Call this meeting to order waiting on my Senate chair to get back with we'll go ahead and get started. All right well it's good it's good to have everybody back it will start back on education. not adequacy it will start that January but we're gonna start on doing some other things and listing some reports and hearing a lot of things today we got the part of it is going to come up and talk to us a little bit I'm sure they'll be some questions they don't want here today but they probably get him anyway so but anyway right now like to have a motion to approve the December fourteenth meeting. I have a motion the second all in favor say aye. He opposed no motion carries. I also need. A motion to authorize the chairs to approve special expenses incurred by the house and Senate interim committees on education. The motion. I have a second. All in favor say aye opposed no. All right that is a new rule from the. A. L. C. we have to do that every year so that the way. Well. I guess without any further ado. We will bring up the department of education get an update on elementary and secondary school merger really funds. I might be a little bit main today I will limit questions to members first if we have time we may pop over here a few non members but we're gonna try looking members ask questions basis this is Education Committee. Secretary key you're recognized thank you Mr chairman Johnny Cade part of education when you said you're going to be a little bit mean I got a little nervous there for a second about your time at being mean to me well I've always said I was gonna say well what's what else is new so. Of the ladies and gentleman of the committee I have presented to you today I think it's in your packet of charts and spreadsheets with detailed information about the spending expenditures of the S. R. one Esther to the S. R. to supplemental and the A. R. P. S. or funds that have been allocated for the state of Arkansas to the school districts and then we can certainly take whatever questions but I would I'll just start with the S. R. one the the pie chart is probably the best place to start I think in your packet that's on the back page. ninety three percent of those funds have been spent have been exposed expended to this point. the seven percent that's remaining is you obviously still available for use for the school districts based on their allocations these are reimbursement funds as as are all of the funds that we're talking about here today and then the pie chart breaks down what they have spent those funds are I won't go in each of those in detail but as you can see there's a wide variety of of of general categories under which these funds can be spent but the bulk of that was spent on technology and if you remember this was the first For us what's the word trosh okay thank you thank you senator of first tranche of of funds that came from the federal government and that was at the time where schools were needing. To upgrade their technology and institute of those systemic procedures for safe operation of schools. Esther to. Hi in exhibit two. well about forty five percent of those funds have been spent to this point. With fifty five percent remaining and these numbers are as of July the twenty six so obviously those change very. can change drastically but for the summer they're pretty stable right now when school comes back out we expect that they'll be a lot more expenditures coming out of that you see there the the shift that occurred with the technology expenditures being on a much smaller part of this fun and category about systemic procedures again those things that help schools could maintain safe operations the of those are in those also could include categories such as the additional. The pay that to some schools of allocated for their teachers. the. The next category is the answer to supplemental and as representative garner and others of just as a reminder the these are the funds because the ESR funds were allocated on the title to formula there are number of districts like Elkins West Fork other districts around the state that because of of their title one numbers did not receive the same level of allocations so we chose to supplement their funds and as you see they're still substantial. Balance of those funds remaining was sixty eight percent. And then the next the category a R. P. S. Sir this is the most recent of funding from the feds and the. You said there's not been much spent from that this is the over one billion dollars and this has a three years life and we don't expect that this money we certainly would not expect this money to be spent rapidly because we want schools to make sure they're planning as a matter of fact under this legislation they are required to approve of a local plan for how they're going to use the A. R. P. S. or fines as part of their back to school strategies. so we still have quite a some of that in we have only asked for the initial eight hundred sixty five million from the Legislative Council for the approval for that that appropriation at the appropriate time and I'm not sure when that is but we we coming back and asking for the remainder of those funds. E. five of this one although it's dated July twenty seventh if we've seen considerable updates on this so E. five is are the projects that have been submitted and they estimated cost on facilities projects you all know these funds can be used for covert related facilities projects such as upgrading their HVAC systems improving relations. Of the. You see on this chart it's thirty three million and a hundred and twenty seven projects give you updated numbers to show you how fast that is happening in the summer because of obviously summers a better time for projects like this we have a hundred and seventy three projects that have received prior approval from around the state at fifty three million dollars. one of the questions that we get periodically is about buses this one of the eligible expenditures for these funds were school buses. And we have approved three hundred for the purchase of three hundred eleven school buses for districts around the state and that was at a cost of just over twenty minutes twenty nine million dollars. So that's an overview Mr chairman and I'll be happy to answer any questions if we want to get more details on the last one on the five also okay I have a question their first four get into some of the other people so that's just rude. Something to upgrade Arkansas second fleet replacement of some heat near unit. Of the HVAC yes yeah it could be replacement entity