Chair and committee. Jason Nazarenko, House District 4. I present to you today House Bill 1993. It's a bill, when you read it, you may think that it's common sense, and I would as well. But I'll tell you that this is happening right now in Arkansas. I sent you pictures this morning of two vehicles which could help you understand the language in this bill. For a short description, Vehicle 1 was rear-ended by Vehicle 2 when coming to a stoplight around Pickles Gap. Rear Vehicle 1 was damaged as it was struck by Vehicle 2. On the front end was damaged so bad that the radiator was broken and it was leaking, making that car undrivable from a seam. Driver of vehicle two claimed that they were struck by a third vehicle, which was then pushed their vehicle into the first. However, as you saw in the pictures, there was zero damage to that second vehicle. Those pictures were given to the farmer's insurance adjuster, who then denied any claim and put all the blame on the third vehicle that could not be proven to exist, especially with the pictures that were proven to them. this was actually identified as this is how I identified it as insurance fraud and in a way and putting that blame could be pushed off on that fictitious vehicle reducing the insurance claim amount incurred to the actual vehicle causing the accident as I said this is a common sense bill right now I'm in talks with with farmers insurance about the specific incident because as because of our schedule that we have left and the time that I know we're kind of running out of right now, I would like to move this to an interim study so that we can reduce or eliminate insurance fraud here in our state. Thank you, Mr. Chair. Representative Stetson Painter, District 3, Baxter and Fulton counties. Committee members, HB 2001 is a compromise, and I will tell you, since running House Bill 1897, I'm not an expert, but I feel like I could start my own towing service after all the calls and emails and everything else about 1897. But after talking with Trucking Association, the governor's office, and towers, we came to an agreement that we all may not like, but it's there to get something started. And the three things that it does, it reconstructs the board, keeps a 20% cap on cargo, 5% on personal vehicles, and then the last thing it does on the invoice, it says how to file a complaint. That's it. I have given my word to the governor's office, to the trucking association, to the towers that if we get this done, let's sit down and work on a new comprehensive bill that address the concerns that each party has let's get the new board in and let's work together

am here to speak against this bill i do feel like that this bill is a condensed version of a bill that has already been voted on and passed out of this committee house bill 1897 1897 addressed many issues that we are we are currently having expenses that we have as towers I've worked for several years with the towing and recovery board to with a with bills that have been passed in in the past and have gone into law that have to do with the lost auto and having a website for one where everybody where lien holders owners can go to find their vehicles this was passed several sessions ago the website was but we're not utilizing it to the maximum capacity because we continue to have the newspaper ads that are required for 45-day and 10-day sale notices currently all towers are required to pay a fee to list their vehicles on lost auto and then also pay a fee to the local newspaper newspapers have gone up people are not subscribing to local newspapers the way they were several years ago six ten years ago so the the people who are actually seeing those are not out looking for their cars lost auto is a resource that was taken out of 2001 that would be beneficial to the state of Arkansas and I did some financial my background is accounting I did some analysis of what I spent in 2004 and in 2004 I spent $3,600 with the newspaper that could have been avoided if we were 100% using lost auto. This was, as I said, this was taken out of this bill. It was in the bill you voted for on April 3rd. Part of that was that in that process, I sent out letters on 186 vehicles in 2004 that were processed between the third and eighth business day. If those letters, if we, instead of doing the letters, if we would have been able to use lost auto, I would have only spent $744. If you take into consideration that there are almost 700 tow companies in the state of Arkansas, and I'm in Conway, Arkansas, and I share the market with five other record services in Conway, 700 record services in the state the state could generate over five hundred and twenty thousand dollars in revenue annually by using lost auto versus using the newspaper ads i feel like this is a key thing that we have tried to fight for for for several sessions to get do away with the newspapers and to utilize lost auto in a manner that it was initially set up for and the state has spent the money to create the website and the data the data service that's there we also are seeing that in the original bill that came through 1897 that predatory towing has become a major issue in this state it was discussed in your meeting last week i've heard horror stories of individuals parking the vehicle in parking lots to carpool back and forth to little rock from conway and then they come back to find their only vehicle has been towed away and they can't find it they contact the businesses where they've towed the vehicles they state that they didn't have the vehicle towed they contact the local police departments sheriff's office wherever the situation is where they've parked they can't find they're being told that the vehicle hasn't been logged with them as being towed then they find out when they finally locate their vehicle that they have a bill of upwards of a thousand to two thousand dollars this is a problem these record services are doing this and not following proper procedures