27 yeah and then 85 percent numerically within the parentheses
Speaker 3
0:14
all right all right we're going to suspend the rules I don't know that's not really substantive I mean it's SUBSTANTIVE MOTION TO SUSPEND THE RULES I MAKE A MOTION SECOND BY SENATOR JUSTIN BOYD
TO SUSPEND THE RULES TO DO THIS VERBAL AMENDMENT ALL IN FAVOR SAY AYE ALL OPPOSED ALL RIGHT Senator, your amendment is line 13, add 85 in written and in parenthesis 85 numerically. The same in line 16, change that 90 to 85 written and in parenthesis numerically.
Yes. All right. That's your amendment. That's your amendment? Yes. I'll accept a motion by Senator Irvin. Yes. Second by Senator Boyd. All in favor, say aye. Aye. All opposed, like sign. All right. Thank you. Your bill is amended. So, all right, you
Senator Missy Irvin

1:33
Yes. Thank you, Senator Johnson. and so this is a bill that we I presented before spring break has had it out there the amendment reflects some work that we have done with in conjunction and partnership with the insurance companies who are the the who we work with with the qualified health plans for this population just to go through it again. This adds the work requirement language that the waiver has
already been submitted to CMS. It also allows for the state to recover the pharmacy rebates. It defines medical loss ratio as well as pharmacy rebate, which is based on our Pharmacy Benefit Manager Licensing Act. It moves our dates and then directs the Department of Human Services again for applying for a waiver section 1115 waiver to continue the Arkansas Health and Opportunity for Me
program and it also allows for the addition of non-hospital based organizations to qualify as community bridge organizations. Is there any questions? Senator
Senator Clint Penzo
Unverified
3:01
Chair. Where exactly is the work requirement in this? Yes,
Senator Missy Irvin
Unverified
3:06
it is on page 8.
Line 8. Yes, line 8. And we do currently have the work requirement in current state statute. I think members just
wanted to repeat it here in the legislation, but to make sure that there was some clarification and some asks, a little bit of changes based on the current administration and what we're seeking and hoping that they will approve. So the waiver has already been requested? They, yes, the waiver has already been submitted to CMS by Governor Sanders.
Speaker 3
3:53
I think there was a previous work requirement that was denied by CMS. And this is an updated version of that
Speaker 23
4:02
that's already in place. Right. We passed that in
Senator Missy Irvin
Unverified
4:06
current statute under Governor Hutchinson. So DHS had the authority to go ahead and... I can't remember if that was 17
Senator Clint Penzo
Unverified
4:19
my understanding that there's 40 million dollars going to be spent
Senator Missy Irvin
Unverified
4:23
to hire coaches is that correct not that no that is
Senator Clint Penzo
Unverified
4:32
not correct okay that's that's what i was told that was in the waiver that was submitted and this is so if we've already submitted a waiver what's
Senator Missy Irvin
Unverified
4:41
the purpose in this again it was requested by representative Lundstrom she felt like she wanted to make sure that we were clear with the language and wanted it to be included in this bill so that
everybody knew what we were so
Senator Clint Penzo
Unverified
4:57
on page 8 where does the where does it show
Senator Missy Irvin
Unverified
5:02
the work requirement again it says comply with any and all federal and state work requirements under the Arkansas Medicaid program and then it lists the different exemptions that's part of that waiver so
Senator Clint Penzo
Unverified
5:21
we've created more exemptions is that correct
Senator Missy Irvin
Unverified
5:25
actually I don't believe that's correct I'm sure I'm not sure DHS is here but no I do not believe we've created more exemptions I think there are exemptions that are in line with the federal current CMS as to what they have put forward. The change is based on a court case where our previous work requirement was kicked out or denied based on a court hearing and so we've made the change in policy to comply with that court decision. So what happens if they don't meet the
Senator Clint Penzo
Unverified
6:03
requirement is that their benefits are their
Senator Missy Irvin
Unverified
6:05
benefits are paused okay I didn't see where
Senator Clint Penzo
Unverified
6:15
it said that well it's part of
Senator Missy Irvin
Unverified
6:17
it again that is part of what they currently have in state statute the
ability to do that and how they apply the waiver okay thank you is there
Speaker 3
6:32
any other questions is there anyone here to
speak for against the against 527 we have no one signed up to speak for against the bill I'm going to wait until we
Speaker 15
6:53
have our other senator here. Yes, I can do that.
Speaker 34
7:07
I have public, well, we have public. Do you
Senator Missy Irvin
Unverified
7:25

Speaker 3
7:28
a motion. Do pass as amended. Motion by Senator Irvin, second by Senator Boyd. Any discussion? All in favor say aye. Aye. All opposed, like sign.
