Next on the agenda we have an adoption of the reports of executive and standing committees and will begin with the executive committee report senator wallace you're recognized. Thank you mister chairman the executive committee met thursday august twenty twenty three reported to the committee the audit special investigative and shortage reports scheduled to be presented to the standing committees and the four legislative journal of the committee this month and new business the committee approved a request for a staff to perform certain procedures to assist with the transition to the office for the newly appointed treasure of state with no additional business discussion the mini was adjourned the next meeting of the executive committee is scheduled for thursday september the seventh twenty twenty three I moved for adoption of this report. The stick the committee adopted the minutes of the meeting held on june first twenty twenty three interviewed one hundred ninety six current reports of these one was referred to the governmental bonding board eleven will refer to prosecuting attorneys in three were referred to the attorney general officials from three entities were present to address repeat findings the committee found one hundred eighty nine current reports in deferred seven so that officials can attend the september meeting to address unresolved findings the committee approved district court accounting low exemption letters for yale county state district court in the seventh judicial district state district court of jarts and county. Guess from the jeep volunteer fire department were present to receive input from the committee on how to resolve a local conflict regarding the operations and finances of the department the committee adopted a motion recommending that the full committee requests the attorney general's assistance to the new volunteer fire department board to access phones held by the former board officials from the city of august to present to explain why they're private all of it audits have not been conducted and the report submitted to legislative the committee passed emotion requesting that the executive committee authorized there to perform limited procedures on the august to financial records for the fiscal years twenty twenty one and twenty two minutes chairman I moved the option of this report. Certified to the government bonding board as well as referred to the applicable prosecuting attorney additionally there were five school district auto reports that will referred to the applicable prosecuting attorney the out of report for the four city school was deferred to the next meeting so that representatives could be present to answer a committee questions related to findings in the audit the committee filed thirty eight current auto reports and two deferred auto reports that were brought before it mister chairman I moved for adoption of this report. The arkansas educational television television commission had several issues related to procurement and the use of bidding and contracts in addition personnel time charge to grants from the department of education were not properly reconciled to asus or properly supported various agencies members were present to report on how the agencies intended to address the audit findings and to answer committee questions. The committee reminded the agencies of the importance of falling proper procedures regarding appropriations and requests for additional finding. During the meeting the committee filed eight of the reports the a t c report was deferred to the september meeting in order for the agency to be able to provide additional information mister charitma for the adoption of this report. From the stabilization fine but when that fine would have been divided out it would have been less than what was needed to address the need so they went ahead and moved this money from another account. We made a very clear in the committee that they could win to peer and got a transfer by inner agency transfer because they had plenty of appropriations they just didn't have the funding so I just think it's important that we get their word in this community today that going forward when they see this negative balance common they'll start addressing at that point instead of waiting and then moving money that was not appropriate for that purpose so mister if you would i'd like to call them to the table and make sure that we get their word on that. Thank you miss chair and one thing I want to bring out is you know these agencies move this money around and the only punishment they have they come here and they say they won't do it again and on monday this will be forgotten and this problem is an ongoing issue it is an issue that we need to address as a legislature to figure out how to reimburse our jury duties in our county level the funding level it it's according to yesterday in according to testimony I found out last night it's a huge ongoing problem so with that I expect you guys to work with the legislature coming into the physical session figure that out it and work in the regular session two years from now and and let's get it permanently fixed so thank you mister. Senator dots and you're recognized thank you mister chair or here decide sorry I wasn't able to make the meeting yesterday to hear your testimony however i'm just curious did you make the decision to do this or how did how did this come about if you wouldn't mind. Just explaining a little bit for some of us that it didn't make the meeting yesterday yesterday so aoc leadership meets regularly eyes the finance director in june of twenty twenty two saw that we had this deficit so we approach the juvenile division director seeing that there were professional fees and services money still available given division director approved and then we paid the county's at that point so did you just not know the this was unacceptable that you needed to have authorization from the legislative branch first or though you saw money was available see just did it so we looked at what jury services and we looked at what are responsibilities are by you know as task by the legislature to reimburse counties for those jury reimbursements we saw that funding was. Particularly down that year then we see okay due to sound fiscal stewardship in this particular