With that part of the of the bill that says that that cost of the mayor the county will bear that cost do you interpret it to be just the cost of the paper ballot to the cost of the whole election or or something in between when I first read that and I read it now it's like you're going to place you go balance you're not pay for the machines the labor and you know we I think this is don't pay for elections up front and pay for

want to address some concerns by reporter senator Payton about the Secretary of State selecting the voting machines that is already in current law under seven five three oh one. and that was passed ACT twenty two thirty three of two thousand five so since two thousand five the only machines that could be used for those approved by the secretary of state so this is not a new thing in the law. I want to say the AC has no official position on this bill but all the feedback I received
from county officials has been positive and they appreciate the clarity to the law that's currently not very clear to those who are not experts in election law. Some corn courts are being lobbied to go paper ballot only but they're not usually involved in elections election commissions handle those so they don't always know the unintended consequences that may come from going to all paper elections so this provides some clarity and that is appreciated

To introduce yourself and you're recognized thank you Mr chairman names Clint Lancaster I am an attorney in a lobbyist I represent the Arkansas voter integrity initiative I would give you my credentials but the Arkansas times would make fun of me again I am an of by all
consideration election law expert having done election law in Wisconsin Utah consulting cases in Pennsylvania Michigan Georgia. and I'm here not be can also want to say I'm a big fan of senator Hammer I do not know a bigger election law championed then senator Hammer however there is a constitutional right to vote on paper ballots it's in our constitution and that's why we have statutes that allow for voting on paper ballots this
twenty four hour requirement chills that constitutional right it almost makes it to where it's not possible to even be exercised I think that's problematic I think that there are better ways to make our election secure the DS two hundred tabulators and ES and S. software I will tell you that nobody I know of knows how he SNS software works I wrote the Legislative subpoenas for the Wisconsin special counsel asking them how their machines work and
they told me withdraw your subpoenas or we will sue you that sounds like transparency to meet the same kind of transparency that miss Bellamy here advocated for when she advocated to shut down the Wisconsin special counsel's investigation by supporting a day at David Becker a George Soros minions so I would encourage you to be cautious with miss Bellamy's testimony. There are problems with this bill there are better ways to do it and I think that high
security ballots will restore the confidence the electorate has in our elections and while I don't think this bill gets there I think it's a great effort but I ask that you voted no. The official state Election Commission. so I'm speaking on the bill the state board hasn't met to consider a position on this but we were Senator Hammer was kind enough to work with us on and I want to speak to to what it does from our perspective a couple things I think are important based on the conversation to to bring out one the twenty four hour rule applies to the unofficial reporting the what what's online is always unofficial start the actual legal action results are just essentially a press release
number two. Twenty four hour at the polling site is important because you can't take a polling site indefinite period of time there is no twenty four hour in this bill as I read it that applies to a central count model so if you count of the central county not bound by twenty four hours twenty four hours simply applies to a precinct count and of course the unofficial results since the main thrust of the bill is to have the The information available in a timely manner you've got to wait on the the the hand count to be completed to get preliminary
results and and I and and I will always reserve the right to be wrong but it's for the reimbursement my read of it would be since the machines are already acquired if you're simply using the equipment we already have the the cost that would be reserved to the counties would be the cost of the paper ballots this is my read on the. Not take any questions yes great question by senator Biden. So on the cost of the machines
obviously are going to last forever in there they're going to break down the maintenance so it would be more than just the paper ballots or do you interpret the replacement and repair and maintenance to be something that would be covered by the state the statement was of course based on the current status the machines are present in all the counties you know in the past what how those machines required were we're a division of of X. of expenditures between county state and federal so I think we would have to to cross that bridge when we got
there but that wasn't that wasn't part of what I contemplated I made the statement okay and you mentioned to. To accomplish the twenty four hour. Stay within the twenty four hour rule that they might be necessary to have a central counting location is that doing it at the precinct level with that mean we would transport ballots that were not counted no Sir that's not a person well I think you either have to transport the ballots in the

I appreciate the opportunity to speak today in opposition to this B. two fifty as written as I am very much in favor of election integrity one thing seems clear from the two thousand twenty and twenty two elections is many states of election integrity issues
whether it be from electronic voting machines vote harvesting or lack of updated voter rolls election integrity issues always occur before election and once votes are cast issues can't or won't be addressed once election has occurred is to tell two thousand twenty three legislative body has the privilege and obligation to address all election integrity issues and ensure issues observed in other states not occur here in Arkansas this body has a chance for Arkansas to become the model for election
integrity for other states to follow. Why is B. two fifty appears to be an honest attempt to ensure election integrity by counties that meet using paper paper ballots to an electronic voting machines this bill as written may inadvertently discourage the use of paper ballots by current election officials in several counties groups of voters have indicated they don't trust electronic voting machines because who they voted for sprint as proprietary barcode on the ballot and that barcodes in red by the tabulator voters have no confidence that there they
voted that who they voted on is correct because they can't read the bar codes. That is only one of several issues with electronic voting machines that are valid concern for voters in Arkansas especially when voter so with his issues and other state states with the electronic voting. And many of those states using electronic voting machines purchased from the same company orders were. one of the items are concerned

