eighty seven percent of the funding will come from that and they also received a grant from are not for thirteen percent of those calls next we're gonna have some for you a five eight bill and all these first three for you a faith bill they're all going to be methods of finance as well as alternative delivery contracts that we'll see you later on and are there architectural contracts so we'll be doing all three actions today

Thank you miss Kathy members we have one question I apologize I don't have a seating chart yes the number sixty seven Representative Dotson you're recognized thank you Mr chair this is for university of Arkansas Fayetteville fine arts center number six.
Taylor if you introduce yourself you know the routine. Rebecca Haley university of Arkansas. Hello Rebecca and so I'd just looking at this and thirty million dollars for an eighty one thousand square foot building is about four hundred and sixty eight or sixty nine dollars a square foot in cost
Prince seems like it's pretty expensive what what's going and all that yes Sir this was a building that was completed in nineteen fifty one the building in landscaping or both listed on that national registry of historical places so that adds to the expenses of the building when we're doing the renovations there's also around six million dollars the deferred maintenance and capital projects that we have to do with the building anyways that to bring it up to eighty eight compliance so there's a lot of different issues with the building itself.
So I mean. It's a lot more expensive than new construction is it and the gas considered building a new building both on the mail is in the middle of the campus and it's on the rest of the national register of historic places. Okay so it's just a lot more expensive to get done I understand Sir but uh it it will be the building envelope it's going to include the original you know still windows the public spaces the exterior the interior it's getting completely re done. Thank you.
I thank members and Representative Dotson no further questions thank you miss sailing thank you Mr chairman. Seeing no further questions these items may consider review moving on the items see. I'm sorry senator Irvin. Thank you Sir I'm at a aging adult and behavioral health on a question number one just a quick
question there's somebody here that can address something that quick question. The DHS number one CHS Mr why could you joins please. Judiciary says the committee. J. hill with a behavior health and mark what would division Human Services or third party services. Thank you Mr head home Mister right quick question number one is that just for that one area
or is this federal grant available for all of our areas across the state for this type of a program and if they are all available is it a matter of just these different eight. Area agency on aging's applying for it. It center in a is available for other areas my members and when we when this first came available through the fence we went out to the triple A.'s and offer this is possibility thank at the time northwest Arkansas the only one expressed interest
in it and so they're now the one that has won those grants my understanding it is still possible if others become interested that they could seek that grant but I'm not aware that we've gotten any interest from others. Okay I'd really like to improve upon that and I think the whole state should apply for it we're leaving money on the table and this is a very very good thing and there are farmers market from their road side vendors all
across the state of Arkansas not just in this and I I give a lot of credit to the northwest Arkansas area agency on aging for apply identifying if the US and applying for it but this really needs to be throughout the state so whatever we need to do to make sure they're not leaving that money on the table that the guy that could help their residents get fresh fruits and produce we need to do that so I I mean I thank you for your efforts that.
These other areas they need to step it up. Senator we have a meeting with the triple A.'s this week and I'll I will convey your your your thoughts on this and please stay on all right a letter to each and everyone of them to as well they need to apply for the and they need to make this available for the citizens of the state of Arkansas thank you thank you Mr chair thank you senator thank you German. See no further questions any questions members. Seeing none without objection these items may consider review moving on item he.
Mister chairman item eighty are our services contracts on on page one of item eighty is a letter from the office of state procurement from Mister Armstrong and in this letter he notes that there is one contract that will need to ratify the work is being done when we get to that that is on page nineteen its contract number six for the insurance department I will go into details when we get there and any notes that none of the other contract submitted

All commissioning services contract amendment those are the construction related contracts on today's agenda.