and it's affecting the citizens of our state house bill 1897 has wording in it that would stop this type of predatory towing from happening house bill 2001 if passed it does not have that language you're you passed 1897 11 to 2 there was something in that bill that y'all liked that this committee liked but now senator painter has decided to take this language out of this bill as a compromise the compromise is allowing the predatory towing to continue to exist i have no problem with the five percent of somebody getting their property as long as they can guarantee that we're going to end up getting payment of our bill i spoke with six record services over the past few couple of days locally from jesseville searcy little rock conway grant county and they all say that their average tow bill for the tow to go out and work at work an accident for local lawn enforcement either they're contracted or the rates that they have on file with the state police is around 175 dollars per vehicle with 50 per day storage all of that is in line with what the tow board says is fair pricing somebody comes in they want to clean their personal property out today myself and several other record services that I deal with they don't charge anything as long as the property owner of the vehicle owner can give them a claim number from their insurance some sort of guarantee that they know that they are going to be paid I don't have a problem with the cargo. I may work one truck wreck a week. I watched the committee meeting. I was absolutely flabbergasted at the dollar amounts of the tow bills that were discussed in this committee meeting on the third. I've been in business for over 20 years, and I have never billed a heavy truck wreck out that was more than $27,000 in 25 years. And we've worked some pretty extensive ones semi-trucks rolled over on the side of the road loaded down with bananas semi-truck the latest one we had it had eggs in it cartons of eggs you can only imagine the eggs were destroyed in an accident and that that tow bill was 15 15 000 plus tax that was it we're not out trying to rape people and i i do not feel like that the majority of the towers in the state of arkansas that they are we do have a few bad apples and house bill 1897 would take care of those bad apples i appreciate that the legislature is trying to put rules in there but i think 2001 leaves a

max pope max is towing and record service in grant county arkansas i'm on my 41st year there in business the house bill 2001 reading it and reading 1897 there's some similarities but the differences are they get me is the lost auto deal in my years i'll have somebody call me one day and want to know where their vehicle is and i tell them i don't have it for example and they don't know where to find the vehicle if lost auto is managed and done right and get to where it's posted out there through the state of arkansas and some advertisement it's going to be a it would be a tool to where it could help people find their vehicles you immediately put it on lost auto you can tell that customer they call me when I tell them I don't know instead of don't know I can say look at a lost auto and if I don't do that and they keep looking for it they struggle to find it storage is going up wherever it's at whatever the price is going up so they're accumulating charges trying to find their vehicle as the local paper our local paper I don't know it has gone way down everybody nobody reads the paper i don't think no more with all the social media stuff on cell phones so they're not finding it you know in the paper and by the time i put it in a paper and it comes out and they did find it is several days i do recommend people to call the sheriff's office but i don't know if the sheriff towed it the city towed it state towed it so 2001 is doing away with a lost auto i think that's a disadvantage i the cargo deal i there's not a big record service in grant county there's in my 41 years has been a couple tried to survive there's not enough business actually november the 29th of 2024 a record service closed in grant county in my 41 years that's 29 companies or individuals i've seen go in business and close because of the money that's to be made there grant county's small there's a lot of small counties in arkansas all. I'm afraid that 5% deal is going to hurt some people unless we have a guarantee you're going to get paid for the car. I got rid of 30 the other day that they weren't worth nothing. I didn't get basically nothing out of them. I lost money on them. If they had cargo in them, it had cargo in them, and I could have collected something, at least some part of the record bill, it would have helped me. But that's the reason I noticed a lot of, it seems like talking to the other people it's been in business gone out they told so many it's non-profit if we give away this the cargo without some kind of guarantee and even as I told somebody once the guaranteed of insurance I've seen that fail because I've had insurance send me an email saying yes this car is insured we will pay the record bill when it come time to pick it up and pay it all we didn't know the driver was excluded from the policy so we don't have to pay so that email of security I had was null and void i lost the money so the i'm totally against the way 2001 is rode up 1897 that everybody's like you know seem to be in favor of seems to work you know a lot better than the 2001 and uh i thank y'all for y'all's

