I can't see. Forty two. Right of first bill of the house bill eleven forty two represent Ladyman are you prepared to present. Thank you Mr chairman I've got a guest on like to call to the table. Okay. If you would just state your name and identify yourself for the record. But instead of. But it has been on the CEO of Arkansas electric cooperative corporation. A. I. X. I ask this question to be here to help answer questions and technical issues. Of. Mr chairman also. asked doctor Bobbitt. Who is the president of the University of Arkansas systems to be here today he's out of town and could not be here so he sent me a letter I would like to read that letter. Okay. I want to lend my full support to representative Ladyman for his steadfast efforts in supporting in support of H. B. eleven forty two the Arkansas nuclear recycling program. Although I am unable to be with you today please do not mistake my absence for a lack of support of representative Ladyman and his commitment to pursuing the objectives of H. B. eleven forty two as president of the university of Arkansas system I have attended several meetings and interacted with experts as they have testified about spent nuclear fuel reprocessing technology that is proven and ready for commercial deployment. The state of Arkansas has as is the case of all nuclear power plants in the United States spent nuclear fuel that can be reclaimed and repurposed. Well this is a complex problem I believe it can be solved with a correlation of diversified institutions including federal and state agencies higher education institutions and the private sector. The legislature's the legislature support of the commitments outlined in H. B. eleven forty two is a key factor for the federal government to understand and agree that the state of Arkansas is ready willing and has a plan to address the matter of spent nuclear fuel H. B. eleven forty two. Recognizes the unique role of the University of Arkansas System can undertake from a public outreach and education perspective. Upon receipt of appropriate federal funding the University of Arkansas System is ready and willing to partner with the state to assist with a solution to this very complex spent nuclear fuel problem. So with that. And and I'll get to how the university system will be involved in this process. But I want to give you some background. Some of you all on this committee don't know the background. me and some others have been working on this project for about six years now. So let me just give you senate it's on. What we've done and and what we want to do to go forward. This bill. Bills upon the study conducted under act ten ninety two that this body passed in twenty twenty one. Under Act ten ninety two our team. Which is made up of a bunch of individuals in different areas our team working to solve the nuclear waste problem in Arkansas and the nation found supporters in Arkansas and in Washington DC. We have the support of our Arkansas delegation in DC. And the support of US senators from Kansas to Delaware and West Virginia Act ten ninety two has been adopted by the American legislative exchange council in the southern states energy council as model legislation. In a nutshell we have proven there is support for doing and are in the project to prove spent nuclear fuel rods can be reclaimed and used to produce power. We need to take the next step which is to develop plans to implement the project. We need to hire a firm to develop plans for completing the project. We need to develop a model for commercial application to prove it that it is commercially viable. We need to develop a storage plan for residual materials. And now that the destination of that would not be part of this bill we need to develop engineering documents for the recycling process. We need to perform site analysis for a research and development plant to verify the commercial viability. We need to develop this construction cost and a schedule for construction of a plant. We need to establish Arkansas is the only state pursuing a final solution for spent nuclear fuel rods through recycling let me add something to that bullet you only be aware there's a couple of plants generation for the. That are being built or at least being planned. And there are other P. the in the U. S. there are plants outside the U. S. there's one in Russia. around the globe there if you none of those plants are using repurposed nuclear fuel rods we are the only ones doing that this call the Arkansas plan and if you go to national meetings they know what the Arkansas plant is it's been out that we've been talking about this for a few years so let me go on. We need to be able to request federal funds from the US department of energy to develop these plans. There is a fund that has been established by the US department of energy over the past fifty years to develop a solution to the nuclear waste problem which currently there is no solution. Funding for this fund was from fees paid by nuclear power generation plants for the last fifty years. This trust fund currently has a balance of fifty one minutes fifty one billion dollars No one to my knowledge except us are pursuing those funds. The main thing this bill does is to allow us to request funds and to establish a management structure. To manage this process and to secure a federal charter which would allow us to receive these federal funds. If we are successful in completing this planning. Of the Arkansas project there is a potential to create six thousand two hundred jobs in Arkansas. For details on how this could be accomplished you can look at the handout that you have in front of you. A call the rolls Royce nuclear report on the front page it has a breakdown of some of the jobs that could be created by the Arkansas plan. that document was developed by rolls Royce in in the U. K. to talk about how they're implementing new clear that the Gen four nuclear plants so let me summarize it just quick bullets. We need to. Create a program obtained a charter obtain funding higher contractor develop a transportation plan develop an outreach program to educate the public and that's where the University of Arkansas comes in. So with that I'd like to ask my guest if he had any comments. You're recognized thank you yeah I spent the first twenty years of my life making nuclear waste. body Haston CEO of Arkansas electric cooperative corporation first twenty years of my career I was in the U. S. nuclear navy. A lot of experience with thermal reactors in the in the in the waste produced representative Ladyman Dr Bob at. Roach made last year talking about this program and I saw the wisdom in the program for a bunch of different reasons I think there are a lot of significant challenges going forward this is not an easy venture but I my dad always told me the only things