there's a reconciliation for that in the AG's office that occurs in the twentieth of each month or the twentieth day of the quarter and we're wanting to do that to the thirtieth the main reason for that is the receipts come in that day the twenty th as well and so that doesn't really give the ages Tom office time to really reconcile receipts to deposits it's a Mason Forsman issue it's about moving this out ten days gives the AG's office for time to kind of look through that and make sure everybody's doing things

the state of Arkansas for these disabled people play bingo is with the paper bingo card in a calendar so physically they have to be able to place the doppler. Onto a number on the card. The fact is there are people in Arkansas that physically are unable to do that and that's an obstruction what they want to do enjoy legally here in our state this bill provides an opportunity for those people to play bingo by providing rules for electronic device that would allow them to participate in

You pay your taxes on your winnings when it to gambling institution both the casinos and the horse track. The all it is is that the people the money already what this bill will do will be to require the casinos or the horse track to deducted at certain levels.

Any winnings at a casino are currently not reported to DFA and there's currently no withholding on those. This law would would implement a reporting and withholding requirement on those casinos if that same reporting holding requirement exists for federal law we're kind of behind of the State Farm yes Sir this is a function of that constitutional
amendment that allowed casinos that constitutional amendment did not include these withholding and reporting required okay thank you thank you Senate representative Tosh you're recognized for a question. If you pull that lever and you win more than twelve hundred dollars you currently owe income tax on that amount but that amount doesn't get reported to
DFA so DFA is required to either the taxpayer has to. Report that and be honest and report that twelve hundred dollars in winnings or DFA has to find it somehow what this bill does is this casino. If that person wins twelve hundred dollars or more you notify DFA that the that this person one that amount and then DFA is looking for that amount to be reported on your tax return. That information I I didn't know

