At representive per year house district twenty five here to present House Bill fourteen seventy nine that specifically prohibits China purchasing agricultural land in Arkansas. I know you guys familiar with Senate bill three eighty three sees me we voted that out of committee yesterday also expect a good vote on the floor today fully supported and that was a co sponsor I feel it's a more comprehensive way of addressing foreign ownership.
I do what you think I do believe with that said that these bills could co exist together and then basically just set a tone for America first attitude with Arkansas. so with that said I'd have any questions you guys have about the different specific differences. you recognize yourself. Thank you you would presenter bill please. My name is Benny Westfall from Fort Smith Arkansas. And I'm here in support of the Senate bill four ninety three. And I just wanted to go over I had sent email to pay this packet to To to all of the senators and just like to go over what the what the issue is. The economic development active
twenty seventeen Arkansas Code section fourteen dash one seventy six dash one oh two three which covers the list of economic development projects at a municipality has the ability to spend funds on to incentivize a project to locate in their community. And in twenty nineteen the house in the Senate passed unanimously and approved on four eight nineteen to amend that to Arkansas Code. To add the list of economic to
add to the list become projects facilities for the seller retails and if you turn to the second page you can see and the third page you can see at the top where the facilities for retail sales of goods has been added. But then later up. There was a an act that that the in twenty nineteen later in article twelve section five of the constitution
by Act ten seventy two it was amended to include sports facilities to the list of economic development projects have been dispatched out they can provide funds as incentives but retail for sale of goods was left out as an economic project that was a lap and you can see that. In the next The next bill. On the. Page three. I was a retail.
And now it's sports complexes. And so what we're requesting is this bill to allow facilities for retail sale of goods to be added to the list for economic development projects and what this will allow it allow Fort Smith to we're calling it project X. I'm under a confidentiality agreement and this group has looked at a hundred cities across the nation and they've narrowed it down to twelve.
And we're one of the twelve and it'll provide ninety three jobs average salary of fifty three thousand a year they're going to spend twelve of fifteen million dollars on the facility. And they're expecting initially a twenty eight million in sales. And. And what we've done is that the the city of Fort Smith of the board of directors they stuck their neck out and they passed a resolution which you can say after. A copy of these bills you look
at this member memorandum of agreement. And the city. Is a. Going to for six years they're going to reduce the they're gonna be a sales tax abatement. Of up to two percent for six years and then fifty percent it'll go fifty percent for the remaining four years and then it will expire. And The city's waived all permit inspection fees and so on so but if you'll turn the next page
you'll see that the total estimated incentives is six and a half a million dollars. The. Across the the country these Incentives for retail have been used to incentivize certain companies to locate in their community.
And with the cost to build shopping centers now especially you know Fort Smith is going to be great we've got the the jets come and and what have you but we when you look at communities that are fifty thousand or under. And and a hundred thousand square foot shopping center wants to go in they're going to need some public assistance they're going to need some help. Of Little Rock they they ponied up from what I've read here sixty million dollars to get
bass pro to locate along interstate forty and you see what. What has happened there I think the best example is Oklahoma City. They wrote a check to bass pro shop for twenty million dollars. The first year that bass pro was opening brick town and it made Bricktown explode you could look one direction when bass pro is under construction and there was just read better. When when bass pro decided to go there John Q. Hammons agreed to
build a thirty five million dollar hotel. There was this side of the movie theater big movie theater in brick town that wanted to be built and it languished for years but once bass pro got there it's a. It was a you know did they move forward on it the first year in Oklahoma City they Estimate that two point three million people visited the city and all of us as saying what happened in broken bow broken
bow the city got a lot of heat the mayor specially broken bow wrote a check for twenty four million for bass pro to be built in broken arrow and all of us know that what we saw there for years was just a bass pro and that Mexican restaurant next to it now look at it as of two thousand sixteen the sales tax in broken bow head was at fifty percent and they've done a lot in the last seven years and all of us see the explosive.