in life we're doing are hard to do so if you look at it. It's a program to reprocess spent fuel when when our commercial reactor today is done using. The fuel rods there is a significant amount like ninety five percent of the energy that could be extracted from that fuel is still sitting there but it's in a form that it's no longer work can be used in the thermal reactor technology. This process what it would. Recycle those fuel rods extract out the fissile material that can still be used and it could be used in a new fast reactor all the reactors we have today operating or throw more actors so does require the Gen four reactor to be built in the US to be used there are a couple that are sort of in the approval stage and and looking at getting bill I do think as we as a country as we look at the future of electricity and reliability. Today to. The existing nuclear plants are getting old right and you're you're getting these license extensions up to like eighty years but everything has to come to an end someday you can extend them forever. we've decommissioned eleven nuclear plants I think in the last. twenty years. China's bill thirty nine. Have another hundred fifty that they plan to build. And if you look at what we're doing with our electricity supply. We're closing all new and basically coal plants are you know going away about as fast as you can see the stacks come down what we replacing it with we're replacing with natural gas which if you've been through the storm areas and you've looked at all the blackouts we've been having lately there's some constraints there so when you look at the base load energy in our country and if you want to basically have all sides get together and say I want a reliable grid in the future but I also want to do due diligence with carbon emissions so if that's a national will then nuclear technology is the only technology that does that that leads me to my next point when you talk about energy security most of the year in our large portions of uranium in the world that you would need to get so if you didn't use this technology gotta go dig up new uranium and process it and get it ready for a fuel rod a lot of that comes from Russia a lot of it comes from countries that may not always be our friends and if you look at what Vladimir Putin did to Europe this year we decided he was just going to shut off the gas valve and what it did to their iconomi what it did to their jobs what it did to those people I think energy security comes into play here too so there's enough remaining energy in the spent fuel in America to run as well beyond what I'll live on this planet and and and probably even my grandkids live on this planet probably even beyond that so I think it from that perspective it's it's wise I think the technology is it's it's it's exists it's been proven I do think there's a lot of challenges to to get it off the ground and scale it and use it but but you gotta start somewhere and I appreciate that representative Ladyman doctor by the University of Arkansas or sand and we can put a plan together to do this. Sorry I forgot a step back to the let me let me just add one thing to what Mr asking said I and I appreciate your input on that very much If the existing inventory of spent nuclear fuel at Arkansas nuclear one is re process in use in next generation reactors of the same size. that would be smaller plants that would accumulate to that size there is over one thousand a one thousand year inventory fuel existing. and in the U. S. but the correct me if I'm wrong but we are still the number one nuclear nation in the world to correct. We are but at the at the current rate by twenty thirty two we will not be China will be number one in the world and twenty thirty two given their current build and they're commissioning path and our current decommissioning path so I'm a proud American I was proud to ride around a nuclear submarines for twenty years and doing doing the nation's business we say we we as a nation started this we know how to do this we've done it safely for a very very long time and I do think this is a space that you want to be number one I hear this term forty nine are thrown around a lot since I've come to the state of Arkansas I think that this is a place you want to be a leader in the pack not a follower and it does solve a problem all the spent fuel in America today is sitting on site at those nuclear power plants this process reduces that by. I believe about ninety five percent so imagine if you take ninety five percent of your waste and reuse it and then you're left with five percent the waste is there today has half life that will require it to sit for a very long time save thousands of years you get done with this process and you an hour left with let's see at a hundred pounds of waste. when you're done with this ninety five house that area gets re used five pounds of its waste and now it only has to hang around for three hundred years still a long time but still a significant exponential improvement and it does address that issue and still provide gender security and prevents us from having to get new uranium all around the planet. And one more thing when this was brought to me originally six years ago so we all know that in my past life I deal with this kind of thing with the written getting read a wasted no backed your read a and you know this is a not only in Arkansas problem in a US problem this is a global problem. And I believe that if we do this right here in Arkansas we can solve or help solve it be the first to solve a problem that affects everybody I believe we can do that so with that I'd be glad to take any questions. Thank you chairman represent eleven thank you so much for bringing this for what I'm really excited by the opportunity for Arkansas can you just I know we're looking for federal funds so what would be our initial cost of anything right now check to go after those funds to get this started you see anything at all that would have to invest well the first step would be to get this federal charter that I read that I referred to. And part of our team went to Washington we met with senator from West Virginia mansions staff and talk to them because what we would have to do is we would have to create this federal charter that's the first step and we would have to go through Congress to get that either the house or the Senate. And as I said we have three senators that are already on board with this I've talked to him personally but we would need to set that charter up and then that they would go that would go after the funding so it would not cost the state anything initially quick follow up chairman says okay I'm sure all of us have gotten emails from constituents that are concerned you know with all this program so New directors and also very concerned