Melissa fulls. You would to introduce yourself and then you can begin your testimony. Thank you Mr chairman for allowing me to be here speak today my name is Melissa fulls. I represent Arkansas normal and if it a long time patient advocate. I realize many of y'all have already made your decision on this bill but I would like to take just a few minutes of your time to point out some issues
and give a patient's perspective since we're the ones that's going to be paying it. Arkansas has a medical marijuana program. Not an adult use. This excise tax is being paid by patients. The chemotherapy industry is not being asked to pay an excise tax for this program. Yet there seems to be no qualms about making medical marijuana patients pay for it. Unlike other medicines insurance
doesn't pay for campus it comes out of our own pockets. Many of our patients are disabled and live on a very small fixed income. Many of our PTSD patients are veterans. Men and women that served our country to the best of their ability and were sent home with permanent damage both mental and physical. We have hospice patients patients in constant pain Alzheimer's patients in yes cancer patients.
Many of these patients are in pain and dine and this bill was asking them to find a program that has nothing to do with medical marijuana. We've been treated like second class citizens since this is the beginning of this program all because we have chosen to use a medicine that is more effective. Less dangerous and less addictive. Many legislators have stated publicly that they oppose this program yet now are looking at it as a source of tax income.
Since the state is obviously needing more revenue and looking for revenue to cover the NC I the legislature actually has a golden opportunity right now to make an unbelievable amount of tax revenue for the state. According to the tax foundation an adult use program in Arkansas can generate over fifty nine million dollars a year in the excise tax alone. With the strong possibility of
the US Congress passing them more act this year it would give Arkansas a head start on other surrounding states a legalization this could also have a huge impact on patients it will give them better access and forced the industry to lower the prices it would also create thousands of jobs and adult use program could be the perfect choice for funding in C. I. as well as other programs but I beg if you please do not continue to place this burden on patients.
I hope you will consider their pot the plight of these patients we already pay more than three times for our medication than any other state in the nation. And anyone add insult to injury by continuing this excise tax this tax was originally promised that it would only be for two years in order to get the minute medical marijuana program thing going but is now not being used for the medical marijuana program but for a program that
has nothing to do with medical marijuana. I'm asking you please show the second I patients the compassion that they deserve and vote no on this bill thank you very much for your time and I would be glad to answer any questions you may have members any questions. seventy go it. Mr chairman and committee members my name is Luke story. And I represent the Arkansas broadcasters association approximately two hundred and forty broadcasters across the state of Arkansas. I had arranged for some broadcasters to be here but mother nature has prevented that from happening so I'm flying solo on this mission. I thank you for welcoming me into today's meeting allowing me to speak on Senate bill three fifty.
We are opposed to this bill short shooting the identities of large lottery winners removes the element of transparency that is essential to preserving the integrity of our state lottery. As you know the lottery is funded by public dollars. You don't have to play the lottery in Arkansas but if you choose to play you except that you're playing by the long established rules which include disclosure of identity if you win.
This transparency deters fraud and abuse and provides public oversight of a publicly funded program. It also helps ensure the success of the lottery showing Arkansas showing our Kansans. That there really are individuals just like them out there playing and winning the lottery. This bill is simply a solution in search of a problem that doesn't exist. The Arkansas lottery has no record of any complaints filed
where someone said that they had been harassed in any way because of their identity being released after winning a publicly funded lottery. Lottery winners currently have a hundred and eighty days that's six months. The claim winnings and to get their affairs in order and we believe that is ample time to maintain anonymity and to get their affairs in order. I assure you. That if I won a million dollars I would show you just how quickly I would get my affairs
in order six months would be plenty of time. Only eleven other states exempt the identities of lottery winners there's a reason for that. Disclosure of winners names is the most effective way to keep the games trans transparent. Senator Teague point this would also help ensure that employees of the lottery are not claiming huge lottery winnings. Unfortunately lottery fraud
schemes do you happen in two thousand seventeen a security director for the multi state lottery used his brothers to help commit the biggest lottery scam in history. Including five states lotteries and one of those states the state of Kansas. Provides confidentiality in immunity. Without transparency around winners we don't know. When individuals like family members or employees claim prizes.
Also most other states recognize blocking transparency around winners hampers lottery advertising and therefore lottery revenue it's a lottery marketing one oh one. Again people won't buy tickets if they don't think they can win. As you all know the lottery. Had a few rocky years but we are in a place now where we are seeing record revenue in the lottery the lottery set another record just last month in fact in twenty twenty it generated five hundred and thirty two
million dollars which may close ten ninety million dollars available for scholarships for aspiring Arkansas students this bill will negatively impact lottery sales. Less revenue means fewer scholarships for Arkansas students. This will also negatively impact broadcasters and newspapers. These are primarily locally owned and operated businesses that are investing heavily in communities and they rely on these advertising dollars to
make those investments in closing I ask that you please join the broadcasters the press association the for your coalition the for your task force in opposing Senate bill three fifty five and preserving the people's right to know I think each of you for your servant leadership and the opportunity to address you today and your consideration of my comments I'll gladly take any questions. Introduce yourself you can be thank you Mr chairman my name's Aaron Sadler on the communications director for the Arkansas press association I really appreciate what Mr story said he's did still a lot of my talking points all try to be really brief Senator Teague
pointed out the situation that is is probably more real than what we might think it would be yes Is Senator T. work to win the lottery and then give the ticket to his cousin right now of reporters in Nashville J. R. Sharma chairman who owns that paper probably know see Mr Thiessen Senator keys because and is probably going to be able to reach out and say Senator Teague didn't have anything to do with the city and ask those questions under this law that would not be possible
legislatively a poll enacted for the task force which was enacted in twenty twenty seventeen by this body it includes some representatives of the press but also representatives of cities counties state agencies that task force voted not to endorse this bill. Largely because the possibility of corruption we mention the Iowa case where the director of the Iowa state lottery sorry multi state lottery in Iowa a colluded with his brother again his brother would not be considered an immediate family
member under Arkansas law so that brother when he cast a ticket under this bill. No one would know whether and whether or not there was any kind of connection for at least three years. in addition to corruption there's also the issue about accountability to private creditors if a multimillion dollar dollar lottery winner decide to spend that money on travel or other things rather than a yes mortgage car payment or is a lot of line of credit it's a local hardware store those critters wouldn't have any ability to
find out whether that person and won the lottery they would call the lottery and the water would say we can't give you that information if that would be a for a violation not to mention the fact I mean it it's it's conceivable that a a spouse could win a lottery not tell their significant other it's conceivable that a group of people at a at a factory or work working in another group or a church group one person could buy a lottery ticket that could
win and all they have to do is say. No ours wasn't a winner there be no recourse for that those other people who were participating in that to be able to find out whether or not they they're taking one lottery for three years but maybe most importantly the Arkansas lottery already balances privacy versus the public rights to public right to know in recent months they have listed only the first name of winners at that person's
