on, state your name for the record and you're recognized. Senator Missy Irvin, District 24. I'm here to present Senate Bill 275, liquid, which is the liquefied petroleum gas board adoption of the NFPA 58, um, what this bill does is it enables the LPGB to adopt by rule the requirements of nationally recognized safety standards of national fire protection pamphlet 58, which is The 2020 edition regarding the storage handling, transportation and use of liquefied petroleum. It allows the board to adopt nationally recognized safety standards through the rule process subject to public comment and ALC review, um, and repeals any unnecessary statutory provisions, um, the adoption of these national standards will increase, um, I'm sorry, we'll reduce the burden on the industry by streamlining and standardizing Arkansas's liquefied petroleum rules, uh, It will positively impact permit holders' ability to secure employment of trained individuals, and it allows enhanced industry, industry training which will promote consumer and industry personnel's safety. It has a consensus and support from the LP gas board and the Arkansas Propane Gas Association. We do have some folks here in the room, uh, that have come here in support of the bill, um, and I'll let them, uh, come up, uh, at the proper time. Uh, before we

do that, I'll ask the committee if you have any questions, Senator Irwin, at this time? If not, Senator Irwin, if you'd invite your if they want

to come up, they've traveled here, so, um, if you have any questions for them, if you don't have any questions and you're ready to vote for the bill, we can just do that, um, whichever the committee. I would like to do. They're here though. You want to go ahead and come on up, Mr. Falzer. Are y'all OK?

Senator Missy Irvin Unverified 3:20
Congratulations. You have another bill? I do. Thank you. Thank you committee. Senate Bill 280. 280. Again, Senator Misty Irvin, District 24. You re to tell us about that bill. Thank you. This is the office of the State Geologist, Property bill, um, Act 697 of 2023 abolished the Arkansas Geological Survey and placed the Office of State Geologist within the oil and gas commission, uh, what this bill does is it fixes a reference to that which was missed in the last bill and allows the oil and gas commission to consolidate assets with the Office of State Geologist. OK, members, you want to

the record you're recognized. Senator Clint Penzo, District 31. Uh, thank you, Mr. Chair. Um, Senate Bill 305 addresses an issue with testing requirements for new products. The industry is always evolving and the rules aren't clear when processed products are tested. Some products like infused flour are comprised of different ingredients that can be tested at different times. This requires the final product to be tested as a whole. That testing will include testing for pesticides, heavy metals, microbiological contaminants. Residual solvents, THC. And Canada uh Bada. Um, it also clarifies that marijuana products and drug paranalia are different. There was a little bit of a confusion, uh, with the 2017 bill, and this just clarifies the language. I'd be happy to answer any questions that anybody might have. I give the committee just
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 6:04
a moment to let them read the bill a little closer. Senator Senator Hickey, turn your mic on, please. of I guess I have
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 6:43
a question. So right, right now whenever they sell Whenever they do marijuana is not rolled form, right? Right, OK. I see this line. On the 2nd. Let's see here, I'm sorry. I can't see anymore. Uh, page 2, line 2. So this says we're gonna test it after all processed marijuana products shall be tested. After being fully processed. So would that mean after paper was around it? then that'd be a finished product, yes. So what we're gonna do then, we're, we are going to start allowing it to be Be rolled with this bill also? Is that where
▶ Play Suggest a correction Report an error
Senator Clint Penzo Unverified 7:27
it's not now? Yeah, right now it's, that's, uh, that's where the confusion's at is that the, the papers, if they're sold individually or considered paraphernalia. If they're with, with a marijuana product or That'll be a a finished product. So as of now, like and the testing is more than just testing like, uh, a finished product of a, uh, with marijuana and the paper, it's also infusions and stuff like that. So it, it expands the testing on all, uh, Marijuana products. I don't not, not just the But that's what I'm
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 8:03
saying though. Up, up until now, up until now, it's not been enrolled for. That's correct. OK, so this will allow A rolled form To be sold to the public, correct? That's correct. Time out. OK.
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 8:18
I don't, I've got somebody in the back room in the industry shaking her head. So that's fine. That that that I'm I'm trying to help you out. I don't,
▶ Play Suggest a correction Report an error
Speaker 35 8:30
I might have misunderstood a little bit, sir, that, that's
▶ Play Suggest a correction Report an error
Speaker 37 8:34
not the intent of the bill. I'm Bill

