wanna present? Sure, thank you, members, appreciate the time this morning. You know, one of, one of the issues that Senator Boyd and I have been trying to
dress for a couple of sessions now is that when you buy a new or use boat from a motorboat dealership. It's treated basically just like any other item you would buy at Walmart or a grocery store. The sales tax has to be remitted at the point of sale, and that's we feel like that's an unnecessary burden on our boat dealers. It's not the
way we handle things with motor vehicles, and so we've been trying to work out an issue, an issue where they could pay their sales tax at DFNA when they register their boats just like when they register their cars. It's been a lot of challenge getting that piece of legislation correct because every time we tried to do that we were either inadvertently adding attacks on used boats or inadvertently removing a tax on used boats to end up having an impact on general revenue with this bill, we've, I think now with the FNA, and I know I've worked with Paul Gehing on this too, and he's happy to come to the table and answer questions
maybe better than I could. We finally got a version of this where it's revenue neutral and all we're doing is changing the location of where the tax is collected, so it's not a new tax. It doesn't create any tax cut. It just says that if you buy new or used boat from a motorboat. dealership when you register that boat at DFNA, they're going to collect the tax there just like we do on motor

So presently if you go and buy a new or used boat from a motorboat dealership, you have to remit the sales tax at the dealership. The dealer responsible for collecting the tax and then turning it back into DFNA just like any other item we sell. What you would do
after this bill passes is you would do it just like just like a motor vehicle, so you're required to go and register your boat. You're required to register your motor vehicle at DF. And I, and presently if you buy a motor, you know, a car, when you go to get your tags, you pay your sales tax at DFNA. This would create the same process for new and used boats for motorboat dealers. So if you buy that, you would go to get your tags for your boat, and you'd pay your sales
tax when you picked up the tax for the boat. OK, can we get DFA table? Yes.

Senator Hammer. Thank you and I'm not trying to make it hard on y'all this morning, but what I'm thinking is that uh and and how would this correlate, how would
it be the same right now we're having such a terrible time with temporary tags on cars because the money is not collected at the point of sale. The dealerships have always pushed back about, you know, collecting money on a car at the point of sale, and they want DFA to do that, so. If we're going to change the model on the used boats from the way it's being done now, which is, if I understand it right, the money on the taxes is being collected at the place of sale which is remitted to DFA.
How are we gonna, are we going to create the same problem we've got with cars and used taxes as far as people delaying paying their taxes. Are we about to create the same scenario in the boat industry as well, or what would be the difference. So the

process currently is, is that when you purchase a newer used boat, you are required to come to DFA to obtain a certificate of number if it is a new boat, you would have a requirement to obtain also the certificate of title for the boat, and also if most boats are When they are sold, they're sold
with an accompanying trailer for the boat, that trailer has to have the sales tax paid on the trailer at DFA. Trailer needs a tag as well and a registration. So yes, there is going to be a change in that there. would be, instead of the tax being collected at the dealership for new and used boats, there would be a time period, which is 30 days, the, the, the purchaser has 30 days to come in to DFA and obtain the certificate of number for the boat before they can lawfully operate it on the waters.
Um, if there is under the bill on 638 if that person does not come in and register the to obtain the certificate of number and pay the sales tax on their purchase, there is a 10% penalty that applies to as well, so that would be the incentive for the person to make sure that they're coming in promptly within 30 days and processing their transaction. So they're going to be temporary tax issued go on those boat trailers. The trailer will will have a temporary tag when it when it's purchased from

Yes, Senator Hammer, so we certainly, we received that information from the dealers in Arkansas on expired temporary tax, it is what is a primary use of information that we have to send out assessments for taxpayers that have not come in and registered their vehicle or their trailer, and if that A person gets an assessment. credit on certain beer and and sake using Arkansas rice. We, we have on here that we have an undetermined reduction in
that. OK, just no way to calculate exactly what that would be, or is there some ranges with on this particular one. Paul

So it is an undetermined fiscal impact, but what we did is go back and look at the number of accounts within DFA that are remitting that those particular tax levies, and they're about 40 accounts that are levying that that are collecting. Those, those Tax levies that would be subject to possibly obtaining the credit and also of those 40 accounts
that are collecting that tax. There's about 12.4 million in total taxes collected, but we certainly understand that not everybody would be eligible to claim the credit and also it's not a 100% credit against the tax. It's just a, it's just a partial credit based upon having the Arkansas rice content in the in the product. So it's nowhere near what be the eliminate the full 12.4 million. It would be a small percentage of that.