replacement yes to be whatever or some kind of great to him or upgrades pressures are you all right uh we have a couple questions you could also include some of those portable. handling devices or that's the sort of thing we got a few questions here senator Elliots. Thank you Mr chairman my my first question is for the chairs do we have another Education Committee meeting schedule any time soon. The. At September the September eighth Mr sun okay I miss. At nine o'clock September seventh at nine o'clock sept September seventh okay I was just thinking on a I would like if if it could work out a request of the chairs that somebody from this facilities will give us an update about how our schools are doing and making sure there what they're doing to make sure the schools are safe you know from the standpoint of facilities and we have any issues outstanding I just request you consider having him come and give us an update at the next meeting I'm out Commissioner key I want to ask about a special the A. R. T. S. funds and any of the others as well and maybe five maybe number four if. It is allowable that any of those funds could be used to help out of school employees who have to use their sick leave if they have been exposed to somebody who had scolded or they have to quarantine of that kind of thing is is is not allowable under any set of these funds. All right I'm going to turn and as I answer you shake your head but the answer is yes I hear you have on the call and you can't see him of his strategic. That the answer is yes what has it has to be part of their plans so if a district chooses to do that they can use those funds and they can submit that planned us obviously it has to be covered related example you used would be covered related so it is an option that school districts and so have districts already submitted their plans that they still do one so or they are in the process and the process emitting planned the plans are due by August fifteenth okay posted on their website that we're not really we're we're not approving the plans something we're working with them to make sure their plans fit within the guidelines of the US department of education of the only thing that we truly have approval of time are the facilities product the prior approval facilities and bus purchases but we're working very closely with them to make sure they don't run afoul of anything that would cause an audit hit down the road I just a follow up that do you have any idea say if I'm submitting a plan Do I have to be really speak about the question I asked earlier to have to be really specific about. May be the contact was at school or a. Do you happen to know how specific there's to be there I don't think there any guidelines okay specificity there it and one thing to keep in mind to these plans have to the required to be updated every six months okay do you have to wait six months so if it is currently we're having conversations with districts about certain policies masking policies bus policies and those types of things and we're saying look whatever you duties being your plan and if it changes after Labor Day or whatever don't wait six months yeah go ahead and get your stakeholder engagement and update your plan okay I thank you for that and and for all the people who are contacting us about that please remind your administration this can happen as it is significant for me thank you so much thank you Mr. Thank you Mr K. I members of the committee at first just want to say thank you for so many of you praying for my mother just really appreciate that so much and I am going to leave it in the hands of representative because our and to the members of the Senate committee today but I just wanted this state personally how much each of you mean to me and I appreciate you very much and I appreciate the prayers that you have offer from another I just thank you all and just ask you to continue to pray for her so I will leave it in your where the hands and I will see you soon. Right. You know please do keep remember her mother in prayer she's in a struggle so. As many other all right out there to use the service member all of. Of represent five. Thank you Mr chairman. I was just noticing that some schools didn't use their funds in particular was looking at Arkansas school for the blind in school for the deaf on them. Exhibit B. two do you know why schools did not choose to use the sponsor is there a plan to use them later it would be a plan to use them later A. as in like for the case of the schools you know they they may be. Have sufficient Funding from the state funding for the S. R. one and then they've also receive some gear funding you know we make sure that schools of those two schools received your funding because this is these funds are reimbursement funds there may be expenditures that they have done that would be the come back and fall under this category later thank you. Thank you Mr chair thank you secretary key I have a question about these categories that we see on the graphic our are those the only allowable and categories for these types of funds and and if so how much flexibility to districts have to say their expenses are for example systemic procedures or student support if you could give some kind of concrete examples of the types of expenditures district Sir planning for it and utilizing if those are that the only buckets are there's flexibility you know there's extreme flexibility within within these bucket so systemic procedures that broadly defined as what does it take to keep school open that could include personnel costs second include you know what they're physical planner or maintenance or cleaning costs those those types of examples of where districts went purchased farmers for instance you know or or some type of of device that would help accelerate the the sanitation process or operations in the cafeteria so that they can either you know it could also include the spacing if they needed to convert an unused room or you know to to be able to use for students or labs whatever it might have been to help spread out me those are some the example so yeah there's wide flexibility within each category. Thank you is just a clarification I did hear you say that you know if conditions change of districts see the pay what they originally anticipated or planned for is is not exactly meeting their needs they're able to update their plan immediately or or as needed and and able to kind of as as needed and as their as conditions change as data Maninder understanding of the data changes. You know