National licensing review subcommittee to order and on our agenda today we have. The. The arts are state board of dispensing appetitions they would please come to the table. The. I think we've seen you before today you're busy man. So this is the organization board of dispensing uptitions in a mac you more in use jerry hinds. Okay thank you made your more department health if you would please are yeah secretary of trans with argued tell state board of smiths in apticians okay if you would do me if they pull your microphone a little bit closer to you says better yeah that'll be good alright you may proceed alright so I think miss harms is going to give a quick overview of the board and will have to take any questions but pressure charlestown this morning thank you the cancel state board of expensive petitions license up to sentence opportunities the board meets us needed the board office is able to approve license by examination and apprentice the application it's quickly. There are three hundred fifty five license options and two hundred five apprenticed competition. This number is growing about fifteen percent per year our fees and men we do some sixty dollars to three dollars because of the reduction to lower our fund balance. Our rules are in the process of being changed to include the uniform service members license or process at one thirty seven of twenty twenty three. The board honest resuprosti which makes app from other states able to get a license so they can move to arkansas or employment the board requires four hours of continuing the education on the even years and five on the odd years the extra hour cars requirement is due to products there is a low this is low required to other states most states require twelve are a more hours a year. To be able to take the license exam the candidate has to have a tick the candidate can't either have a two year associate degree from adaptationary school approved by the commission on up teaching with a creditation or server three year printership which is four thousand eight hundred hours they can serve this open ship under an arkansas license appetition and or cancel license optometrist or a position skilled in the disease of the r. I will be happy to answer any questions. So let me ask you just a question about the prediction of program we're just talking about you okay and the apprenticeship program you will just talking about would you go back over there again in n how is that run through the labor department is that in the printership program to labor department or not member it's not through the labor department is run through the board they have to send their hours into the board cordly and they have to be signed off where they are supervised by license out tomorrow i'm really enough to match this in the lowest his position skills in the disease of the are a license starting. Okay alright with any other questions from the committee. Okay see no questions here will this check in this report will be saying this reviewed thank you for your time and have a great thank you. We have a steep board of barber examiners. Yeah. Yeah. You all would identify yourself she'll be recognized lacey curtair counsel for the department of labor and licensing. Phillis jake of send director for the state board of barbara examiners and division of the department of license and library labor licensing. Ricky brian barbara board chairman. You live receipt. If I may I buy to give a short overview of our agency the board of barbara examiners was created by the arkansas legislature march the twenty fifth of nineteen thirty seven by act three thirteen to regulate the practice of barbaring our board consist of five members. Three or license barbers with at least five years of experience to our public members want to represent the consumer and want to represent persons of sixty five years of age or older. The secretary of the department labor and licensing is an exophision member of our board. As a board it's our mission to protect the health of the public by conducting random inspections of barbara shops and barber schools enforcing barbara laws setting the curriculum for the schools and testing applicants who present themselves for licenser. Regulation of the profession helps to ensure that barbers are properly trained in sanitation and our knowledgeable and the use of products and tools specific to their trade. That's all I have and i'll be answered happy to answer any questions you may have thank you do we have any questions from the committee. This. Sites. Representative cabinet thank you madam chair i'm happened to notice that none of your your phase seemed to be reduced. And we had passed the law where if you had a certain amount of fund balance then you would reduce the fees up to maximising percent do you not have enough fund balance to do that I do not I have one year spend balance okay and. With all these. I want to make sure is that is it the one ahead twenty four hundred license is yes okay and from the twenty four hundred were collecting how much money. You're doing. Fifty annually. Yes I read a report yesterday and from july first through march the twelfth we've issued about thirty seven hundred license and we've taken in about two hundred and five thousand dollars okay and. What are your annual expenses. The roughly. Yeah. I'm sorry there with me. We had expenses totalling around three hundred and sixteen thousand. Okay where does your other revenue come from. I revenue comes from licenses okay you gonna collect at two hundred and five you say your expenses were three hundred sixteen that lives in a deficit so where is the rest of them money coming from two hundred and five will we still have several months to go to collect revenue okay so so we reflect around that we collected last year around two hundred ninety one thousand dollars in case when