27. Yeah, and then 85% numerically within the parentheses. All right. All right,
Speaker 3
0:19
uh, We're gonna, we're gonna suspend the rules. I don't know. That's not really substant. I mean, it's substantive motion to suspend the rules. Uh, I make that motion, uh, seconded by Senator Justin Justin Boyd, uh.
To suspend the rules to do this verbal amendment. All in favor say aye all opposed are at Senator, you're amendment is line 13. And 85 in written and then and then parenthesis 85, numerically the same in line 16. change that 90 to 85 written and in parenthesis numerically. Yes. All right,
that's that's your amendment. I'll accept a motion by Senator Ervin. Yes. Seconded by Senator Boyd. All in favor say aye. I opposed like sun. All right. Thank you, uh. Your bill is amended. So All right, you want to present your
Speaker 11
1:33
bill as amended. Yes, thank you, Senator Johnson, and
Senator Missy Irvin

1:43
So this is a bill that we, I presented before spring break, has had it out there at the amendment reflects some work that we have done with in conjunction in partnership with the insurance companies who are the um The the who we uh work with with the qualified health plans, um, for this population just to go through it again, this adds the work requirement, language that the waiver has already been
submitted to CMS. It also allows for the state to recover the pharmacy rebates. It defines medical loss ratio, as well as pharmacy rebate, which is based on our um pharmacy benefit manager license. Act, it moves our dates, um, and then directs the Department of Human Services again for applying for a waiver, Section 1115 waiver to continue the Arkansas Health and Opportunity for Me program
and it also allows for the addition of um non-hospital based organizations to qualify as community bridge organizations. Is any questions? Senator Penzo, thank you,
Senator Clint Penzo
Unverified
3:06
is the, the work requirement in this, uh It is on page 8.
Senator Missy Irvin

3:25
Line 8 and we do currently have work, the work requirement in current state statute, I think members just wanted to
repeat it here in the legislation, but to make sure that there was some clarification and some asks a little bit of changes based on the current administration and what we're seeking and hoping that they will approve. So the waiver's already been requested. They, yes, the waiver has
already been submitted to CMS
Speaker 3
3:58
by Governor Sanders. I think there was a previous work requirement work requirement that was denied by CMS. And this is an
Speaker 23
4:07
updated updated version of that that's already in
Senator Missy Irvin
Unverified
4:11
place, right? We passed that in current statute under Governor Hutchinson, so DHS had the authority to go ahead and remember that
Senator Clint Penzo
Unverified
4:24
happens, it's my understanding that there's $40
million going to be spent to hire coaches. Is that
Senator Missy Irvin
Unverified
4:31
correct? Not that, no, that is not correct. OK. That's, that's what
Senator Clint Penzo
Unverified
4:37
I was told that was in the waiver that was submitted, and this is, so if we've already submitted a waiver, what's the purpose in this. Again,
Senator Missy Irvin
Unverified
4:46
it was requested by a representative Lundstrom. She felt like she wanted to make sure that we were, uh, clear with the language and wanted it
to be included in this bill so that everybody knew
Senator Clint Penzo
Unverified
5:02
what we were on PG, where does the, where does it
Senator Missy Irvin
Unverified
5:07
show the work requirement. And it says, um, Comply with any and all federal and state work requirements under the Arkansas Medicaid program. And then it lists the different exemptions. That's part of that waiver. So we've
Senator Clint Penzo
Unverified
5:26
created more exemptions. Is that correct?
Senator Missy Irvin
Unverified
5:30
Actually, I don't believe that's correct. I'm sure, I'm not sure. DHS is here, but no, I do not believe we've created more exemptions. I think there are exemptions that are in line with the federal current CMS um as to what they have put forward, the change is based on court case, where our previous work requirement was kicked out or denied based on a court hearing and so we've made
um the change in policy to comply with that court
Senator Clint Penzo

6:06
decision. So what happens if they don't meet the work requirement. Is that
Senator Missy Irvin
Unverified
6:10
benefits are, their benefits are paused. Ah OK, I
Senator Clint Penzo
Unverified
6:20
didn't see where it said that. Well,
Senator Missy Irvin
Unverified
6:22
it's part of, again, that is part of what they currently have in state statute,
the ability to do that and how they
Speaker 3
6:37
apply for the waiver. OK, thank you. Is there any other questions? Is there anyone here to speak for or against against 527. We have no one signed up to speak for or against the bill. I'm going
Speaker 15
6:58
to wait until we have our other senator here. Yes, I
Speaker 34
7:01
can do that. Uh I have public, well, we have public health. You close your beer. I'm closed. I make a motion to pass as
Speaker 3
7:33
amended motion by Senator Ervin's second by Senator Boyd any discussion. Uh, all in favor say aye. I'll opposed like sand. Sorry, Senator. I have to do it whenever we get enough seats, people in the