Industry Association. What this does, uh, Senator, is allows, uh, or, uh, mandates, testing in final product like an edible, a tincture, or whatever. This does not, uh, give thumbs up to, uh, pre-rolls that will still be in the purview of the ABC. But if they do approve that, then this
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 9:00
would require it to be tested after it's roll. OK. And that's, I think that's the point we're ABC will
▶ Play Suggest a correction Report an error
Speaker 37 9:07
still have the ability to, to create, uh, rules and regs and as of right now, they have a rule that does not allow for
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 9:19
the sale of pre-roll. And that's OK, so that, that's my question though. OK, so ABC they would have the authority, but of course, they would have to bring that before a rule. They had to promulgate, promulgate those rules and bring it before the legislature, uh, before that, that
▶ Play Suggest a correction Report an error
Speaker 38 9:32
could be done. That's absolutely correct. You're gonna have the final say. But, but this bill, all this bill does
▶ Play Suggest a correction Report an error
Speaker 37 9:38
is say that, uh, uh, processed product will be tested before it goes into final packaging. OK,
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 9:44
so they're, so ABC is also going to have to promulgate rules for this, correct? OK, so I guess. My thing, and again, I don't know where I would be on that. I just know that a lot of our other members have struggled with that. So if they were to promulgate rules off of this, off of this new bill, we're not anticipating or nobody's pushing for them to do that as far as bringing the, uh, to put that in the rules, are they? Not that I'm aware of. I would is ABC here? Well May I, may I speak to them,