there would still leave you in a deficit so where does the rest of the money come from. More part the deficit was from shared services we operated within our appropriation of two hundred and seventy eight thousand. Rap but just telling me your expenses are three hundred and sixteen thousand but you're only brying in in two hundred and ninety seven thousand so that's going to leave you with more expenses than you're bringing in so that's what i'm asking brand talking about your appropriation i'm talking about your actual spending. I have. Do you have fines that come in. Not very often no ma'am. The. It's based most their income is received through renewal of license. Certification of records to other states. Okay if you could just any of send this to the staff if you'll get a breakdown of your revenue and your expenses so we can look at that will tell me what i'm looking at so if you just send that to staff guess me okay I appreciate that ok thank you. Representative fortner thank you matter chairman at i'm over here in the corner okay would you help educate me just a tony bet are with I guess my question is do a barber license and putition license training overlap are they similar or are they the same the reason I ask because. So many up beauticians if you will cut me internal which are that they're acting as a bargain. Okay so barbara's work from the neck app in carsbologist work from head to to. They have we do type of hericading shaving. And facials but were basically from the necker they do nails estimation work so the barrel barely matos alone that's right okay thank you you would want them to touch him senator payton thank you i'm aware to you left so representative forty or just kind of brought up the same line of questioning I was wanting this. Oh and I appreciate your experience I didn't know where where we do the land there but in our words the mutitions the cosmetology they deal with everything from the neck up also don't they they do but they don't do any shaving we we still have a straight race or shave okay so other than the saving they already regulate manage everything that you do. A sad shaving yes they we aren't curtain to him here. So i'm just gonna wonder why we have two boards into. Segmentance instead of folding it all into one if the only thing you regulate that they don't regulate is the shaving can you help us with understanding why we would need to have two separate. Boards and two separate bodies to regulate that. Ricky brand to barbara which here think the difference is you went to a cosmetic school you were flat at their. Doing ninety percent of my rolling hair. Permitting sure cranny they're not really cutting. Me and stales are. The certain styles they we we all cannot teach a little bit different though in that category true they do do a lot of cutting and we do the saying that so it doesn't different overdone at the teaching of the craft or are we talking about regulating it with an out for to protect the public health. I think your question i'm saying the teaching of the craft okay. Why I would think that the state's interest would basically be up protecting public health more than teaching the craft would appreciate your interest that's thank you madam chair yes. Seeing are there any quip further questions. Seeing no further questions this with our objection this report stands as reviewed thank you very much and you will get that information to the staff. Thank you all right they'll hear the department of health. So we have a number of folks coming up here. The. The. The. I think we have cars metallic and body art. Environmental epidemiology led based paint program. On site white waste water. Accepted tank cleaners. So if you all would identify yourself she'll be recognized short times and attorney arkansas department health. Correct meant the turning or to sort of probably help kelly courses section cheap for a cosmotology massage there be and body thank you go ahead thank you madame cochair members we have first off we have we have the body article in front of you miscourses over that section and we will have other we have other subject matter experts for the other license or types that will bring up that at the appropriate time and then you just start went on second year your reports are on the very back staple together they do their stuff online so it's all on the on the back here each of these sections. At the very back thank you go ahead thank you madame cochair first up we have the body artists that says cosmetology body arts section in twenty nineteen i'm sorry in twenty twenty one body art was moved from title twenty into title seventeen as part of the cosmetology and now there's still separate acts but it's in store and the same code section that allows them to have membership on the cosmetology tack and allows them to have a little bit more oversight and also to the extent that that we we may need to do some administrative administrative discipline that a good allows us to do that at a at a at the seatak level instead of directly at the board health so we have the body artists in the legislature has been very interested in body art tradition traditionally I know senator urban ransom early legislation that is regarding that and also recently senator davis randsome somebody art legislation that we just had twenty twenty three which were going through the rule promulgation process right now regarding that we currently have one hundred seventy six body art instructors artist instructors we have two hundred seventy seven a body piercers we have four hundred twenty seven permanent cosmetic artists now permit cosmetic artist is a little bit different than a tattoo artists of which we have six hundred seventy two with the permanent cosmetics are for someone that needs to for their you know maybe they were injured or burned or something of that