twenty percent of the A. R. P. S. or funds I have to be committed to learning loss recovering learning loss you know as districts understand their ACT aspire data I understand you know where the focus needs to be whether it's math whether it's literacy or how you know if it's across the board how do they need to to address those then yes those plans can be changed that again they don't have to wait and we would ask that they not wait six months because that engagement process for with stakeholders teachers students parents that really should be ongoing right now thank you thank you Mr. Sir just fill. Thank you Mr secretary key on exhibit five. It goes to Mike. Two thousand six hundred ninety four dollars to three point five million give me some examples of what they're using them for besides the buses. Okay They could be accelerating their in facilities you have a master plan and in that master plan you might have a plan to replace your heating ventilation or heating air system. Two years from now this gave them an opportunity to possibly accelerate the timeline for that I think your some of your larger numbers here are going to reflect larger projects like HVAC renovations or could be other types renovations related to covid so that to this promotion of safe operation continuation schools is molar amounts could be repairs. Is this competitively done or is it on a rotating basis to some school districts get it next year or as these got it this year how does that work no every district this is from their allocation of funds that the district has so each district has the opportunity to evaluate their needs and submit proposals these were the funds that would would come from the A. R. P. S. or or tester to whatever category they're spending in the these are allowable expenses across all care or across all the funding. Methods when I couldn't help but notice that none of my school districts on here so I was just wondering. Since I represent about four I think it's probably at some matter of timing more than anything with some of them and Yeah they've they may still have those projects in review okay but I I know for example Little Rock they recently did some significant upgrades throughout the district for HVAC within the last three years so there needs may not be as great and maybe maybe looking at using those funds and other areas all right thank you. Representative Kinsey. Thank you Mr chair. During the session we passed the bill with regard to the tutoring program I had a lot of questions on it at the time I think that was tied to the S. R. to funding is that correct so with regard to. What the qualifications are who is who the cheaters gonna be if I recall it it takes effect in twenty twenty two so could you give me I know that time the answer was or to work that out rules or can you give me more information about how that's going to work now they're closer we can get that for you we actually or are finalizing of the the last details on the tutoring plan we're working with actually Missy Wally is leading that project for us and I believe of that's getting very rollout. This week next week. Yes. September okay. so so in September but we can get the details for you so you can see what all the qualifications are how we're recruiting what the goals are for that program Capri sheet that thank you. Came a regular members are done I'll take a few questions from non members I believe senator Hammer you just pop the. Thank you Mr I was wondering on those air conditioner units are there any requirements that the department is placing on that with regards to any kind of filter systems that would help control the vote the of COVID virus or anything maybe in the future so that we could. Have the systems in place. Has there been replaced well certainly Mister Kane is is more qualified to address the details of that but I I believe the focus has been on the number of air changes in the room so having the handling air handling system so that the the air circulation and there's a way to measure air changes so HVAC professionals can do that and I forgot now what the recommended number of air changes per hour or I would be but we can get that for you I don't think we wouldn't be so making those informer requirements but I think our team has been issuing what's best practice and asking districts to to make their decisions based on those best practices the there are a number of different types of filtration and purification systems out there that have a scientific studies behind of each district is making those decisions based on their what what they determine their needs are to thank you Mr. Shrubs and got for. Thank you Mr chairman secretary K. I you mention best practices I feel like I'd be remiss if I didn't ask about and districts and schools and even classroom teachers and encouraging mask wearing especially in a district where there's not a mandate I know that some districts have implemented mass mandates but some have not but I'm continuing to hear from school leaders and from teachers who are very anxious and from parents I have a kindergartner interpreter myself and I'm a little bit nervous too who are anxious about students being announced in classrooms and so I know that the desi guidance is to encourage mass wearing and so I'm just wanting if you could share best practices that you've seen I'm whether that's from district plans or even from individual principals or classroom teachers who are having success in encouraging and facilitating mask wearing in districts where there's not a mandate in place I know I want to get a personal shout out to my kids school Westwood elementary in Springdale they spring up currently has not implemented a mandate but but my kids school has been very strategic in I'm just having strong and purposeful leadership and encouraging massacring among students my son went to his kindergarten assessment they ask the parents were mass I students but not signed I have been encouraged by that leadership even in the absence of a mandate so I'm wondering if you could offer additional examples of encouragement where we've seen kind of to kind of qualified with that anxiety that families are feeling if their district doesn't have a mandate how we can still encourage according to your guidelines mask wearing. Well and just let me let me note that. The guidelines we issued of in conjunction with the health department the moment we send amount the CDC change their guidelines and and so as many of you probably know within minutes after ours going out of our references were incorrect