from some fear this will have to relay the fears of our citizens of sent us some emails of what what exactly doing this we're not doing at this point we just in research and development so can you let some of the fears that I've gotten emails from constituents yeah. Let me read something I wrote down just to get my thoughts in order and I'll talk add to that but if if you receive emails or text saying we're creating a nuclear waste drop in on the up in Arkansas that is not true. This bill would actually reduce the amount of spent nuclear fuel rods in Arkansas if implemented this project only request federal approval to store enough feedstock to supply the plant which would be much less than what is currently stored at nuclear one in Russellville so. The reason that's in the bill is that we we have if we're going to construct the plant you have to have the stock or the materials to feed that plant that's what we would have to have but it would be much less than what we currently have stored at nuclear one and it would be less. with hazardous right word but. The fuel at nuclear one is pure nuclear fuel this is not pure nuclear fuel that we would be storing also some people ask about transportation we've been transporting nuclear fuel into nuclear one for fifty years. So that's not a new requirement we do that now. The. The other questions. Reserve Richardson you're recognized for a question. Thank you Mr my question how many Roger currently do we know how much is currently being stored at a you know. I don't have that number Okay that could you could you could ask someone to come to the table might be able to answer that might not. Yes please. You just state your name for the committee. Like a paid department of environment there are approximately forty forty five years worth of material stored at a new one now so every year and a half for shows a pull out some old rides and replaced with new right so you have a properly forty plus years of accumulation of material. Several times. VOL you're recognized for Paula so is there a is there a process by which we are expecting to select where the rods for the feeding process is going to come from is that going to come from a you know initially are we going to be taken elsewhere that's good question on page as that because this. To implement the Arkansas plan what we call Arkansas plan there's basically three stages you do a study which we completed under the last bill you do planning which is what we're asking for here and then you would do implementation or execution which would be a no another bill that would have to come to the legislature I'm not sure how we would be involved in that third stage but this bill does the planning and establishes the plans to be able to go to the third stage so those detailed questions like the one you just asked would not be answered until that third stage. Seeing no one receive let me close your bill well I just wanna say committee I appreciate your patience in letting me read all this and I talk about I could talk about it for a few more hours but I will but I I appreciate all your interest in this I think it's a great thing for Arkansas this will solve a global problem that nobody else is working on so I really believe we need to do this and I believe it will be good for our state so with that I'll close it has to make a motion of do pass a motion to pass all those in favor say aye. This looks like it would actually reduce the fees and it would make it more realistic as to what the actual cost of of doing this process is it also clarifies and corrects some of those things I actually have held that licenses in the past so I think this really makes it easier and less expensive to get that license and to renew it. Yes that is correct we're not changing any permit fees that's where the nineteen ninety two Clause was referring to we are changing the waste water licensing fees so you will pay the rent the fee that you're used to paying to get your license but there will be a separate fee to test and the reason for that is because our tests were costing more than the fee that we are actually charging we're losing money so so this will actually just cover the cost to run the program. Because when I'm here we're increasing fees because we weren't making enough money on the fees to cover the cost of the test. You can walk me through this I'm I think the confusion being represented as either having it is we're hearing two different things and seeing two different things and just walk me through it all works together real quick yes Sir certainly so this is kind of an omnibus bill we're changing a couple different sections of statute that relate to water permit fees so the first part is the water permit fees what it costs to get a permit to discharge into waters of this state we removing the nineteen ninety two basis and so that we will be able to look at our fees and make sure that they're appropriate to run a program if we find that they are not a we would be able to propose rulemaking to increase them by no more than three percent. As long as it's apple to run the program that we go through this body the governor's office and so forth the waste water licensing at the bottom of the bill that will will start immediately and that is to cover the cost of the test the test cost more than what they were actually paying historically we've added an extra testing fee along with the application fee so it does double your initial. B. to get a license and test but the bi annual renewal to renew your license is the same. Be prepared to present the bill you're recognized yes thank you thank you and so working with our department of health on this at this piece of legislation I think what's important is to note that we have the and I can't remember it's not so I'm just gonna do the bill and if you look at the amended but we didn't and the Senate was we made an amendment to add the emergency clause in the emergency clause is why we are having to remove this language from the licensing board requirements so the Emergency Clause it is the way that this is written with these quotas actually becomes unconstitutional in becomes discriminatory and how this board is designated with the different qualifications of the people that are supposed to be appointed to those boards and so we are and needing to remove that that language as it relates to the to the racial quotas I will say that that as removing this language in no way in my opinion reflects you know we want to make sure that the most qualified people no matter who they are or what they look like where they come from are able to serve on this board and and and I think that this is just language that becomes unconstitutional because it's discriminatory and it needs to be removed and the emergency clause will give you that detail.