nature so that to make to make their body look more and look more natural for the thing of that nature where should have to ask they're usually doing this we're talking more of an art more of art type. Type work we have three hundred twenty four astablishments or shops where you they're doing body art and we also have one hundred nine schools you have in front of you at towards the back it talks we do currently have have a fund balance though we are looking at i'm ways to reduce that fund balance in accordance with. In accordance with applicable legislation as represent cabin all mentioned earlier I think that's that's about all I have would be happy to take any questions about body art or or the tattooing or anything in general. Yeah. And see our representative capital thank you so you appreciate manager on your fund balance you are looking at trying to get those fees reduced yes represent count or we're making sure we're trying to we're making sure that we have we comply with legislation part of that fund balance is that at one time the the the when you look at it that's actually the licenses are for two years and so you're actually pulling your pulling revenue for two years worth of rabbit you know two years worth of revenue but it's not doesn't reflect not reflect in the expenses so there is we think we're pretty close to getting that even but we may be able to reduce some fees to make sure that we're that even in the future when will you make that determination where we're still reviewing that because we still have to go through we have to get through this fiscal year and figure out what we're what we're looking at because there was legislation that's legislation between twenty one i'm sorry in yeah and twenty twenty one and twenty twenty three which changed how we did the fee collection so there was some gaps and changes so right now we're still. Looking at what has happened since twenty twenty three and how that has changed regarding our fee collection what is your fund balance just if you know an off top that the current the current dollars reserve a hundred sixty five thousand dollars thank you. Representative coffer. Thank you madame chair as saw a headline the other day I don't know if you can answer this but it said that in some ink that they were using in tattooing that it was causing oregon damage have you seen that you know anything about that that has not been brought to our attention madame co chair we'd be happy to take a look into that now we do have as members of our of the seat that advises us and those those professionals would probably bring that to our attention if they had a concern or it heard about it but I would be happy to go back and see if there's you know if there's anything that they may know about it but it's nothing that's completely attention to the department currently okay thank you. Any further questions on this topic okay moving right along have an environmental appealed apart emailed that based paint program. Manco chairman of I would ask that we have actually mason our subject matter expert come to the table. If you'd identify yourself you'll be recognized hi my name is ashley mason I am in epidemiologists with the arkansas apartment of helpful at base program. Go ahead. Thank you mamco chair what you are what you have before you members is the information concerning lead paste bait and the training are the lead based abatement training program is is via state statue but it is required federally so if we want to do it the federal government would come in and do it for us so currently you have before you we have nine lead based paint and baitment contractors are consultants we have a nine lead base to payment abatement inspectors we have lead based abatement one led based abatement project designer nine lead based batement a paid abatement risk assessors seven web based pate and bateman supervisors two led based a payment training providers and ten led based paper batement workers and there's no prior educational requirements in this program you want you can you don't even have to have a high school to plumber gd you just have to take the training the training and then you pass the training in your able to be certified if we weren't worked to have this and arkansas it would like a said it would be done at the federal level which would be read it's done regionally that way so you're dealing with federal bureaucracy so to speak with getting the training done getting your certificates at the arkansas level you're having much quicker turn around you have our cances talking to you when you're going in here to get this training to get this certification this cut these certifications are required for many federal jobs like hard housing and things that that nature you have to have this certification to when you're dealing with light based paint. The fees have not changed the fees are collect the fees that are collector actually going to a lead based paint obatement find we do really receive some grant funds from the epa to help keep this program going but like I said it's it's a creature state statute that is required federally if we weren't doing it the feds would do it for us i'd be happy to take any questions and happen as mason also be happy to tell me again where is that people get the training to and the certification where it is at high it's through an apa certified course and there are many people who have been trained through the epa who are qualified to give these trainings and they would just need to go through those is this a like a month or a year or um it's once a year they have the initial training and then they have a refresher and some people get a certification when they finish that course they define car. Representative representative cabinet thank you manager. If you can refresh my memory winded weight actually put a banana using