professional fee and service find cherry serve jerry service is a service of a kind right and so. We understood that time was that. Applicable now now legislative audit his brought that to our attention well now that's not correct and so we see that now obviously. Again and the most recently concluded fiscal year knowing this information we did not repeat that mistake so that is how it occurred so obviously we've got your word that you're not going to do that again what what sort of policies and procedures do you have in place to ensure that something like this doesn't happen are you regularly really communicating with legislative about it to ensure that you're not. Across the lines that you're not supposed to at that and in a different port regular consultation with DF n a to make sure that we are in compliance and this is our only reportable finding in our least in my six years and being at the AOC that said it's a report will find it we take it seriously and we. Ah the reports of the executive standing committees will move to the next item which is a review of the reports. The first item is investigative report of a review of selected disbursements from the plasky county regional solid waste management district from december first twenty sixteen through june thirtieth twenty twenty two mr lock your recognized to give the report. Thank you mister chair while we were conducting other engagements in two thousand twenty two we noted some questionable disbursements that were made by the plastic county regional solid waste management district so we came back in conducted this review where we examine those questionable payments as well as other selected disbursements of the district. The district was established in nineteen ninety two and serves palaski county in the cities within plastic accounting the districts governed by regional solid waste management board the board is comprised of the place he can each urge and the mayors of jacksonville little rock marmel north little right sherwood in rights for the district assist local governments in place he county with planning and overseeing municipal silent waste management programs in the district also in ministers recycling grants and operates of waste tire program. There were several hours in an eight excuse me an ag opinion that we used is criteria while reviewing these expenditures. According to artists our code regional salaries management boards shall adopt county purchasing procedures in the district should follow them. The stated purpose of artists are code annotated eight six seven oh one is to protect the public sales and the state's environmental quality by establishing regional solid waste management and planning the use of public phones due to here to the public purpose doctor and according to opinion two thousand twelve ninety four the public benefit of expending public phones must be clear and direct. We noted little over nine hundred thousand that was paid to an individual and a company owned by this individual and as you can see on the slide two hundred ninety thousand was paid to the individual its contract labor for waste tire coordination services and six hundred and twenty two thousand was paid to her company for advertising and media services now keep in mind this is over a five and a half year period for we examine these payments then we found two discrepancies. The district eventually solicited beards and internet to contracts for these services I believe that within two thousand nineteen and two thousand twenty one. However we found that the contractor and the company owned by the contractor were paid all over three hundred and fifty five thousand before bids were solicited or the contracts were in place. And also it appears that the company build the district for some services that the contractor had already been paid for resulting in a two thousand eight hundred and eighty dollar overpa. We also noted seven hundred dollars in in proper reimbursements to the district director they used to reimbursements included five hundred one dollars for an employee christmas party that was hailed in two thousand seventeen hundred and thirty seven dollars for parking in meals that had been paid for using the districts credit card and district caught one of those in the director subsequently reimbursed sixty four dollars for then there was a sixty two dollar lunch with district staff with no business purpose indicat. We also noticed sixty three thousand six hundred and forty five dollars in contributions to charities and other organizations that did not align with the purpose of solid waste management districts or the public purpose doctor. The contribution is consisted of thirty one thousand in event sponsorships seventeen thousand paid to a nine profit organization established and managed by the district director. Fourteen thousand in donations without contracts for services and twelve hundred and fifty dollars for tickets to a bank with without an apparent business purpose also the district purchase two paintings. For fifteen thousand forty six dollars in january two thousand seventeen. Then and you land of twenty twenty they donated the paintings to the little rock convention and be a strip bureau so we question whether this purchase in the subsequent donation meet the purpose of salaries management districts. We met with the district director in the cfo would you last seventeen to go very findings and we recommended that the district solicit be it's an obtain contracts for services when applicable and that the district insurer that dispersements compliance with the public purpose doctor in and the stated purpose of solid was management districts provided in arkansas code annotated eight six seven one. And mister chair that could close my presentation and believe the director is here to answer any questions from the committee. Thank you mister so it's my understanding there is a representative here of the plasky county regional solid voice management district is that correct. Yeah. The. The. Greg douglas director of the regional solid waste management district complex account. Good morning and thank you for being here today we typically swear witnesses and during this. That kind of portion of an. The meeting but in this case i'm not going to do that i'm gonna let