Cheer sees decorum and we'll call this meeting to order. Committee, thank you all for Or even the snow and ice to get here today, um. Unfortunately, we're only going to hear one bill this morning. We're not even going to take a vote on it, so. Um, I hate that we drag everybody down here for just this, but I think Representative Steinmel deserves a chance to explain his bill, so with that you're recognized to present your bill. Thank you, Mr. Chair. This is uh

This is a uh House Bill 1212, and this is a great constituent driven bill that would allow JP is currently serving to also serve as law enforcement officers as long as it wasn't in his or her district qualified law enforcement officers are tough to find and fill the needs of rural counties and communities. But because I'm poorly worded statutes. Uh, in my opinion, this bill would likely violate our Constitution. To all the JPs across the state, especially Al Roar. I applaud your willingness to
serve your communities on many different fronts. And with that, Mr. Chair, I would like to pull my bill down. All right. Do you,
Chair

would you be willing to take any questions from committee? Absolutely, I'd love
Representative Trey Steimel

to take some questions because I have, you know, learned a lot with, uh, this process. Do we have any questions from committee members? Yeah, Representative. Richardson, you are

recognized. Thank you very much, Mr. Chair, uh, and, and I appreciate you
represent stop bringing the bill. My question is, why is it unconstitutional because there's some language in there
Representative Trey Steimel

where they're not allowed to hold a civil office based on their, uh, the term limits that uh they're, that they run, uh, visit with Mark Whitmore, uh, very knowledgeable on that. We, we dove into it. We thought we found a workaround, unfortunately, it didn't pan out when um We got word from the AG's office, there'll be likely a, a conflict with the Constitution, you know, we, uh, we, we doubled
down to make sure that that in fact was the case and and we did find that that would potentially, uh, you know, have good people acting in good faith, arresting people or, or, uh, you know, putting people away to potentially come back uh out if there if it was ever challenged. So to me it's, it's not worth the risk in my opinion and there again, this is a great bill in my opinion, a lot of support locally. and across the state but you know, until that language is fixed, uh, there's really no, nowhere to go from here. Well,
Scott Richardson

2:43
that's too bad because I, I agree. I think it, it would be a great, uh, benefit to the state, so thank you so much for bringing it and doing the

research. Thank you. Representative Holcomb, you're recognized for the question.

Could you just expound on that a little bit, kind of tell us what's going on, how, how, how, what brought this about for you to bring it up, right, and I appreciate

that, uh, you know, Representative Holcomb, and, uh, to elaborate on this a little bit. So I had a JP in my district that was a, uh, 30 plus
year law enforcement, uh, served as sheriff of Fulton County, uh, great guy, and he wanted to always continue to serve his community, even though he's, I believe about 76 years old. And I was wanting to work as a a police officer in Salem, Arkansas, which was not in his district and uh when he found that there would be potentially a, a conflict. He reached out to me and uh we started doing some digging and, and we like I said we found we thought we found a work around, we had it drafted and um, you
know, so, like I said to those JPs out here willing to serve their, uh, their communities and all the different uh capacities they can, that's great. um, and We'll, uh, we'll go from there. One more question, how are
Representative Mike Holcomb

we gonna fix that with it sounds to me like something that, you know, we need but we do it did they give you a, you know,
Speaker 17
4:08
it's gonna require a constitutional amendment. OK, OK, uh,
Representative Trey Steimel

to be placed on the ballot in order to, uh, to go forward from here. That's my understanding from,
Chair

uh, uh, AG's office and from, uh, from Mark Whitmore. Thank you, seeing no further questions from committee members.
Representative Bart Schulz

All right, we'll have a comment from Representative Schultz. Representative Steinel, I just wanted to say I appreciate you digging into this. I served as a JP for a long time and there's, there's a lot of gray areas around. The duties and responsibilities, especially when it comes to law enforcement because long ago, a JP was Sort of like a constable and there's, there's still a little
language in there, so I think we all need to work together and try to get this fixed. Good job diving into that. I appreciate
Representative Trey Steimel

those kind words and, uh, you know, I will continue to work on this to see if we can find um A way to get this on the, uh, you know, on the ballot, maybe one day. So, thank you. OK. Seeing no further questions or
Speaker 2

comments without objection, we'll allow you to pull your bill down. Thank you, Mr. Chair. Thank you, committee. And seeing no further business on our agenda, we are adjourned.
