unanimous. The House Resolution 1003 passes. The end of morning hours business. Now, members, we'll continue on the red calendar. and thank you members of the House. This bill would do simply what it states in the title of it, the subtitle it would amend the requirement for an audit to be performed for anyone requiring or applying for a state contractor's license, and it would require in its place a financial statement. A financial statement is a lot less expensive. It's a lot easier to obtain through an accountant or a CPA at this point in time, and right now there are very few accountants or CPAs who are actually doing audits, and it's harder to find one that will provide this service, and the expense is rather great to those wishing to obtain the license. It is a proposed bill that was recommended by the State Contractors Licensing Board, and I would appreciate a good vote. Thank you. Representative

what is the current process for getting your license renewed with the Contractors License Board? Does it require an audit or an audit review?
▶ Play Suggest a correction Report an error

It requires an audit for the contractor's license, and this would amend that to only require a financial statement. Okay, thank you.

Thank you. Representative Barnett, what purpose? Question.
▶ Play Suggest a correction Report an error
Representative Jonathan Barnett Unverified 13:50
Do you recognize? This reminds me of the old days in Dun & Bradstreet when you have to be audited and then all of a sudden they released that requirement and everybody went away, but this is significant in the sense that all of these years, ever since the beginning of the contractor's licensing board, you've had to get an audit every year in order to keep your license. And I guess I'm surprised that the licensing board is requesting this. There's been a lot of contractors that have gone out of business in the last year or two and a lot of bankruptcies. Can we get to the question? Pleasure. Thank you. This is something that the licensing board wants to reduce. They want to go from an audit position to just a financial statement. that's something that the whole board supports absolutely the um greg crow was with

Representative Betty Overbey Unverified 21:01
You're recognized. Thank you again, Mr. Speaker. Members, this is the third municipal league of the day. This bill sets out to act as mayor in the absence of the mayor in the first-class cities. It's been a law for many years that the recorder is the acting mayor in the second-class cities, but it's unclear who acts in the first-class cities. This bill makes the city clerk, which is the same as a recorder in the second-class city, or another elected official of the city designated by the mayor, the acting mayor in the absence of the mayor. I would appreciate a good vote.

We take a question, Representative Overby. Representative Lane, you're recognized for a question. Thank you, Mr.
▶ Play Suggest a correction Report an error
Representative Betty Overbey Unverified 21:54
Speaker. I've got a little background on this. I want a little clarification. The executive committee approved this. Yes, sir. Okay. Are you talking about with municipal leave? Yes, ma'am. Yes, I just talked to Don Zimmerman. Okay. And because I had been questioned about the way it had read here, that they understood it to read if the mayor had designated. Well, Don told me that it says, where it says, or duties, the city clerk or other, let's see here, of the city, let me look just a second here. Okay. The city clerk or other elected officials of the city, if designated by the mayor, may perform the functions of a mayor during the disability or absence of the mayor. Now, Don interpreted that to me a while ago, that if the mayor has not designated someone, then the city clerk can do it. Okay. Also, the mayor pro tem, which you have the president pro tem, which is elected by the city council. Yes. Does this take away any of his powers? Because my understanding was on a first-class city, the mayor pro tem, which is the president pro tem, would serve in the function of the mayor. This way, if the mayor wanted to appoint a city
▶ Play Suggest a correction Report an error
Speaker 62 23:30
clerk or another alderman other than president pro tem, he could do that? Yes, he could.

mr chairman now it's my understanding that not all cities have elected clerks so the way i read your bill that unelected clerk would become a mayor handling functions that have normally been handled by an an elected official. Is that a, could that happen under your act, under this bill? MS. Now, repeat
▶ Play Suggest a correction Report an error

that. I'm sorry. I missed you. MR. I believe that some cities do not have an elected
▶ Play Suggest a correction Report an error
Representative Jim Nickels Unverified 24:18
clerk. They have a clerk who's been hired. MS. That's been hired, right. MR. Been hired. MS. Right. MR. And so the way I read this, then that unelected person would be performing chief executive functions of the city, but has never been before the voters. Could that happen under
▶ Play Suggest a correction Report an error
Representative Betty Overbey Unverified 24:40
this bill? Yes, I guess it could. I don't think that – this is talking about the first-class cities, and the first-class cities would have an elected one. The second-class cities don't, I don't think. Well, I'm not sure. I think
▶ Play Suggest a correction Report an error
Representative Jim Nickels Unverified 24:56
Little Rock would be considered a first-class city. MS. Yes, it would. Yes, it would. MR. And I believe their clerk is not elected. I believe that's a hire. MS. Oh, is that right? MR. A hire. MS. Okay. MR. So if – and I may be wrong, but that's just my recollection of that. So without some clarification on that, I think it's a major policy shift to go from people who hold elective office being responsible to turning it over to somebody who's been hired in that position. Thank you.
