I'm not a morning person. Alright, House Bill 1293. Um So what we're doing is increasing the lot of death duty benefit. We have men and women who put themselves on the line every single day. Firefighters, first responders, police officers, state troopers. And this bill also is adding um our highway department workers does well. Um, people who serve our state, our communities. And expect to go home to their families every night. But unfortunately, life happens and They don't always get to go home. And so It's been over a decade since this has increased since there's been any touch of this, you know, increase or anything. And so all this does move it from 150,000 to 250,000, um, this doesn't touch any of the actual retirement systems. Um, because it's partially paid out of state claims and then the other half is paid out of the appropriate agency. Um, I think if you look at the actual run sheet, it says on average over the past 10 years been 5.5 claims a year. Um 5.1 is still too high, you know, the goal of this is to pay out, is to never have anyone die in the line of duty. But that's simply not the case of what happens. So what this does is, It, it just gives their families a little more meaningful financial support. 250,000 is nothing to make, to make things whole. It's not, but it, it helps. OK. Thank you, Mr. Chair. Good morning, committee. So back in 2019, we as a legislature prudently um made occupational cancer, so certain cancers that firefighters get as a result of fighting fires. We made those, uh, we made all of the changes in Arkansas law for those to be covered as a line of duty disability. We just neglected to cover a line of duty death benefits that result from those same cancers. so potentially survivors and beneficiaries are missing out on a line of duty death benefits. This cleans that up so that there's a framework to allow them to get it. I echo everything Representative Andrews just said about the importance that these men and women serve to our communities. This bill was written with David Clark from Lotv if there are particular questions, hopefully he or I will be able to answer them, but that's what the bill does in a nutshell, if you look at the actuary statement that came with the bill, there is one family that would be impacted by this since 2019, which is when we made that original. change to the law, and Senator Boyd, just in case you see language in the bill that does go back to 2019. That's why at that date, because that's when my occupational cancer um became codified as a line of duty disability, so we're just trying to line that up. So like I said, one family since then would qualify for these, so, um, Impact would likely be small in terms of fiscal to the state, but would be huge for these families who have given us so much, so I'd be happy to take

So, many people believe employee benefits is a part of public retirement. Believe me, I know because I get the calls. They are separate entities. House Bill 1327 begins to bring clarity to the situation by changing the name of the program to state and public school life and health insurance program. Members of the retirement systems are eligible to participate in this program. But the program is managed by employee benefits. There are 2 main requirements in this bill is trying to clarify. And put in statute specific requirements, so there are no questions. On who qualifies and how you get to participate. In this program. Number one, you must be vested in one of the retirement systems. 2. You must have been in the program for at least 5 years before retiring. There's one exception to that. I'm a perfect example. Uh For legislators. I am covered by my employer's insurance. I don't need The insurance through work right now. But I plan to retire in the future. And so I was asking Grant. What about me? I'll be vested. At the end of this term, if I wanted to use this. Insurance in my retirement years. Why wouldn't I be able to use it? So because I'm not going to be in it for 5 years. So anybody that uh was employed prior to March of 2022. You only have to be a participant for one day. To get to Use the Program for retirement. OK, so there's a one exception to that. Rule of having to have been in the program for 5 years. If you joined before. March of 2022. All you have to do is be in the program for one day. And then you can participate When you leap. So Uh, the only other items raised in this bill are to make clear that participation in this program is not allowed if there's a conflict with federal law as to a member's ability to participate. And then confirmed that a member's failure to respond in the required period of time is not grounds for being reconsidered or acceptance in the program. You know that it You've got to uh say I'm either in or I'm out. Failure to respond is not a problem for employee benefits. You either do it when you're supposed to or you're not going to be able to get in the program. Uh, there's no fiscal impact on any of the state retirement systems and there is minimal to no impact on the state and public school life and health insurance programs, so I'd be glad to take any questions. State and public school life and health insurance program. We want to make sure that we make it clear for everybody. This ensures that a firefighter who retires but is not yet of the age to qualify for Medicare can stay on the health insurance plan. Of the city they retired from. This bill amens Act 535 of 2023 by Representative Acre. Which brought consistency across the state regarding police officers who retired but were not yet of age to qualify for Medicare benefits. Allowing them to stay on the health insurance plan of the city or county they retired from. The constituent of mine who is a retired firefighter asked if we could insure the same benefit to all retired retired firefighters. That is what this bill does. It simply amends Act 535 to include firefighters. It says that a firefighter who retires and is not yet of age to qualify for Medicare can stay on the health insurance plan of the city they retire from. And the city will will determine the amount of the premium the retiree will pay. Now it's understood and assumed that the city will likely require the retiree to pay the whole monthly insurance premium, but ultimately that determination is left up to the city. This will just give the retiree an additional choice when planning for their health insurance needs after retirement. Allow them to keep their health insurance plan if they like it. Most cities are already extending this privilege to retirees, but we just want to bring consistency across the state, make sure all cities are on the same page and no one is being missed. As well as ensure that firefighter retirees are extended the same benefit that we have already given police retirees with Act 535. I visited with the municipal league and they support this bill.