Any questions are members or move on items he to. Right seeing none let's move on thank you the next group of contracts are inter governmental contracts of the first one is the education department with the UAMS and this is an amendment for a contract to add funding to support the return to school activities because code nineteen school closures number two is environmental quality with you see a and this is an original contract to develop and are revise their water quality
criteria for wait a full streams and eastern coastal plains for the Washington or river basin and number three is DHS with UAMS this is for ombudsman program for child abuse and neglect at training services for helping professionals throughout the state. On the next page numbers four through seven are all going to be the same these are offer you a a law are with various universities for
the and they were federally awarded of recipients of US of a grant and so these are the sub grants with vendors that will provide entrepreneurial and small business services to the it's designated geographical territories throughout the state and those are all of the inter governor tracks on today's agenda new have one question maybe to represent war laws issue this time yes Sir all right number two the ET I want
to talk to someone from AT queue if possible eighty two you see a Grumman. Welcome serve your honor to issue self to the committee for the record. Thank you Sir Mike over pay department of energy and environment. Absent OR not thank you Mr chairman it it bothers me a little bit this wording under the explanation which says
develop or revise the water criteria I mean do we not know what our waterfront tearful are running water streams are today. I would that yes we do. Okay so what are we going to fill up and revised Mr chairman I'm sorry I didn't ask for permission. Now go in German Wardlaw. I'm sorry to be the question to what we going to develop our revise on this water criteria
for the Ouachita river which runs down the whole west side of my district. Well what we're doing is taking samples. Of the settlement in the and the nutrients in the water ways. And it will use those to create if there needs to be any. We modification to the existing. Mister chairman one more go ahead. Has there been a problem one no washed all river is or is there
a reason the EPA asked us to do this I understand that were used doing it there you see a because we don't have the manpower to do it so it is their problem or is there a reason. I am not aware reason. Our problem. Thank you Mr. Thank you. Any other questions on got a seat sixty six thank you thank you Mr chair so I'm going to kind of piggy back off the Representative Vaught Wardlaw if
there's no problems then why are we doing this. No be glad to get the dental people down here to explain in more but they're not here today. But the question is or that. I'm sorry repeat the question one more time so if there's not a problem then what made the EPA flag this to do this. I don't have an answer for that today and then I would like an answer to that Mr chair but can
I ask one more please yes for. Thank you Mr chair so I know the you they took a lot of criticism over there at water waive the testing of the buffalo so did you see I have the capability to do this. It did you taking water samples. Under direction so yes okay so the net leave me to mine that cost is a hundred fifty eight thousand dollars for them to take water samples. That's actually a grant from the EPA been were passing it through
so it's not costing the state any money. Mr pay is AT T. doing any work here you just passed through agency for the grant going to use for managing the work the students are actually out in the field doing that some or managing or yes Sir you know everybody here from the water division today did not expecting questions on this and we are actually. If you would like I'd be glad to step back from the table and get
a few answers for you come back I think we're gonna hold this Mr pay if you don't mind I just I consents members would like to get a better explanation about what's going on here. Today or. Let me know when I will be here real long getting here will listen to them for the the meeting Esther otherwise Alisa me on the agenda Friday thank you Sir thank you. I'm sorry presenter bonded I cut you off isn't thank you the everything else Mr pay that was what I was going to ask.