to the CDC so we're in the process of making updates work with health department to issue those with the updated information. Here's what I can tell you because it because we haven't been in school and and when we were in school last year we had a mask mandate up until the last few weeks of school most districts carried on with that to finish out the school year my observations from being in the schools and and hearing from team members from the department that were in schools and hearing from teachers and principals of the elementary students. They did a good job they under they it wasn't some of the stories that you know at least what we've been told where the district had trouble with smaller children keeping or masks on they did pretty well with that the what we did see in the summer is number pre K. of that in without a mask mandate without masking in place we had a number of pre case across state that had closed due to the positive cases in the close contacts came from that so I can point to Quitman Quitman element Quitman school district day day if I'm remembering correctly they did not close or pivot to virtual at any point during the last school year. Because of the it's not just masks the layers of protection that's the thing we have to keep in mind of the the distancing the masking the cleaning the the ventilation all of those things that we recognize our of the layers of protection to make sure that the school can operate safely but that there are others Quitman just someone that pops to mind they were also one of our peel C. schools so they have a lot of collaboration with administration teachers and staff about how they were going to continue other school year and and the safest possible but hopefully that helps with with your with your question. The McKenzie. Thank you Mr chair I know that this is what we're talking about now with the answer funds and and the safety that certain important I'm glad we're talking about that I know that I guess. We obviously should talk about I believe also in conjunction with that and the learning loss with the tutors all the different programs are looking at here. We we had some bad scores we've week Intesa painted a drop but it was about one and so my question is I hope that we can. With regard to these youngest kids And I haven't seen a I'd like more information if you would hear an elaborate how we did across the board with regard to of course when we first trying to teach these young readers how to read and the issue. With Halloween I know often ties it will people testify here will ask them to remove their masks because their social distancing so we can hear them better so I'm wondering what do we look at here for our teachers then with these early readers on how weak it is they're trying to visuals part of it in this and then the hearing and so much involved with that so what options are we looking out for instance we provide us some options here so we can better communicate what we're looking out for because safety is certainly important. But we're taking a report we're going to school for a reason to to educate as well so what can we do to address both of those sure how will it end I think when we when we're thinking in terms of masking and we recognize that does have an impact on learning especially for young readers those that are learning the the sounds are and how the the sounds are made and what the sounds mean and how they fit into the words so certainly our testing system or K. two assessment system which is not for accountability it is for informing instruction you know that has been in place and I think we strengthen that last year of this year were also rolling out what's called smart data it's system I would describe it briefly You saying this meeting coming early warning system so that captures all of the data not just test scores but discipline attendance all those things and provides an opportunity for more focused work with this the students that needed But the one thing that we do. We need to stress is that if even if there's masking a place it shouldn't be permit. we'll that's why the governor's been so how insistent and inconsistent when he talks about the vaccines and the need for for everyone to get vaccines vaccinated and then for those younger students that cannot get vaccinated right now surrounding them with people who are vaccinated whether be teachers staff or family members so the the masking doesn't need to be permanent in the meantime teachers have it and we can give get your examples of what teachers have done to overcome some of that I don't have any specific examples that I brought with me but our teachers in those early years they they understand because of the focus we've had on signs reading the more clearly now then we say five years ago they understand how critical it is for students to be able to see the mouth when they are trying to teach them those sounds of so we can get some of those examples Stacy Smith with bill pull some that together and make sure you get it. To to see exactly what teachers are doing is that that's what our teacher our co op specialist do the the literacy specialists that we have a out of the coops they work directly with those classroom teachers to help find those ways to make sure that the learning is happening. I have a couple things I want to bring up yesterday we were here Nailsea hearing about the hospitals in the nurse's search situation so. So they're gonna start to take the hospitals in offering you know better bonuses are we gonna lose some or school nurses to go back to the hospital is that a possibility. It yes I mean it's always a possibility you know you can't to. You can't fault somebody for a taking an opportunity to to better themselves better their family income situation when I have to I'm not heard of that happening but I wouldn't say that it's outside the room possibility was or any chances are schools can offer that same extra bonus to our nurses are on line or schools you know under this subheading of continuing systemic procedures and continuing operations the I. SA the flexibility would be there with the nursing staff of the same as would be with teaching staff so we're happy to work with it is launched in the plan you know we're gonna come back to stress if you see the need and it's covered related and you can put in your plan and our team will help you put it in such a way that. This lessens the risk of audit then that something would be open to talking about well you know we've always talked we've had certain representatives of always