you. And I give you a response and at some point we do that necessary we certainly reserve the right to do that but you're recognized and then we'll open it up for questions after that thank you thank you mr chairman as mr lock stated the the report was done over five and a half year period from december first twenty sixteen june thirtieth twenty twenty two the questionable payments the first one that was sited in mr locks report was waste our coordination and media advertising services are with the advent of the new waste higher program in twenty seventeen that was adopted by the legislature we felt it important to to quickly bring on board and independent contractor to modern to the development of that program and the the development of what became reg thirty six that arborates the waste tire program so throughout the state the. Then twenty seventeen and twenty eighteen these programs were put in place and is noted by the the audit once the program was up and running bids were taken for the ongoing services in question in contracts now exist for those services I think it should be clarified that the waste coordination payments income encompassed all of the above mentioned services as well as the decude required manifests both electronic and paper for manifests that are interested in to the system operated by the on every single tire that the district collects in those incumbers hundreds of entries per month the two hundred ninety thousand dollars paid to the waste higher coordinator was in fact over five in a half year period roughly forty four hundred dollars a month on their contract and the six hundred and twenty two thousand dollars an advertising services also over the five and a half year period was a one hundred percent pass through of verified media placement for the district the district has all districts do as my understands by understanding we have an information in communications program that we operate our advertising and promotion budget is a hundred and twenty five thousand dollars a year as you know in terms of recycling recycling starts with the consumer if the consumer does not understand the best way and the proper way to to recycle consumer goods are then the program doesn't work so we routinely I have a advertising and promotion program that the contractor operated in and has a contract had a contract to do that are we now bill all those services direct to the district to the cfo because the coordinator simply does not have time in operating the tire program to also. Manage the the advertising program all bids have been taken in contracts or existing in terms of the reimbursements to to myself all of the the events were recycling related and waste reduction related with our staff in the contributions to charities I just to give you those highlights thirty thousand dollars was paid to the clinton foundation and that was for an exhibit called washed assure the exhibit of sculptures was made a exclusively from plastic harvested from rivers lake streams and oceans and these this was a recycling education program that we sponsored for elementary schools field trips that came to the clinton's center we understand from the center over three thousand people attended I and view that recycling exhibit also the the foundation that was noted by mr lock said it was it was a established actually I registered the foundation as a five o one c three and it did receive a five or one c three designation from the IRS the foundation is also recognized by the department of commerce in arkansas and an aedc managed program which is the technology transfer assistant grant program this foundation is received two grants from the from adc and the tea tag program one of those grants for research and information on glass recycling his resulted in the recent announcement of a glass recycling plan for north little rock arkansas are based on the research that the foundation contributed that that plant will create thirty private sector jobs other donations have been made to keep sure would beautiful keep north little rock beautiful. The little rock sustainability conference in the arkansas recycling coalition now finally the the noted payment in twenty seventeen on some paintings that were but for the large convention investors bureau on the opening of robinson center that was. Done prior to my coming on board that was not a proper expenditure that that we discovered after that that I discovered after the fact the paintings were noted that they were on loan to the little rock convention investors bureau and the board decided to donate those paintings and just to get him off of off of our books so those are our responses to mr locks report and i'll be happy to answer any questions. Thank you sir senator mark johnson you're recognized thank you mister chairman and i'm going to try to be as concise as possible although I think I could ask mr douglas questions about this for the next couple of hours but first of all. Mr on page two of the report you monitor the quote of the attorney general's opinion it says the public benefit attending any expenditure of public funds must be clear and direct with any private benefit being merely incidental. Thirty thousand dollars to sparture exhibit that three thousand dollar three thousand people attended at the clinton foundation our summer clinton library is at clear and direct use of public phones and it's it's hard for me to even even far them there but you make it clear in your letter on page eh I guess it would be page two of your letter the exhibit was directly associated with the mission of the regional solid waste management district and increased list what I think about trying to put those to reconcile those two statements could you come in on there oh yes there's senator johnson the the exhibit was to promote plastics recycling. As I mentioned the exhibit was and this is a national touring exhibit the exhibit is was made up of sculptures exclusively from plastic that was taken from rivers and streams areas such as is our own fush creek that contains a lot of plastic ways but this was done in order so that elementary school children on field trips could attend those the the figure we were given was that that three thousand figure was from regional school and other elementary school and other education