Chip Leibovich. I'm staff attorney at ABC overseeing medical marijuana. OK, and I appreciate you, uh,
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 10:34
being in the committee and being prepared like that. So you heard, you heard my question like that. Whenever you all look at this, look at this bill, would it be your intention to be, to bring rules before us that would, uh, Do you, do you think that this bull, that this bill would require you to come before us with a road type product with a rule
▶ Play Suggest a correction Report an error
Speaker 51 10:59
for that. It would certainly authorize it, uh, currently under Amendment 98, Amendment 98 does prohibit the possession of rolling papers at a dispensary, and that was previously the interpretation. And so ABC rules do currently prohibit any sort of pre-rolled joints, uh, being sold and dispensaries, so this bill would authorize that because it makes the distinction that the rolling paper once it has been combined with cannabis is now a finished product and it is not
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 11:24
a separate paraphernalia product. And I appreciate that, Mr. Pascoe, though, you're saying that's not y'all's intent, though, is
▶ Play Suggest a correction Report an error
Speaker 55 11:30
that correct? I, I don't have any, I can't answer
▶ Play Suggest a correction Report an error
Speaker 38 11:34
that definitively that nobody in my industry, I'm I don't would my industry like to have pre-rolls someday? Yes, sir, because we, we think it's a safety issue when somebody buys one that's already pre-rolled, you know, the dosage, and you know what you're getting when they buy it in flower and go out and roll it in their car, you don't. So ultimately would we like to have pre-rolls, there's no
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 11:56
question about that. OK, here's, here's what I'm gonna ask or suggest, Senator Penzo, I know you get tired of me doing this, but Based on what you said, you know, I don't, I don't ever want to second guess what the general general assembly's a tent may or may not be down here, obviously, but I'm gonna think that it might not be that. So I would ask that we just do an amendment in here that would stipulate that this does not relate to any way giving authority for this to be, uh, pre-roll. And if somebody wants to bring a bill to do that, it would be a separate bill that, so everybody would understand exactly what's going on. So that would be what I would hope and. suggest to get an amendment just to clarify that. So let me rephrase it. That's what it'll take for me to, to vote,
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 12:40
to vote yes, I have a question of what you stated. You said the amendment, the marijuana amendment did not allow free rolls, is that, is
▶ Play Suggest a correction Report an error
Speaker 51 12:49
that correct? Not exactly. It was our interpretation at ABC. The amendment prohibits any paraphernalia that requires combustion for use, so that would include pipes, chillums, bongs, and rolling papers. So it was ABC's interpretation that that would encompass pre-rolls and so by rule, the ABC did prohibit the sale of pre-rolls. OK Yes, sir. Ser Gilmore, do you have a
▶ Play Suggest a correction Report an error
Senator Ben Gilmore Unverified 13:10
question? I do. So just on that, so the amendment doesn't actually directly speak to pre-rolls. That is correct. OK. Um, and if I may, Mr. Chair. Sure. So this, and we're just for clarity for everyone, we're talking about medical marijuana, correct? So by having pre-rolls, we think that it's a, um, Medical healthy medical decision to smoke marijuana? Which is that directed to whoever, whoever wishes. Yes, sir. We, we think that the marijuana has medicinal purposes,
▶ Play Suggest a correction Report an error
Speaker 55 13:42
yeah, absolutely. And, in a, in a smoking form. Yes
▶ Play Suggest a correction Report an error
Speaker 66 13:46
sir, that's the quickest way for
▶ Play Suggest a correction Report an error
Speaker 55 13:52
some people to get that into the
▶ Play Suggest a correction Report an error
Senator Clint Penzo Unverified 13:54
system Senator, Senator Gilmore, um, when I was in the house, I ran, uh, legislation that, uh, Made it to where they had to have, uh, vaporizers, um, because I would, you know, inhalation is, you know, my, my goal is to, if it, if the people voted for us to have medical marijuana in this state. My, my goal was to make it as healthy as possible. If somebody's gonna inhale, uh, I prefer it to be a vaporizer, um, so I ran legislation for that. My, my drive for this one was to make sure the testing was at the final product, um, because If things are combined and not everything's tested, I wanted it to be safe. So, um, many people, I mean, y'all, y'all probably know my sister's, uh, quadriplegic t feeding tube, um, she's, she utilizes medical marijuana, um, there, there are instances out there she used tinctures now, but, uh, it has got her off 3, of her prescriptions, um, and her lifestyle is significantly better. So, so my, my concern is, The people that are using this for, for truly medicinal purposes, uh, that they get the cleanest product possible. And, um, that it's, that it's properly tested and, uh, but, you know, personally, smoking a Smoking a pre-roll is probably not the, Uh, cleanest version of, of You know, inhalation, so. Well, I, I appreciate those comments. Thank you, Mr. Chair. Uh, I
▶ Play Suggest a correction Report an error
Senator Ben Gilmore Unverified 15:27
appreciate those comments and, and I will tell you that I think that it's probably wise to test something, I guess my concerns are somewhere similar to Senator Hickey's in the sense of, I hope we're not getting the cart before the horse in this scenario. And, you know, again, whether or not, um, we have the conversation about medicinal value of, of cannabis. I think that's a separate conversation. I think inhaling smoke into one's lungs may not be, um, the, The, the best definition of what is healthy, but I mean, again, that's not for discussion necessarily here. I appreciate your comments, um, and I would agree with Senator Hickey, I, I think
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 16:10
an amendment would be helpful. Any other committee member, man,