late paint. It was nineteen seventy eight ok and do we have any idea how much lead pain is still out there do we know. Cause there's been a lot of time since we banned it since it's been able to be used now do we have any idea how much well the reason that we used lead it in led based paint is because it was very persistent it was very good at what we needed it to do so unfortunately it doesn't really break down so of course you know there was letting gasoline so and there was also leading my base paint papers. So and unfortunately a bateman is pretty expensive to do so a lot of rental properties owners in general they won't remove the paint and so it just and it stays there and you can paint over it to contain it but you know it's it's still there if any type of construction is being done which is where we can yeah but we I just enough we do any idea about how much was you know was out there that is still needs to be abated at some point if you like I can look into it for you and get it to you if you don't mind I appreciate that I think thank you. Okay saying for the question here. Saying no further questions will say this is approved and we move on to the next thing which is on site wave water in madame coach at asked that terry paul are branch manager over environmental services. Branch chief i'm sorry of environmental services come o. The. Tripal environment held brench chief. Thank you madame chair members once you have before you is the report on on site was water we have um unsight waste water includes the except attack designer sewage waste disposable d r's that designated representatives you all may have heard that turnbare often over here in the past also september installers so you have eighty eight for the wastewater monitors. Licensees you have one hundred and fifty two drs and you have one thousand forty two septic tank installers and i'm sorry two hundred four septic tank cleaners. As program is overseen by our environmental environmental health section. We received typically about six hundred seventy one well and that's and should say typically because we don't necessarily eight years different but last year received about six or seventy one complaints in the past year that's typically filed at our county helpful county local health units regarding general sanitation and sewage issues I know you in your districts probably hear about this kind of thing often that are and so. We could of a collected approximately one or twenty five thousand dollars in revenue and FY twenty twenty four we estimated any expenses are estimated to exceed two million dollars two million dollars so our fees are not changed on this at a long long time and so it's. We. So it's a twenty five dollars collected for each individual sewage permit that hasn't changed so we are definitely not happy running a fund balance I think mr. Barking. Good top further on that there's any questions but we'd be happy to take them. Just the is this our return accepting thanks and what we're talking about. Yes mount here this is referring to septaine designers accepted cake installers and in this case there are certified monitoring personnel that check on the discharging systems. Interrupt tell me again you may have said this but what where do they go and get the training for this for this. They training it is more ourselves of self perpetuating people who are interested in in various things especially in the are part of it are usually from some kind of souls or science background and there are some minimal requirements for that particular license and they can go through data leasing the rules that we have that we recommend and we try to work with them to make sure they have experience with soils to make that determinations on how to load a system so it's not a complicated but there's not particularly a school that someone goes to to learn how to do these particular trains somebody can show up. In kind of think I think it's not my might like to do. And then they would get some training from in house or from other people in the business or and then is there a license of certification that they could test for I guess some can talk about where where we were they get the information to take it out right the information that in clarifying there's three different occupations in this particular rule one it's the days no representative which requires more training and expertise and a minimum of of a qualifications for a d r in law as you had to be either an engineer a sanitarian a master plumber. Ah are registered land surveyor or assembly qualified individual so if you meet those requirements you can study the information and our rules are basically laid out to where that's it's a designer largely you can study that you can get with the department we try to help people in this endeavour and they can also get with other designate representatives if if they choose to trying them to do that so yes there is a. Many ways to the II guess is we were thinking about how we help people get jobs. And thing about the passport careers that are out there it important to figure out how to somebody get to that please you know what one of the requirements to get there owned sometimes it's just. Who you know. And what you can load on the job yeah in this case it's generally people with some kind of sites or may I not make your favorite time that college some experience or college or some type of experience related to uh one of these professions or one of these are license debts they have a background a little bit and they want to do most of these individuals that are d r s part time in this particular business in the state we issue about seven thousand seven eight thousand permits per year and those are. My will just thought a number out there there's about thirty or forty that do this as a as AAA full time living a lot of the mar uh retired