Thank you, Mr. Speaker. Again, I apologize for not having the amendments on the desk. This amendment is from existing money. It changes the current distribution of Act 833 funds for fire departments in Crittenden County from three to ten fire departments with any remaining funds to be distributed to other fire departments based on population. And this comes to us from the interlocal governing body of that county. Members, heard an explanation of the

be from ADQ, and they signed off on this.
They have? Yes. My concern was, you know, we've heard a lot about tight budgets and no room for, you know, that we lack the ability to find money. Do you think that the Department will be able to do without this
funding? $125,000 a year. Director Marks indicated that they would be able to move

the amendment. Thank you, Mr. Speaker. I had a question, but regardless, I wanted to know what the fund balance here was.
And I think, I do think this program needs to be fully funded. I think the program itself that it's funding is a good thing. But the point does go to the broader debate of pots of money, how they're distributed, how we continually just move all the cards and all the money around on the table and never really get to the real point. I was going to ask a question, but I think we need to pass the amendment. I think we need to pass the appropriation, but that was the point. Thank you.
Chair (Representative Robert S. Moore, Jr.)

Representative Burris, for the amendment, anyone who wants to speak against the amendment?
For the amendment, not the question for the House, Adoption of Amendment No. 1 to House Bill 1128. All in favor of adoption, say aye. Opposed, no. As have it, Mr. Clerk let the record reflect the amendment received more than 51 votes. Representative Webb moves that we place House Bill 1142 back on second reading for purpose of amendment. 12:29
Thank you, Mr. Speaker. This is an amendment from Senator Lamoureux. It adds special language sections that address recent bankruptcy court decisions which prevent use of state's statutory foreclosure act by out-of-state mortgage lenders not authorized to do business in Arkansas. And it revises the emergency clause to make these special language sections effective on passage and approval. Representative Carter,
Speaker 38
12:53
what purpose? I have a question for the parliamentarian, I think. All right, you recognize?
How arms, I mean, this, to me, I don't see how this is related to an appropriation. What limits, if any, are placed on special language as it applies to this session?
Speaker 1
13:15
I don't know of any limitations on special language. I think they can have a meeting and vote out of there what they want. And it goes to the joint budget, and the joint budget recommended that I do pass. That's what the committee report says. So it's been examined by special language and joint budget both with the necessary recommendations.
So I guess the only thing you could do, Mr. Carter, would be to try to defeat it or make a motion to send
Speaker 38
13:42
it back to the joint budget. Thank you. I'm not opposed to it. I just wanted to know what the rules were. That could get out of hand. I mean, if that's... The committee has been accused of that, Mr. Carter, from time to time. Representative Hammond, what purpose?
Representative Kim Hammer
Unverified
14:08
Question, please. Recognize. Thank you. Representative Webb, I just want to make sure I'm interpreting this correctly, if you could help me, please. If I read this right, we're going to take the requirements off of any entity outside of our state who's coming into our state for the purpose of foreclosing on someone and not require them to file with the Secretary of State. Could you straighten me out if that interpretation is not correct, please? That

15:28
this point, Mr. Speaker? Yes. Okay. Thank you. Representative Penard, you're recognized. Mr. Speaker, thank you.
First of all, I'm very proud to represent the House as your special language chair. Those of you who know that I like to, every member, and I watch out for House members, that they have their fair day before special language. Thus, I want to say that this amendment was brought by Senator Lamoureux to try to clarify and assist many businesses throughout the state of Arkansas that deal with mortgage and loan service on them.
The federal law allows individuals like entities that aren't registered, the federal trust law, mortgage law, allows these individuals to do business throughout the United States. And therefore, this amendment that Senator Lamoureux brought merely clarifies that in light of a federal judge order that said that they couldn't do business in the state of Arkansas
because they weren't registered with the Secretary of State. In this case, the special language committee, Mr. Hammer, felt that Mr. Lamoureux's arguments for the passage of this special language in terms of federal law, in this case, were appropriate. And that's, we took, there was really not any really objections to Mr. Lamoureux's amendment
because it will allow many of our banks and other loan servicers in the state of Arkansas to do business with these national corporations that do business in the state of Arkansas. on. I hope that's assistive, Mr. Hammer. And for anybody else, I hope I didn't confuse anybody else. Representative Klammer, what purpose? Question. Do

up. And I think I'm clear, but I'd like to ask a question, and maybe it will prevent me from filing legislation for the next year
to deal with this. Recently, in Saline County, a number of – I hate to call a name – but another national mortgage company that was not approved to do business in the state of Arkansas had foreclosed on a number of homes and Realtors and home buyers were proceeding to purchase these properties only to find out at the last minute that they couldn't be sold because the company was not approved to do business in the state of Arkansas are we fixing that yes we are that's what I