Another example is a a business that I was involved with in Fort Smith a target one to come to town and our family owned this five acres in the front that was flat and then the Kelly family owns the remaining thirty acres that was like that. Will target they wanted a free pad. Ready to go vertical roads into it and they didn't care that the land was like that they didn't care what they cared about is three the main arteries in Fort
Smith interstate five forty Phoenix an old old Greenwood three the main arteries met right there so he would brought in the largest track code in the world there was two a and we would a million dollars over budget on the land we're a little nervous on land but we made some money interest rates went down but target would not come if they didn't get freelance. And Right now Tulsa is a talking cosco into building a second
store. But in to build a second store they are given tosco. The two percent sales tax abatement for fifteen years until it hits three point nine million once it hits three point nine million then it will be you know paid off what they did in broken Erro is that the sales tax that the calculate the sales tax that would come from the bass pro and that money was
Was what paid the note off and we see what what's happened happened there now. And if you'll turn. Inspur here through the the incentives and it talks about the competition and and. And why to do it but over here there's this Incentive this is Oklahoma in the center of learning bass pro to cities and the we talked about Oklahoma City broken arrow
but Kansas city they gave incentives to Bass pro to locate their. In Louisiana. They get Louisiana they gave fifty million dollars for a package for for bass pro to to locate in Denham springs. And the. Bell is can you say to receive sixty six million for the Bellas to locate and then Caballos twenty eight made to locate near Detroit. Bottom line is every state that
joins us. Allows. Incentives. In the form of sales tax abatements. And and other things and I know that the infrastructure and some of that is part of and I'm sure that may have been part of a lot of of the big money that was paid to get to get that shopping center here in North Little Rock and There's a. And and I just think that to.
With. And and you look at. There's a ninety three bass pros in the country. There's about nineteen hundred and fifty targets and there's thirty five hundred walmarts and there are cities in and one there's always positives and negatives or whatever we do the the small retailers some of those they get hurt they get hurt when that they come into town.
And the communities that. The side we don't want Walmart we don't want these big. Big big boys coming in because they're going to squeeze out the the small guys then. You're going to see these towns where are these young doctors one of the main reasons that I stuck my neck out on target is we were having we're still short of doctors but having a hard time getting doctors to come to
Fort Smith and what I wanted is when those young doctors and their wives when that planes coming in and look at the left wind and icy C. target over there you know that would be a positive and now that targets there and we had to give them free land but then. Now Dicks and Best Buy in thirty other other stores of their. So there there's just a. And and that's why I think it is good with the cost because.
What happens to these towns that have just just don't want this change in the what. They is. They don't don't fare as well. But I've talked to loan but I just like to for you all to just let me know if you got any questions. We will order corporation should feel I'm not will take a vote. Number three of us here. NDA or something but are we are we talking anything that's a retail yes it's a it's a retail slash tourism and what they're gonna do is we're going to go into this old Best Buy building and then adjoining the Best Buy building is another building that they're going to raise and then they're going to expand it to the facility that's about sixty thousand to sixty thousand square foot and they might go
vertical sun and ninety three ninety three jobs fifty three thousand average and it's in day everywhere they go they go they command These and these incentives and day at if they get the incentives there common if not they'll they'll go to to other that they got another lesson started with a with a hundred they looked at a hundred.
They've narrowed it down to twelve. And It's really interesting this company date that they use to do their due diligence could that tell all of us what we used or credit card for yesterday there. Very very very good but and I can't can't tell the name of the company but for the people that are involved in that own it They do other things in the community.
