Representative Darrin Williams Unverified 0:00
Thank you, Mr. Chairman. Good afternoon, Committee. I apologize for being tardy. Let's see. 1304 first. Okay. This is a bill to modify the time period for non-judicial public sale. What happens is when a car is impounded, it sits in an impounded lot, if it's sold, the law requires that you have to keep the proceeds for three years. That means the city has to hold on its money for a long period of time. If someone is going to claim that money, those proceeds, they do it in about the first 90 days. So this just shortens the time so the city can dispose of those monies as required by law in a shorter period of time, not to hold them for a three-year period, only a one-year period. And it's usually we're not talking about a very much

Speaker 3 0:48
amount of money. Are you ready for questions, Representative Williams? Yes, sir. I am,
▶ Play Suggest a correction Report an error
Speaker 4 0:54
Mr. Chairman. Representative Bernard. As I understand it, that means,
▶ Play Suggest a correction Report an error
Speaker 20 0:59
and you're talking in terms of dollars here on line 32. I don't have any problem with the three years down to the one year. So that means they have to sell the vehicle and then whatever monies, what does it mean, the excess? What does that mean? Well, after you

Representative Darrin Williams Unverified 1:19
pay in-pound fee charges, whatever charges may be related to the bill, whatever is left over, in theory, it would go back to the owner of the vehicle. And if they don't claim it now within three years, then it can go to the county. We're trying to shorten that three years to one year so they don't have to hold two dollars

Speaker 20 1:40
for a long period of time. So the in-pound lot person, owner, sells the vehicle, keeps the proceeds for a year, And then after that time, what, he gets to keep the access? MR. The county clerk. If you look

Representative Darrin Williams Unverified 1:52
on line one on the second page, if the vehicle is removed to a private impound lot, the access shall be paid to the county clerk to an account of a person legally entitled to the access. So the impound lot just doesn't have to continue to hold on to it.

Speaker 20 2:07
MR. So if it costs $1,200 for the impound lot, and this is just an example, to keep it for a year and they get $2,000 for it, then the $800 goes to the county. I guess I
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 2:21
understand. I think you may be right. What did
▶ Play Suggest a correction Report an error
Speaker 20 2:25
you say about the $1,200? I apologize. If the impound lot owner, it costs, I don't know how much this is. This is just an example. If it's $1,200 and they sell the thing for $2,000, then the excess, which would be $800,
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 2:40
it goes to the county? MR. That's correct. And the $1,200 would have to represent the cost of storing the vehicle of MS. Letting it rust? MR. Yeah,
▶ Play Suggest a correction Report an error
Speaker 20 2:52
basically, yes. MS. Okay. And one further question, and then I'm through. Who endorsed the bill? MR. The City of Little Rock brought
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 3:02
the bill, I believe, to the Municipal League. Is that correct, Mr. Wilson? And the Municipal League, in addition to the City of Little Rock, has endorsed the bill. But this was brought to the Municipal League on
▶ Play Suggest a correction Report an error
Speaker 20 3:14
behalf of the City of Little Rock. But the Municipal League, what time is it, 4 o'clock? The Municipal League endorsed it. Yes, ma'am. Okay. Thank you. Thank you very much.

Speaker 3 3:29
Thank you, Mr. Chair. Representative Slyker. You have
▶ Play Suggest a correction Report an error
Representative Mary L. Slinkard Unverified 3:34
the, your turn. All right. Thank you, Mr. Chair. Representative Williams, under line six on page two, when you stated that these excess monies are paid to the county clerk, under the Unclaimed Property Act, don't they go, I mean, they're held by the county clerk, and then they go to the state as unclaimed property, or does it mean that it is paid to the county general fund? Ms. Slinkert, I would

Speaker 27 3:59
really defer to your wisdom as a former county clerk. Whatever happened prior to this, when it was

held three years, the same thing will happen if it's only held one year. I apologize. I'm not positive about that. All right. Thank you.

Representative William, a quick question for me. During this transaction, is it any way that the owner is going to be notified that he may or may have access equity in that property? Is it under current law or
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 4:32
statute? MR. It's my understanding that the impound lot has to make significant efforts to notify the owner before they can sell the vehicle. They can't just, it has to sit there for a period of time and have to make significant attempts to notify the owner before. There's a process that has to take place before they can actually just sell the
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 4:54
vehicle. MR. So they sit there and then they advertise, either advertise it in the paper they're going to have a sale, they sell the property. Does the owner, when they make that notification that they're going to sell the property, I assume they'd make that notification to the owner before they
▶ Play Suggest a correction Report an error
Speaker 35 5:08
do it? Yeah, the owner can always come back, pay the impound fees, and get his cart back before it's sold. But if they sell it and there's an excess, does anyone notify the owner that he may have an equity due him? I'm looking at my help from the city of Larkin, they're telling me yes, that's correct,
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 5:26
that's what happens. Okay, thank you. Any other questions from Reverend Williams on 1304? What's the pleasure of the committee? We have a motion to do pass. Is anyone in the committee in the room who would like to speak against the bill, for the bill? All in favor of the motion to do pass motion on 1304, say aye. Aye. Any opposed say no.