related field trips to view the exhibit and also to get information about how to do recycling right and the detriment that plastics when they're not recycled the impact that it has on our rivers and streams so we think it is a direct response to to the mission of the regional recycling district and any other solid waste management district have respectfully disagreed if I could do a quick follow up mister chairman does the foundation the seventeen thousand dollars paid to the recycling research resources foundation and it says it's a non private established and managed by the district director that would be you correct yeah II registered the the five or one three the tax dollars were given to the non profit that you are so operate is that correct I don't manage it I established it I registered whom who manages its management board okay and he is the board the same board is your solid waste managed no it's it's a city provide the committee with membership of the happy to yes and in the final thing it would ask you about. If you know we've the journal simply in state government and certainly your agency and others are dealing with it specific problem relating to wait it's a big issue I think we all agree on there so when I see these types of phones cannot being deserted why yes we're all against people throwing plastic and streams it's that's a terrible thing and people are doing not do that but when I see the data amounts in proportion to all of the other work it's needing to be done especially on this major waste tire program and frankly apparently the kind of money would be spent on their I don't know who your predecessor wise I think two paintings to be basically given to the convention of issues bureau is absolute abuse and i'm very pleased that the report has been forwarded to the six district prosecution attorney and the attorney general are do you have any response to what I just say on that on that expenditure I would agree with you a hundred percent what about the the they're on the white hour and the deferment from the year foundation I did your board approved the seventeen thousand yes he transferred to the occasions. None of the expenditures in this report came out of the tire program money which is a as you well know which is a separate a separate phone that is the revenue from which comes from the three dollar removal. I'll have all of the advertising is comes out of the regular administration of the recycling grant program not the tire program is a am I misreading this report where it says that two hundred and ninety thousand came out of there. The way star coordination came out of the waste higher program and over a fab and air for your period okay do you have any relationship with the advertising contractor in this. I'm a trying to understand also the non profit issue could you just explain to me why the nonprofit that's been discussed as even associate with this reporter what marine does it have. Well i'm not exactly sure how to answer that question other than the uh start up of the of the nonprofit the. The regional solid waste management district contributed seventeen thousand dollars. In twenty. Nineteen I believe it was too that uh to that nonprofit and and the purpose to the nonprofit is what again research recycling research is completed to date has completed two recycling programs one for glass recycling and one for plastic recycling under a tag grant from aedc okay and. With regards to all gold to represent a figure question about in a we gave quite a bit of money for what I think the sideways managed district exists for. N yet bush money that was moved abbed i'm just wondering could the money had been moved to take care of the same needs that we gave the million dollars for or where were their limitations as to why that money could not have been moved to take care of the tire issue that no longer on the tire program our tire district and the other tire districts routinely is I understand it used some of the annual recycling grant to supplement the tire program. So the answer you question would be as. Then then why was it not moved instead of. What the money was spent for why weren't why was it not used for that purpose which I think is the sole purpose. For why the solid waste management districts exist versus the dollars being moved to these other projects. Well some of the some of the recycling grant money has been used to supplement the tire program not a hundred percent obviously because it is funded by the three dollar rem removal fee but I suppose you could use the you could use the total recycling grant from d q for the tire program and and in the last question would be now that you're in the position of the jury and what is your philosophy as far as the usage of the money given the. Report that before and just factor we have supplemented so heavily from the past what it what is your philosophy what's going to be your your business management perspective our policy is to use only those phones that are in the proper categories for the proper purposes thank you thank you representative ward law you're recognized thank you mister chair craig uh am slow and sometimes I missed off but if you read down under contributions and donation there's fourteen thousand one hundred forty five dollars there it says under management response go to pindics a when I read all six of those are bulletin points but never seen you explain what that fourteen thousand one hundred five hundred dollars was forty five dollars was for our. What you would do going forward on that and spending that money without contracts. The. Oh okay the the fourteen thousand dollars over that five and a half year period two other non profits oh we were non private like the arguments all recycling coalition in folks like there are quite we were advised I think two years ago by legislative audit is if the district makes the contribution or or does a sponsor share that we should have an agreement with the non profit before we make the donation the district had never done that we do it now for instance the district is so if you do it now why not put that in your management response they should have ed and explain that so that we can account for every dollar that was found in this audit finding I should have included so will you submit that to the