But there was a drafting error that needed to be corrected and there wasn't enough time to correct that since the House didn't suspend its rules to get it all corrected. this morning. You know one of the one of the issues with Senator Boyd and I have been trying to address for a couple of sessions now is that when you buy a newer used boat from a motorboat dealership it's treated basically just like any other item you would buy at Walmart or grocery store. The sales tax has to be remitted at the point of sale and that's we feel like that's an unnecessary burden on our boat dealers. That's not the way we handle things with motor vehicles. And so we've been trying to work out an issue where they could pay their sales tax at DF&A when they register their boats, just like when they register their cars. It's been a lot of challenge getting that piece of legislation correct, because every time we tried to do that, we were either inadvertently adding a tax on used boats, or inadvertently removing a tax on used boats, to end up having an impact on general revenue. With this bill, I think now with DF&A, and I know I've worked with Paul Gehring on this too, and he's happy to come to the table and answer questions maybe better than I could. We finally got a version of this where it's revenue neutral, and all we're doing is changing the location of where the tax is collected. So it's not a new tax. It doesn't create any tax cut. It just says that if you buy a new or used boat from a motorboat dealership, when you register that boat at DF&A, they're going to collect the tax

the taxes? So presently, if you go and buy a new or used boat from a motorboat dealership, you have to remit the sales tax at the dealership. The dealer's responsible for collecting the tax and then turning it back into DF&A, just like any other item we sell. What you would do after this bill passes is you would do it just like a motor vehicle. So you're required to go and register your boat. You're required to register your motor vehicle at DF&A. And presently, if you buy a car, when you go to get your tags, you pay your sales tax at DF&A, this would create the same process for new and used boats for motorboat dealers. So if you buy that, you would go to get your tags for your boat and you'd pay your sales tax when you picked up the tags for the boat. Okay.

Yes, sir. Okay. There's a question by Senator Hammer. Thank you. And I'm not trying to make it hard on y'all this morning, but what I'm thinking is that, and how would this correlate? How would it be the same? Right now, we're having such a terrible time with temporary tags on cars because the money is not collected at the point of sale. The dealerships have always pushback about you know collecting money on a car at the point of sale and they want DFA to do that so if we're going to change the model on the used boats from the way it's being done now which is if I understand it right the money on the taxes is being collected at the place of sale which is remitted to DFA how are we going to are we going to create the same problem we've got with cars and use taxes as far as people delaying paying their taxes. Are we about to create the same scenario in the boat industry as well, or what would be the difference?

So the process currently is that when you purchase a new year's boat, you are required to come to DFA to obtain a certificate of number. If it is a new boat, you would have a requirement to obtain also the certificate of title for the boat. And also, if most boats are, when they are sold, they're sold with an accompanying a trailer for the boat. That trailer has to have the sales tax paid on the trailer at DFA. Trailer needs a tag as well and a registration. So yes, there is going to be a change in that there would be, instead of the tax being collected at the dealership for new and used boats, there would be a time period, which is 30 days. The purchaser has 30 days to come into DFA and obtain the certificate of number for the boat before they can lawfully operate it on the waters. If there is, under the bill on 638, if that person does not come in and obtain the certificate of number and pay the sales tax on their purchase, there is a 10% penalty that applies as well. So that would be the incentive for the person to make sure that they're coming in promptly within 30 days and processing their transaction. So there are going to be any temporary tags issued on those boat trailers? The trailer will have a temporary tag when it's purchased. Typically, when you buy a new or used boat,

So it is an undetermined fiscal impact, but what we did is go back and look at the number of accounts within DFA that are remitting those particular tax levies. And there are about 40 accounts that are collecting those tax levies that would be subject to possibly obtaining the credit. And also of those 40 accounts that are collecting that tax, there's about 12.4 million in total taxes collected. But we certainly understand that not everybody would be eligible to claim the credit. And also it's not a 100% credit against the tax It's just a partial credit based upon having the Arkansas rice content in the product. So it's nowhere near would it be the, would eliminate the full $12.4 million.