Sometimes big things. Some so if follow up so is there any exclusions to where it says the the retail sale of goods I mean could that be. Any retailer any type of I mean that could be anything that's selling retail and and what what the cities should do and they've done this in Texas is that a and and that this the city's they
just don't let ever bye bye in the city's usually control that they're just not going to let someone that's not financially sound It may be in may be a business that's first to market is the it's it's something its first to market and it would have to be a business if I was growing up in a city that But this thing a tracks other businesses who that is the attracts other businesses which this thing will win if they decide to cut if they get the if
they get the incentive for common if they don't they probably won't ever and but if they come. Other stuff will come to and it's just and there's certain things like target. best of the bass pro shop and. Things like that that just attract other other businesses and and it does hurt. You know some mom and pops there's no question about that
but the committees that. Just wanna keep the big boys away. Where do where do their children when they get out of school you have that brain drain from communities and you have a and then you get the brain drain and then they go off and then they have children so then the parents and the grandparents they leave town and you have these towns it just died and that's why I think I mean Fort
Smith this fine and just to be totally transparent we own the Best Buy building I got an L. Y. right now for a bargain. That I can lease that project far more than what I get from them. This project decks so it's not economically gonna. I just I just think this would be great for Fort Smith The Great for Fort Smith and I think it would be great for the state because of it can allow us some things even in smaller
communities where they can talk someone it means with inflation and the cost of building stuff some of these businesses to switch to put him over the age to come in it takes some of that. Of. A bass pro is not looking to go to to a broken Erro broken Errol came to them and told them will build the building far you you just pay us back with sales tax. Extra sales tax you get so it to miss no brainer. But.

Thank you as leader to introduce yourself and you're recognized thank you Mr chairman thank you committee members I'm Randi's of president Arkansas state chamber of commerce and associated industries of Arkansas. the written look it's it's unusual for us to be talking about Slowing down any effort. To accelerate economic growth anywhere in the state of Arkansas. And that's not my intent here my intent is to express. deep concerns about what this
will lead to inevitably and quickly I'm fairly sure. in terms of demands on other communities and and demands from other sources for this type of of help or assistance or R. or subsidy for a given individual business. One of the basic tenets of economic principles economic development principles is that. You do not incentivize retail retail follows.
Rooftops retail follows population retail. Is not mobile retail must be where the people are in order to serve in a track customers and. And make a profit off of their business transactions. The incentives that states typically and other economic development entities smaller in Texas for instance is Mister Westfall said there of all this is done typically at the community or city level in Texas instead of at the state level
and most other states almost all. Those incentive programs like create rebate tax back all those incentive programs that you the and your predecessors to have put in the law and under written for years all of those. Programs. We've broken. Pretty dramatic entrance. All of those programs are aimed at what's called primary jobs like manufacturing corporate
headquarters healthcare facilities things that do not follow automatically the the the rooftops or the head counts because those things are highly mobile like a manufacturing plant like a steel plant in Mississippi County or a paper mill in south Arkansas or. Any of any of the other manufacturing basic primary job sources distribution centers those things are mobile and the
capital investment required under item is is something that can be incentivised on a reasonable basis the numbers that are talked about in this project for instance I mean you're talking about thirty or forty or fifty percent of the total investment in the project. And on the in an empty Best Buy building and I would remind us that retail does not last forever how many Kmart empty buildings are there how many. Best Buy buildings are empty how many. Walmart buildings have been
emptied and and moved on from so retail is not something that that you can. Bank on for an indefinite period of time you gotta be careful but so I'm all I'm doing here is is suggesting we slow down on this proposal this idea. In narrowly tailor something because if you don't what you'll end up with is number one you'll have communities betting against each other imagine a bass pro shop saying to northwest Arkansas hi bill gets
it and then you've got Rogers betting against bring Dale against Bentonville against viable this could be very. problematic and even beyond that for smaller communities if this passes in its present form you're going to have basically every community in Arkansas coming up here asking you for at least three or four hundred thousand dollars for a dollar general store in every wide spot in Arkansas and there are already about halfway there so that's my concern is that that
it's going to open a floodgate of cities of proposing projects like this that are not necessarily pretty good deals I mean you're being asked in this bill to make or marginal deal a good deal and that's not what economic development incentives are all about the you typically are opening up broad areas for for for multiple pop potential investments and that's not what this is and that's what
not what the bill will lead to That's basically it I don't have much more to add to that there you have questions the circle of. Thank you Mr so some misses the. So we have a couple of bass pro shops already here in one in my district do we do a project like this from bass pro shop as far as I don't know I'm I was but when those deals are done I wasn't involved in this I'm really just not the right person
I should love limit let me say that what they're asking for the patients bill that would be no the city may have done something but not not under the terms of what they're asking us to pass today okay yes my question thank you will not not be correct on it when we shop you thank you if Buckley is a absolutely yes. L. the recreational chamber my understanding right now is that cities can build infrastructure and so with the bass pro project that was most likely how it was done but you can't give money directly to bass pro to itself but but it was not done under the program that you're trying to get is to vote all right of the roads and internet enters you know interstate access that sort of thing basic infrastructure that serves other. businesses at the same time.

