to authorize Arkansas livestock and poultry commission impose a civil penalty for certain actions against the incline and to allow and to allow a body condition score to be used for quiring under the offense of cruelty to animals, and if I don't pronounce that properly,
that's just the way I say that word. Um penalties.
A person who commits offense of cruelty to animals against is subject to civil penalties posed by the Arkansas Livestock poultry not to exceed
5000 per violation and um so I think the word if it, if they failed to supply an animal with his or her custody with a sufficient quantity of the wholesale food. wholesome food or water, uh, to be determined if adequate food and water. have been supplied, uh, that's basically what this bill is all about. If they're not doing that, and I think they could be fined. correct That's correct. Yes. You're recognized. Um, this is pretty,

this is a simple bill. We've had, uh, the
problem here is that um when it comes to nutrition issues and welfare issues with Eve Klein. Uh, there is a statute, but it's a criminal code 562103. Uh, the problem is, uh, especially the last few years, we've gotten a lot of complaints that, um, local authorities have been going to these complaints, but because uh law enforcement is not the expertise when it comes to animal health. uh have to determine the cause of the issue and in the law itself,
it, it says that they have to provide adequate or sufficient quality of wholesome food and water. Well, if they have a block of hay there or a cup of water in the officer's eyes, then that's adequate, uh, but the horse may be very malnutrition. So what we're trying to solve here is giving the um Authority to the livestock Poulture Commission to impose civil penalties, uh, and we would accompany that with our state veterinarian that will go out and do a body score to prove that that animal is truly
malnutrition and not a situation where the animal was 30 years old, or falling in the dead of winter time, uh, there has to be adequate proof that they're not providing that food and water, and due to the criminal code, they just haven't had that ability to do that. So we've lost a lot of cases, so this would. Just give us the ability to go in. Now we're not gonna go in and assess $5000 penalties at the beginning, uh, there's a process. We'll go out, we'll issue a warning letter. Uh, we'll go out and vent the problem and score it, and we'll
go through a lot of procedures before we ever get to that point, uh, but these are for extreme cases. Uh, this is not. Um Cruelty as far as how they're being cared as far as breaking the animal, this is solely for nutritional and mild malnutrition and lack of care. Mr. Chair, I know all

Uh, this is a district-specific bill, uh, specifically for Crawford County, um, apparently the levy taxes are not included on their tax statement from the assessor's office and the tax collector's office and this makes it to where they have to pay that for their with their
property taxes. Myself, I live in the city of Clarendon, uh. We have a levy that's been there since the 1800s and when I pay my property taxes, I pay my levy taxes because that levy protects me, especially in times like these when water is high, and I would urge you to vote for this bill because it's a good bill. This is a Crawford County bill. It's a bill for Brad Hall and his community that'll take any questions. Man, any questions? See that