not I thought our system was working properly in but after the primary last year I started doing some the the dating for seven months I read about everything I could possibly read I consider myself an expert on this issue and I will tell you the system we have right now it's not transparent it's not accurate and there's no accountability this is the system that we have I would ask all of you become experts in our voting system if you don't know about the SNS if you don't know who that company is if you don't realize that those we don't even
know who owns it S. McCarthy group we don't know the investors McCarthy group we have no idea the people that run our elections at all we can't read Marco this is what I found that would look like I don't who meet the of the drives are but if you look at that that's what a regular ballot looks like that top portion or bar codes that's what you bring read by the DS two hundred not the names below it doesn't read it I have no way to confirm who I voted for none except for perhaps a risk limit audit or some other little thing
that they said the two to make me believe it works we have no way of knowing every every cybersecurity expert that I've spoken with the last seven months tells me that same thing we have no idea of the code that that machine uses so why do we want to go to paper ballots fire the county screaming for that we got two groups of people that will machines are one of the suburbs of people first one. The machines they trust them
they think that they work even though I just showed you we don't know what they're what they're counting we cannot see the code were not allowed no one could see the cold. So when I voted I I carried that paper ballot that had the names of the four marked yes Sir over to a machine invented in correct and I'm confident that that paper ballot was retained in the base of that machine that's correct so. I have had. Have you ever asked for and been denied the opportunity to count those ballots in the bottom of that machine and compare them to the results.
Okay there's two things issue here one is the express code itself and that is the touch screen that we use it is proven and I've got the studies from Berkeley from Princeton from Harvard that will show you that the voter intent is not captured on the touch screen like it is on a paper ballot like this is not ninety eight percent of people no in fact they made a mistake here it's not true on the express vote. Don't tell me why but if you're driving down the road and you don't see a motorcycle is right in front of you it's similar to
that that you don't see if there's a mistake on the machine it's a problem so the answer is yeah that prints all the answer is that ballot they called about is not a valid by the way it's a ballot summary sheet that's what is about some record that's what ESPN's culture because it doesn't have all the selections on it it goes in that machine and yes it is held in that machine you can go count that but the secretary of state's office only done one on it and then we'll do a one machine they don't do not primaries they don't know I guess I should

in the Senate with the SP two nine four earlier Regarding SB two fifty and one of the things I did film AT sometime ago was the ballot counting process in Pulaski County when they had the damage ballots you go to keep Arkansas legal in time and type in the term Pulaski County damage ballots you can see that process it made me the most exciting thing but it is and it's not it's tedious but at least you have some accountability and I also observed the Pulaski County Election Commission when they had hearings in this very room
regarding what happened in the Pulaski County elections and so while paper ballots and maybe as I said before TSN kind of time consuming. I believe it's at least somewhat of a way to hold some people accountable on a local level if something goes wrong regarding the machines I I actually looked up the Arkansas delayed elections this is seen it turns out in Phillips county in twenty twenty two that was some kind of delay it was some messed up with the machines I'm not sure what exactly happened but
It's in one machine having one failure either by deliberate sabotage or by and you know mechanical failure can cause a delay and and the but the stories posted December nineteenth twenty twenty two so they certainly did not make the twenty four hour mark now regarding that election so I'll I like that aspect of having guidelines are going paper ballots but I feel right now to SP two fifteen its current form seems to be like a bill that discourages then this a county switching from the SS machines which a lot

people we live with okay I don't know about these people up in Nebraska I don't buy into that just be quite honest with you because right here I have in front of me an attorney general's report that was released yesterday from Arizona a Democrat Attorney General who released a Republican controlled legislature or a attorney general's report that said in Arizona Hey things turned out okay but yet that report got suppressing got buried somehow or another and there it is if you wanna read I'll be glad to
share with you and so I want to go on and finish saying what Trent Minter said he said while the results of the recount did not change the outcome of the race the transparency and speed with which they accomplish the recount leaves nothing to be desired we're fortune Faulkner County have such professionalism and integrity in our elections the commission the clerk's office and their staff have shown themselves to be a model for the. As to the state Arkansas can be proud of knowing that every lawful vote was counted every voice was heard and that we are blessed to live in a country free and fair elections now I
don't know how Mr mentor feels about this bill but what he says in context is we ain't broke don't fix this limit to what the heritage foundation said Zacks Smith a heritage legal fellow said that Arkansas election procedures excel in two key areas it's voting machines are never connected to the internet and there is a paper trail that can be reviewed during an audit recount of which we audit our elections and they have come out a hundred percent accurate tied
into the name to the actual audit we have just passed a bill I think out of committee where we are going to if everything works right give our election board commission or the ability to go into fifteen counties and also to audit we've got what we need to assure that the machines that we have are working properly the he goes on to say Smith said the hand counts aren't practical particularly in urban areas County ballots by
hand is necessarily going to be more labor as and prone to human error and more difficult to do accurately and quickly he said I'll be glad to share this in case anybody wants to call the question that I read that or the source of what I said this bill simply make sure that what some people want not every county wants but if the county wants it that it establishes a pair process and accountable process and if you choose to do that and you are a single County you are
to counties why should all the other counties in the state that feel totally confident in what we have have to bear the burden for your decision to break away from what is already a proven system that has yet to be. Why should the rest the counties have to do that for someone who's concerned about outside interference in elections certainly they've gone to great lengths to interfere with our state that has a reputation of being in the top six we use
before but then some other states to our ideas and that pushed us down to six why should we let them interfere with our election process in the state of Arkansas that is proven to be effective secure and safe as given by somebody who got beat.