you committee for giving me the time today My name is Matthew Ross. I'm the owner of Pro Towing and Recovery in Conway. I've also been on the Towing and Recovery Board for a period of over 10 years. I sit on a national council, the Open Highways Commission. And I can tell you that predatory towing is a nationwide problem. I testified in front of the Department of Transportation six months ago on this issue. I'm here today, spoken to the two major trade agencies in the state, the Foundation for Responsible Towing, and the PTRAA. I've spoke to representatives from both of them. They both voice their enthusiastic support for this bill. We have deep appreciation for Representative Painter. If he will not come to his senses and joins the wrecker industry, we'll help him. We'd love to have him. We'd try to talk him out of it maybe beforehand, but if he insists, we'll take him. This bill is a foundation. we have been here in these halls before and we have heard from our representatives that we want compromise this bill is the foundation for that compromise hundreds of towers dozens of companies now stand ready to work with the trucking agencies the police agencies and the people involved in legislation to create a path forward so that we can get comprehensive solutions to predatory towing in the state of Arkansas, and we can fix some issues that were even addressed by the folks who spoke in against this bill today. We are grateful for this opportunity. As a measure of good faith, preemptively, we sent out a call to start to collect data about pricing in the state, And I'll tell you that between the two agencies, we've collected over 1,800 pieces of data on pricing for towers in the state of Arkansas. We are happy to continue on that path of information and data collection, and we are happy to share that with Representative Painter and whoever else is at the table as we move forward in good faith, looking for meaningful results for the citizens and the companies of the great state of Arkansas. good morning mr chairman members of the committee i'm shannon everett with american truckers united i want to talk about a growing problem on arkansas's highways one that's hitting not only the towing industry but the trucking industry as well. And it's the rise of uninsured foreign commercial truckers. And it's time that we address this issue instead of piling more rules on those trying to clean up the mess on our highways. First, let's look at the numbers. Arkansas's highways are seeing more and more crashes involving these uninsured foreign truck drivers. Why? Many lack the proper training, vetting, oversight, or accountability that American drivers face. When they crash, and they do, there's no insurance usually to cover the damages that are caused. That means wreck vehicles, total trailers massive write-offs that no one pays for the towing industry has stepped in they haul away the wreckage but too often they're left holding the bill on these write-offs these are small businesses family-run outfits in many cases and they can't absorb those losses and so this isn't just about money the flood of uninsured drivers has forced towing companies to take unusual actions to survive some of them have you know raised their prices some of them we've heard of holding collateral or holding equipment and so we believe that they're doing these things to accommodate what they're seeing in the industry. This isn't them targeting American trucking companies. It's a response to the chaos that we're seeing because we've allowed all of these unvetted foreign truck drivers on our highways. American truckers are already dealing with tight margins and rising costs, and now we are facing higher towing fees and delays as a symptom, I guess, of the issues that are being caused by this. The instinct might be to crack down on towing companies with more regulations and more oversight, but the real fix isn't more rules for the towers it's getting the all of these uninsured foreign truckers off of our highways we need stronger enforcement at the borders and ports of entry we need our law enforcement officers enforcing the law we need to verify that all these trucks have insurance check their credentials and this isn't about protectionism it's about fairness and safety our towing industry our towing industry just like our truckers are drowning in this flood of illegal, unregulated, unvetted foreign truck drivers. And so remove the non-citizen truck drivers, and we'll see fewer crashes, we'll see fewer write-offs, and you won't have a conflict between the towing industry and the trucking industry. And so I'm here to speak for this bill. I think it's a good compromise between the two, but I

That's in there. That's the detail. So I'd ask the committee a good vote for this. That way we can get to work on the real issues in the industry, and that way when we come back next legislative session at the beginning of that, we would have two years to work on a good bill that can address a lot of the issues that are hurting this industry, hurting our consumers, hurting the truckers. you will introduce yourself you may proceed thank you mr chair committee uh brad hall state representative of district 24 i bring before you today senate bill 478 and uh what this uh bill pertains to uh is that you will no longer have to use def fluid in the state of arkansas so let me give you a little background history of it uh in 2008 it was mandated that diesel exhaust fluid uh that is used in diesel equipment would have to be used across the country this affects tractors construction equipment and trucks this bill has the ability to bring in new manufacturing plants for death-free engines this bill only allows for death-free engines to be used inside the state of arkansas farmers and ranchers construction groups are all for it if you want to you can still use death fluid you know in all your vehicles or your tractors or whatever you want to use uh i personally as a cattle rancher it seems like every time i have something going on the tractor will read that it's out of death fluid and i can't finish you know bailing hay or feeding cows or something like that or you know on the dozer something will come out you know and you're a million miles away from somewhere to go purchase more death fluid uh and the cherry on top of this is is oklahoma and texas are currently uh running the same bill and uh we could be the first state to to pass it so we could beat them so okay