audit staff so there will have that on record absolutely and I want to know I want you to break down the whole fourteen thousand let us know where each dollar went be happy to thank you. Senator mark johnson you're recognized thank you miss chairman i'll be brief mr douglas said that the issue of the are payments to the advertising media services was a direct passed through that correct yes was a fifteen percent fee that's usually taken by an agencies was that paid no so there was no commission was net yeah it was a net person okay thank you thank you and and also said johnson the the direct billing that any that we receive from any media today no commission is paid thank you. Representative grant hardest you're recognized thank you chair. I'm struggles helen have you been in the the position you're in now as director july one twenty seventeen. Okay so on this contract or lack there are with the vendor. For the waste tires and the marketing piece. You began paying this without having either doing a bid or having a contract. Was that we started off that after the legislation was passed in twenty seventeen. The trigger for you all at the county levels. To have a bid required bid to thirty five thousand dollars is that correct. I think that's correct i'd have to look that up I think it is yes sir so I would imagine in the ordinary course of your operations you probably have a lot of. Contracts and things to come along that hit that thirty five thousand dollars level. A number of their do yes and we we bid those out as we eventually do this we just did not do it immediately which we should have done so it's the eventually part that i'm wondering about why if you are doing this and a regular basis. And it's probably common practice for you did you decide not to better where we decided to go ahead and and put the independent contractor in place because the tire program was starting it was starting very rapidly it was new we had tire of stacking up we had to start processing tired you knew that was in violation of the law um I did not know at the time I know it now. Okay. Whenever you were you initially started making payments to the spender with no bed and no contract. Then when that was brought to your attention one where the other then you decided to bid it. So you didn't rfp yes yes we did and in the rf the contract was awarded to the same vendor you're already using right did you have multiple bids. I believe we did i'd have to go back and look in several years I can do that. Thank you. Senator patent you're recognized thank you mister chair so mister was the recycling research resources foundation that that nonprofit that you registered guess do you hold a position or have you ever held a position on that board I have served as the executive board member of that are you currently on that board now okay and you said that they had received a grant from eighty dc yes how much was that do you know two grants for a five thousand dollars each okay so this seventeen thousand dollars. There is mentioned here what troubles me in that paragraph it says district entered into a written service agreement with the foundation for future contributions. So they didn't have stop with the seventeen thousand other what is that contract how much is it are there there is no contract there there haven't been any future no nations nor will there be there was a one term donation from the board what is subsequent. Are you saying that's not true there are no future contributions or anticipated it's been several years ago senator travel go back and look at that though you see what number in the middle of that paragraph yesterday and we can we can certainly modify that contract if it needs to be modified because they're won't be any future contributions okay where would seem to me that legislative audit may have misunderstood something there but they saw something that caused them to think that there would be ongoing your expenses the way I read it the other question I have about the two pay names is talked about the fact that they were. Purchased before you were the director with the dates here would indicate. That they were purchased in twenty seventeen but donated in twenty twenty. The the board decided to donate those to the world where they in that interim they were at the at the robinson center as I understand it i've never seen the painting so I really don't know okay well they were obviously very valuable painting certainly five hundred dollars a piece. Do you know who we purchase them I do not know okay. So they were basically in january of seventeen when they were purchased they went straight to their destination as I was a formerly donated until twenty twenty. Thank you thank you mister chair thank you. So I have a question just out of curiosity why is a regional solid waste management district in the business of owning paintings in the first place. The. I don't know mr chairman I don't think we're in the business to own bandings. Response number one from your july twenty twenty three it says the other period from december first two thousand sixteen through june thirtieth twenty twenty two we would note the current executive management of the district did not begin until july first two thousand and sixteen yeah that i'm not sure what that resident yeah that's a typo is two thousand seventy that's what I assumed but I wanted to confirm and then the the next question deals with the employees and and the contract labor or or subcontract whatever you want to call it. Before the coordinator is there is there any reason why you have that as a as a contract as opposed to employee on sale that person is now a full time equivalent employee it started off initially as an independent contractor because of the start up of the tire program and and and they the two hundred and ninety thousand it was mentioned by added. All of that occurred in the five and a half year period in a new most recently how how long ago did they become an employee a year and a half ago. So if if the state continues up to participate in these solid waste districts do you think that the plasky county regional waste management district will continue to give money to non profits for educational purposes or any other purpose. I suspect when we our current policy is is to support non profits