Absent were law you have another question. I'm sorry that senator Irvin. Yes just just on that what am on that end in you when you come back that's fine Mr chair I just wanted to give them a heads up that I'm interested in this as well and then if if this is consistent across the state. Do we do this in other areas across the state so I'll reserve my question for later thank you
Sir reticent Irvin your eighty six in German Wardlaw sixty eight and I got confused. All right we're finished with the inter governmental contract items moving on to eat three. The next great Mr chairman or the out of state contracts the first one on page nine is the act right apartment this is for in a temporary employment services number two of is Arkansas geographic information systems and this is an amendment
this has to do with their digital of services for the entire state number three career add rehab services with as a job this is a of amendment to a contract for providing necessary maintenance and support for the Arkansas rehab services vote re had case management platform. On the next page correction department number four there has a contract amendment to provide waste disposal services two east
Arkansas regional unit number five is DFA building authority and this is for unarmed security guard services at six locations here in little rock of the buildings that they operate number six is also for building authority services for janitorial services this happens to be for the BG Hendrix building in Fort Smith on the
next page is the racing this is an original contract to do alkaline K. nine drug testing kits and service number eight disability termination this is an original contract of for US social security administration's medical consultant number nine is educational TV TV a PBS this is an amendment to a contract for computer science technology online courses to Arkansas educators through the Arkansas
ideas portal maintained by the a ET in number ten is the health department and on this is for prescription prescription drug monitoring program software system that's an amendment to the existing contract number eleven is DHS this is the original contract to identify and promote practice and policy initiatives that will create strong and closely coordinated partnerships and collaborations between families youth community and residential based treatment
service providers advocacy and policy makers number twelve the AGS this is an amendment all this is for their independent verification invalided validation services for comprehensive child welfare information system. Number thirteen out in your packet of letters there on a pad of their pretty don't golden rod paper the first of five pages have to do with this contract and to other contracts for DHS
so I'll explain it here but this is DHS requesting another year for special procurement to continue providing the transportation services to Medicaid beneficiaries that are participating in the early event intervention day treatment and adult developmental day treatment services these are similar to the non emergency transportation services that are also provided to the Medicaid beneficiaries a settlement agreement was made that require DHS to conduct a cost study to
determine of appropriate right for the service in due to complications this year they've been unable to complete the study because of the dramatic drop in the used during twenty twenty so the utilization data is so we're regular it won't work for setting a new reimbursement rate for new solicitation I list the director has stated in a letter that he's urging DHS to report on the status of its efforts to conduct a Capri competitive procurement of the services no less than
quarterly in twenty twenty one with that condition he is authorized DHS to initiate another special procurement of these contracts and then submit them for legislative review and again there are two more contracts in the in state that referred to this letter as well but that is the contract number thirteen contract number fourteen this is amendment sixteen a with a contract formerly it was H. P. now it's D. X. the and you'll notice
contract number fifteen and number sixteen or not adding any additional money to the contract number fifteen was done when they change the name to D. X. the are they have to. To change the contract numbers in aces and number sixteen A is a revised performance indicators and in talking with the age yes today they could not line it up for both of them to be on the same amendment they were still
negotiating the performance indicators when the first one was done then on the next page on page fourteen contract number fifteen these are for personal care under twenty one for prior authorization and and retrospective reviews for select Medicaid populations number sixteen DHS with General Dynamics this is the addition of a. A rough order of magnitude are EM requested for data met data
mining and Medicaid finance operational support contract number seventeen is DHS this is the an amendment to an existing contract for electronic visit verification system number eighteen DHS with public consulting group for cost allocation systems and processes. Number nineteen and twenty or both for north northwest Arkansas community college and these are both done is a special preparative six in your golden
rod paper is the letter that pertains to this up for Mister Armstrong of for the special procurement on this one it's for a health insurance consultant and primary up pharmacy benefits manager and they're nearing the end of the year in in light of open enrollment deadlines they did not have time to conduct a competitive solicitation of the services and under the circumstances OSP has authorized up to a year to prepare a competitive solicitation before
the year is over so those two original contracts the first one being for the insurance consultant I believe in the second one is for the pharmacy benefits manager number twenty one on the next page on page sixteen this is U. A community college thanks full are this is the original contract four completing their conversion from their legacy system into their new work day of and of. They're making that move in July
twenty twenty one and so this is part of of the process of making that move to work day and because of colleague work day number twenty two is you a pine bluff and this one is for the. Arkansas A the Louis Stokes alliance for minority participation stem academy and H. B. C. U. master's degree programs UAAP be the next one and this one happens to be also
for this universities work to of new to the work day system. Number twenty four is work for services this one is for. Transition to work with state call center managers and call center application issued questions coordinators those kinds of things this is with computer agent cooperated and number twenty five work for services also with computer rate is for a senior architect to work with developing in modifying mainframe mainframe programs and reports and
providing support needed to continue day to day operations of the cares action and L. the B. as programs those are the out of state contracts on today's agenda. Very good any questions members on any of the out of state contracts. Right seeing none will move on to item eighty four in state contracts. On page eighteen we start the in state contracts the first one is with corrections department and to provide waste disposal services.