▶ Play Suggest a correction Report an error
Speaker 48 6:59

▶ Play Suggest a correction Report an error
Speaker 50 7:04
We were told that the amendment would be here
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 7:09

Representative Clark Hall Unverified 7:16
not mind, if you would step aside and we'll run down to the regular agenda and when we get the amendment we will come back to this bill I appreciate that thank you yes sir thank you we're going to the regular agenda House bill 1409 is anyone here to run that bill the amendment is on its way so we're going to represent Williams if you'll just bear with us. House Bill 1292. House Bill 1498. No one? House Bill 1577. House Bill 1602. House Bill 1739. Look like you're the sole winner, Representative Williams. That would be nice. I'd appreciate that. We're just going to sit here until we get the amendment, ladies and gentlemen. While we're doing that, we have some house cleaning to take care of pertaining to the constitutional amendment. And we need approval of the committee. We're going to ask for approval from the committee. Do we have our calendar handy? The constitutional amendment is meeting as the committee sees fit. I think you're planning to meet in the morning, 9 o'clock, is my understanding. With the approval of committee, we will hear as a body, as a whole body, we will hear the constitutional amendments and the recommendations from the subcommittee on March 9, 2011. On March the 16th, 2011, will be the last day to run a constitutional amendment. The last day to run constitutional amendments will be March 16th, 2011. We will set a special order of business to hear the constitutional amendments as a body at time we'll print on the start and when we take up business from the regular agenda on March the 16th. So if we run out of the regular agenda on March the 16th, we will start hearing constitutional amendments and rank them by vote. Could

you have the staff give us those dates?
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 9:42
We certainly will. Thank you. You will get this copy of what I'm reading from the staff right now.

▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 9:55
us who's on that subcommittee? Well, yes, ma'am. The members of the subcommittee is Representative Nichols, Representative Schlinkler, Representative Cheatham, Representative Roebuck, Representative Duncan Hutchison, Representative Hobbs, Representative Tyler. Representative Klemmer, do you have a question?
▶ Play Suggest a correction Report an error
Speaker 57 10:15
Do we have a, after tomorrow, do we have another day for the subcommittee? Yes, ma'am. I was asked to come tomorrow,
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 10:22
but I had a previous conference. Yes, ma'am. We're going to run some next week. of next week is my understanding is that the subcommittee is tentatively setting to run next Monday or Tuesday to hear the rest of the subcommittees because we have a couple that were shale bills that will be filed Monday. So I presume we will listen to
▶ Play Suggest a correction Report an error
Speaker 59 10:41
them next Tuesday. Tuesday afternoon would be what you're
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 10:44
thinking after adjournment? That's my understanding in visiting with the subcommittee chair, Representative Nichols.
▶ Play Suggest a correction Report an error
Representative Ann V. Clemmer Unverified 10:49
Okay. And that will be the last day for the subcommittee to
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 10:54
go. That's right. That's the right day. And then from that day on, the whole committee is going to take it over. And what the subcommittee did is to do is certainly to just give the sponsors a chance to discuss their amendments and maybe find out some issues and correct them before they meet with us. If it's appropriate, I would be willing to schedule
▶ Play Suggest a correction Report an error
Speaker 28 11:15
for Tuesday. Or is that – do I have any choice in the matter?
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 11:20
You would need to take that up with Representative Nichols. Okay. You can show up. I mean, you're on the agenda. Those who have not already presented their amendments, they're on the agenda for – Or even Monday. Okay. Like we do a regular agenda. So you're assuming that after
▶ Play Suggest a correction Report an error
Representative Ann V. Clemmer Unverified 11:36
Monday, Monday afternoon after adjournment, the committee will – That's my understanding.
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 11:40
Okay. Monday and Tuesday. And then after that, we're going to have to take it up because we're getting pushed by the Senate to hurry up. They're ready to hurry this up and move on. Okay. Thank you, Mr. Chairman. We're going to get that out. We'll get the constitutional amendment. It's very soon. Before we leave here, we hope. Anyway, ladies and members, we will get these dates out on the order of business that we're going to take up as far as the constitutional amendments. There's numerous bill, Representative Cowling, for your information, there's numerous bills out there on the congressional redistricting, so we will see how they play out. As an amendment being passed out right now, Representative Williams, do you have that amendment
▶ Play Suggest a correction Report an error
Speaker 35 12:47
yet? Yes, sir, I have it. Have we got one?
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 13:01
Has everyone got a copy of the amendment?
▶ Play Suggest a correction Report an error
Speaker 67 13:17
Yes, sir, I'm trying to make sure it's
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 13:28
correct. One second, I'm sorry. Did everyone get this report that was asked by Representative Nichols the other day on Has everybody got that while Representative Williams is reading his amendments? Make sure everybody gets a copy of that. Thank you.
▶ Play Suggest a correction Report an error
Representative Darrin Williams Unverified 14:24
Mr. Chairman, I apologize. I don't believe the amendment properly strikes the correct words, because maybe someone can help me, but it doesn't read correct at all, I don't think. So with that, I may just have to fix this. If it's
▶ Play Suggest a correction Report an error
Representative Clark Hall Unverified 14:54
not the correct amendment, we will not be able to run your bill today. Thank you. Yes, sir. With our objections, we'll let Representative William pull this back for a corrected amendment. We have that. Representative William, thank you. Ladies and gentlemen, since we've already run down the regular agenda and no one was here to run their bills, we stand adjourned until... The subcommittee meets tomorrow at 9 o'clock. Representative Nichols, your answer to your sheet metal is on your desk. Is there any other questions from the committee? Anything? Anything that's stuck? Okay, we'll see you all Monday. Are we meeting Monday? Representative Nichols, is the subcommittee meeting Monday? You're meeting tomorrow. Tuesday is the last day the subcommittee can run because we've got to move this forward to comply with this. You may have to meet Monday and Tuesday because we've got some shell bills that are supposed to be formulated in the entirety by Monday. Okay, would you do that? Okay, you want to make that announcement Monday? We're going to go into session Monday, okay. Nothing else, we will see everybody. Y'all have a nice weekend.