that have a direct recycling education benefit. Or that have things associated for instance with community cleanups we do that routinely I would suspect it that our board would want to continue that I don't know that but it it seems to us that it is AAA proper use of funds to support the communities we serve within the county for a community clean ups for education on recycling and other environmental related issues. Did you and I think this question would ask you have a shortfall on the tire program. Yes. In even with that shortfall and I know this was asked you think the best use of the the management was to spend thirty thousand dollars at the clinton library instead of taking care of use tires where the thirty thousand dollars did not come out of the tire program. And I think you said that it was because it was recycling from streams and rivers or something plastic recycling and you said you are suspend money to support community cleanups did you think to consider spending thirty thousand dollars it just actually go clean up a river or a stream take the recycling out of the stream or take that they'll waste out of the stream that recycling at the annual recycling grant is used routinely to support communities when they do community clean up so we do not actually do the actual cleanups communities have contracts with with different service providers and we participate in those by providing roll off dumpsters things of that nature. For wait higher coordination services and your company owned by this contract for advertising media are those two one in the same thing yes yes okay and did our stand and answer to the question while a girl the normal rate for advertising would have been fifteen percent but that was waived or not yeah that's the west what advertising agencies usually retain but these those are called gross services these world and net no commission. How is it that they would do that and why would they do that because to me if i'm a business handling those kind of dollars in our way fifteen percent. And we attended the bank with and supported the bank with because of that agreement fill and her smith i'm sorry was with for lander smith college. So it was a recycling bank with we we participate in the bank with because we were doing they were doing recycling us recycling program on campus as a test program for the district and so we attended the bank with okay but to be clear it doesn't sound like the bank would have any nexus the bank would have self did not have a direct relationship to recycling though we were engaged in a recycling project with the campers so in that case what benefit did the solid waste management district derived from that spartreship. Just supporting the lander smith okay well I would just say that I share representative of word laws interesting having a itemized breakdown of all of these donations to various charities and non profits that didn't have contracts and it share the I share the observations of. A great number of my constituents would be livid if they found out if they read the findings in this report and found that thirty thousand dollars and money from your entity was given to the clinton foundation. And enter your testimony earlier all those donations were made to people that were working in recycling so I just wonder how these people benefited recycling the donations that I approved where i'll recycling related the once you decided were made prior to my coming on board what year did you come on board july one twenty seventeen. So the best friends animal society was done nine nine nine thirteen nineteen so that was under yours so what did they do not benefit I would have to look that up representative or I have no recollection of that donation the john and kelly robertson down it was done that same day in two thousand and ninety I don't think that's correct i'll have to look that I approved I did not approve either one of those donations in my recollection but i'll find out. On the investigative reports they are usually referred but on on this it's any time there's a what would we be considered a misuse of public phones and here where they are our spanish looks like they're there some constitutional provisions violated i'm required by law to refer all of those where there is an apparent misuse of public funds to the prosecutor okay mischair i'd like to make a request at one dish when gits put up to the prosecutor that the staff. So at mac my question is the seventeen thousand dollars that went to the foundation i'm more concerned about how that money was expanded in where that we to follow the paper trail even further than then just from the solid waste district to the foundation and and hopefully the proskin internet can get that information and they may be give us some god somewhere the response we are unless you'd like to tell us how the foundation expands those monies well the foundation expense those monies periodically on on research programs recycling research program says the purpose of the organization. You hire contractors you have research we have had a contract we have hard contractors in the past. I have done some of the work we have had to contractors and then we've also done the work that that we were given two grants from adc on research for plastics and glass recycling yesterday it just looks like everything's a little too kill mangled. The there have been other donations to the district that have paid credit governments communications yes sir. The the original contribution from the district was to start up the foundation and and to also look into additional research on plastic and glass recycling which ended up getting additional grants from adc. Now media services I would assume would be bill boards and radio newspaper print media or something like that how familiar you are you with the automobility of of how that six hundred and twenty two thousand was spent. Oh. What can what was encompassed by the term advertising cause I mean you know you can buy ten thousand dollars. Trailer and hanging out two hundred and fifty dollars on it and call it advertisement are these were over there over that five and a half year period have been actual paid media in terms of television radio billboards the purchase of what could be called infrastructure vehicles are no no no