Call the city carry local meeting to order all right considerator urban we're going to start with you about you've got a an amendment for senate bill seventy nine and would you like to exponge the vote by which the last moment was adopted and started new yes please all right got a motion from service services solvent all in favor say I closed congratulations much been expand your welcome to present you are knew amendment okay members thank you again this new amendment as specifically as a drive saying some tightening up of language in the definitions so that we are narrowing the digit digital asset minimum business and defining that that we're looking at the digital asset mining businesses that utilize the block chain networks there's a lot of other technology that use blacktain network so we don't want to fall them and to the so we wanted to tighten if the language worked with the governor's office and this was a request and i'm happy to accommodate that I actually think it's a great change and so happy to everything else in the middle is the same I think there was just one technical change that review b l or a review card which was a typo other than that that's it so it would just easier to expand the first amendment and replace it with a near moment to make it quicker and easier for everybody okay that's basically alright members of our explanation the amendment they are questions for the committee are sir sulven organized for questions that will center rice okay much of a ceremony of a question recognized thank you since urban league it up with I keep remember this being asked what was if you had on the band of section here. Page three above section three that uh went down to see where it talks about person hibited foreign party control business in operation before the effective date of this act if there are perhaps it in foreign party while we're giving them a year was at discussion that haven't families that i'm sorry no that's a good we actually originally had it at I think a hundred and twenty days but it was upon requested the attorney in general's office that they wanted that three hundred and sixty five days to give them the ability to diverse I think it was based on um maybe legal precedents and they felt like that was the appropriate and right time to give them in the language for them to diverse but it was upon request of the attorney general's offers do you know if the interest we're living in a very uncertain world if they consider we might have a hostile aggression among us that it would be good not to have its loud you know present discussion on my I think you know we all feel that concern uhm which is why in the legislative and transaction we added that a provision about potential cyber security or national security threats um I think again this is kind of the starting point but we wanted to work really closely with the attorney general's office because they would be the ones and charge of this and that was really their per review in their language that we wanted to go where that they felt like gave them the strongest legal standing to proceed but II do share your your concern and i'd do think we are going to have to perhaps potentially address that um and and I am not familiar with federal law or or even any type of state law where we would be under a. Hack from some sort of a cyber security same point so i'm not familiar with that sector sections of law but could it happen absolutely I mean and and I think that's a huge issue and one thing you know as we're looking at the language of these definitions technology changes so fast and I think this is just going to be an area we where we legislatedly are going to struggle right because we're set up to be you know we cannot take our time which is a good thing but we take our tom on language to make sure it's correct but as technology changes so fast you know we may have outdated language that we're really going to have to go back and address so and and I would just share I mean I my my daughter her boyfriend works for a company that they have they were under sabra attack and it shut them down there was a random ware situation and eight they they shut them down from november until end of january and you know and it was a rain somewhere situation now I think there are laws but II can't speak to that but i'm pretty i'm sure there are laws you know if there's not there probably should be as it deals with ransom type situations rant somewhere and those type of cyber security tax so that what i'm i'm hopeful to the different there's laws in a federal government to do if we are under uh a sabre attacked thing that it would be something could do but I have questions where the federal authorities are are there due diligence when we get to the state they worry into appreciate you answered one of the time I own page two uh number of older a section to a while is accept as provided by subsection d this uh section local government she all not are we going down. Uh that's a lot of big deal read where that what is that subsection d OK where are you again on page two oblige latest in in number a radar ride up toward the top under section two a said accept as provided by subsection d spare day and only drassies large day down below when it's in section three so I wouldn't sure section is I have this section I think they're referring to existing arkansas code and the subsection of. The existing arkansas occurred and I don't know i'm sorry I can is there any way quickly we could see what that is because we're we're providing any exception right there I think we're you know as we were writing these bills it was to try to make sure that they work in the address in the right your recognition here subsection desert the section that deals with home digital set money and so he deals that with in in that powers behind where it says the internet to discriminate against and and I know somebody else I think may for that I don't think i've got exemption for them discriminate it married to things that had these kind of things being ported out do concern me some but uh appreciate your winning this to answer and thank you for porting that out thanks to her sooner better you're recognized for a question I just add is thank you mister chair I just looked at up in that section in d actually deals with the prohibitions under section a of the section of this section do not apply to any rule or rate for utility service provided by or on behalf of a public entity thank you and that's our some good discussions that I think we had around there so and I think that you heard from john battle and in the way that they're able to utilize uh you know we don't want to step on anybody's terms but this is kind of a an issue that has to be played in concert with one another you know from the psc energy water local and then you know we're trying to add an energy and environment all and gas commission so they're all appropriate roles that everybody is playing but you can't have to work in concert with each other thank you central urban all right members are any more questions from the committee. All right seeing over the questions again a motion to adopt all right in a much center sullen second person to brian all in favor of adopting the limit say I opposed the regulations to intrigue your members been adopted thank you now recognize the presents your bill as amended appalling this is the you know the amendment is the bill but if there's anything you'd like to expound upon just appreciate your dediligence and stick in around and let him us have the opportunity to present on this issue and appreciate them your members the members time for taking the sign from em senator bryant and all the people we represent right numbers ever an explanation of the bill we've got a motion of much president or solvent samsung patty all in favor of say I opposed regulations surgery bill passes thank you as amended alright as american thank you all right members such a bright. A social bright you did not have any movements on the florida data I did not yet so just referred this back as a same bill as amended that we passed out last last thursday and growth copy of last thursdays of memory so members just for point clarification we greeting committee last thursday in center brian was kind of to agree to refer to his bill back for additional public comment that was necessary and then just to get the american growth so members have a chance to see the bill you know pulling for the minute pulling gross in the bill so with that singer brian let you give a brief you know give explanation brevity i'll attempt to cause it just unpacking what act the fifty one as a whole really a you know apply for existing owners of these facilities there are there are numerous in the state more and more than more I ask them where I realize there is more that had been operating the state for that some of up to thirteen years been operated in our state so protections again against locals from changing their laws to effectively discriminate was that day fifty one what we have learned since then is local control does need to apply to facilities that do not behave appropriately when I additionally bound is there's numerous counties that do not want local control we give the counties the the ability to have police powers over there and land in while it can be judged told me that they did not want to affectuate the the requirement to utilize those police powers meaning passing ordinances for planning passing orders as resonant because those are typically what people can appreciate inside them in its power but enjoy uh not having that local government over you in the county so for the the actors that want to uh behave badly worked senator bill seventy eight days is restore that local control. As an effective tool for those local governments with the sucks section that deals with noise comes in the play is for those counties that do not want to affect your local ordinance it basically requires these actors to be able to certain way and it gives standing to the low qualities of property owners to take them to court to make them comply with the state law that is only for local control whether counties were misparties do not want to pass local ordinances to require them to be good neighbors and in the last section early deals identically with senator urbans bill regarding foreign ownership requirement to divest and then what these look like in i'll be seen in the future in the state of arkansas great thanks and write around them sort of any questions from the committee senator sullivan you're awful you have a question most of the proper time certificate of our questions like to ask all right our acts the normal questions were not seen any more questions from the committee of a motion motion for senator sullivan second senator petty all in favor please say i'm opposed congratulations editor burpasses again all right members seen no further british to come before this committee we are journal.