Of a calico rock number two is eighty Q. for cleaning services number three DHS with Tankersley this one has to do with food storage and distribution services number four and number five are these are the two additional contracts that went with the the first five pages the letters of four DHS dealing with the day treatment transportation and the need for the special procurements in the
on those number six is the insurance department with Cranford Johnson Robinson woods this one also is a special precariously pages six thirteen in in your of gold packet we have information on the special procurement I'll go over that and this is also the contract that Mister Armstrong pointed out in his letter to us noting that it need to be ratified so also provide you that information which is on page eleven of your goal packet but
the special procurement has to do with the Arkansas health market place was transferred to the Arkansas insurance department in FY nineteen part of transformation an existing contract with C. J. R. W. for marketing and branding related services was procured through an RFP process and was also transferred to the insurance department but it was determined that the contract was never transferred within asus there's not enough time for the insurance department to develop
and finalize a competitive solicitation so it's the state the special precursor the services is warranted for the year to come Mister Armstrong also stated in his letter that he has not been made aware of facts established of establishing that the prior contract was unlawfully awarded merely because it was and recorded in asus so that has to do with this. National procurement the ratification request the letter on page eleven state that the department of commerce that
knowledge is a deficiency in internal knowledge and understanding of state procurement procedures and requirements and is now actively working to develop a plan to address these deficiencies. Insurance department also reports that there has been a determination that there was no intent to circumvent state procurement processes nor that fraudulent activity was involved on the next page also for the insurance department contract number seven three nine these are all the same they're
amendments two existing contracts these are funded by Imad PPA grants to help older adults individuals with disabilities and their caregivers apply for special since it's and that has to do with Medicare savings program and part D. prescription drug programs number ten of this is also the insurance department would J. W. software ink and on this one this is for purchase of workers compensation claims
administration software I do want to note of that I've talked with the insurance department earlier today there was a mistake in retrieving this information from the portal the actual contract amendment that we're seeing today is for sixty thousand dollars not four hundred ninety two thousand five hundred and on the first page there under number team in the total authorized after this amendment will be six hundred
twelve five hundred and the total after review will be six hundred seventy two thousand five hundred so I did want to make that note I'll change that in the report number eleven also for the insurance department is four workers compensation managed care. Number twelve is mid south community college they have a couple year with Ramona Maunsel associates the first one is the sole source justification and so on pages twelve and thirteen of your letters packet on the golf
golden rod paper you have a sole source justification for mid south on this one they originally ward of the contract for grant writing and technical assistance services for their title three predominately black institutions grant using an R. F. P. in this vendor is help to ensure mid south remain compliant the department education recently extended those grant funds for all institutions for an additional year did a program interruptions from co that the original contract with this vendor has expired but need south needs to
continue receiving these critical services for an additional years so that the provides the justification for their sole source procurement of this original contract and then the other one also with Ramona Mansell is for consultant services to develop a new title three grant proposal an application deadline so those of next page I to me page twenty two you a fateful this is a the amendment for security services
number fifteen A you a fable for powers of Arkansas for facility System monitoring prevention repair maintenance for the AS MS a equipment including H. back equipment fire safety systems back up generation generators up plumbing electrical mechanical systems and chilled water systems. Number sixteen you a pine bluff this is for securing a web conferencing for system for the U. a system you a school of
agriculture and fisheries department number seventeen you a P. B. far clerical administrative event and general labor temporary staffing services for the a university you a P. B. number eighteen for disposal services for the university number nineteen up again some contracts for work for services the first one is for assisting families to reach self sufficiency number twenty is an original contract for