Thank you Mr look and so we we do incentives periodically through the legislature but they're typically narrowly tailored right yeah and so that's not unusual to to allow for sentences just more typically we look at not wanting to open maybe Pandora's box on you know any retail establishment right exactly okay you could this could be I mean this you could apply this and and the you you have a hard time denying a request for a restaurant.
A high end restaurant of. You know of a magnet a kind of a a traction restaurant but it's a restaurant. And you know that's what private capital exist for that's what bank loans exist for us what stock offerings exist or not. Public investment and private projects. And it would be a box of Pandora's and governors whites. Any other questions. Lingo thank you Mr thank you

but written in our enabling statute is we advise you as members of the General Assembly so in that context means give me just a couple of thoughts about the the bill you have in front of you. What Mr cook said about primary were secondary jobs is exactly right we want to focus economic development activities on job to create jobs the ripple effect that you get with that so I would say be thinking about that as you as you consider this bill the other thing I would say is the dove tailing that occurs between the list that's an
article twelve the state constitution in the list of permissible business activities under the consolidated incentives act that's our list of incentives that we offer as as eighty ADC they dove tail they fit the same list right so we're able I think to give some help to the local communities when someone like a retail establishment comes calling we can say here's here's the list that are permissible and we're gonna be partnering with you on those projects that meet the
list I think you want to be thinking about be concerned about situations where there could be pressure locally to maybe approve a project that just did not pencil out that that be a concern that I would have the time we're talking about retail the thing is wheels retail has a very broad spectrum of activities unlike manufacturing activities and so you have everything from a dollar general or convenience store up to something that could be like a large retail complex
as bits been said before local communities already engages some level that typically is at the development for the whole Senator Irvin guttering drainage things like that any bits benefits not just one business it usually benefiting a large shopping center or something like that and there's other capital much more capital getting invested in that and so we would you know want to see us and sending the sort of economic activity that is bringing new things in is not creating
competition within the community. I think that's very important consideration anytime you're looking at these opportunities so a narrow so **** myself of what comments misters of just any questions questions. of rodeo events I watch Bricktown and I watch what happens when they moved the The best pro shop in there and it how it beginners are growing I'm also I'm also wondered why every state around us is doing it and they seem to be doing well but we're not. So You know other than what a missed west Wallace is told you I don't think I could add anything else to that I think were missed the boat sometimes because we got communities that

With them here so if there's questions the answer but this is kind of a simple bill that says Hey we know that we have lodging in our state parks and right now they are confined to the procurement laws meaning the sheets that we put our hotel beds are the same she so we put our prisons same pillows same coffee at like lowest man bid but we understand in the in the hospitality industry that you've got it you've got it sometimes
do better than that so we are just saying that we're gonna remove those procurement restraints from our lodging facilities we're going to ask people to come and spend their their vacations so we need to upgrade the sheets or upgrade a better upgrade certain things we don't have to take a little bit on those things. And I guess it's it's it's really that simple we're gonna continue to encourage people to come here and spend but we'd like from the state at our state parks we already have facilities. division of state parks and to answer questions Senator days yes we're we operate basically with our cash revenues that's how we support our overnight lodging facilities last year we garnered about thirty one point seven million in cash operations about fifty percent of that comes from overnight lodging operations FOR cabins camping and lodges and so that money directly invest back into our operations and so that's the funds that we use for the purchase of these commodities. So would be fair to say that it

right now we realize American paper and twine there's other companies out there we've utilized in the past such as national hotel supply and a mer American hotel register and so we utilize a number of these of these companies to build for fill our needs.