have asked for more nurses and not to mention any names but so it's it seems like that you know nursing is really a whole lot different now than it was maybe two years ago before code because it's a lot more challenged I guess I could say so I think that's what we probably need to look at our school the look at and one other thing I text you briefly the other night about something that was happening I want my schools and the offspring was offering Amazon gift cards to kids thirteen above to get their shots and so I double more checking that is that is really happening and I think you said they could use their funds to do that with the federal funds to do that they're promoting of vaccinations is an eligible use of yes of the federal funds yes and so I think you said that could possibly even come spread across state more people start doing that so what my biggest question is I'm sure the parents have to sign off on that or be there when they have their shots the corrected and the parents would receive a card are we going direct I will I will pass on that one because that's probably health department okay question I thought I would just think a kid anybody under eighteen would have to have a parent's consent or the standard Saddam when Welsh alternate look but. Thank you Mr you mention about the guidelines will go the guidelines you're referencing where those ones or put out last week or week before last. That you had to make changes because you see changed I believe they were issued the week before last yes okay and then the CDC changed like the day after maybe later that afternoon right so you have new guidelines about come out for this school year then or did you modify the ones from two weeks ago modified just modified because on as it relates to masking in quarantine okay the that issue and also noting that they'll be a a note there for school districts and I'm sure there are all aware but in case they are made the notation about the status of judge fox's ruling okay and when what were they have those been sent out then or the coming up today or where do we find them so we can look at a okay we have as soon as they are the issue we know that they are Approved by everyone needs to approve them will make sure we get those out to you I think it's this I think it's either is it today I think that we send those out okay okay should be today. Tomorrow at the latest are you at liberty to say what changes you made based on the ruling from last Friday or just a note it's the the the what we put in there was simply a note that says judge fox issued a ruling that that Prohibits the enforcement of ACT NO two and to consult their local council if they are looking to enact any policies regarding my square. Jordan mandate them to but it gave them the option. That if they want to do that and does that require school board involvement work in the superintendent make that call by themselves it depends on what's in their policies currently if if they have a policy that allows the the administration to make that call then the administration make that call what we're hearing from districts is that in some cases superintendents can can do it in other cases there having special board meetings to consider it so it really depends on what is in their current policy so they get pushed out to the local level at the end of the day. Of well in essence I mean that's that pending whatever additional legal. Through the Supreme Court I mean that that's where we are today if that changes then we'll make modifications accordingly thank you. That is all we have I have no more questions for you. Good morning thank you for for having me here. my name is Joey Barton Berg I'm a supervising senior or alter Arkansas legislative audit. We've got IT if you want it's just so. We've got we've had we have it so let's just go ahead okay everybody has your bill. I've got some props here to tell me when to go to the next slide so. That that's when you should turn the pages pose okay. The next slide. Each year legislative audit prepares a summary of all grants distributed by the Arkansas department of education Division of elementary and secondary education. This report is issued under authority of Arkansas code annotated. Ten three twenty one oh two. F. one. The two thirds the fiscal two thousand twenty report summarizes the three point four billion that was provided as grants to school districts charter schools education cooperatives and other entities this report is available on our website. Grants are funded from state and federal sources during fiscal twenty. Two point eight billion with provided from the public school fund five hundred and thirty two million was provided from federal funds. One hundred thirty two million was provided from other state funds overall department distributed sixty one point five million more in fiscal twenty then was distributed in fiscal nineteen. Next slide. The total amount distributed to each recipient. School districts charter schools and other recipients can be found on attachment one. Page three to eight along with a comparison of the total distributed in the prior year. The remaining attachments display the amounts distributed to each recipient from particular grants in the current year in the fiscal twenty year next slide. There are fifty six programs distributed from the public school fun eight distributed from other state funds and twenty three distributed from federal funds. Program amounts distributed to each recipient from the public school fund are included on attachments two through four. Program amounts distributed to each recipient from other state funds. Our including attachment five. Program immense distributed to each recipient from federal funds are included on attachment six. Finally in the back of the report attachments seven eight and nine can contain brief narrative descriptions of each of the grant programs. In this report we didn't do any auditing procedures at the recipient level regarding how the money was ultimately used. That work is done when the school districts are audited or the or the other if you will let her go ahead and set that up PrecisionHawk that were sorry. Yes. Largely in the appropriation acts and if the appropriation acts are not specific enough finish by. By the programs administered it designations by the department of education frequently. What we want is not specific by pro by by the appropriation act and and it and it falls to to some other entity to make make that designation is frequently the federal government to make the call on that it's not.
