present your amendment good afternoon jay richardson district 49 uh just here to to highlight a couple
of the the changes that came back from the senate side on house bill 1695 uh bankers association wanted some changes to make to make it uh to clear up the existing lien holder holders notice uh land title association asked for another change about the liens that are being in place and then the final one was a
change that Senator dismay wanted to do to give the notice to the land commissioner's office about buying delinquent property so it was all in line and it was all agreed upon legislation and ask for a good vote all

right any questions from committee members yes let me get you representative Andrews you
Representative Wade Andrews

2:36
were recognized for questions thank you mr. chair and i haven't looked at the actual bill draft but on your amendment here it's one it says 165 and then 365 in parentheses is that just a typing
error or say that one more time on on your senate amendment right here where it says page two line 30 delete 165 and then in parentheses
Speaker 19
3:02
it says 365 is that supposed to be like that for
Representative Wade Andrews
Unverified
3:22
to fix the typo before we adopt
the amendment I mean I'm not trying to slow down the process or anything
Speaker 23
3:39
I'm trying to make it right how soon can I bring
Speaker 28
3:44
somebody up real quick chair just introduce yourself
Speaker 29
3:49
for the record John Wilkerson Arkansas Municipal League I think perhaps the three did not need the hundred is fine the three was
the previous line would be my guess but i'll take a look real
Representative R. Scott Richardson
Unverified
4:03
quick because what page page 2 line 29 see the task at 120. my original one has 120 days
Speaker 40
4:26
Yeah, it is a mistake. Okay. And on the line 29, there's a three? Oh, there it is. Yeah, three. Yeah, sorry. Yeah, you're
Speaker 29
4:52
right. Page two, line 29. Thank you. I thought that
Speaker 43
4:56
it's right Mr. Chairman we figured it out okay so
Speaker 49
5:11
you think you can y'all have an explanation on page 2 line 29 in the top of it it's striking out 120 and adding 3 and
Representative R. Scott Richardson
Unverified
5:21
in line 30 it's deleting that piece the 165 so that changes it to the 365 that's that's still not
Speaker 1
5:33
right because on page 2 line 30 there's
nothing referenced 165 yeah or 365 on on line 30 yeah you're right chairman so
Speaker 58
5:47
it should be adding because there's nothing on that right
Speaker 1
5:52
now i'll tell you what we're gonna do We're going to take a break on this and figure out what we need to do here. And we'll take up Representative Painter's House Bill 1555 in the meantime.
So we take no action yet on House Bill 1695 and the Senate Amendment. Representative Painter, you are recognized to present the amendment on House Bill 1555. Do I need to explain what's going on here? I can do that, Chair, if you want to.
Representative Stetson Painter

6:32
Representative Stetson Painter, District 3, Baxter and Fulton County. So, colleagues, after working with Senator Hester and
the Municipal League, we've come to an agreement. But we've kind of, at the end of the session, have some gobbledygook we're going to have to go through.
So we did not concur with House or with Amendment No. 1. We have two amendments on this we have to do, but BLR has told us to get the bill that we've all compromised with. We have to concur with Amendment 1 first. Then we could go to the next Amendment No. 2, concur with that, and then we get the exact bill what we want. So in doing that, I would make a motion that we would concur with Senate Amendment No. 1 to House Bill 1555.
Speaker 1
7:17
All right, let's see if I have any questions from committee members Seeing none we have nobody in the audience speak for against We'll take up your motion any discussion on that motion we have a motion to concur and I Believe we probably need to take these up one at a time so amendment the motion will be to concur in Senate amendment number one to house bill 1555. All in favor say aye. Aye. All opposed, no.
Ayes have it. We've concurred in Senate Amendment
Representative Stetson Painter
Unverified
7:54
No. 1. Thank you, colleagues. Amendment No. 2 is the agreed-out language that we decided with the Municipal League. I'd be glad to take any questions. Any questions? Seeing
Speaker 1
8:05
none, no one's signed up to speak for or against. i make the motion that we would
Speaker 64
8:13
concur with senate amendment number two all right motion is concur
Speaker 1
8:17
center number two any discussion on that motion seeing none all in favor say aye

Speaker 43
18:04
yeah just to just to confirm the amendment has already been engrossed in the bill and what the and this still is of the time
Speaker 29
18:11
frame we in the original bill we'd extended the time frame to perfect liens and file the liens and the title companies did not want to extend those time frames so we went back to the existing time frames made no changes to the time frames for cities to perfect the liens and then of course the other two issues taking out the notice provision with the land commissioner and then the bankers association adding language to ensure that they had notice of the lien any foreclosure process should they have a lien okay I have any questions from
Speaker 1
18:42
committee members seeing none we do have one person signed up to speak against this Paul Calvert if you'll
Chair

Paul Calvert

and turn your mic on. Here you go. Okay, my name is Paul Calvert. Thank you, committee. This is a bill that kind of touches close to an issue that I've had personally.
And my biggest beef is that it's expanding the power of the cities to impose liens. And I don't think we should do that. I've had trouble with this myself, and it hasn't been fixed, and the Municipal League is continuing to support the action that has been taken against me that was unlawful. So I don't think we're ready to give the cities any more power. That's all I have. All right. Any questions? Seeing none, thank you for your testimony.