trailers young no no actual paid media services as well as as well as handling the invoices and the payment of those services. Okay so now. We just found arrives found out that you run a communications business. Did any of that six hundred and twenty two thousand for media services. The research foundation which is your own company the entity that you personally started as that right the research are registered yes okay and you're the one who's conducted the research is that right some of the research and that's paid from the foundation that you sit on is that right yes okay and then. At the same time you also are the director of the regional solid waste management district correct and I assume that you receive a salary for that I do. And i'm sure it's public information but what what's the salary that you receive for being the director of the regional solid was management district I believe it's a one hundred and thirty thousand dollars a year so you get a salary from there do you receive any money for serving on the foundation board no when did you begin to serve on the foundation board. When I the registered it I guess that was two or three years ago. No not the research fat so my understanding is that there's two enter two entities there there's a foundation and then there's the research foundation that you'd have that that's the same thing craig douglas communications is a company that i've added for thirty okay so tell so crack that that's the other one so there's the research foundation there's craig douglas communications and then there's the regional solid waste management distress and you're involved in all three of these entities yes and there's money that's been that's changed hands between all three of these entities is that correct. The foundation yes the reason has the regional solid waste management district paid money to the foundation. Are they the original start up of the foundation yes which is for you to do research which was for the foundation to do research some of which I have done what what kind of research did you do a on glass recycling on a plastics recycling on developing markets for recycling. Did the regional solid was management district pay money to crack douglas communications no did the foundation per money to correct out whiskey. So the regional solid waste measure of district paid money to the foundation which then paid money to the business. Right. The. Yes. All right representative landified you're recognized. Is there a reason or you know that this is going to go to the prosecutor is there anything that you think it would be beneficial for you to say right now that would that would help us have a low volunteer comfort given all the questioning today that would relieve us with any idea that you have used your position to to financially benefit yourself I haven't used my position to financially benefit myself no sir about benefit others. No only professional not only provision okay so you don't know this person outside of just professional setting by any sense. So describe professional what would or would that mean you have an occasional launch or. The. As it fortunate has been used since nineteen seventy one to help prevent vehicles and other property of drug traffic from being used in the commission of subsequent offenses during the late nineteen nineties legislators became a concern that the lack of uniformity and accountability in forfeiture procedures across the state who was undermining confidence in the process during the ninety nine meeting of the area so general assembly act eleven twenty was enacted to address these concerns that the amendment of the uniform controlled substances act the forfeiture process shown on the side and an exhibit three on page three of the report arks our code provides that within forty eight hours of an asset seizure the seizing officers are file and original confiscation report with the saving law enforcement agency for maintenance in a separate file within three days of receiving that report. The seizing agent she shall forward a copy to the prosecuting attorney for the district in which the property were seized and to the artists all drug director for entry in the asset seizure tracking system in turn across key attorney has sixty days to follow a complaint in circuit court listing the seas property. The. Schedule one on page four the report provides the summary of seized assets for county twenty two for all judicial districts for example I show on the slide in the second judicial district over seven hundred and sixty three thousand dollars twenty five automobiles one hundred and eight firearms and four other assets received and twenty two for the entire state approximately three point six million dollars three hundred and twenty five automobiles six hundred and twenty six firearms and thirty nine other items were seized over the past ten years over sixty million dollars nearly forty six hundred vehicles and approximately fifty one hundred firearms have been ceased. The map on the slide and an exhibit one on page two of the report shows the seven years for districts selected for testing to conduct the review two seizure incidents as in each district were chosen from the asset ceaser tracking system let us wait a month day i've traced the seized as as recorded in the assets these are tracking system to the supporting confiscation report and verified require procedures had been followed in the disposition of the seized assets additionally one comments goes from a report was randomly select from the agency's files and traced to the assets these are tracking system to ensure all seized assets had been properly reported. Finally one seized as it was randomly select from the agency's evidence room and straight to the entity's confiscated s immatoriate records. Our material assets selected for testing where account and for however exceptions and record keeping were noted in favor of the thirteenth agencies reviewed. As listed on pace through the report the natwest twentieth and twenty first drug task forces as well as the place deportment did not maintain adequate seas property in the toy records the twentieth in the twenty first drug task forces as well as the white hole place department also did not maintain a separate file of the original conversation reports.