janitorial services number twenty one is with our house to provide T. clients work pay clients homeless and near homeless population and other ten if L. eligible individuals who are looking to escape poverty with employment opportunities and those of the in state contracts. members any any questions on the in state contracts. Mr drop a can you is anybody here from water division yet
just say yes or no. Friday all right very good. All right. Alright members not seeing any other questions on item the these items will be considered reviewed excluding item to in section eighty two point eighty Q. and you see a. Arms Kathy item F. please Mr chairman and I'd of if we have
our reports on the first group of reports and those reports are those contracts with no material change their extending and adding the same amount that they've had in the previous of review. Pages one through nineteen that's what that is pages one through eight in F. two are this is the contracts that ARE executed contracts below the threshold for review pages one through eight would have would
take care of that that if to and then the next one F. three of these are the critical emergency procurements and there's one through eleven these are all of the contracts that recently been entered into that deal with cove ID and they have been procured using critical emergency procurement says of the reports on today's agenda. Thank you miss Kathy no action required by us some items F. so item G. we have no new business
so members of brings us down item age under H. H. one this has to do with page one is a request from the education department this is new for the subcommittee this isn't all right Q. review it's a new ID item from the current study that we did a few years ago requiring an agency that wishes to use in our if queue outside of architects and engineers of and things like that to receive approval from S. P. to solicit
using an RFQ process in this case in the letter that they provided the request is for education to use the R. F. Q. from soliciting hearing officers who will be paid at a rate set by education and it will be stated in the contract and so this is a review item for the committee again this is a letter from Mister Armstrong and part of the new regulations and laws that we passed requiring an agency to get review and approval from a wispy and the
review subcommittee prior to entering into an RFQ the next thing I want to point out to the committee is the annual cooperative spend reports last last time we met which was in September I believe I noted that we had received cooperative spend reports from all agencies except for a grouping I reached out to them again and I've received something from all of the agencies except for the first one Arkansas northeastern college and I'll be following up with them these are reports that
are being filed with the SEC with the subcommittee and be available if anyone wants to look at their cooperative spend reports and those of the all the items on today's. Thank you miss Kathy represented us in is that you. Yes share This probably for staff. Could you remind me what process was for H. one prior to the law change. For this sort of thing for our cues a.
There was no process side that I'm aware of the agency could just use that Mister Armstrong is here and may have some additional information on that. Judgment from from the upon the sure. Mysterons firm he wouldn't mind joining the Senate issue self for the record. Thank you very much is settled Armstrong with the office of state procurement department of transformation insured services. Previously the determination the termination was made
specifically and exclusively at our office we would decide whether or not something would qualifies in our queue and the consultant said come in that you're tired and they saw that I had a process where I would ask the agencies to justify why they didn't want to use price competition but it didn't want to do an RFP and I would also ask them why. Or how if they were going to ask for price competition how they were going to control the costs. And the consultants that that
was a good process and they recommended that it be made part of the law and so that's why now that's in the statute based on their recommendation okay so it's just a little bit more transparency in the process FOR Brad speak to the to level with the determination here then we present to you that the termination. And then it moves forward unless there's some objection to a so what's really new here's the legislative review. Right. Is is this the first time we've used the since the new laws been employees that's correct this is
the first time in it is that only applies there's a separate statute as Kathy indicated that authorizes in fact it mandates are excuse for certain types of contracting engineers architects landscaping interior design and so forth. So obviously they don't need to ask go ESPY's permission to do any of that because the law tells them that they have to but if somebody wants to use in our queue for something outside of those then they have to get of recipes permission if you will
and then if I grant that then it comes here. Awesome thank you very much appreciate that it seems from from like what thank you that Mister Armstrong thank you Representative Dotson any other questions members. Are saying nine item H. one requires review without objection this item be consider reviewed this Kathy we have any further business. Alright members like we're done return.