▶ Play Suggest a correction Report an error

I'll, I'll let you respond to Senator Hickey, Senator Gilmore. I mean, that's, uh,
▶ Play Suggest a correction Report an error
Senator Clint Penzo Unverified 16:38
If, if the, if the committee. Request that, I, I mean, I guess Senator Penzo, I, I mean, I understand
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 16:46
you're carrying stuff for the industry and I, I don't, I don't have a problem with your bill. I mean, is, is it your intent? It would it be your intent? That this would allow for. The pre rose. I mean, I guess
▶ Play Suggest a correction Report an error
Senator Clint Penzo Unverified 17:04
that's the way I need to. I mean, uh, I don't know that that's, I'd say that's my intent. My, my intent is if there, if there is a pre-roll, that it's tested at the, the final stage, not prior to being The finished product, right. I think, I think you know that,
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 17:19
I guess the decision jurors the way I would look at it, obviously, uh, that, you know, if it's your intent that that would be, I think that we would just have to be, need to be more specific that this would allow that, and that we were requesting it and if the legislature wants to do that, that would be fine, but I just, uh, I I, I, I personally think it's probably gonna be easier to pass without that in there would be my guess, but I can't even tell you, you know, where I would be on the, because there's a part of me that says, well, if people are going to smoke it, I probably would want the paper tested too. So, you know, I do have that. I, I do have that thought in my head. I just, I'd want to be more whenever we're running this legislation that, you know, everybody knows that, you know, this would allow that, and the reason that, that it would be allowed and that basically, you know, ABC would have the authority to promulgate rules based on that because the way I see it. I think the legislation is going to require the ABC to promulgate rules for that because from my standpoint, whenever you look at a line that says, in the form of a finished product suitable for packaging on line 3. I don't know, I don't know how else we could, uh, interpret it any other way. So
▶ Play Suggest a correction Report an error
Senator Clint Penzo Unverified 18:40
OK. I mean, yeah, I mean, I can, I can pull this down. We can discuss, uh, an amendment on it. And, uh, we'll come back and, and see y'all. Because like I said, I mean, there, people are going to run to the gas station and they're going to get their flower at the Dispensary and go get their own papers. So I mean, ultimately, if, I mean, if they ever, I mean, that's what's currently happening. Ultimately, I would like to finish product if it ever does get past,
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 19:05
uh, have testing, but I put down we can vote either way. You, you what? He said he'll vote either way. He'll vote on the amendment on the bill the way it is or if you want to amend
▶ Play Suggest a correction Report an error
Senator Jimmy Hickey, Jr Unverified 19:19
it, yeah, if, if. If it's not our intent to allow the road, I'd want an amendment. But if it is our intent to allow the roles, which I believe the way it is written. That would require them to promulgate that personally. Then I, I would just, I would run it and see what it would, would take. I just think as we're, as we're presenting this on the, on the Senate floor and the House floor, we're going to be very specific that this bill does require that, and that, uh, that is the intent whenever you vote on
▶ Play Suggest a correction Report an error

for your bill. I'd like to make a motion to pass and ask for all in favor say aye, all oppose. Thank you. Uh, Senator Johnson is not here. I want to ask Senator Gilmore and Senator Johnson, we, we will not hear these bills on Thursday. I know y'all traveled here many times to hear these bills and uh that next Tuesday we will either hear these bills or move them to the deferred list. So that way y'all won't have to come and, uh, they won't be on there until we vote them off, put them back on, and that would give you all the, the courtesy of letting you know what's going on, uh, in reality, uh, uh, Senator Johnson was supposed to run his bill today, and he and the governor are, uh, behind closed doors trying to come to an agreement on that to let you know where we are. It's not the committee's fault that, uh, we're not hearing it. It, it is a situation where, uh, I did expect for him to run that bill today and was told this morning. that he would not run it. So, uh, we will not run it Thursday, so y'all rest assured on, on that and, and we will plan on it next Tuesday if he does not run it on next Tuesday, we'll move it to the deferred list, which will give you 2 or 3 days' notice. I can outrun it if it's on the deferred list and we come in here, we're not gonna run it that day. I will not be unfair to anyone in the public on that whether I'm for the bill or against the bill is irrelevant, but uh in, in all fairness to all parties, uh, you will have public notice. Just when the bill will run. And, uh, Serge Gilmore like for you to do the same thing, find out if you we could run your bill next Tuesday. And if I would move it to the first because we've got people traveling here also for your bill, uh,

that nature, Senator Lanning. Does that mean the committee's not going to meet Thursday
▶ Play Suggest a correction Report an error
Senator Ronald Caldwell Unverified 23:07
at all, or we're just not gonna depend on what else comes up. We may meet Thursday, but, uh, in all fairness to these people, I, in, in fairness to both senators, I want them to have time to, to get their negotiations in order. And so we'll give them this way, if I told them we were gonna run it Thursday or put on deferred list, they have a day and a half and we've other major bills out there. This would give them till next Tuesday to be able to run your bill. And I,