or just do a few here in there so on the doors in manager we do there is a a printership structure for drs but less than five percent of our applicants take. Take that route. So there again there is that there is a apprenticeship structure set up to get a d r license but less than five percent of applicants take that route but it is a bit though is that they're the department of labor or is that who's that will. A blown share program recognized approach your premium we set that up and we we set it up with they have to cooperate with a a d r that will take them on or a person where he is a d r that will take them on in and sort of shepherd them through the process to where they can then apply for and take the test so I guess my question is that the department of the labor has these certified programs it is that one of their certified programs no matter charity this is program that the organization no matter that's not the department of labor it's not to enter learn actor that nature this was already set up in the department we've allowed for that and we we recognize that that the necessity and importance of that already so we didn't need earned learn to do that and in fact it's probably quicker through us because you don't not deal with another separate state agency representative capital thank you so I just will make sure I understand. For these license there's no requirement of training through you correct. All the dr there is some minimum requirements there is a yearly device that we have usually with our installers that they complete but you don't have to hit further for the installer or the monitor you don't have any educational requirements you just passed the test. The dr again they have some minimum requirements initially and then we provide training at least once a year for down to realize them. Okay so they installers did as have to have general knowledge in the past the teaster you they get a license there is no continuing education well again the the law requires us to to have some form of education which is for years we did it by a computer program now we've done it in some other different ways but when we re licensed them every year we make sure any new information we have to give them which and that out and and in have them comply with that okay thank you representative offered thank you madame chair up here my question is my question is what happens. When someone has their land perked and they say it won't perk for a seperate tank. But it were looking at. In what i'm hearing it seems like there could be a lot of movement in that area who would they go to it their land did not park. And they needed to get a second opinion or third right what we typically do and sometimes the designate representatives go out to the site and find that either due to the size of a lot of discurbance of the lot or the sort of conditions on the light will say it's unsuitable for a subservice was disposal system or sewage disposal system. In that case we try to not only the dr he usually contacts the health department if they're to see if there is maybe an offense system are some other system that might be feasible are in that situation you have there is still disagreement a lot of times that will arise to the level of of our office and and I will actually simply people out to look as well just to try to determine if there is a a solution sometimes the solution isn't on the light of question so the prime minister may be needing additional property so we we try to work through those situations every time but we have all kinds of situations that present ourselves to every year ever seem like every few weeks and a so we just try to work through them with the destiny representative in homer blight size means a lot to us or enough room to put in an a what we call a standard system but I did look at some numbers not too long going to steck on i'm sorry not too long ago that only about three to five percent of the systems we approve or actually what we would consider surface discharging system so we try to keep all these systems underground at all possible my understanding is that you have to have an accurate at least to put a sceptic in the set the reason i'm asking as I have that I can stituent who has had a problem with this and they told her that she could be old something above ground but that's thirty thousand dollars so there's we've got to have a little help in this right the the thing that we will be running into when we have those watch that in in a. Not real sure what you're talking about but if you will get the information i'll look into it I will say that the three acres is generally our cut all for what we call surface discharging systems but we do have systems now that. Do cash to three thousand plus you can and their usually systems of last resort let's get get together if we could thank you thank you thank you okay so moving any other further questions on this topic. We will now move forward to septic tank cleaners. And thank you thank you mancochair we have two hundred four september cleaners in arkansas I think where I think misported already talk a little bit about their the education and and and we've talked about about the fees regarding that we have to take any any questions regarding some potential cleaners. Members. That objection this report stands as review. So ladies and gentlemen do we have some other business here anybody have anything they'd like to bring up questions the ask. Okay and so if you have some recommendations for things that we would like to take out or we need to change the would submit that to the those to the staff then we'll all be able to look at them and boat on them so if you have some recommendations so our next meeting is june twentieth at two pm. That's a little ways away then it'll be here before you know it so thank you very much the means that.
